Bayfield County Board of Supervisors’ Meeting
Of October 29, 2013 – 6:00 p.m.
Bayfield County Board Room, Courthouse, Washburn, Wisconsin
The monthly meeting of the Bayfield County Board of Supervisors was called to
order by Chairman Miller at 6:00 p.m. Roll call was taken by County Clerk, Scott Fibert as
follows: Rondeau-present; Meyers-present; Bussey-present; Jardine-present; Maki-
present; Kittleson-present; Bennett-present; Pocernich-present; Schultz-present;
Williams-absent; Bichanich-present; Miller-present; Crandall-present. Total: 13, 12
present, 1 absent. A quorum of board members was present. The following were also
present for the meeting: Mark Abeles-Allison, County Administrator; Dawn M. Bellile,
Deputy County Clerk; Carrie Linder, HS Aging & Disabilities Service Mgr.; Jason Bodine,
Forest Administrator; Jan Victorson, Emergency Mgmt Coordinator; Paul Susienka,
Sheriff; Terri Kramolis, Health Director; Tim Kane, UW-Ext Community Resource Agent;
Mary Motiff, Tourism Director; Sheldon Johnson, Representative from Northwest
Regional Planning, and community residents.
The Pledge of Allegiance was recited by all in attendance.
1. 2014 Bayfield County Budget Public Hearing. A motion was made by
Rondeau/Meyers to adjourn as a County Board and convene as a Committee of the
Whole to hold a public hearing on the 2014 Bayfield County Budget. A roll call vote
was taken as follows: Meyers-yes; Bussey-yes; Jardine-yes; Maki-yes; Kittleson-
yes; Bennett-yes; Pocernich-yes; Schultz-yes; Williams-absent; Bichanich-yes;
Miller-yes; Crandall-yes; Rondeau-yes. Total: 13, 12 yes, 0 no, 1 absent. The
motion carried.
Abeles-Allison informed everyone present that the 2014 proposed budget was
published in The Ashland Press as required. This budget represents our plan of action for
2014. Overall, the budget increased slightly due to infrastructure needs within a few
departments. The levy is comprised of a base levy, library and bridge aid. The Total levy
would be increasing in 2014 about $500,000.00, mostly for infrastructure needs,
approximately a 5.65% increase. Discussion took place on library funding and how it is
structured and paid. A brief introduction was given regarding the overall budget.
Chairman Miller asked if anyone in attendance wanted to comment on the proposed
budget.
Mike Overman, Marketing Director for Legendary Waters in Red Cliff, was present
as it was eluded to him that there is some discussion going on regarding the Tourism
Department. It was his opinion that you need to have a reason for families to plan their
trips. He is a big believer in branding and this area has more to offer than just in the
season of May to October. The businesses want to keep their doors open. There is a
very unique need for branding in this area.
Mark Wendling, Town of Russell, commented on Agenda Item 5 as it related to the
Tourism Department. He stated that Bayfield County’s economy is tourism driven. We

have unique natural resources that we can leverage for tourism. This has been done very
successfully, but we need to promote what we do well, which is tourism. He spoke about
sales and marketing and feels that Bayfield County should not reduce the funding for this.
If it was his decision, he would increase the tourism budget. Best available asset to
Bayfield County is the Tourism Department.
Chair asked 3 more times if anyone from the audience wished to comment. The
floor was closed.
A motion was made by Pocernich/Rondeau to close the meeting of the
Committee of the Whole and reconvene as a County Board. A roll call vote was taken
as follows: Bussey-yes; Jardine-yes; Maki-yes; Kittleson-yes; Bennett-yes;
Pocernich-yes; Schultz-yes; Williams-absent; Bichanich-yes; Miller-yes; Crandall-
yes; Rondeau-yes; Meyers-yes. Total: 13, 12 present, 0 no, 1 absent. The motion
carried.
2. Discussion and Possible Action Regarding Funding Level and/or Direction
of the Tourism Department. Supervisor Schultz had asked to have this placed on the
agenda for discussion. He read various newspapers articles on how times are changing
from paper newspapers, brochures, leaflets, and the like to using our I-pads, computers,
cell phones, etc. We don’t need to publish as much anymore as we have all of this
information at our fingertips. Times have changed. He quoted Administrator Abeles-
Allison as having written one article which stated just that – times have changed. Schultz
wanted to suggest to the Board that perhaps the Tourism Department needed to go this
route as well - to change. Perhaps we no longer need the department. He read another
important item which stated that if you do not have a presence in the heart of your
business, you are not a part of the tourism business. If it isn’t open 9am to 9pm, Monday
through Saturday and 10am to 6pm on Sunday, you are not in the tourism business. We are
neither of these.
He went on to state that approximately 175,000 people went through Bayfield this
year. How many visitors got a piece of information from the Bayfield County Tourism
Department. Does anyone here even know? It is our responsibility to make the best use
of taxpayers’ money. On July 30th, the Tourism Director came before us mentioning
branding Bayfield County and mentioned 2 other counties that were similar to Bayfield
County, those being Price and Vilas. Price County has 2 part-time people and they are not
increasing the department. Vilas has the same budget, however, they do over 195,000
million in tourism, Bayfield County does 40 million.
He gave out another document for comparisons between counties. This is
information for us to discuss. This has come directly from the Wisconsin Counties
Association.
Supervisor Jardine stated that they have tried to restructure the Tourism
Department by taking away some of the duties assigned to the Tourism Director to allow
her time to work on marketing and to improve the overall department. We are still
competing for tourism dollars. Tourism is the only business that Bayfield County has.
We are in transition to make money in Bayfield County. He can’t believe that we would

want to destroy the Tourism Department. What does a Tourism Director really do?
Every week there is a report in the weekly reader of what she does. Right now she is
working on the branding and logo for Bayfield County and working with other chambers
within Bayfield County. This seems to be working. This is just part of the promotion.
Kittleson suggested that if there is to be reorganization, it be done through the
Tourism Department and not this evening at the County Board meeting. A lengthy
discussion took place as to why it is on the agenda.
Supervisor Meyers spoke on the fact that she felt the County Board should not be
in the practice of donating dollars to non-profit organizations. She spoke of the $5,000
that was for the Paralympics which will be taking place in Cable. She wanted to know what
the review process is for looking at grants. Is there a criteria in place for this? She
spoke that yes the Board donated $250.00 to CORE last year for an EMS dinner, but that
was for all volunteer EMS’s. There is a huge difference between $250 and $5,000.
Chairman Miller explained that the $5,000 was a sponsorship not a donation.
Supervisor Bussey stated Tourism is important. If there is a proposal or
suggestion regarding the Tourism Department it should be brought to the committee for
discussion and then to the full Board. He didn’t feel it was appropriate for tonight
Pocernich stated that he felt the tourism topic should be brought back to the
Board. Tonight was mainly for discussion for us to do some more research and bring
findings back to the full board to make a logical decision on tourism. He agreed with
Meyers that Bayfield County shouldn’t be in the business of donating money to non-profit
organization, stating that at the town level they cannot distribute funds, it is against the
law.
3. Discussion and Possible Action Regarding the Possible Consolidation of
the Emergency Management Department into the Sheriff’s Department. Supervisor
Schultz also asked that this be put on this evening’s agenda. Sheriff Susienka spoke
about the cooperation that presently exists between the Emergency Management and
Sheriff’s Department. He stated there needs to be communications within the two
entities at all times. If this was to be considered, he would like to have this done at the
committee level. He is big on efficiency and if there is a way we can operate in a more
efficient way, he is willing to do so.
This item is merely for the possibility of merging the two departments together.
The pay for each person would remain the same. It just seems like the logical thing to do,
perhaps when someone retires. It logical to consolidation.
The Board wanted to hear from Jan Victorson, Emergency Mgmt. Coordinator. A
motion was made by Pocernich/Crandall to suspend the rules of the County Board
allowing Jan Victorson the opportunity to speak to the Board. The motion carried.
Victorson spoke, explaining she has been in this department for 20 plus years now.
This department is small with only her and a half-time employee, and she answers first to
the Administrator and then to the County Board. She further explained what her
department does and how it works closely with the Sheriff’s Department. She stated

that she would not have a problem consolidating the two departments, however, she stated
that if you do choose to go forward with this, to do so, in a fair atmosphere, looking at
both sides, good and bad ideas, and then making a fair decision. Supervisors thought this
might be worth looking into but not this evening.
A motion was made by Maki/Jardine to have this item placed on the next
Sheriff’s Committee agenda meeting for further discussion. The motion carried.
4. Discussion and Possible Action to Adopt the 2014 Budget. Abeles-Allison
again went over the proposed budget with the Supervisors. Schultz had questions
concerning different pages of the budget and they were answered by Abeles-Allison. A
brief discussion took place on the topics. A motion was made by Bussey/Crandall to
adopt the $25,731,110.00 2014 Bayfield County Budget as proposed . Further
discussion took place on not donating to no-profit organizations. Discussion as to whether
the Visitor’s Center was a non-profit. Their budget doesn’t tell you where the allocated
dollars are going. Discussion took place on the BART funding. Discussing took place on
capital improvements such as the Brownstone Restoration Grant, and a new generator. The
Zoning Department budget came up. It was the Board’s understanding that this
department is overstaffed in the winter. The Department was to move an employee to
part-time during the winter. Abeles=-Allison stated that the department is down ½ from
last year, but it was pointed out, that it was to be down another ½ for the winter.
Further discussion will take place on this. A roll call vote to approve the 2014 budget
was taken as follows: Jardine-yes; Maki-no; Kittleson-yes; Bennett-yes; Pocernich-
no; Schultz-no; Williams-absent; Bichanich-yes; Miller-yes; Crandall-yes; Rondeau-
yes; Meyers-yes; Bussey-yes. Total: 13, 9 yes, 3 no, 1 absent. The motion
carried. Abeles-Allison stated that we are fortunate to have Department Heads here
this evening, representing their various departments and he read off their names. These
people have put much time into this Thank you.

5. Discussion and Possible Action to Set the 2014 Tax Levy. A brief
discussion took place, and a motion was made by Crandall/Rondeau to accept the 2014
Tax Levy of $9,376,385.00. A roll call vote took place as follows: Maki-yes;
Kittleson-yes; Bennett-yes; Pocernich-no; Schultz-yes; Williams-absent; Bichanich-
yes; Miller-yes; Crandall-yes; Rondeau-yes; Meyers-yes; Bussey-yes; Jardine-yes.
Total: 13, 11 yes, 1 no, 1 absent. The motion carried.
6. Motion Regarding Minutes from the October 1, 2013 Bayfield County
Board of Supervisors’ Meeting. The Board dispensed with the reading of the minutes. A
motion was made by Rondeau/Bichanich to adopt the minutes of the October 1, 2013
Bayfield County Board of Supervisors’ Meeting. Clarification was made to the minutes;
Sonja Hauser should have been Sue Neuhauser, and discussion as to who was in favor of
the resolution and who was not, Quaintance being in favor and Naas, wanting the Board to
wait for further information. There being no further discussion, the motion carried.
7. Public Comment.
Mary Motiff, Bayfield County Tourism Director, gave an update on what has been
happening in her department. The 2014 Business and Visitors recreational Guide is being
worked on, seeking new advertisers. The 2014-15 ATV maps are being updated. The
filming is done with Discover Wisconsin episode which will air in May, 2014. Work is still
taking place on the scenic-by-way and she is about to turn in an application for a grant for
a Coastal Management brochure with points of interest on the by-way. We are ahead in
sales tax revenue by $73,000 from where we were this time last year. Ads have been put
in snowmobile magazines and there will be a feature on Bayfield County in Badger
Sportsman Magazine. There are cooperative projects underway with Legendary Waters
and we are also partnering with KB JR for winter getaways.
There were no other comments and the Chair closed public comments.
8. Discussion and Possible Action Regarding Northwest Regional Planning
Community Development Block Grant (CDBG) Regional Housing Agreement and Review
of other Programs in Bayfield County. Sheldon Johnson, NWRP Representative, was
present this evening to explain the contract to the Board. The contract being considered
is the same contract that the other 8 counties are considering over the next 30 days. It
is required of all 9 counties that are partners, and Douglas County is the lead county and
will assume all responsibilities thereof. All other counties are eligible for Block Grants.
This agreement establishes a Regional Housing Committee which has a person sitting on
the committee. Scott Fibert is Bayfield County’s representative. Bayfield County has
been active with this committee for the past 12 years. This agreement allows Bayfield
County citizens to participate in the program.
Johnson passed out a document entitled Northwest Regional Housing Program,
which gave the criteria for how low to middle income residents can make improvements to
their home if they qualify. He explained how they would be able to qualify and how the
funds would be paid back. A lengthy discussion took place on prior grants and/or loans,
how they are paid back, if in fact, they are even paid back.

A motion was made by Rondeau/Crandall to approve the Northwest Regional
Planning Community Development Block Grant (CDBG) Regional Housing agreement.
Discussion on how the administrative fees are allocated over the 4 years. The motion
carried. The Board thanked Johnson for coming.
Abeles-Allison stated that the Bayfield County Housing Authority as well as
Ashland County were invited to be at this meeting as well. Denise Lutz, Executive
Director for Ashland, is present to explain how the CDBG funds work in Ashland County
for Bayfield County as well. Lutz went through their various programs and how citizens
can apply to see if they are eligible or not. 11 people work for the Ashland County Housing
Authority with 1 satellite office in Superior and in Woodruff. The Board thanked Lutz and
her co-worker for attending this evening.
9. Presentation on New Owners Shoreline Packets Grant Project. Tim Kane,
UW-Extension Educator and Karen Saarinen, Representative for Bayfield County Citizens
for the Protection of Inland Waters were present to explain the project and what has
taken place. The Committee is small with members from Barnes, Cable, Iron River,
Namakagon and Russell. They applied for and received a DNR small scale grant and with
these funds were able to put together a packet which contains zoning ordinances and
additional sources of information for new shoreline homeowners. A very lengthy discussion
took place on Bayfield County lakes and lakeshores. The Board thanked Saarinen and
Kane for their hard work and efforts.
10. Department of Human Services 2012 Annual Report. Carrie Linder, HS
Aging & Disabilities Service Mgr. was present give this report. She highlighted main points
in the report, which provided a 5-year perspective. The department entered 2012 with a
$240,000.00 deficit due to mandated services by the State. Abeles-Allison also went
over a couple of the graphs shown in the report for a more careful review by the Board. A
motion was made by Rondeau/Bichanich to receive and place on file the Department of
Human Services 2012 Annual Report. The motion carried. (A copy of the Report is on
file in the County Clerk’s office for review).
11. Bayfield County Resolution No. 2013-50, Bayfield County Request for a
Representative to the Community Care of Central Wisconsin (CCCW) Board. The
Board dispensed with the reading of the Resolution. Linder reported that Northern
Bridges service to Bayfield County will be ending on Dec 31, 2013. Community Care of
Central Wisconsin (CCCW) Board will be taking over the 1st of January, 2014. Under the
new leadership, they are reconfiguring the membership of their Board and will only have 11
members to the Board. There will now be 16 counties involved. Bayfield County is stating
that they want to have its own membership on the Board per State Statutes which read
that there be 1 member per county. The Resolution reads as follows:
WHEREAS, the Northwest Wisconsin Long-Term Care District, referred to as
Geographic Services Region (GSR) 7 by the Department of Health Services (DHS) includes
the counties of Ashland, Barron, Bayfield , Burnett, Douglas, Iron, Polk, Price, Rusk,
Sawyer and Washburn Counties; and

WHEREAS, GSR 7, was previously provided Family Care services by the Managed
Care Organization (MCO) Northern Bridges and each of the 11 counties had a
representative to the Northern Bridges governing board; and
WHEREAS, the Family Care contract for GSR 7 has been awarded to the MCO
CCCW beginning January 1, 2014; and
WHEREAS, the CCCW Board has adopted a new board configuration to include the
counties from GSR 7 but does not afford all counties equal representation to the
governing board (detail in attached letter); and
WHEREAS, Bayfield County strongly feels that equal representation by small, rural
counties is paramount to ensuring the success of the organization in GSR 7; and
WHEREAS, county representation to the CCCW Board will allow residents of GSR 7
to demand accountability from a local representative.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of
Supervisors assembled this 29th day of October 2013, does hereby recommend adoption of
this resolution to request that the CCCW Board change its board configuration to include
one representative per county of GSR 7, so that residents of each county are
appropriately represented.

A motion was made by Jardine/Bussey to adopt Bayfield County Resolution No.
2013-50, Bayfield County Request for a Representative to the Community Care of
Central Wisconsin (CCCW) Board. Further discussion took place. Next month there will
be a representative from the CCCW at the County Board meeting. This is something new
as we never did see anyone from Northern Bridges. The motion carried.
12. Bayfield County Resolution No. 2013-51, 2013 Department of Human
Services Budget Adjustments. Linder also explained that this Resolution is for non-
funded, mandated services. The Board dispensed with the reading of the Resolution,
which reads as follows:
WHEREAS, adjustments to and transfers within the Department of Human
Services 2013 budget are necessary to satisfy state statutes and accounting principles;
and
WHEREAS, the Department of Human Services currently maintains a Risk Reserve
Fund in the amount of $355,000; and
WHEREAS, Human Services expects to exceed the 2013 budget authority; and
WHEREAS, some additional county levy is required to balance the 2013 budget; and
WHEREAS, the Department of Human Services is requesting to access the Risk
Reserve Funds in the amount of $90,000.

NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of
Supervisors assembled this 29th day of October, 2013, does hereby approve that the

A motion was made by Crandall/Jardine to adopt Bayfield County Resolution
No. 2013-51, 2013 Department of Human Services Budget Adjustments. Discussion
took place on Court-ordered placements. A roll call vote took place as follows:

13. Discussion Regarding Establishment of Per Diems and Salaries for
Bayfield County Board Supervisors. Abeles-Allison explained that he and County Clerk
Fibert put together a proposed compensation schedule in Resolution format for next
month’s County Board meeting. The last adjustment was done in 1999 and a comparison
was given. Discussion took place.
14. Discussion on Constitutional Officials Wages. Abeles-Allison stated that
he and Fibert looked over the past 4-6 years of compensations in Bayfield County and also
made comparisons with other counties. This information will be put into final format and
will have to be passed by Resolution at the March County Board meeting, prior to election
papers being taken out for elected officials on April 1, 2014. This would include the
offices Sheriff, Clerk of Circuit Court and Coroner. Discussion took place.
15. Bayfield County Resolution No. 2013-49, Supporting Cooperative Law
Enforcement Services Agreement Between the Bayfield County Sheriff’s Department
and the Red Cliff Community Law Enforcement. This item is not ready for the Board.
Abeles-Allison asked that it be tabled. A motion was made by Rondeau/Crandall to
postpone Bayfield County Resolution No. 2013-42, Supporting Cooperative Law
Enforcement Services Agreement Between the Bayfield County Sheriff’s Department
and the Red Cliff Community Law Enforcement. The motion carried.
16. Report of the Bayfield County Planning & Zoning Committee Regarding
the Rezone of the Mark A. Pozzi Property Located in the Town of Bell from
Residential-Recreational Business (R-RB) to Residential-One (R-1). The Board
dispensed with the reading of the Report, which reads as follows:
TO: The County Board of Supervisors of Bayfield County on the hearing of petitions to
amend the Bayfield County Zoning Ordinance.
The Planning and Zoning Committee of the Bayfield County Board of Supervisors, having
held a public hearing pursuant to Section 59.69(5)(e), Wisconsin Statutes; notice thereof
having been given as provided by law; and having been duly informed of the facts pertinent
to the following changes; hereby recommends the following action on said petition:
The Zoning of Mark A. Pozzi 0.172-acre parcel (Tax ID#7923), described as a parcel of
land laying and being in the Southeast Quarter (SE¼) of the Northeast Quarter (NE¼),

17. Bayfield County Zoning Amendatory Ordinance No. 2013-18, Regarding
the Mark A. Pozzi Property Located in the Town of Bell from Residential-Recreational
Business (R-RB) to Residential-One (R-1). The Board dispensed with the reading of the
Ordinance, which reads as follows:

AN ORDINANCE AMENDING SECTIONS 13-1-4, 13-1-21, 13-1-32, and 13-1-61,
CODE OF ORDINANCES, BAYFIELD COUNTY, WISCONSIN.
Section 1. Subsection (a)(1) of Section 13-1-4 [Definitions] of Article B [General
Provisions of Chapter 1 [Zoning Code] or Title 13 [Zoning of the Code of
Ordinances], Bayfield County, Wisconsin is hereby amended to read as
follows, with additions highlighted by the double underline feature
(additions):
(1) Accessory Structure. A detached, subordinate structure which is clearly
incidental to and customarily found in connection with the principal structure
to which it is related and which is located on the same lot as the principal
structure.
Location of Accessory Structures. An accessory structure to a
conforming or nonconforming structure shall comply with the applicable
setback set forth in Section 13-1-32 and 13-1-60 and shall be located at
least 5 feet from the structure.
Section 2. Subsection (a)(27) of Section 13-1-4 [Definitions] of Article B [General
Provisions of Chapter 1 [Zoning Code] or Title 13 [Zoning of the Code of
Ordinances], Bayfield County, Wisconsin is hereby amended to read as
follows, with deletions highlighted by the strike out feature (deletions) and
additions highlighted by the double underline feature (additions):
(27) Home-Based Business. A gainful occupation conducted by a member of the
family within his/her place of residence, where the space is incidental to
residential use, where the floor area does not exceed twenty-five percent
(25%) of the total floor space. Home-Based Businesses. Home-based
businesses shall require a special use permit and shall occupy not more than
twenty-five percent (25%) of the residential floor space or seventy-five
percent (75%) of the floor space of an accessory structure and shall not
employ more than one (1) nonresident employee.
Section 3. Subsection (b)(1) [Requirement] of Section 13-1-21 [General Land Use
Requirements] of Article B [General Provisions of Chapter 1 [Zoning Code] or
Title 13 [Zoning of the Code of Ordinances], Bayfield County, Wisconsin is
hereby amended to read as follows, with additions highlighted by the double
underline feature (additions):
(1) Requirement. A land use permit shall be required for any new residence, any
building or structure erected, relocated, rebuilt or structurally altered
(excepting alterations which do not increase the size or change the shape of
a structure); any change in the use of the land; or where any use of the land
is altered. A land use permit shall be obtained prior to the initiation of
construction or a change in land use. No permit shall be issued if the

applicant is in violation of the Bayfield County Zoning Ordinance, Sanitary
and Private Sewage Code, Flood Plain Ordinance, Shoreland-Wetlands Zoning
Ordinance, or Subdivision Control Ordinance.
Section 4. Subsection (b)(3) [Improvements to Nonconforming Structures] of Section
13-1-21 [General Land Use Requirements] of Article B [General Provisions of
Chapter 1 [Zoning Code] or Title 13 [Zoning of the Code of Ordinances],
Bayfield County, Wisconsin is hereby amended to read as follows, with
additions highlighted by the double underline feature (additions):
(3) Improvements to Nonconforming Structures. Exterior improvements and
additions to nonconforming structures which change the size or shape
thereof shall require a land use permit. Replacement of decks, additions to
decks, or new decks attached to, non-conforming structures shall also
require a land use permit.
Section 5. Subsection (g)(1)-(4)c [Impervious Surface Standards] of Section 13-1-32
[Inland Lake Classification and Shoreland Lot Development Requirements] of
Article B [General Provisions of Chapter 1 [Zoning Code] or Title 13 [Zoning
of the Code of Ordinances], Bayfield County, Wisconsin is hereby created to
read as follows, with additions highlighted by the double underline feature
(additions); and with deletions highlighted by the strike out feature
(deletions):
(g) Impervious Surface Standards. The construction, reconstruction,
expansion, replacement or relocation of any impervious surface within 300
feet of the ordinary high-water mark of any navigable waterway must meet
the following requirements:
(1) Lots or Parcels with 15% or Less Impervious Surface. Up to 15% of
the portion of a lot or parcel that is within 300 feet of the ordinary
high-water mark may consist of impervious surface without the need
for mitigation.
(2) Lots or Parcels with More than 15% but no More than 30%
Impervious Surface. Between 15% and 30% of the portion of a lot or
parcel that is within 300 feet of the ordinary high-water mark may
consist of impervious surface provided that the landowner obtains a
permit and provided that the mitigation measures of subsection (f)
paragraph (11) shall apply.
(3) Lots or Parcels with More than 30% Impervious Surface. No more
than 30% of the portion of a lot or parcel that is within 300 feet of
the ordinary high-water mark may consist of impervious surface.
(4) Existing Impervious Surfaces. For existing impervious surfaces that
were lawfully placed when constructed but that do not comply with
the standards in paragraphs (1) through (3) above, the property
owner may do any of the following:
a. Maintenance and repair of all impervious surfaces;

b. Replacement of existing impervious surfaces with similar
surfaces within the existing building envelope;
c. Relocation or modification of existing impervious surfaces with
similar or different impervious surfaces, provided that the
relocation or modification does not result in an increase in the
percentage of impervious surface that existed at the
effective date of the Bayfield County Shoreland Zoning
Ordinance, and meets the applicable setback requirements in s.
NR 115.05 (1) (b), Wisconsin Administrative Code.
(g) (h) Relationship to Other Provisions. Subsections (b) through (f) above are
subject to the provisions of Section 13-1-22 (a) (modifying setbacks for
certain structures), Section 13-1-26 (pertaining to substandard lots of
record), and Section 13-1-40 (pertaining to nonconforming uses and
structures).

of Article D [General Provisions of Chapter 1 [Zoning Code] or Title 13

Amendments to Sections 13-1-4, 13-1-21, 13-1-32 and 13-1-61, Code of
Ordinances, Bayfield County, Wisconsin. The Board dispensed with the reading of the
Ordinance, which reads as follows:
The Bayfield County Board of Supervisors ordains as follows:
That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same is
hereby amended as follows:
WHEREAS, Wisconsin Statutes §59.69 (5) authorizes the County Board to adopt a
zoning ordinance; and

WHEREAS, Wisconsin Statutes §59.69(5)(e) authorizes the County Board to amend
an ordinance; and
WHEREAS, Section 13-1-104 Code of Ordinances, Bayfield County, Wisconsin
authorizes the County Board to make amendments to Title 13, Chapter 1 of the Code of
Ordinances, Bayfield County, Wisconsin pursuant to Wisconsin Statutes §59.69; and
WHEREAS, it is deemed in the best interest of the County of Bayfield to amend a
definition under Section 13-1-4(a)(1) Code of Ordinances, Bayfield County, Wisconsin to
include language regarding “location of accessory structures”; and

conforming or nonconforming structure shall comply with the applicable
setback set forth in Section 13-1-32 and 13-1-60 and shall be located at
least 5 feet from the structure.

Provisions of Chapter 1 [Zoning Code] or Title 13 [Zoning of the Code of
Ordinances], Bayfield County, Wisconsin is hereby amended to read as

(27) Home-Based Business. A gainful occupation conducted by a member of the
family within his/her place of residence, where the space is incidental to
residential use, where the floor area does not exceed twenty-five percent

twenty-five percent (25%) of the residential floor space or seventy-five
percent (75%) of the floor space of an accessory structure and shall not

(1) Requirement. A land use permit shall be required for any new residence, any
building or structure erected, relocated, rebuilt or structurally altered
(excepting alterations which do not increase the size or change the shape of
a structure); any change in the use of the land; or where any use of the land
is altered. A land use permit shall be obtained prior to the initiation of
construction or a change in land use. No permit shall be issued if the
applicant is in violation of the Bayfield County Zoning Ordinance, Sanitary
and Private Sewage Code, Flood Plain Ordinance, Shoreland-Wetlands Zoning
Ordinance, or Subdivision Control Ordinance.
Section 4. Subsection (b)(3) [Improvements to Nonconforming Structures] of Section
13-1-21 [General Land Use Requirements] of Article B [General Provisions of
Chapter 1 [Zoning Code] or Title 13 [Zoning of the Code of Ordinances],
Bayfield County, Wisconsin is hereby amended to read as follows, with

(3) Improvements to Nonconforming Structures. Exterior improvements
and additions to nonconforming structures which change the size or
shape thereof shall require a land use permit. Replacement of decks,

A motion was made by Bussey/Bichanich to adopt Bayfield County Zoning
Amendatory Ordinance No. 2013-22 Regarding Amendments to Sections 13-1-4, 13-
1-21, 13-1-32 and 13-1-61, Code of Ordinances, Bayfield County, Wisconsin. The
motion carried.
28. Appointment of 2 Public Members to the Bayfield County Ethics
Committee. Chairman Miller stated that he would like to have Ernest Korpela and Billie
Hoopman appointed to the Bayfield County Ethics Committee. Korpela is familiar with
government working being a former Superintendent and Wisconsin Senator. Hoopman also
is very knowledgeable presently working at the Bayfield City Hall as Clerk. A motion was
made by Rondeau/Crandall to approve the appointment of Ernest Korpela and Billie
Hoopman to the Bayfield County Ethics Committee. Discussion – Supervisor Schultz
stated that he had a problem with candidates that have worked for government entities.
He wanted to see someone from the public with business insight. Supervisor Meyers asked
if this means that we now have some criteria in place for selecting board/committee
members? The motion carried with one opposition.
29. A motion was made by Crandall/Rondeau to move into Closed Session
pursuant to §19.85(1)(c),considering employment, promotion, compensation or
performance evaluation data of any public employee over which the governmental body
has jurisdiction or exercises responsibility; and (e) deliberating or negotiating the
purchasing of public properties, the investing of public funds, or conducting other
specified public business, whenever competitive or bargaining reasons require a closed
session. The motion carried.
A motion was made by Rondeau/Bennett to move out of closed session. The
motion carried.
30. Discussion and Possible Action Regarding Union Contract for AFSCME –

31. Discussion and Possible Action Regarding Union Contract for WPPA Jail
Division. No action was taken.

32. Administrator’s Report:
a) Superior Days Topics. Abeles-Allison reported that there are a number
of topics for this year which include US Hwy 2; incentives for individual property owners
to provide easements for trails on their property. Discussion took place on the trails. The
Forestry Department is checking the trails to see what condition they are in and finding
that some of them need some work. Another topic for Superior Days was PILT payments.
b) Telemark Update. James Bolin, Chamber Director, sent a summary of the
US Olympic and Paralympic events that might someday be held at Telemark. They are still
trying to see if they are interested in using Telemark for sports events. There is a 2
year agreement in place for the Birkie and Fat Tire races.
c) 2014 Construction Updates: The Forestry garage is proceeding. The City
approved the higher bid to county site for the garage; soil borings are taking place for
4.2 miles of work to be done on Co Hwy G in 2014.
d) November 12th Statutory Meeting Date. The Board will be meeting on Nov.
12th per State Statute. County Board re-election packets will be ready for disbursement
at the next meeting. You need between 20 and 100 signatures with these to be turned in
by January 7, 2014. The earliest you can circulate papers is December 1st.
e) December County Board Meeting. If the Board agrees, the date for the
December meeting will be held on the 10th at 6:00 p.m. This is almost a month away from
November’s meeting and doesn’t conflict with the holidays. The Board was in favor of this
meeting date.
33. Supervisors’ Reports. No reports.
There being no further business to come before the Bayfield County Board of
Supervisors, Chairman Miller adjourned the meeting at 8:40 p.m.
