Minutes of the
Bayfield County Board of Supervisors’ Budget Meeting
Of June 30, 2015 – 6:00 p.m.
Bayfield County Board Room, Courthouse, Washburn, Wisconsin
The monthly meeting of the Bayfield County Board of Supervisors was called to
order by Chairman Pocernich at 6:03 p.m. Pocernich welcomed everyone to the meeting.
Roll call was taken by County Clerk, Scott Fibert as follows: Miller-absent; Crandall-
present; Rondeau-present; Wendling-present; Bussey-present; Jardine-present; Maki-
present; Kittleson-present; Bennett-present; Pocernich-present; Strand-present;
Williams-present; Bichanich-present. Total: 13; 12 present, 1 absent. A quorum of board
members was present to conduct business. The following individuals were also present for
the meeting; Mark Abeles-Allison, County Administrator; Dawn Bellile, Deputy County
Clerk; Ben Dufford, County Conservationist, Robert Schierman, Planning & Zoning
Director, Jason Bodine, Forestry Director; Linda Coleman, Corp Counsel; Beth Meyers,
Assemblywoman, and community residents.
The Pledge of Allegiance was recited by all in attendance.
1. Bayfield County Resolution no. 2015-40, Employees of the Year. Mark
Abeles-Allison, County Administrator, read the Resolution, which reads as follows:
WHEREAS, the Bayfield County Board of Supervisors recognizes the value of
dedicated employees; and
WHEREAS, the following employees have served Bayfield County with distinction,
honor and dedication in their respective Work Groups; and
WHEREAS, their fellow employees have determined that these employees reflect
the highest level of values within their employee work group and promote a positive image
of Bayfield County.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of
Supervisors assembled this 30th day of June, 2015, hereby honors:
Robert Schierman, as Employee of the Year for 2015 in the Courthouse employee
group, for his dedication and service to Bayfield County; and
Gwen Goodrich, as Employee of the Year for 2015 in the Sheriff’s
Department, for her dedication and service to Bayfield County.

A motion was made by Bussey/Jardine to adopt Bayfield County Resolution No.
2015-40, 2015 Employees of the Year. The motion carried.

2. Public Comment. Chairman Pocernich reminded the public that public
comment is limited to 30 minutes, with 3 minutes per person for anyone wishing to speak.
Speakers are asked not to ask questions of the Board as this time if just for commenting.
Mary Dougherty, Bayfield, spoke on an article that just appeared in a newspaper on
vested laws and quoted Black Law Dictionary. Reich’s have filed 2 applications, both are
still incomplete. She feels the original application was filed in haste just to get something
in place. She asked the Board, what about Bayfield County residents’ right? Don’t we have
vested rights in the clean water, air, soil, etc.? Why should two shotty applications take
our rights away? Dougherty read a definition also about good rights from the dictionary.
Reich’s have stated that they are good neighbors, then why was their application turned in
incomplete.
Beth Meyers, Bayfield, says she misses her Board and welcomed Kathy in her place.
Meyers reported that after receiving a letter asking for an Environmental Impact
Statement (EIS), the DNR issued a press release that says they are going to do an
Environmental Impact Statement (EIS). The letter of the community, several Tribes,
municipalities that have spoken up is what determined that this is the right thing to do.
You did a great job coming forward with this issue.
Pocernich pointed out to the public that the Board will be talking about the vesting
issue in closed session, but there will not be any decision made at that time. The Board
will just be speaking with legal counsel about the issue.
3. Minutes of the May 27, 2015 Bayfield County Board of Supervisors’
Meeting. The Board dispensed with the reading of the minutes. A motion was made by
Kittleson/Crandall to adopt the minutes of the May 27, 2015, Bayfield County Board
of Supervisors’ Meeting. The motion carried.
4. Bayfield County Resolution No. 2015-42, Forestry & Parks Department
Budget Amendment FY2015. Jason Bodine, Forest Administrator, was present to bring
the Board up to date with this transaction. It has taken almost 9 months for this
transaction to come into play. Bayfield County can purchase $2.6 million worth of timber
for $360,000.00. This amount should take care of any other expenses that should come
up as well. Discussion. The Executive Committee approved this at their meeting earlier,
however the final decision is here tonight. The Townships also come up ahead with a type
of sale as this.
The Board dispensed with the reading of the Resolution, which reads as follows:
WHEREAS, via Resolution 2014-52, the County Board gave the Forestry and Parks
Department authorization to apply for the acquisition of County Forest land through the Knowles-
Nelson Stewardship Grant (the Grant); and
WHEREAS, the Resolution outlined the general parameters for the application; and
WHEREAS, the Grant application was approved for both the Meteor Timber and Lyme
Timber Acquisition projects; and

WHEREAS, as part of the Grants, the County would acquire 1,392 acres from Meteor
Timber and 463 acres from Lyme Timber; and
WHEREAS, the appraised land value for the Meteor Timber Acquisition project was
$1,682,000.00. The appraised land value for the Lyme Timber Acquisition project was
$556,000.00; and
WHEREAS, the final selling price for the land in the Meteor Timber Acquisition project
was $1,990,560.00. The selling price for the land in the Lyme Timber Acquisition project was
$601,900.00; and
WHEREAS, the total selling price for both projects combined is $2,592,460.00 for the
land, with additional associated expenses (i.e. appraisals, legal fees, signage, recording fees)
estimated to be $27,770.00. The grand total cost for both acquisition projects is expected to be
$2,620,230.00; and
WHEREAS, the Knowles-Nelson Stewardship Grant will provide funding for 50% of the
appraised land value, and other associated costs, for each project; and
WHEREAS, as part of the Grant, the County is required to provide matching funds for the
remaining 50%; and
WHEREAS, as part of the matching funds, the County applied the appraised value of an
additional 746.8 acres of County owned, non-County Forest Law, lands. These match properties are
appraised at $1,119,000.00; and
WHEREAS, the value of the Grants, including the appraised value of the County match
properties, is $1,697,350.00 for the Meteor Timber project and $568,420.00 for the Lyme Timber
project. The total Grant value of the combined projects is $2,265,770.00; and
WHEREAS, to complete both Grant acquisition projects, the County would need to
contribute an additional $354,460.00 (or roughly $191.08 per acre); and
WHEREAS, combined, these acquisition properties have excellent short and long term
timber management potential and are estimated to contain $330,000.00 in timber value over the
next two years; $635,000.00 in timber value over the next five years; nearly $1.0 million over the
next ten years; and more than $2.0 million over the next twenty years; for an average revenue
potential of approximately $100,000.00 per year over the next 20+ years; and
WHEREAS, the County match properties, which were acquired at no out of pocket costs to
the County, also have immediate timber management potential and are estimated to contain
$325,000.00 in timber value over the next year; and
WHEREAS, revenue from timber sale stumpage is predicted to be over $4.0 million for CY
2015. This would exceed the budgeted revenue amount ($2.75 million) by over $1.25 million; and
WHEREAS, all properties acquired through the Grant, as well as all County properties used
as a match, will be enrolled in County Forest Law and managed as part of the County Forest. In
total, 2,601.8 acres will be added to the County Forest; and
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors,
assembled this 30th day of June, 2015 approves the Knowles-Nelson Stewardship Land Grant
Acquisition projects, as presented, and approves the following budget amendment to the 2015
Forestry and Parks Department budget:

A motion was made by Bussey/Bichanich to adopt Bayfield County Resolution
No. 2015-42,Forestry & Parks Department Budget Amendment FY2015. Discussion
took place that Bayfield County ranks 4th in the State in acreage, but 1st in the State in
sales. A roll call vote was taken as follows: Crandall-yes; Rondeau-yes; Wendling-
yes; Bussey-yes; Jardine-yes; Maki-yes; Kittleson-yes; Bennett-yes; Pocernich-yes;
Strand-yes; Williams-yes; Bichanich-yes; Miller-absent. Total: 13; 12 yes, 1
absent. The motion carried.
5. Bayfield County resolution No. 2015-41, 2015 Health Department
Budget Amendments. The Board dispensed with the reading of the Resolution, which
reads as follows:
WHEREAS, adjustments to the 2015 Health Department budget are necessary due
to increases/decreases in federal and state grant funding; and
WHEREAS, this will not affect the amount of tax levy requested by the
department.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of
Supervisors assembled this 30th day of June, 2015 amends the 2015 budget by $40,480
and authorizes the increase/decrease of the following revenue and expense accounts for
2015.

Changed from Residential-Recreational Business (R-RB) to Forestry-2 (F-2). The
Board dispensed with the reading of the Report, which reads as follows:

to amend the Bayfield County Zoning Ordinance.
The Planning and Zoning Committee of the Bayfield County Board of Supervisors,
having held a public hearing pursuant to Section 59.69(5)(e), Wisconsin Statutes;
notice thereof having been given as provided by law; and having been duly informed of

Chairman Pocernich informed the Board that the Report and Amendatory
Ordinance for the Rezone of the Fred W. & Dianne Weier parcel; the Darrin E. &
Kristen R. Schmitz parcel; and the Michael Haroldson and Yvonne A.I. Sorenson
parcel will not be acted on this evening.
22. Appointment of Sarah Boles and Sally Ann Pease to the Aquatic Invasive
Species Committee. Abeles-Allison explained that the applications of Boles and Pease are
on file and it is the recommendation for the AIS Committee that these two applicants be
approved. A motion was made by Jardine/Rondeau to appoint Sarah Boles and Sally
Ann Pease to the Aquatic Invasive Species Committee. The motion carried.
23. Appointment of Rick Geisen to the Industrial Development Agency Board.
Abeles-Allison explained that this appointment would be through 2016. The Board is made
up of Corporation Counsel, Executive Committee Chair, County Board Chair and a County
Board member. This Board also oversees the incubator buildings in Iron River and
Bayfield. A motion was made by Bussey/Crandall to appoint Rick Geisen to the
Industrial Development Agency. The motion carried.
24. Appointment of Board of Adjustment Members. Abeles-Allison explained
that William Kacvinsky has been a long-term member but is ready to step down. He would
like to move Richard Compton into that regular position, appoint Jane Bucy to an alternate
position and reappoint Frank Kostka to a 3-year term. A motion was made by
Kittleson/Bennett to move Richard Compton to a full-time position. The motion
carried. A motion was made by Kittleson/Wendling to appoint Jane Bucy to an
alternate position. The motion carried. A motion was made by Rondeau/Williams to
reappoint Frank Kostka to a 3-year term. The motion carried.
25. Bayfield County Resolution No. 2015-43, To Repeal Paragraph 23 of
Motion #520 to the State of Wisconsin 2015-2017 Budget Bill. Rob Schierman,
Zoning Administrator, was present to explain that is such an action is indeed put through,
in Schierman’s opinion, would move our move our ordinances back 40 years, including any
actions taken by the boards, citizens, etc. and actions as they relate to lake
reclassifications, comprehensive use plans, etc. The Zoning Planning & Committee has sent
a memo to the Joint Finance Committee. Schierman is asking that this be removed from
the budget and asking for County Board reinforcement.

The Board dispensed with the reading of the Resolution, which reads as follows:
WHEREAS, the Bayfield County Planning and Zoning Committee has been advised
that the Joint Committee on Finance has passed Motion #520 as part of its discussion and
deliberation on the Budget Bill; and
WHEREAS, Paragraph 23 of Motion #520 changes the standards for regulation of
existing structures in the shoreland area contrary to adopted standards in NR 115 and to
the detriment of environmental quality and the orderly economic development of Bayfield
County; and
WHEREAS, the State of Wisconsin and Wisconsin Department of Natural
Resources has adopted NR 115 and updated it periodically after public input and review;
and
WHEREAS, Bayfield County has 105 miles of coastline on Lake Superior, arguably
one of the most important bodies of fresh water in the world; and
WHEREAS, Bayfield County has over 400 miles of classified trout streams, which
provide some of the finest trout fishing in the State; and
WHEREAS, Bayfield County has 962 inland lakes constituting 732 miles of
shoreline, Bayfield County is unique in its abundance of water resources; and
WHEREAS, it has been the expressed opinion of the citizens of Bayfield County
and the Bayfield County Board of Supervisors that additional protections of the County’s
water resources are warranted; and
WHEREAS, Bayfield County has been enforcing the minimum standards of NR 115
since its inception in the late 1960s, and has accumulated considerable experience while
working with the various incarnations of NR 115 over many years, and furthermore has
noted during these many years that the current laws have protected the water quality in
Bayfield County, and at the same time have protected property values, the County’s
wildlife and fisheries habitat, and the natural scenic beauty of Bayfield County’s
shorelands, and at the same time provided flexibility to property owners in development of
their property; and
WHEREAS, Bayfield County has started the process of enacting NR 115 as it is
currently written; and
WHEREAS, Bayfield County Board members conclude that the water quality of
those water bodies within our County would suffer if development is not regulated to the
benefit of both the property owner and the water body whose shorelines are proposed for
development as it currently is in NR 115; and
WHEREAS, Bayfield County has had good protection of landowner rights, property
values, and the environment, including water quality, when following the current minimum
standards; and

WHEREAS, Bayfield County feels that the shoreland standards should not be
changed without due consideration by the entire legislature, the Natural Resources Board,
and the public; and
WHEREAS, Bayfield County strongly objects to paragraph 23 of Motion #520
amending the 2015-2017 State of Wisconsin Budget (SB 21 and AB 21), because it weakens
regulation of non-conforming structures and does not provide adequate protection of our
valuable water resources; and
WHEREAS, the amendment as written will prevent the local governmental units
charged by the State of Wisconsin with overseeing development within its shorelands
from protecting the rights of the property owner, the citizens of the area, and the
environment in a fair and equitable manner; and
WHEREAS, Paragraph #23 of Motion # 520 as written will result in unchecked
development along our shorelines which will cause irreparable harm to the water quality of
our County; result in a drop in property values which in turn will damage the economy of our
County; and promote harm to the environment by contributing to the degradation of our
surface waters and ultimately the ground water of our County and the state.
NOW, THEREFORE, BE IT RESOLVED, by the Bayfield County Board of
Supervisors that it hereby requests that the State of Wisconsin, repeal paragraph 23 of
Motion #520 to the 2015-2017 Budget Bill (SB 21 and AB 21), and retain the current
provisions of NR 115, Wisconsin Administrative Code, and thereby protect the citizens and
environment of our County and great state.

A motion was made by Jardine/Bussey to Repeal Paragraph 23 of Motion #520

26. Executive Session. A motion was made by Rondeau/Bichanich to move
into Executive Session pursuant to §19.85(1)(g) conferring with legal counsel for the
governmental body who is rendering oral or written advice concerning strategy to be
adopted by the body with respect to litigation in which it is or is likely to become
involved; and to allow Linda Coleman, Corporation Counsel; Robert Schierman, Zoning
Administrator; and Benjamin Dufford, County Conservationist to remain in closed
session. The motion carried.
A motion was made by Rondeau/Crandall to move out of executive session and
into open session. The motion carried.
27. Administrator’s Report:
a) Future meetings: July 28th, August 25th and September 29th;

b) Annual WCA Conference. If you haven’t already registered and you
want to go, please let Mark know as soon as possible. This is a very
informative and important conference.
c) Construction projects: Gave an update on the Safe Room and Beef
Pavilion at the fairgrounds.
28. Supervisors’ Reports:
a) Supervisor Strand gave an update on the Livestock Committee. They
have met 3 times since the last Board meeting. The June topics
discussed were underground and surface water issues with Randy and
Michelle from the DNR. We also discussed the Clean Water Act,
impaired waters and the CAFO waters. This Thursday will be on
microbiological issues and concerns. Jason Fischbach will be meeting
with local farmers on July 23rd giving the Findings of Fact that the
Committee has come up with and asking them for ideas and concerns
that have not yet been thought of.
b) A Resolution was received from the American Legion Department of
Wisconsin – 12th District and read. It recognized Terri Kramolis, Pete
Morrissette, Brenda Spurlock, Cheryl Hanson, and Liz Lexau for their
assistance in hosting the 12th District Spring Conference.
c) The Board was reminded that if they want to review minutes or
documents pertaining to the Livestock Committee meetings, they can
be found in the Drop Box.
d) Supervisor Kittleson reminded everyone of the fair and gave them a
copy of sponsors that have been secured for this year’s fair.
There being no further business to come before the Bayfield County Board of
