HomeMy WebLinkAboutCounty Board of Supervisors - Minutes - 12/13/2011 149 Minutes of the Bayfield County Board of Supervisors’ Meeting Of December 13, 2011 – 6:00 p.m. Bayfield County Board Room, Courthouse, Washburn, Wisconsin The monthly meeting of the Bayfield County Board of Supervisors was called to order by Chairman Kacvinsky at 6:12 p.m. Roll call was taken by Bayfield County Clerk, Scott Fibert as follows: Crandall-present; Rondeau-present; Meyers-absent; Bussey-present; Jardine-present; Maki-present; Kittleson-present; Bennett-present; Kacvinsky-present; Rantala-present; Williams-present; Bichanich- present; Miller-present: Total 13: 12 present, 1 absent. A quorum was present to conduct business. The following were also present for the meeting: County Administrator, Mark Abeles-Allison; Deputy County Clerk, Dawn M. Bellile; Sarah Pischer, Representative for the Department of Tourism; Mary Motiff, Tourism Director; James Bolen, Representative from the Cable Chamber of Commerce; Carrie Linder, Human Services Dept. Aging & Disability Service Manager; Elizabeth Skulan, Human Services Director; Kay Cederberg, Clerk of Circuit Court; and Julie Buckels, Reporter for The Daily Press; and community residents. The Pledge of Allegiance was recited by all in attendance. 1. Motion Regarding Minutes of November 15, 2011 Bayfield County Board of Supervisors’ Meeting. The Board dispensed with the reading of the minutes. A motion was made by Kittleson/Rondeau to adopt the November 15, 2011 Bayfield County Board of Supervisors’ Meeting Minutes. The motion carried. 2. Public Comment. Theresa Kummerow, 706 E. 3rd St., Washburn, WI. She introduced herself stated that she is an employee of Bayfield County. She wanted to talk about the proposed Policies & Procedures Manual that is on the agenda this evening for adoption. One issue in particular she pointed out was for benefits to part-time employees. The way the Manual reads, if adopted, she would not make enough money to even pay for her health insurance. She explained that her work schedule is somewhat different, where she works more in some months than others, but there are others who will be affected by this as well. She urged the Board to go through the manual thoroughly as there are issues in it which don’t make sense. 3. Presentation of Plaque Honoring Jan Bergst upon her Retirement from the Bayfield County Human Services Department. At the November County Board Meeting, Bergst was honored with a Resolution, but was unable to attend meeting. This evening, Jardine stated it would be an honor to present Bergst with her retirement plaque. Bergst thanked the Board for hiring her and for looking out for Bayfield County residents. 4. Discussion and Possible Action on Transition Committee Non-Represented Personnel Policies. The Board did not go through the Personnel Policies as part of a discussion. Maki/Jardine made a motion to turn down the Personnel Policies and Procedures as recommended by the Transition Committee. Jardine started discussion stating that the Transition Committee, he felt was biased, stating 3 of the committee members were business people and felt that their influence was present, and felt that this manual has not had enough time to go through, and it needs more work. Miller spoke as a business owner. Maki asked what exactly the State was taking away from the employees – 150 was it 5.5% or 5.8%. The new law states that employees are to pay their half of the WRS contribution which took place in August. He inquired as to what the new manual will also take away from the employees. Abeles-Allison commented stating that the existing sick leave banks and payout provisions will be left in place. Further questions were asked of Abeles-Allison and the Transition Committee, asking if this committee will be around in 2-3 years if more “tweaking” needs to be done or will this go directly to the County Board for further revisions. There is more work that needs to be done on the manual and we need more time to digest the manual in its entirety. Some of the changes would be good for new employees, but not for existing employees and it was felt that it is too soon to put this into place. Discussion took place that this should go into effect for all employees at the same time and not into place now, using it only on the non-represented employees. Further discussion took place on the fact that if it is passed this evening, and changes are made to it, it could be brought to the next Board meeting for amending. A question was asked if the employees have yet had a chance to look at the manual. To date, employees have not seen the policies or have been notified of what is going to happen. It was felt by some that employees should not be left in the dark and that they should know what it is going to be set in policy. It was also felt that any tweaking that needs to be done to the policy, should be done before it is put in place. Bussey stated that he would like to see policy put in place in January of 2013, with any tweaking done prior to that time. A roll call vote was asked for reminding the Board that a yes vote would be to reject the manual. Roll call vote took place as follows: Rondeau-no; Meyers-absent; Bussey-no; Jardine-yes; Maki- yes; Kittleson-no; Bennett-yes; Kacvinsky-no; Rantala-yes; Williams-yes; Bichanich-yes; Miller- no; Crandall-no: Total 13: 6 yes, 6 no, 1 absent. The motion dies due to a tie. A motion was made by Bussey/Kittleson to adopt the Personnel Policies & Procedures Manual, making the effective date January 1, 2013, putting the topic on the agenda for the next County Board meeting for any proposed changes to the policies by Board members. The motion carried with one opposition. 5. Bayfield County Resolution No. 2011-46, Department of Human Services Budget Adjustments. Elizabeth Skulan, Human Services Director, was present to explain that the resolution is not for County dollars, but rather, to use from the Risk Fund. Skulan explained the purpose of the Risk Fund and there are cases for use of the funds. The Board dispensed with the reading of the Resolution, which reads as follows: WHEREAS, adjustments to and transfers within the Department of Human Services 2011 budget are necessary to satisfy state statutes and accounting principles; and WHEREAS, the Department of Human Services currently maintains a Risk Reserve Fund in the amount of $355,000; and WHEREAS, Human Services expects to exceed our 2011 state/federal funding for mandated services; and WHEREAS, the Department of Human Services is requesting to access the Risk Reserve Funds in the amount of $10,000; and 151 NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 13th day of December, 2011, does hereby approve that the following 2011 budget line adjustments be made. The motion carried. 6. Bayfield County Resolution No. 2011-47, 2011 Board of Adjustment Budget Amendment within the Planning & Zoning Department Budget. This item was removed from the Agenda. 7. Bayfield County Resolution No. 2011-48, Tourism Department Budget Adjustments. Abeles-Allison explained that the amendment is for grant dollars received. The Board dispensed with the reading of the Resolution, which reads as follows: WHEREAS, the Bayfield County Tourism & Recreation Department received a Valhalla Recreation Area Project Grant through the American Recovery and Reinvestment Act (ARRA) in partnership with the USDA Forest Service, for improvements at the Mt. Valhalla Recreation Area in 2010 in the amount of $120,000. WHEREAS, the Bayfield County Tourism & Recreation Department completed only a portion of the project in 2010 and funding in the amount of $105,076.58 remained in the grant. WHEREAS, the Bayfield County Tourism & Recreation Department will complete the project in 2011. 152 WHEREAS, the Bayfield County Tourism & Recreation Department requests that the 2011 Tourism & Recreation budget be amended to reflect the $105,076.58 anticipated to be spent in 2011 for the Valhalla Recreation Area Project. NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors, meeting this 13th day of December, 2011, does hereby approve a budget amendment of the 2011 Tourism & Recreational budget as follows: Increase expense line 100-23-55203-50290 by $92,526.58 Increase expense line 100-23-55203-50315 by $50.00 Increase expense line 100-23-55203-50390 by $12,500.00 Increase revenue line 100-23-43270-001 by $105,076.58 By Action of the Bayfield County Board of Supervisors William D. The motion carried. 8. Bayfield County Resolution No. 2011-49, Budget Amendments to Squad Fleet, County Fleet, and Copy Funds. Abeles-Allison explained that all three of these funds are internal service funds with balances in them. This will have the revenues match expenditures. The Resolution reads as follows: WHEREAS, it is anticipated that revenues and expenditures will exceed the budgeted amounts for FY2011 in the Copy Machine, County Motor Pool and Squad Car Funds. WHEREAS, these internal service funds are intended to break even. WHEREAS, there is sufficient fund balance in each of these funds to cover the anticipated overages; WHEREAS, In the Squad Car and Motor Pool Funds, gas prices increased over expectations, costs charged per mile were increased at the beginning of the year allowing for additional revenues, expenditures are still over estimate. Report of the Bayfield County Planning & Zoning Committee Regarding Ordinance Amendment to Section 13-1-40 Code of Ordinances, Bayfield County, Wisconsin, Regarding the Construction and Restoration of Non-Conforming Structures Damaged or Destroyed by Natural Events. The Board dispensed with the reading of the Report, which reads as follows: TO: The County Board of Supervisors of Bayfield County on the hearing of petitions to amend the Bayfield County Zoning Ordinance. The Planning and Zoning Committee of the Bayfield County Board of Supervisors, having held a public hearing pursuant to Section 59.69(5)(e), Wisconsin Statutes; notice thereof having been given as provided by law; and having been duly informed of the facts pertinent to the following changes; hereby recommends the following action on said petition: 154 AN ORDINANCE AMENDING SECTION 13-1-40 CODE OF ORDINANCES, BAYFIELD COUNTY, WISCONSIN AND REGARDING THE RECONSTRUCTION AND RESTORATION OF NONCONFORMING STRUCTURES DAMAGED OR DESTROYED BY NATURAL EVENTS WHEREAS, Wisconsin Statutes §59.69(10m) does not allow an ordinance to prohibit the restoration of a nonconforming structure if the structure will be restored to the size, location, and use that it had immediately before the damage or destruction occurred if the damage or destruction was caused by violent wind, vandalism, fire, flood, ice, snow, mold, or infestation; and WHEREAS, Section 13-1-40, Code of Ordinances, Bayfield County, Wisconsin currently does not have an exception for the reconstruction or restoration of nonconforming structures not located within shorelands that have been damaged or destroyed by violent wind, vandalism, fire, flood, ice, snow, mold, or infestation; and WHEREAS, the omission of such an exception in the Code of Ordinances, Bayfield County, Wisconsin places the Code of Ordinances in contradiction to §59.69(10m), Wisconsin Statutes; and WHEREAS, Wisconsin Statutes §59.69(5)(e) authorizes the County Board to amend an ordinance; and WHEREAS, Section 13-1-104 Code of Ordinances, Bayfield County, Wisconsin authorizes the County Board to make amendments to Title 13, Chapter 1 of the Code of Ordinances, Bayfield County, Wisconsin pursuant to Wisconsin Statutes §59.69; and WHEREAS, it is deemed in the best interest of the County of Bayfield to amend Section 13-1-40 Code of Ordinances, Bayfield County, Wisconsin to create an exception for the reconstruction or restoration of nonconforming structures that have been damaged or destroyed by violent wind, vandalism, fire, flood, ice, snow, mold, or infestation so as to place the Code of Ordinances in compliance with the provisions of the Wisconsin State Statutes; and WHEREAS, it is deemed in the best interest of the County of Bayfield that the Code of Ordinances, Bayfield County, Wisconsin be further modified and amended in the manner hereinafter set forth; NOW, THEREFORE, the Bayfield County Board of Supervisors does hereby ordain as follows: Section 1. Paragraph (c) [Nonconforming Buildings and Structures.] of Section 13-1-40 [Nonconforming Uses and Structures.] of Article C [Nonconforming Uses; Conditional Uses; Environmental Impact Analysis] of Chapter 1 [Zoning Code] of Title 13 [Zoning] of the Code of Ordinances, Bayfield County, Wisconsin is hereby amended to read as follows, with additions highlighted by the double underline feature (additions) and deletions highlighted by the strike out feature (deletions): Sec. 13-1-40 Nonconforming Uses and Structures. (c) Nonconforming Buildings and Structures. 155 (2) Nonconforming Accessory Buildings and Structures and Nonconforming Principal Buildings and Structures of Less than 600 Square Feet. Except as provided in paragraph (6) below regarding reconstruction of damaged or destroyed structures in the shoreland, nonconforming accessory buildings and structures and nonconforming principal buildings and structures of less than six hundred (600) square feet of enclosed dwelling space are limited to ordinary maintenance and repair and shall not be improved or expanded. However, such accessory buildings and structures may be externally improved by a land use permit. (3) Nonconforming Principal Buildings and Structures of 600 Square Feet or Larger. Except as further restricted by the provisions of paragraphs (4) and (6) below, nonconforming principal buildings and structures of 600 square feet or larger may be improved internally, externally, or expanded provided that: (4) Additional Requirements for Nonconforming Buildings and Structures on Shoreland Lots. Except as otherwise provided in paragraphs (4a), and (4b), and (6), nonconforming buildings and structures on inland lake shoreland lots shall be subject to paragraphs (c)(2) and (3) of this Section, and in addition thereto, principal buildings and structures on such lots of six hundred (600) square feet of enclosed dwelling space or larger shall be subject to the following provisions of this paragraph: (6) Damaged or Destroyed Nonconforming Structures. Except as provided in paragraph (7) of this subsection, nonconforming buildings and structures nonconforming as to shoreland zoning provisions and which that are damaged or destroyed by a natural event, including, but not limited to, violent wind, vandalism, fire, flood, ice, snow, mold, or infestation may be reconstructed provided that: a. Damage which is due to an intentional act of the owner or his or her agent may only be repaired in conformity with this Chapter; cb. Repair and reconstruction shall be limited to that part of a structure and its specific improvements which are actually damaged or destroyed by a natural event and similar building materials shall be utilized; bc. The owner must has the burden to establish that the specific extent of damage or destruction to a nonconforming structure or part thereof was actually caused by a natural event to a structure and its improvements and to establish the specific extent to which said damage or destruction occurred; d. The structure or part thereof that has actually been damaged or destroyed shall be restored or reconstructed to the size, including the footprint and total square footage, location, and use that it had immediately before the damage or destruction occurred; 156 e. The owner shall bear the burden of proof as to the size, location, and use of a damaged or destroyed nonconforming structure or part thereof immediately before the damage or destruction occurred; f. The size of the nonconforming structure can be larger than the size it was immediately before the damage or destruction only if it is necessary to comply with applicable local, state, or federal requirements; dg. Repair and reconstruction shall be in compliance with all other provisions of applicable ordinances; and eh. The mitigation requirements of paragraph (5) above shall apply to nonconforming structures located within shorelands. Bayfield County Planning and Zoning Committee recommends this petition be approved. The motion carried. 10. Bayfield County Zoning Amendatory Ordinance No. 2011-26, Regarding Ordinance Amendment to Section 13-1-40 Code of Ordinances, Bayfield County, WI, Regarding the Construction and Restoration of Non-Conforming Structures Damaged or Destroyed by Natural Events. By Action of the Bayfield County Board of Supervisors William D. Kacvinsky, Chair A motion was made by Jardine/Rantala to adopt Bayfield County Zoning Amendatory Ordinance No. 2011-26, Regarding Ordinance Amendment to Section 13-1-40 Code of Ordinances, Bayfield County, WI, Regarding the Construction and Restoration of Non-Conforming Structures Damaged or Destroyed by Natural Events. The motion carried. 11. Appointment of Rick Geisen, Scottie Sandstrom and Jack Carlson to the Bayfield County Industrial Development Agency Board of Directors. Abeles-Allison reported that the Agency was formed in 2007 to assist with loan funding of World Class Manufacturing. The purpose of this organization is to promote industrial development in Bayfield County. The Board appoints the membership if there is a change. Presently officers are, William Kacvinsky, President; Brett Rondeau, Vice-President; Otto Rusch, Secretary; Daniel Anderson, Treasurer. The Board would like to recommend the following additional appointments: Jack Carlson, Corporation Counsel; Rick Geisen, BCEDC, President; and Scottie Sandstrom, Executive Director. A motion was made by Bussey/Rondeau to appoint Rick Geisen, Scottie Sandstrom and Jack Carlson to the Bayfield County Industrial Development Agency Board of Directors. The motion carried. 12. Appointment of Michael DeFoe to the AIS Committee as Tribal Representative. Abeles-Allison explained that the AIS Committee has recommended the appointment of Michael DeFoe to the AIS Committee as a Tribal Representative. The Ordinance, as written, provides for such a representative. A brief discussion took place and a motion was made by Crandall/Rantala to Appointment of Michael DeFoe to the AIS Committee as Tribal Representative. The motion carried. 13. Discussion and Possible Action Regarding Contributing to Central Cross-Country Ski for Cable Paralympics. Abeles-Allison reported that at last month’s meeting it was suggested to look into some funding for this venture and to come back to the next month’s meeting, so this is an update on the progress of obtaining funding. Some funds have been secured, Bayfield County Economic Development has donated $5,000 for the event, and they are searching for more funds. The snow machine is needed as they have to guarantee snow for the event. As more information is obtained, we will inform the Board. 14. Reappointment of Thomas Toepfer as Bayfield County Highway Commissioner. Abeles- Allison reported that it is his responsibility as County Administrator to make a recommendation on the reappointment of the Highway Commissioner to the full Board. It is his recommendation that the Board confirm his recommendation for the reappointment of Thomas Toepfer as Bayfield County Highway Commissioner. A motion was made by Bichanich/Crandall to Reappointment of Thomas Toepfer as Bayfield County Highway Commissioner. The motion carried. 160 A motion was made by Rantala/Rondeau to move into Executive Session pursuant to §19.85(1)(e), deliberating or negotiating the purchasing of public properties, the investing of public lands, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The motion carried. A motion was made by Crandall/Kittleson to move out of executive Session. The motion carried. 15. Administrator’s Report: a) Superior Days – February 21, 22 Big Top will hopefully be back at Superior Days. If you have any topics for discussion specific to Bayfield County or Northwest Wisconsin, please let Mark know. b) Bussey asked Abeles-Allison on the status of the I-Pads. Abeles-Allison reported that dollars are in the budget to provide County Board Supervisors with their own I-Pad. He discussed with the Board how this will practically eliminate any paperwork being mailed, etc. You will be able to view your agenda, minutes, and other documents anytime you have access to WI-FI. Discussed how confidential documents will be handled. c) Election. Fibert stated that Meyers, Jardine, Kittleson, Bennett, Rantala and Rondeau have turned in their papers and ballot status. Presently, the only contested race is Neil Schultz running against Rantala. Just a reminder that you have until January 3rd at 5:00 pm to turn in your papers. d) Per Diems and Mileage. Fibert reminded Supervisors to turn in their per diems and mileage vouchers by December 19th.
