HomeMy WebLinkAboutCounty Board of Supervisors - Minutes - 2/26/2013 350 Minutes of the Bayfield County Board of Supervisors’ Meeting Of February 26, 2013 – 6:00 p.m. Bayfield County Board Room, Courthouse, Washburn, Wisconsin The monthly meeting of the Bayfield County Board of Supervisors was called to order by Chairman Shawn Miller at 6:00 p.m. Roll call was taken by Bayfield County Clerk, Scott Fibert as follows: Rondeau-present; Meyers-present; Bussey-present; Jardine- present; Maki-absent: Kittleson-absent; Bennett-present; Pocernich-present; Schultz- present; Williams-absent; Bichanich-present; Miller-present; Crandall-present. Total 13: 10 present, 3 absent. The motion carried and a quorum was present to conduct business. The following were also present for the meeting: County Administrator, Mark Abeles- Allison; Deputy County Clerk, Dawn M. Bellile; Scott Galetka, Land Records Administrator; Robert Mick, County Surveyor; Elizabeth Skulan, Human Services Director; Nikki Revak, DHS Financial Manager; Kay Cederberg, Clerk of Circuit Court; Susan Anderson, retired DHS Employee; Mary Motiff, Tourism Director; members of both AFSCME and WPPA Unions, and Hope McCloud, Reporter for The Daily Press. The Pledge of Allegiance was recited by all in attendance. 1. Motion Regarding Minutes of the January 29, 2013, Bayfield County Board of Supervisor’ Meeting. The Board dispensed with the reading of the minutes. A motion was made by Pocernich/Crandall to adopt the Minutes of the January 29, 2013, Bayfield County Board of Supervisor’ Meeting. The motion carried. 2. Public Comment. Al Bitz, WPPA Union Representative. There has been some controversy between Bayfield County and the Union on whether you can negotiate with patrol deputies and not the correction officers. He stated that this statement is not true and that Bayfield County has the absolulte right to negotiate. We have made numerous attempts to negotiate with the Administrator, he has asked the Administrator for the amount of dollars that have been spent on attorney’s fees regarding bargaining, and to date, has not received them. Abeles-Allison stated to him that he has not sent them out. Bitz went on to further state that other counties are leaving both the patrol deputies and jailers in protective services as they have been for the past many years. He stated to the Board that a WERC complaint has been filed but do not have a date on a hearing yet. He further stated that it is not illegal to negotiate protective placement for jailers – you have a responsibility to these folks who work for you. We just want to negotiate a contract. Heidi Danielson stated that about a month ago, she wrote each Board member a letter explaining what a jailer does in his job duties. This evening she is here to reiterate the points that she explained in her letter. She stated that we are dedicated employees who have served Bayfield county for decades. We know what it is to live in fear for our families as we are threatened on a daily basis by inmates. We are not stock boys or trained monkeys as a board member pointed out. This was both hurtful and demeaning. We are educated people who have gone for training, who know what to do in harmful situations. To have recognized our jobs in protective placement for over 28 years and 351 then to do a complete about face is incomprehensible. We are still giving you our all and deserve better than the way we are being treated now. Anthony Budreau stated that he is a Union Steward and a Patrol Sargeant. As a Patrol Sargeant he is in protective services. He stated that he believed that the jailers positions should also be in protective placement as well. He explained that when they pick up someone who is beligereant, thrashing around, spitting, hitting, kicking, and the like, we turn this individual over to the jailer, who in turn has to contend with the person’s behavior. If they are brought in like this, it isn’t likely that the attitude will change. The jailers job is dangerous and perhaps at times, more at risk than ours. They are locked in an enclosed area with the inmates on a 24/7 basis. Budreau stated that he has read through the State Statutes regarding deputy sheriff’s, jailers, and the like. They fall under the same statute as a patrol sergeant and are not exempt from this. He said he will be sending a copy of this Statute to everyone which explains the protection. We call them jailers, they are deputy sheriff’s, they are working under the same law as he does. We need to keep them in protective placement as has been the practice for the last 28 years. Kevin Susienka stated that he has been employed by Bayfield County for the past 15 years as a jailer. He reiterated what the people ahead of him tonight were stating. Our job gets worse and worse each year. We deal with the worst society has to offer. The facility offers many programs and tries to encourage people to lead a productive lfe. Our responsibilities also carry outside the confines of the jail. Jail staff have to do transports to pick up juvenile prisoners. For all of these reasons we have been protected and now suddently, this has been changed. Through all of this, we are still doing our jobs. We deserve better. 3. Bayfield County Resolution No. 2013-13, Honoring Susan Anderson upon her Retirement from the Bayfield County Human Services Department. Elizabeth Skulan, Human Services Director, gave a brief background of Anderson’s work with Bayfield County. Nikki Revak, DHS Financial Manager, read the Resolution, which reads as follows: WHEREAS, Susan Anderson has served Bayfield County with distinction, honor and dedication in the Human Services Department for over 18 years. NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 26th day of February, 2013, honors Susan Anderson for her over 18 years of public service to Bayfield County and expresses gratitude for her efforts, wishing her well in the years ahead. By Action of the Bayfield County Board of Supervisors Shawn W. Miller, Chairman A motion was made by Crandall/Bussey to adopt Bayfield County Resolution No. 2013-13, Honoring Susan Anderson upon her Retirement from the Bayfield County Human Services Department. The motion carried. 352 4. Bayfield County Resolution No. 2013-14, Request to Amend 2013 Tourism Department Budget for a Balanced Revenue and Expenditure Increase for the Bayfield County Fair. Mary Motiff, Human Services Director, was present to explain the resolution. The Board dispensed with the reading of the Resolution, which reads as follows: WHEREAS, the Bayfield County Fair provides high quality entertainment in the grandstand;and WHEREAS, the cost of grandstand entertainment is greater on the weekend; and WHEREAS, the daily gate fees will increase by $2.00 for Saturday and Sunday in order to offset the additional cost; and WHEREAS, the FY2013 budget does not take this increase into account; and WHEREAS, the Bayfield County Tourism Department requests that the 2013 budget be adjusted as follows to reflect the revenue and expenditures anticipated to be received/expended through the increased weekend daily gate fees and the increased entertainment budget. NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 26th day of February, 2013 approve the following budget amendments: Revenue and Expenditure Line Items: Increase revenue account #100-23-46740 by $9,000 Increase expense account #100-23-55461-50299 by $9,000 By Action of the Bayfield County Board of Supervisors Shawn W. Miller, Chairman A motion was made by Jardine/Rondeau to adopt Bayfield County Resolution No. 2013-14, Request to Amend 2013 Tourism Department Budget for a Balanced Revenue and Expenditure Increase for the Bayfield County Fair. A roll call vote was taken as follows: Meyers-yes; Bussey-yes; Jardine-yes; Maki-absent: Kittleson- absent; Bennett-yes; Pocernich-yes; Schultz-yes; Williams-absent; Bichanich-yes; Miller-yes; Crandall-yes; Rondeau-yes. Total 13: 10 yes, 0 no, 3 absent. The motion carried. 5. Bayfield County Resolution No. 2013-15, Adopting an Amendment to the Bayfield County Outdoor Recreation Plan for the Town of Bayfield, Cable and Namakagon. Motiff stated to the Board that this Resolution was not meant to be on February’s agenda, but rather, on March. The reason being, there is more documentation and information from the DNR needed. A motion was made by Rondeau/Schultz to postpone Bayfield County Resolution No. 2013-15, Adopting an Amendment to the Bayfield County Outdoor Recreation Plan for the Town of Bayfield, Cable and Namakagon. The motion carried. 353 6. Bayfield County Resolution No. 2013-16, Authorizing Participation in Outdoor Motorized Recreation Trails, Stewardship Local Assistane Grant Programs and Federal Recreation Trails Act. The Board dispensed with the reading of the Resoltuion, which reads as follows: WHEREAS, Bayfield County is in interested in maintaining, acquiring, insuring, developing lands for public outdoor purposes as described in the application: and WHEREAS, financial aid is required to carry out the project; and WHEREAS, Bayfield County has budgeted a sum sufficient to complete the project or acquisition and NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors, assembled this 26th day of February, 2013, hereby authorizes, Mary D. Motiff, Bayfield County Tourism & Recreation Director to: Submit an application to the State of Wisconsin Department of Natural Resources for any financial aid that may be available; file reimbursement claims along with necessary supporting documentation within 6 months of project completion date; sign documents; and take necessary action to undertake, direct and complete the approved project. By Action of the Bayfield County Board of Supervisors Shawn W. Miller, Chairman A motion was made by Jardine/Rondeau to adopt Bayfield County Resolution No. 2013-16, Authorizing Participation in Outdoor Motorized Recreation Trails, Stewardship Local Assistance Grant Programs and Federal Recreation Trails Act. Discussion took place on Resolution which allows Motiff to apply for grants. The grant value is $400,000. The motion carried. 7. Discussion and Possible Action Regarding Approval of 2013 Emergency Fire Warden List. State of Wisconsin Department of Natural Resources Form 4300-10 Rev 3-86 EMERGENCY FIRE WARDEN ORGANIZATION LIST To: The County Board of BAYFIELD County, Wisconsin. Board Members: 354 A motion was made by Schultz/Bichanich to approve the 2013 Emergency Fire warden List. The motion carried. Chairman Miller asked the Board for their permission to amend the agenda to have items (b) “Union Negotiations” and (c) Wage Increase for Non-Represented Employees” from Executive Session moved into open session. A motion was made by Bennett/Rondeau to move items (b) “Union Negotiations” and (c) Wage Increase for Non-Represented Employees” into open session. The motion carried. 8. (b) §19.85(1)(3) Union Negotiations. Abeles-Allison stated that he met on Monday, February 25th with the Lance Nelson, AFSCME Union Representative, Craig Parks, AFSCMS President, and Mike Furtak, Union Steward). The parties were able to come up with a base wage agreement and it was ratified by the AFSCME Union as well. The agreement was for a 2% wage increase effective Marxh 2, 2013. A motion was made by Rondeau/Schultz to approve the 2% wage increase for the AFSCME Union effective March 2, 2013. The motion carried. Department of Natural Resources Brule, Wisconsin ______________________ Date By _________________________________ By ___________________________ County Board Chairperson 355 (c) §19.85(1)(3) Wage Increases for Non-Represented Employees. The Personne Committee discuissed and made a recommendation to increase wages 2% for non-represented employees, to take effect on March 2, 2013. A motion was made by Jardine/Pocernich to approve the 2% wage increase for non-represented employees effective March 2, 2013. The motion carried. 9. Executive Session: A motion was made by Bennett/Rondeau to move into Executive Session pursuant to §19.85(1)(e), deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session; and (g) conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. The motion carried. A motion was made by Rondoeau/Jardine to m ove out of executive session. The motion carried. Now in open session, a motion was made by Rondeau/Jardine to deny the request of Boyd Carlson. A roll call vote was taken as follows: Bussey-yes; Jardine-yes; Maki- absent: Kittleson-absent; Bennett-yes; Pocernich-no; Schultz-yes; Williams-absent; Bichanich-yes; Miller-yes; Crandall-yes; Rondeau-yes; Meyers-yes. Total 13: 9 yes, 1 no, 3 absent. The motion carried. 10. Administrator’s Report: a) Abeles-Allison asked the Board for their permission to change the March 26th meeting date to the 19th. All were in agreement. Abeles-Allison also reminded the board that the April meeting is early per State Statutes, which will be held on April 16th. All will be held at 6:00 p.m. b) Superior Days. Abeles-Allison stated that there were many good meetings. The Veterans Officer talked about the tele-health. We will be getting a room ready for this use – this is a very good and productive. They were all there the night the Governor announced his budget. There was a lot of discussion on the mining issue. It is hopeful that Superior Days will be even stronger in future years. The WCA and League of Municipalities had a joint meeting and discussed how the companies can meet together on more issues. There was also more discussion on 4-lanes for US Hwy 2. The Tourism meeting and presentation was nice and went very well. There is a lot of advertising done in the Minneapolis area and likewise they are helping to assist us. There are plans in the making of having President Obama visit our area. All in all, a very productive Superior Days. There being no further business to come before the Bayfield County Board of Supervisors, Chairman Miller adjourned the meeting at 7:10 p.m. Respectfully submitted, Scott S.
