Minutes of the
Bayfield County Board of Supervisors’ Meeting
Of March 4, 2009 – 6:00 p.m.
Bayfield County Board Room, Courthouse, Washburn, Wisconsin
The monthly meeting of the Bayfield County Board of Supervisors was called to order by Chairman Kacvinsky at
6:00 p.m. Roll call was taken by Bayfield County Clerk, Scott Fibert as follows: Miller-present;
Miller-present; Crandall-present; Rondeau-absent; Good-absent; Gordon-present; Jardine-present; Maki-
present; Kittleson-present; Blahnik-present; Kacvinsky-present; Beeksma-absent; Williams-present;
Bichanich-present. Total: 13, 11 present, 2 absent, a quorum was present to conduct business. The motion
carried. Others present were: County Administrator, Mark Abeles-Allison; County Clerk, Scott Fibert; Deputy
County Clerk, Dawn M. Bellile; Karl Kastrosky, Zoning Director; Rick Olivo, Reporter for the Daily Press; and area
citizens.
The Pledge of Allegiance was recited by all in attendance.
1. Motion Regarding Minutes of January 27, 2009 Bayfield County Board of Supervisors’ Meeting.
A motion was made by Gordon/Jardine to adopt the minutes of the January 27, 2009 Bayfield County Board
of Supervisors’ Meeting. The motion carried.
2. Public Comment: Chairman Kacvinsky asked if there was anyone from the public that wished to
comment this evening. Kacvinsky stated that he noted people in the audience and let them know that if they were
going to speak on the Town of Russell issue, that this matter will be handled in executive session and there will not
be any action taken this evening. Public comment was then made by the following:
Dave Martinsen, Town of Russell. He was present to mention again, that he is part of the claim against
Bayfield County. He commented on the process that has taken place, and believed that the County Board is
obligated by state statutes to defend the Town of Russell’s Land Use Plan. He has a recorded copy of the 2 Board
meetings where the rezone was listed as new business. This was all approved in less than 20 minutes. Board did
not perform well to its residents. He stated that if nothing else was done, the Klinger family should have been
notified. He submitted a letter for the board to read as well.
Kristy Jensch, Washburn. Jensch has owned acreage on Co Rd K for over 40 years. She spoke on the
noticing of the meetings, stating that she felt it was severely crude place to notice a meeting – on the door of the
town garage. There was no effort made to notify the surrounding neighbors either personally or by mail. Given the
size of the project she felt this was severely inadequate. She asked as to whether or not the County Board had
seen the Land Use Plan for the Town of Russell? No one had. She pointed out where the proposed project was to
be and that right next to the site is wetland. She read an excerpt from the Land Use Plan. This project is in
contradiction to the stated values in the land use plan.
Tom Galazen, Town of Bayfield. Galazen stated that when the leaves drop from the trees, he could
clearly see the proposed site for the development. Pike’s Creek is near and dear to him and he is interested in its
protection, as well as the DNR and other area residents. He stated that this situation is interesting. He doesn’t
believe the County Board members were aware of the concerned citizens regarding this project. The state of the
economy has become much more on a downslide, there are new outlooks and focuses. This may be a derelict project
and could very easily fizzle with the way the economy presently is. There was a memorandum missing from the
Board’s original packet. He noted the findings that were contained in this memorandum by NRC. (A copy of this
document is on file in the County Clerk’s office).
Chairman Kacvinsky asked three more times if there was any further public comment and there was none.
3. Bayfield County Resolution 2009-12, Honoring John Bennett upon his Retirement from the
Bayfield County Maintenance Department. Kacvinsky read the Resolution, which reads as follows:
WHEREAS, John Bennett has served Bayfield County with distinction, honor and dedication in the Bayfield
County Maintenance Department for 18 years,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this
24th day of February, 2009, honors John Bennett for his 18 years of public service to Bayfield County and
expresses gratitude for his efforts, wishing him well in the years ahead.

A motion was made by Jardine/Blahnik to adopt Bayfield County Resolution No. 2009-12, Honoring

The motion carried.
4. Report of the Bayfield County Planning & Zoning Committee Regarding Amendments to Sections
13 of the Bayfield County Zoning, Subdivision Control and Sanitary and Private Sewage Ordinances. The
Board dispensed with the reading of the Report, which reads as follows:

law.
*** Developments containing multi-businesses (commercial or industrial parks) or parcels with a structure
designed for multi-business tenants shall be permitted to erect one (1) multi tenant sign not to exceed 14
feet in height and include a maximum of one (1) panel for each business with an area not to exceed 16
square feet. Each panel included in the multi tenant sign shall count as one 50 square foot on premise or off
premise sign
depending on sign location. Multi-tenant signs shall be limited to one per development or multi-tenant
parcel. A multi-tenant sign may be located on a multi-tenant parcel or at the first common road intersection
serving a multi-tenant business parcel or multi-business development site.
**** Agri-business signs shall be located at road intersections or points of common road entry to
agricultural areas. The first sign placed will be required to obtain a Class B permit designating the location
as an “agricultural sign mall”. Only businesses engaged in agricultural production and sales or the sale of
processed agricultural products shall be allowed a sign at an “agricultural sign mall” location.
Note: For purposes of this Section, two back-to-back faces on one sign structure constitute a single sign.
(3) Off Premise Signs
Off premise signs visible from the same road and located on the same side thereof, including signs
advertising different businesses. products, etc., shall have a minimum separation distance of one
thousand three hundred twenty (1,320) feet between them. Multi-tenant signs, if off-premise,
described in section 2 are exempt from the distance requirement.

A motion was made by Miller/Rondeau to adopt Bayfield County Zoning Amendatory Ordinance No.
2009-05, Rezone of the Shaun Bird Property in the Town of Namakagon, Bayfield County, Wisconsin. The
motion carried.
Supervisor Gordon stated to everyone that after reviewing all of the Reports and Amendatory Ordinances,
he noticed that the Report and Amendatory Ordinance 2009-03 for Sections 13-1-62 and 13-1-64 was noticed
properly. These two particular items are for the sign ordinance. A motion was made by Gordon/Jardine to
rescind the actions of the Report and Amendatory Ordinance No. 2009-03 for Sections 13-1-62 and 13-1-
64 and to send them back to the Zoning Department to have them clarify the proper wording for the March
31st, 2009 agenda. The motion carried.
10. Bayfield County Resolution No. 2009-13, Radon Information Center Grant. The Board
dispensed with the reading of the Resolution, which reads as follows:
WHEREAS, The Bayfield County Health Department has received a Radon Outreach Grant in the amount
of $2,500 to educate the citizens of Bayfield County by submitting public service announcements to be published in
local newspapers throughout the year, with information on the importance of radon testing, the health risks
associated with radon exposure, radon test kit availability and follow up services. Also to distribute 100-200 short
term radon test kits, depending on the cost, to citizens of Bayfield County throughout the year. Total award
beginning January 1, 2009 and to be expended by December 31, 2009; and
WHEREAS, The 2009 Budget does not contain any projections to account for any revenue or
expenditures for said grant; and
WHEREAS, It is the desire of the Bayfield County Board of Health to accept and expend said grant in
2009.

NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled the 4th
day of March, 2009, hereby authorizes the use of Revenue Account Number 100-20-43550-017 and Expense
Account Number 100-20-54106 for the Radon Outreach Grant; and
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors hereby amends the 2009
budget by $2,500 to reflect the revenues and expenditures.

11. Bayfield County Resolution No. 2009-09, 2008 Budget Amendments for Motor Pool, Copy
Fund, Squad Car Fund & Animal Control. The Board dispensed with the reading of the Resolution, which reads as
follows:
WHEREAS, it is anticipated that expenditures will exceed the budgeted amount for FY2008 in the County
Motor Pool, Sheriff’s Squad Car, Copy Machine, and Animal Control Funds; and
WHEREAS, there is fund balance available to cover the additional expenses.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors, meeting this 4th
day of March, 2009 approve the following budget amendments:

12. Bayfield County Amendatory Ordinance No. 2009-06, Revisions to Animal Control Ordinance,
Chapter 1, Section 7-1-1(c) – Dog License Fee. Abeles-Allison reported on this Ordinance. He reported that
the rates are dictated by the State Statute and that this proposal was reviewed and approved by Executive
Committee. The Board dispensed with the reading of the Ordinance, which reads as follows:

That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same, is hereby amended as
follows:
WHEREAS, Bayfield County operates under the State of Wisconsin Dog License Law, Chapter 174;
WHEREAS, current rates for dog licensing are set at $3 and $8 for dogs and $35 for kennels as provided
in Chapter 174.;
WHEREAS, these fees no longer cover the cost of dog licensing activities;
WHEREAS, state statutes 174.05(3) and 174.053 (3) provide counties with the authority to increase the
dog license tax within its jurisdiction;
WHEREAS, state statutes also allow the County to set the compensation rate to listing officials;
NOW, THEREFORE, the Bayfield County Board of Supervisors assembled this 4th day of March, 2009,
hereby ordains that Section 7-1-1(c) of the Bayfield County Code of Ordinances be amended as follows (new text
underlined):
(c) Chapter 174, Wis. Stats., Incorporated. The terms and provisions set forth in Ch. 174, Wis. Stats., as now
stated and as hereinafter amended, are hereby incorporated herein by reference as though fully set forth herein,
except that Sections 174.05(2), 174.053(1), and 174.06(3) of said chapter are replaced with the following
provisions:
(1) Tax. The minimum dog license tax is $5 for a neutered male dog or spayed female dog, upon presentation
of evidence that the dog is neutered or spayed, and $12 for an unneutered male dog or unspayed female dog, or
one-half of these amounts if the dog became 5 months of age after July 1 of the license year.
(2) Multiple dog license option. Any person who keeps more than one dog may, instead of the license tax for
each dog required by this chapter, apply to the collecting official for a multiple dog license for the keeping of the
dogs. Such person shall pay for the license year a license tax of $55 for 12 or fewer dogs and an additional $5 for
each dog in excess of 12. Upon payment of the required multiple dog license tax and upon presentation of evidence
that all dogs over 5 months of age are currently immunized against rabies, the collecting official shall issue the
multiple dog license and a number of tags equal to the number of dogs authorized to be kept by the person.
(3) Listing official compensation. A listing official who is not a full-time, salaried municipal employee shall
receive as compensation $1 for each dog listed, to be audited and allowed by the county board as other claims
against the county and to be paid out of the dog license fund. A listing official who is a full-time, salaried municipal
employee shall receive this compensation from the county board but shall be required to pay the compensation into
the town, village, or city treasury.

This ordinance shall become effective on April 1, 2009.

13. Discussion and Possible Action Regarding Emergency Fire Warden Organization List. A motion
was made by Maki/Williams to Receive and Accept the Emergency Fire Warden Organization List as
presented. A brief discussion took place. The motion carried.

pursuant to §19.85(1),(e), (g), conferring with legal counsel for the governmental body who is rendering oral
or written adv ice concerning strategy to be adopted by the body with respect to litigation in which it is or
is likely to become involved, and to also include in Executive Session, Legal Counsel, and Zoning Director,

14. Administrator’s Report:
a) Chairman Kacvinsky thanked everyone for the flowers that were sent for his mother’s
funeral and for their support.
b) Personnel Manual Update and Worker’s Compensation Update. An update has been done
to the County’s Personnel Manual and to our procedures for Worker’s Compensation claims. These claims go to
personnel, if they do follow the guidelines, then go to the County Board.
c) Accessibility (Elevator Project Update). We are in the process of proceeding with bids.
We have been informed by Bremer that we will receive a grant in the amount of $75,000. The project estimate is
in the low $200,000 range. Timeline: bids will be finalized being opened on March 26th and coming back to the
Board on March 31st. Supervisor Jardine adamantly stated he will not vote for project until questions have
been answered. What’s wrong with elevator we have? How many will actually use the new elevator? How many walk
through hallways now? Isn’t the distance the same from the old elevator to the Human Services Receptionist
compared to where the new elevator will go in to the back? And, we will not vote for the project until he has seen
comparisons. Abeles-Allison stated that at the last meeting the Board authorized the project to go out for bids.
After the bids have been received, it will come back to the Board for either acceptance or rejection. If anyone

has a concern as to how this project is designed he encouraged them to talk to him. Supervisor Maki asked Abeles-
Allison as to how much has been spent to date: He replied that $10,000 in engineering costs and $580.00 for a
permit. There are advertising expenses that have been spent as well, but those dollar amounts have not come back
yet.
d) Approval and Notice of Required Bonds and Insurances Properly Filed in the County
Clerk’s Office per §19.01(4m), Wis. Stats., Fibert reported to the Board that we are in compliance with the
State Statutes.
e) Stimulus Project Update: The County has been exploring stimulus ideas. A first
distribution to the State of Wisconsin for State highway projects. Next phase: County projects, shovel ready
projects that we are submitting in addition to highway projects. We are looking at infrastructure. Cell and broad
band coverage are options. Justice programs for law enforcement or alternatives to incarceration. We are trying
to keep the jail as empty as possible. Discussion took place on Homeland Security. It was reported that there
are 3 new people in our area regarding Homeland Security. Our proximity to Canada and people coming across is
becoming more and more in need of security. Do they give any notification of who, what, or when and where they
will be?
f) 2010 Budget Planning Meetings: The Board discussed amongst themselves and came up
with the date of May 11th at 4:00 p.m. for a budget planning meeting. This will be in addition to the regular monthly
meeting date of May 26th.
15. Supervisors’ Reports: Discussion took place on budget meeting. Supervisor Gordon stated that
we have to look at our economy regarding the towns, schools, cities, and even county. There is a note of concern.
The economy is bad and if you talk to Dan Anderson, he will inform you that there isn’t the money and people are
not paying the first installments of their taxes. We should think about whether we are heading for a depression -
jobs are drying up. The State doesn’t have any money and they aren’t going to do anything to help us out. Dialogue
needs to be done because if people don’t pay their taxes the County won’t have any money to conduct business. We
need to be prepared and see the writing on the wall. Supervisor Maki stated that if you talk with real estate
agents, the trend is that there is a decline in property value – the high evaluations are not there anymore. When
are we going to adjust? Supervisor Blahnik stated that perhaps it is time to take a hard look at reassessments.
Supervisor Miller reported that most loggers are being laid off – Saapi has done so already.
Supervisor Blahnik reported to the Board that on Thursday, March 19th at the Visitor’s Center, there will
be an information meeting regarding the US2 & 13 Intersection.
There being no further business to come before the Bayfield County Board of Supervisors, a motion was
made by Jardine/Crandall to adjourn. The motion carried and the meeting adjourned at 8:15 p.m.
