Bayfield County Board of Supervisors’ Meeting
Of October 28, 2008 – 6:00 p.m.
Bayfield County Board Room, Courthouse, Washburn, Wisconsin
The monthly meeting of the Bayfield County Board of Supervisors was called to order by Chairman
Kacvinsky at 6:00 p.m. Roll call was taken by Bayfield County Clerk, Scott Fibert as follows:
Gordon-present; Jardine-present; Maki-absent; Kittleson-present; Blahnik-present;
Kacvinsky-present; Beeksma-present; Williams-present; Bichanich-present; Miller-present;
Crandall-present; Rondeau-present; Good-present. Total: 13, 12 present, 1 absent, a
quorum was present to conduct business. The motion carried. Others present were: County
Administrator, Mark Abeles-Allison; County Clerk, Scott Fibert; Deputy County Clerk, Dawn M.
Bellile; Elizabeth Skulan, Human Services Director; Mary Motiff, Tourism Director; Robert
Lobermeier, County Conservationist; Ned Ziehlsdorff, American Birkebeiner Foundation; Darrell
Pendergrass, Director, Washburn Public Library; and Barb Hoekstra, Bayfield Quilt Company; and
citizens of the surrounding communities.
The Pledge of Allegiance was recited by all in attendance.
1. Motion Regarding Minutes of September 30, 2008 Bayfield County Board of
Supervisors’ Meeting. A motion was made by Gordon/Good to approve the minutes of the
September 30, 2008 Bayfield county Board of Supervisors’ Meeting. Discussion. The motion
carried.
2. Public Comment: Chairman Kacvinsky asked three times if there was anyone else
from the public that wanted to comment - there was no response.
3. 2009 Bayfield County Public Hearing. A motion was made by Jardine/Kittleson
to adjourn as a County Board and reconvene as a Committee of the Whole to hold a public
hearing on the 2008 Bayfield County Budget. A roll call vote was taken as follows: Jardine-
yes; Maki-absent; Kittleson-yes; Blahnik-yes; Kacvinsky-yes; Beeksma-yes; Williams-yes;
Bichanich-yes; Miller-yes; Crandall-yes; Rondeau-yes; Good-yes; Gordon-yes. Total: 13, 12
yes,0 no, 1 absent, the motion carried.
4. Public Comment on Proposed 2009 County Budget.
a) Barb Hoeskstra, 120 S. 6th Street, Bayfield, WI 54814. Her question to the Board
was, “How much is being put into the budget towards free listing for advertising in the Visitor’s
Guide. Supervisor Rondeau responded that the Vacation Guide is paid for by the advertisers.
Chairman Kacvinsky asked three times if there was anyone else from the public that wanted
to comment - there was no response.
A motion was made by Gordon/Rondeau to adjourn as a Committee of the Whole and to
reconvene as a County Board. A roll call vote was taken as follows: Maki-absent; Kittleson-
yes; Blahnik-yes; Kacvinsky-yes; Beeksma-yes; Williams-yes; Bichanich-yes; Miller-yes;

5. Discussion and Possible Action to Adopt the 2009 Budget. Abeles-Allison went
over the budget briefly with the Board. The budget is at $23,128,848.00, which resulted in an
increase of approximately 2.22% over last year’s levy. He reported that the overall expenditures
are down from 2007 to 2008, basically because of capital expenditures. There is an increases in
Human Services, the animal fund projects a 13% increase. What is unique this year, however, is
departments have cut back and we have scaled back on our use of excess revenue. This year we do
not have any county excess revenues, but rather have rollovers from the Health and Forestry
departments.
A motion was made by Jardine/Crandall to adopt the 2009 budget in the amount of
$23,128,848.00. Discussion took place. Supervisor Rondeau, on behalf of the Executive
Committee, thanked Mark and Kris for putting together a very good budget from which they were
able to work on during the budget process. He reported that they met four times and were
satisfied with what they had for a budget, moved figures around, put it into final form, and are very
pleased with the outcome. The departments came in with figures knowing that we didn’t have extra
funds to spend. He applauded and thanked the full County Board for a job well done. We are
tightening up our purse strings and trying to be proactive, looking toward the future and proud of
what we did. Supervisor Gordon also said that Bayfield County is one of few counties that can be
proud that we have no debt and we fund our county services, are trying to have activities for our
youth such as 4-H, the Fair and our local libraries and are working towards other outlets for all
ages that we can be proud of. Our neighboring counties have debt problems. This was a tough year,
and the future years will be even tougher, but we will make it. Chair Kacvinsky also thanked the
Board, we didn’t have problems with the working with the budget figures. A roll call vote was

6. Discussion and Possible Action to Set the 2009 Tax Levy. Abeles-Allison
reported that the tax levy is $8,681,495.00 with a mill rate set at approximately 3.28%. A brief
discussion took place. A motion was made by Gordon/Jardine to set the 2009 Tax Levy at
$8,681,495.00 with a mill rate of approximately 3.28%. A roll call was taken as follows:

7. Discussion and Possible Action Regarding Tourism Guide Concerns. Barb
Hoekstra, was present to address the Board regarding the Bayfield County Visitor’s Guide. She
commended Mary Motiff for making an effort to resolve the matter. However, still isn’t happy with
the outcome. She explained different scenarios as they related to “free” advertising through the
County’s website. On the website under the Zoning & Planning Department, Soil Testers are listed
for people to contact. She questioned as to whether or not they were licensed in their field. The
Human Services Department has home repair programs, where plumbers and contractors are listed.
Are they members of a Chamber of Commerce? Why can’t there be a free listing for all businesses
in Bayfield County who wish to be there? Supervisor Rondeau addressed the situation regarding
the free listing. Rondeau stated that whatever the Tourism Committee or Tourism Department
does, doesn’t seem to appease Hoekstra. We have tried to work with Hoekstra on different
proposals, however, they are never good enough and she wants more. Earlier on, it was only the
Quilt Company, now it is your Bed & Breakfast, what’s next. Hoekstra stated she wants the same
equality, why can’t she have a free listing if the soil testers, plumbers and contractors have free
listings on the website? Hoekstra stated she does not belong to a Bayfield County Chamber of

Commerce as she doesn’t need the advertising or help from them and chooses not to join. Hoekstra
had with her 50 names on a petition who are in agreement with her. She wants equality for all
businesses.
Chairman Kacvinsky asked the Board if they could suspend the rules to allow Mary Motiff,
Tourism Director, to speak to both the Board and Hoekstra. They were in agreement. Motiff first
addressed the “free” advertising on the website stating if the other Departments list businesses on
their pages to be helpful, that is entirely up to them, she can’t tell the different departments what
they can or cannot put on the their web page. The Tourism Department’s job is to promote
businesses. Motiff explained the first offer that was made to everyone that belong to any Bayfield
County Chamber, to help promote the small businesses to help boost their business and Bayfield
County’s economy, while trying to promote tourism in Bayfield County. Motiff explained that this
offer was not acceptable to Hoekstra as she didn’t belong to a Bayfield County Chamber of
Commerce, but rather, to the Ashland Chamber of Commerce. The current offer to everyone, in an
effort to showcase the variety of businesses that our area offers, we have a new one-line directory
listing for a reduced rate of $25.00, making it more affordable to be a part of this important
publication. Also, if a business belongs to either a Bayfield County Chamber of Commerce or
Business Association or are located in Bayfield County and belong to any area Chamber of Commerce
or Business Association you can get a full 20 word listing for $50.00, saving $25.00.
The Tourism Committee felt this was a fair offer, and they have also contacted the
County’s corporation counsel, whose opinion was that it was also fair. Motiff stated that she was
not aware of any other complaints as she has only heard from Hoekstra. She stated that as far as
the plumbers, soil testers and contractors go, they are not a part of the tourism guide. They will
be listed if they so choose to, but not free. Motiff went on to state that the Visitor’s Guide
directs people to the website, which is why she can offer a free listing on the website, as it is
Tourism’s website.
Supervisor Good commented by stating that it isn’t Bayfield County’s intent to be the sole
marketing person. We want to encourage people to use this facility to help the betterment of
everyone.
Supervisor Gordon stated that she can get the advertising, but it won’t be free and she will
have to pay for it like any other business. Motiff again stated that she is projecting costs in hope
that the Guide can pay for itself. This is first year Bayfield County is putting the Guide together
on our own. It is designed to be self-supporting so we won’t take taxpayers dollars.
Abeles-Allison stated that it is Bayfield County’s intent to encourage participation with local
Chamber of Commerces for local events, activities and advertising. This is the effort behind the
Tourism Committee. Discussion took place on the fact that throughout the county and state, there
are room taxes. Those room tax dollars have to be distributed correctly. The State of Wisconsin
has directed that the room tax dollars go to tourism. Chambers are a way to organize local
business and to assist regions. Hoekstra stated that the room tax is not an option where dollars
go as it is dictated by statutory direction and regulated through the state.
At this point, Chairman Kacvinsky stopped discussion stating they have heard Hoekstra’s complaint,
they have gotten an opinion from the County’s corporation counsel, and a decision has been made.
A motion was made by Good/Rondeau to support the recommendation of the Tourism
Committee offering a one-line directory listing for a reduced rate of $25.00, and if a

business belongs to either a Bayfield County Chamber of Commerce or Business Association or
are located in Bayfield County and belong to any area Chamber of Commerce or Business
Association you can get a full 20 word listing for $50.00, and to endorse that this be in the
Visitor’s Guide. Hoekstra asked for a roll call vote, but was informed by Chairman Kacvinsky that
she doesn’t have the right to ask that. Instead, Supervisor Good then asked for a roll call vote,
which was taken as follows: Kacvinsky-yes; Beeksma-yes; Williams-yes; Bichanich-yes; Miller-
yes; Crandall-yes; Rondeau-yes; Good-yes; Gordon-yes; Jardine-yes; Maki-absent; Kittleson-
yes; Blahnik-yes. Total: 13, 12 yes, 0 no, 1 absent, the motion carried.
At this time, 6:35, the Board took a 10 minute recess.
8. Bayfield County Resolution No. 2008-50, Tax Charge Backs of 2007. Abeles-
Allison briefly explained the purpose of the charge backs. The Board dispensed with the reading of
the Resolution, which reads as follows:
WHEREAS, the Executive Committee of the Bayfield County Board of Supervisors, has
examined a report of the Bayfield County Treasurer setting forth the certain Tax Certificates now
owned by Bayfield County. These Tax Certificates are illegal and void in that said Certificates were
issued on the tax exempt property, or property on which there was a double or incorrect
description and for other reasons as set forth in said Treasurer’s Report; and
WHEREAS, from said examination it has been determined that said reports are illegal and
void and that the taxes upon which said Certificates are based, are not justly reassessable.
NOW, THEREFORE, BE IT RESOLVED, the amounts of said illegal and void Tax
Certificates are charged back to the respective towns, cities, or villages where in such lands are
situated.

A motion was made by Blahnik/Williams to adopt Bayfield County Resolution No. 2008-
50, Tax Charge Backs of 2007. Supervisor Good explained the purpose of charge backs.
Discussion took place on the taxes. Consulted with corporation counsel, and he is comfortable with
the way the County currently handles the charge backs. A roll call vote was taken as follows:

9. Bayfield County Resolution No. 2008-46, Changing Official Road Name. The
Board dispensed with the reading of the Resolution, which reads as follows:
WHEREAS, Bayfield County has established a Countywide Address System through
Ordinance, Title 8, Chapter 1; and
WHEREAS, the intent of this address system is to assign each location a unique address
which will aid emergency personnel in providing the fire protection, emergency medical services, law
enforcement services, postal mail delivery and meet other general location needs of the public; and

WHEREAS, the local unit of government with jurisdiction over the road is designated as
the authority to rename a road; and
WHEREAS, two sections of county highway have been identified that an official name
change is required in order to alleviate confusion between parallel sections of those county
highways; and
WHEREAS, those sections of county highways are currently used for addressing with the
proposed name changes.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors,
assembled this 30th day of September, 2008 resolve that the following county highway road name
changes be implemented:
a) Co Hwy J be officially designated S CO HWY J as it travels west from the
intersection with Star Route Rd to ST Hwy 13 (Town of Bayfield);
(b) Co Hwy H be officially designated E CO HWY H from its intersection with Co Hwy
E east ¾ of a mile and south 1 mile (Town of Delta-Section 13 line, T46N, R7W); and
BE IT FURTHER RESOLVED that the highway signs will be changed to indicate these
official road names.

A motion was made by Gordon/Beeksma to adopt Bayfield County Resolution No. 2008-46,
Changing Official Road Name. Discussion took place on the reason for the name change. It was
explained that it is due to 911 and the two different ambulance services and their jurisdictions.
The motion carried.
10. Bayfield County Resolution No. 2008-47, Request to Amend 2008 Land & Water
Conservation Department Budget for Award of WI Coastal Management Program Grant
Agreement #AD089091-007.57 (0809-G003). The Board dispensed with the reading of the
Resolution, which reads as follows:
WHEREAS, Bayfield County applied for and has been awarded Wisconsin Coastal
Management Program (WCMP) Grant Agmt. #AD089091-007.57 (0809-G003);
WHEREAS, the FY2008 budget was developed prior to the award of this grant
WHEREAS, the Bayfield County Land & Water Conservation Department requests that
their 2008 budget be adjusted as follows to reflect the revenue and expenditures anticipated to be
received/expended through the WCMP Grant Agreement No. AD089091-007.57 (0809-G003);

NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors,
meeting this 28th day of October, 2008 approve the following budget amendments to reflect
WCMP Grant Agreement No. AD089091-007.57 (0809-G003) revenues and expenditures:
Increase revenue account #100-28-43586-002 by: $50,000
Increase expense account #100-28-56221-50290 by: $50,000
Be it further resolved that funds not expended in 2008 shall be carried over into FY2009.

11. Bayfield County Resolution No. 2008-52, Request to Amend Land & Water
Conservation Department Budget for Award of Cooperative Agreement No. 30108-J207
(0810-001). The Board dispensed with the reading of the Resolution, which reads as follows:
WHEREAS, Bayfield County applied for and has been awarded Cooperative Agreement No.
301818-J207 (0810-001); and
WHEREAS, the FY2008 budget was developed prior to the award of this grant; and
WHEREAS, the Bayfield County Land & Water Conservation Department requests that
their 2008 budget be adjusted as follows to reflect the revenue and expenditures anticipated to be
received/expended through the Cooperative Agreement No. 301818-J207 (0810-001).
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors,
assembled this 28th day of October, 2008 approve the following budget amendments to reflect
Comprehensive Planning Grant revenues and expenditures:
Increase revenue account #100-28-43274-108 by: $40,000.00
Increase expense account #100-28-56137-50290 by: $40,000.00
Be it further resolved that funds not expended in 2008 shall be carried over into FY2009.

A motion was made by Good/Crandall to adopt Bayfield County Resolution No. 2008-
52, Request to Amend Land & Water Conservation Department Budget for Award of
Cooperative Agreement No. 30108-J207 (0810-001). Discussion took place to change the
wording in the fourth paragraph, striking the sentence, “to reflect Comprehensive Planning Grant
revenues and expenditures.” This change was then reflected in the motion as agreed to by both
Good and Crandall, and the motion now reads as follows: to adopt Bayfield County Resolution No.
2008-52, Request to Amend Land & Water Conservation Department Budget for Award of
Cooperative Agreement No. 30108-J207 (0810-001), striking the words “to reflect
Comprehensive Planning Grant revenues and expenditures.” in the fourth paragraph. A roll call
vote was taken as follows: Williams-yes; Bichanich-yes; Miller-yes; Crandall-yes; Rondeau-

12. Bayfield County Resolution No. 2008-53, Continue State Tier I and Tier II
Staffing Support for Locally Lead Conservation Programming as Described in State Statutes;
Chapter 92.14(6) and Implemented under County Land and Water Resource Management Plans.
Robert Lobermeier, County Conservationist, was present this evening to address and explain the
purpose of the Resolution. The Board dispensed with the reading of the Resolution, which reads as
follows:
WHEREAS, conservation and protection of natural resources is essential to the economic
and social wellbeing of the residents of and visitors to Bayfield County; and
WHEREAS, Bayfield County directs and supports a wide spectrum of conservation
activities identified in the LWRMP and administered through its Land and Water Conservation
Department; and
WHEREAS, Chapter 92.14(6) established a model to fairly distribute state staffing grants
to counties, providing a stable funding source for the purpose of implementing the conservation
goals identified in their LWRMP including both state and local properties; and
WHEREAS, the Tier I and Tier II model designed under 92.14(6) established the goal of
three (3) staff per county to implement the goals of the LWRMP; and
WHEREAS, Tier I and Tier II are the minimum base on which counties can develop and
expand their conservation programs to address identified conservation priorities; and
WHEREAS, this model has proven to be very effective in implementing local and state
conservation priorities as well as increasing the capacity of Bayfield County to deliver conservation
programs; and
WHEREAS, a departure from the Tier I and Tier II model will significantly reduce the
ability of Bayfield County to fund the three (3) staff minimum as well as the ability to access
additional funding, implement a comprehensive county conservation program or to meet the goals of
LWRMP resulting a narrowing conservation focus and less conservation implemented in the county.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of October, 2008, calls upon the Department of Agriculture, Trade and
Consumer Protection (DATCP) and the DNR to fully fund the successful Tier I and Tier II staffing

model as intended under Chapter 92.14(6) before directing available funds to alternate Tiers or
activities; and
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Bayfield County Board of
Supervisors recommends that DATCP and the DNR confirm their commitment to make funding of
the Tier I and Tier II staffing grant model a priority for their agencies; and
NOW, THEREFORE, BE IT FURTHER RESOLVED, that this Resolution be forwarded to DATCP,
DNR, Natural Resources Board, and the Land and Water Conservation Board for consideration.

A motion was made by Gordon/Bichanich to adopt Bayfield County Resolution No. 2008-
53, Continue State Tier I and Tier II Staffing Support for Locally Lead Conservation
Programming as Described in State Statutes; Chapter 92.14(6) and Implemented under County
Land and Water Resource Management Plans. The motion carried.
13. Bayfield County Resolution No. 2008-48, November 11, 2008 Veteran’s Day
Celebration. Chair Kacvinsky stated that in his absence, Chris Johnson, Veteran’s Service Officer,
asked him if he would read this Resolution. It reads as follows:
WHEREAS, the 11th of November 2008 is Celebrated as Veteran’s Day; and
WHEREAS, Bayfield County Veterans and all Veterans have honored themselves through
their service and dedication to their Country, State and this County; and
WHEREAS, these Veteran’s have provided for our protection and freedom, and have earned
the respect of their fellow citizens; and
WHEREAS, Veteran heroic actions on and off the battlefield has inspired other citizens to
sacrifice for others; and
WHEREAS, our defense of liberty begins with “Those That Serve.”
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors,
assembled this 28th day of October, 2008, salute Veterans for their contributions and express the
Boards’ gratitude for all those who currently serve and those that formerly served in the United
States Armed Forces; and
BE IT FURTHER RESOLVED, that the County Clerk shall provide a copy of this resolution
to all Bayfield County Service Organizations.

A motion was made by Gordon/Blahnik to adopt Bayfield County Resolution No. 2008-
48, November 11, 2008 Veteran’s Day Celebration. The motion carried, and the Board
stated that this should be put in The County Journal for all residents to see.
14. Bayfield County Resolution No. 2008-51, Designation of Authorized Depositories
for Bayfield County. The Board dispensed with the reading of this Resolution, which reads as
follows;
WHEREAS, Section 34.05 of the Wisconsin Statutes authorizes counties to invest any of
their funds not immediately needed, in time deposits, in banks, or savings and loan associations, in
accordance with and subject to the limitations of Wisconsin Statute §66.0603(1m), and also
authorizes counties to engage in financial transactions in which the public depository agrees to
repay funds advanced to it by the county plus interest, if the agreement is secured by bonds or
securities issued or guaranteed as to principal and interest by the Federal Government, and
WHEREAS, it appears to be to the financial benefit of the County and its citizens to invest
funds not immediately needed in such deposits and to enter into such financial transactions from
time to time;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Treasurer is hereby
authorized and directed to invest county funds not immediately needed either in time deposits in
accordance with and subject to the limitations of Wisconsin Statute §66.0603, or by entering into
financial transactions in which a public depository agrees to repay funds advanced to it by the
County plus interest, if the agreement is fully secured by securities issued or guaranteed as to
principal and interest by the Federal Government, with any of the following financial institutions,
which have been designated as public depositories for Bayfield County: Bremer Bank; Associated
Bank; Security State Bank; State Bank of Drummond, Northern State Bank; Chippewa Valley Bank;
and the Local Government Investment Pool.
BE IT FURTHER RESOLVED, that County funds not so invested shall be deposited in
checking or savings accounts at any of the foregoing institutions.

A motion was made by Rondeau/Williams to adopt Bayfield County Resolution No.
2008-51, Designation of Authorized Depositories for Bayfield County. Gordon announced that
he would be abstaining from voting as he is on the board for one of the depositories mentioned in
the Resolution. A brief discussion took place. The motion carried.
15. Discussion and Possible Action Regarding Intergovernmental Cooperation
Agreement by and between Ashland, Bayfield, Iron, Price and Sawyer County. Elizabeth
Skulan was present to give a brief history regarding the Agreement. She stated that all necessary
parties and legal counsel have reviewed the agreement and have given it their blessing.

A motion was made by Gordon/Kittleson to adopt the Intergovernmental Cooperation
Agreement by and between Ashland, Bayfield, Iron, Price and Sawyer County. Discussion took
place. Abeles-Allison and Skulan explain to the County Board the distinction between this
agreement and the MCO agreement. Skulan was congratulated for getting Bayfield County named
as the fiscal agent for all five counties. The motion carried.
16. Discussion and Possible Action Regarding Amendment to Bayfield County Forests
Comprehensive Land Use Plan, Chapter 700, Section 702.01 to Include Additional Miles of
Primary County Forest Roads. Abeles-Allison explained that this amendment adds four miles of
primary county road to our inventory. Each mile of forest road earns the county $336.00. A
motion was made by Good/Bichanich to adopt the Amendment to Bayfield County Forests
Comprehensive Land Use Plan, Chapter 700, Section 702.01 to include Additional Miles of
Primary County Forest Roads. The motion carried.
17. Administrator’s Report:
a) WCA Report Abeles-Allison reported that he, Bill, Dave, John and Scott attended
the WCA Convention in the Dells. He believed that this was the best attended meeting thus far,
learning so much that they are well worth attending. He stated that the WCA conference was
coordinated with the County Clerk’s conference. If some of Board members have not gone in
previous years, they are encouraged to attend.
b) Update on Hiring of Bayfield County Highway Commissioner. Tom Tepfer has
accepted the job offer of Highway Commissioner and will start his position on November 3rd .
c) Reminder of November 4th Election. County Clerk Fibert stated that there are
major races on the November 4th ballot. He reported that in spite of Attorney General VanHollen’s
lawsuit, he believes Bayfield County has done a fine job regarding voter registrations. We are over
80% registered and into the system and are in good shape even with the issues that he has raised.
d) Statutory County Board Meeting Date of November 12, 2008. Fibert reminded
everyone of the November meeting date. Please note the difference in days, as Veteran’s Day is on
Tuesday and the Courthouse is closed. The meeting will then take place on Wednesday, November
12th.
e) Pictometry Report. Abeles-Allison updated the Board on the new imagery project
for 2009 (pictometry/aerial imagery). He stated that it was last updated about 5-6 years ago. A
big thank you goes to Congressman Obey for helping to secure funding for the project which was
approved last year. Flights should be flown in the Spring of 2009. In addition to the traditional
photography, the new flights will provide oblique or angled photography together with software
allowing for measuring height, distance, slopes, etc. There are four counties involved in this project,
Bayfield, Burnette, Douglas and Washburn. This item will come to the full Board at the November
meeting.
f) Report on Lower Level Accessibility Issue and Potential Elevator. Abeles-Allison
updated Board as to where we are with the matter. We met with contractors as well as
Chequamegon Bay Engineering, to review the spaces that would be involved in this project. After
extensive review we believe that an addition of a stairway and elevator off of the main court entry
and into the vault in the basement is the best choice. We are working on grant applications to
lessen the cost to the County. A brief discussion took place as to how the Register of Deed’s feels
about loosing her vault space.
