HomeMy WebLinkAboutCounty Board of Supervisors - Minutes - 1/25/20111 Minutes of the Bayfield County Board of Supervisors’ Meeting Of January 25, 2011 – 6:00 p.m. Bayfield County Board Room, Courthouse, Washburn, Wisconsin The monthly meeting of the Bayfield County Board of Supervisors was called to order by Chairman Kacvinsky at 6:00 p.m. Roll call was taken by Bayfield County Clerk, Scott Fibert as follows: Williams-present; Bichanich-present; Miller-present; Crandall-present; Rondeau-present; Meyers- present; Bussey-present; Jardine-present; Maki-present; Kittleson-present; Bennett-present; Kacvinsky- present; Rantala-present: Total 13: 13 present, 0 absent. The motion carried and a quorum was present to conduct business. The following were also present for the meeting: County Administrator, Mark Abeles-Allison; Deputy County Clerk, Dawn M. Bellile; Claire Duquette, Reporter for The Daily Press; and community residents. The Pledge of Allegiance was recited by all in attendance. 1. Motion Regarding Minutes of December 14, 2010 Bayfield County Board of Supervisors Meeting. The Board dispensed with the reading of the minutes, a copy of which is on file in the County Clerk’s office and on-line for the public to view. A motion was made by Williams/Rondeau to adopt the Minutes of the December 14, 2010 Bayfield County Board of Supervisors Meeting. The motion carried. 2. Public Comment. No Public Comment this evening. 3. Report of the Bayfield County Planning and Zoning Committee Regarding Amending Section 13-1-103, Regarding the Administration and Enforcement of the Zoning Code. The Board dispensed with the reading of the report, which reads as follows: TO: The County Board of Supervisors of Bayfield County on the hearing of petitions to amend the Bayfield County Zoning Ordinance. The Planning and Zoning Committee of the Bayfield County Board of Supervisors, having held a public hearing pursuant to Section 59.69(5)(e), Wisconsin Statutes; notice thereof having been given as provided by law; and having been duly informed of the facts pertinent to the following changes; hereby recommends the following action on said petition: AN ORDINANCE AMENDING SECTION 13-1-103 CODE OF ORDINANCES, BAYFIELD COUNTY, WISCONSIN AND REGARDING THE ADMINISTRATION AND ENFORCEMENT OF THE ZONING CODE WHEREAS, Wisconsin Statutes §59.69(11) authorizes the Bayfield County Board of Supervisors to prescribe rules, regulations, and administrative procedures for the enforcement of Bayfield County’s zoning ordinances; and 2 WHEREAS, Section 13-1-104 Code of Ordinances, Bayfield County, Wisconsin authorizes the County Board to make amendments to Title 13, Chapter 1 of the Code of Ordinances, Bayfield County, Wisconsin pursuant to Wisconsin Statutes §59.69; and WHEREAS, it is deemed to be in the best interest of the County of Bayfield to amend Section 13-1-103 Code of Ordinances, Bayfield County, Wisconsin to allow for the Zoning Administrator to take further action regarding ordinance violations before referring the matter to the Zoning Committee and to allow for a voluntary settlement agreement in lieu of prosecution; and WHEREAS, it is deemed to be in the best interest of the County of Bayfield to amend Section 13-1-103 Code of Ordinances, Bayfield County, Wisconsin to clarify that noncompliance with a mitigation plan or directive of the Zoning Committee or Board of Adjustment constitutes a violation of this Chapter 1 of this Title; and WHEREAS, it is deemed to be in the best interest of the County of Bayfield that the Code of Ordinances, Bayfield County, Wisconsin be further modified and amended in the manner hereinafter set forth; NOW, THEREFORE, the Bayfield County Board of Supervisors does hereby ordain as follows: Section 1. Section 13-1-103 [Violations.] of Article F [Administration and Enforcement] of Chapter 1 [Zoning Code] of Title 13 [Zoning] of the Code of Ordinances, Bayfield County, Wisconsin is hereby amended to read as follows, with additions highlighted by the double underline feature (additions) and deletions highlighted by the strike out feature (deletions): Sec. 13-1-103 Violations. (a) Violation Procedures. If a A violation of any provision of this Chapter which is not corrected on the order of the Zoning Administrator Director of Planning and Zoning or his or her designee, said individual may take further legal action or may refer the matter shall be referred to the Zoning Committee for further consideration. (b) Noncompliance. Noncompliance with a mitigation plan or directive of the Bayfield County Planning and Zoning Department, Zoning Committee, or Board of Adjustment constitutes a violation of Chapter 1 of this Title. (c) (b) Penalty. Any person, firm, or corporation and/or contractor found guilty of violating any provision of this Chapter shall forfeit a sum of not less than $10.00 nor more than $500.00, together with the full costs of such prosecution, plus the costs of any compliance required to rectify the violation. Each day’s failure to comply shall constitute a separate violation. (d) (c) No Permit Penalty. Any person, and/or his/her authorized agent or contractor, proceeding with any action that requires a land use permit under this Chapter without first securing such a permit, shall be subject to twice the fees for such a permit provided that the Zoning 3 Committee, in its sole discretion, may waive doubling of fees for such permit if it determines such action to be warranted under the circumstances of the case in question. (e) (d) Additional Penalty. In addition to the above, any person and/or his/her authorized agent or contractor, proceeding with any action that fails under the jurisdiction of this Chapter may be subject to the terms of Section 1-1-6. (f) Voluntary Settlement Agreement. In lieu of the prosecution of a violation by the commencement of an action in the Bayfield County Circuit Court, the property owner and the Bayfield County Planning and Zoning Department may enter into a voluntary settlement agreement. The settlement agreement may include a provision imposing a settlement fee to be paid by the property owner. Section 2. Except as specifically modified and amended by this ordinance, the Code of Ordinances, Bayfield County, Wisconsin shall remain in force and effect exactly as originally adopted and previously amended. All ordinances or parts of ordinances inconsistent with or in contravention of the provisions of this ordinance are hereby repealed. Section 3. SEVERABILITY. If a court of competent jurisdiction adjudges any section, clause, provision, or portion of this ordinance unconstitutional or invalid, the remainder of this ordinance shall not be affected thereby. Section 4. EFFECTIVE DATE. This ordinance shall take effect and be in full force from and after its passage. Date: December 16, 2010 BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE Kenneth Jardine, Harold A. Maki, Patricia Rantala, Shawn W. Miller, Brett T. Rondeau A motion was made by Rondeau/Maki to receive and place on file the Report of the Bayfield County Planning and Zoning Committee Regarding an Ordinance Amending Section 13-1-103 Code of Ordinances, Bayfield County, Wisconsin and Regarding the Administration and Enforcement of the Zoning Code. The motion carried. 4. Bayfield County Amendatory Ordinance No. 2011-01, Amending Section 13-1-103, Regarding the Administration and Enforcement of the Zoning Code. The Board dispensed with the reading of the Ordinance, which reads as follows: TO: The County Board of Supervisors of Bayfield County on the hearing of petitions to amend the Bayfield County Zoning Ordinance. 6 The Planning and Zoning Committee of the Bayfield County Board of Supervisors, having held a public hearing pursuant to Section 59.69(5)(e), Wisconsin Statutes; notice thereof having been given as provided by law; and having been duly informed of the facts pertinent to the following changes; hereby recommends the following action on said petition: WHEREAS, Wisconsin Statutes §59.69(11) authorizes the Bayfield County Board of Supervisors to prescribe rules, regulations, and administrative procedures for the enforcement of Bayfield County’s zoning ordinances; and WHEREAS, Section 15-1-23 Code of Ordinances, Bayfield County, Wisconsin authorizes the County Board to make amendments to Title 15, Chapter 1 of the Code of Ordinances, Bayfield County, Wisconsin pursuant to Wisconsin Statutes §59.69; and WHEREAS, it is deemed in the best interest of the County of Bayfield to amend Section 15-1-23 Code of Ordinances, Bayfield County, Wisconsin to clarify that noncompliance with inspection requirements constitutes a violation of Chapter 1 of this Title and to allow for a voluntary settlement agreement in lieu of prosecution; and WHEREAS, it is deemed in the best interest of the County of Bayfield that the Code of Ordinances, Bayfield County, Wisconsin be further modified and amended in the manner hereinafter set forth; NOW, THEREFORE, the Bayfield County Board of Supervisors does hereby ordain as follows: Section 1. Section 15-1-23 [Violations and Penalties.] of Article F [Administration and Enforcement] of Chapter 1 [Sanitary and Private Sewage Code] of Title 15 [Sanitary and Private Sewage Code] of the Code of Ordinances, Bayfield County, Wisconsin is hereby amended to read as follows, with additions highlighted by the double underline feature (additions) and deletions highlighted by the strike out feature (deletions): Sec. 15-1-23 Violations and Penalties. (a) Violations of the provisions of this ordinance are subject to the terms of Section 1-1-6, Chapter 1-2 and Section 13-1-103 of the Bayfield County Code of Ordinance. Noncompliance with the inspection requirements set forth in this ordinance constitutes a violation of Chapter 1 of this Title. (b) Any construction which is in violation of this ordinance shall cease upon written order from the County of the placement of a notification of violation at the site. (c) All construction shall remain stopped until the order is released by the County. (d) Violations of this ordinance shall be prosecuted by the Corporation Counsel. 7 (e) In lieu of the prosecution of a violation by the Corporation Counsel, the property owner and the Bayfield County Planning and Zoning Department may enter into a voluntary settlement agreement. The settlement agreement may include a provision imposing a settlement fee to be paid by the property owner. Section 2. Except as specifically modified and amended by this ordinance, the Bayfield County Code of Ordinance shall remain in force and effect exactly as originally adopted and previously amended. Bayfield County Amendatory Ordinance No. 2011-04, Amending Article B, Controlled Intersections; Speed Limits; Section 10-1-10(a)(1), (2), Speed Limits. The Board dispensed with the reading of the Amendatory Ordinance, which reads as follows: The Bayfield County Board of Supervisors ordains as follows: That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same, is hereby amended as follows: The Bayfield County Board of Supervisors ordains as follows: That Title 10 of the Bayfield County Ordinance, Speed Limits, hereby amended as follows: Article B: Controlled Intersections; Speed Limits Sec. 10-1-10 Speed Limits. The Bayfield County Board hereby determines that the statutory speed limits on the following highways or portions thereof are unreasonable, unsafe or impudent and modifies such speed limits as follows: (a) 35 Mph. (1) CTH C. From a point .30 miles northwest of STH 13 (Bayfield Street) to a point 100 feet northwest of the intersection with west 10th Avenue. Adopted this 25th day of January, 2011. By Action of the Bayfield County Board of Supervisors William D. Kacvinsky, Chair A motion was made by Bichanich/Rondeau to adopt Bayfield County Ordinance No. 2011-04, Amending Section 10-1-10 Amending Article B, Controlled Intersections; Speed Limits; Section 10-1-10(a)(1),(2) Speed Limits. The motion carried. 11 10. Bayfield County Resolution No. 2011-01, Supporting BCEDC Twin Ghost Project Appeal. Abeles-Allison explained the Resolution. The Board dispensed with the reading of the Resolution, which reads as follows: WHEREAS, the National Forest Service Twin Ghost project will take place on the Great Divide Ranger District within Bayfield County; WHEREAS there are over 275,000 acres of National Forest Land in Bayfield County; WHEREAS the decisions of the National Forest Service have tremendous impact on Bayfield County and surrounding counties. WHEREAS the impacts have significant social and economic implications for Bayfield County; WHEREAS the sustainable/allowable cut as determined by the Forest Service is nearly double what is currently being harvested; WHEREAS this reduction in harvest has negatively impacted Bayfield County and surrounding counties. WHEREAS the Bayfield County Economic Development Corporation (BCEDC) has studied this issue and has submitted an appeal for consideration; NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 25th day of January, 2011 endorses the appeal submitted by BCEDC. BE IT FURTHER RESOLVED that the Bayfield County board asks that serious consideration be given to the concerns including, but not limited to, the ASQ, Fuels Treatments and Road Closure concerns. BE IT FURTHER RESOLVED that this resolution be forwarded to the appeals deciding officer. Adopted this 25th day of January, 2011. By Action of the Bayfield County Board of Supervisors William D. Kacvinsky, Chair A motion was made by Rondeau/Bennett to adopt Bayfield County Resolution No. 2011-04, Supporting BCEDC Twin Ghost Project Appeal. Supervisor Bussey discussed with the Board that he wanted a better understanding of the Forest Service’s decision and said that he could not endorse the resolution at this time. He stated he could not support the Resolution the way it is right now without more information. Abeles-Allison explained in further detail the concerns and appeals from others and that there was a public hearing held on the matter. The motion carried and there were 3 no votes. 12 11. Bayfield County Resolution No. 2011-02, Aquatic Invasive Species Control Grant, Bayfield County Aquatic Invasive Species Project 2010-2011. Abeles-Allison explained that Ben Dufford, County Conservationist, was going to be present this evening, however, could not be as he is attending the Town of Clover Park Redesign Meeting. The Land Conservation Committee met to finalize this document, which is a 2-year grant supporting the AIS Grant and the hiring of a director or continuing to have a director. This coordinates with the AIS Program, educating the lake associations throughout the county. The Board dispensed with the reading of the Resolution, which reads as follows: WHEREAS, Bayfield County is committed to provide high quality water resources for use by the public for recreation and enjoyment of natural beauty, and; WHEREAS, Bayfield County is presently implementing the Bayfield County Aquatic Invasive Species Strategic Plan, adopted in April 2008, to protect all water resources in the county from introductions of aquatic invasive species, to control those aquatic invasive species populations that exist, and to help safeguard water quality, wildlife habitat, property values and the tourism industry, and; WHEREAS, we recognize some activities of the plan need to be expanded and deepened to strengthen the overall prevention and containment strategies, and improve the risk assessment of AIS in the majority of high use water bodies in the county, and; WHEREAS, we are committed, experienced, networked, and qualified to carry out the responsibilities of an aquatic invasive species control project. NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 25th day of January, 2011, requests grant funding and assistance available from the Wisconsin Department of Natural Resources under the “Aquatic Invasive Species Control Grant Program” and hereby authorizes the County Conservationist, Land and Water Conservation Department, to act on behalf of Bayfield County to:  submit an application to the State of Wisconsin for financial aid for aquatic invasive species control purposes;  sign documents;  take necessary action to undertake, direct, and complete an approved aquatic invasive species control grant; and  submit reimbursement claims along with necessary supporting documentation within six months of project completion date. BE IT FURTHER RESOLVED THAT Bayfield County will meet the obligations of the aquatic invasive species control project including timely publication of the results and meet the financial obligations of an aquatic invasive species grant, including the prompt payment of our 25% commitment to aquatic invasive species control project costs. Kacvinsky, Chair 13 A motion was made by Bichanich/Bussey to adopt Bayfield County Resolution No. 2011-01, Aquatic Invasive Species Control Grant, Bayfield County Aquatic Invasive Species Project 2010- 2011. Discussion took place. The motion carried. 12. Administrator’s Report: a) Update on Superior Days. Superior Days will be held on February 22 and 23. We have many different issues, 4 or 5 different legislative issues, the highway 2 issue as well as the tax reciprocity issue with Minnesota. We have 4 people going. b) Reschedule of February County Board Meeting. Abeles-Allison stated that because of Superior Days, he would like to reschedule the February meeting to March 8th. A motion was made by Bussey/Bichanich to reschedule the February County Board Meeting to March 8, 2011 at 6:00 p.m. The motion carried. c) On February 1st, Congressman Sean Duffy will be present to meet with Bayfield County Departments. d) Supervisor Meyers shared with the Board that CORE is now providing services in the City of Washburn. She also asked the Board to remember Harold Maki and Arden Weber, as Weber was involved in an auto/truck accident where one of the parties was killed. Our condolences are shared for both parties. e) Supervisor Kittleson informed the Board that the UW-Extension District Meeting will be held on February 4th at the Great Lakes Visitor’s Center in Ashland from 9:30 a.m. to 3:00 p.m. If you are interested in attending, please contact Tim Kane.
