Bayfield County Board of Supervisors’ Meeting
August 28th, 2018 6:00 p.m.
Bayfield County Board Room, Bayfield County Courthouse, Washburn, WI
The Bayfield County Board of Supervisors was called to order at 6:01 p.m. by Bayfield County
Chairman, Dennis Pocernich. A roll call was taken by County Clerk, Scott Fibert, as follows: George
Newago- present; Thomas Gordon- present; Larry Fickbohm- present; Harold Maki- absent; Jeremy
Oswald- present; Jeffrey Silbert- present; Dennis Pocernich- present; Fred Strand- present; Thomas
Snilsberg- present; Marty Milanowski- present; David Zepczyk- present; James Crandall- present; Brett
Rondeau- present. Total: 12 present, 1 absent. A quorum was present to conduct business.
The following were also present for today’s meeting: County Clerk- Scott Fibert; County Administrator-

3. Pledge of Allegiance; The Pledge of Allegiance was recited by all in attendance.
4. Motion Regarding Minutes of June 26th, 2018 Bayfield County Board of Supervisors’ Meetings;
Motion by Rondeau, Fickbohm to approve the minutes of the July 31st, 2018 meeting. No additions
or corrections. Motion carried.
5. Public Comment – Limited to 3 minutes per person.
a) Scottie Sandstrom, Executive Director of the Bayfield County Economic Development Corporation
and Washburn resident, presented an award from Governor Scott Walker. Bayfield County was
certified as a Telecommuter Forward! Community.
b) Jeffrey Fahl, a candidate for Wisconsin State Assembly, also spoke. He graduated from Prentice High
School and received a bachelor’s degree from Milwaukee School of Engineering. He was the Mayor
of Phillips for 6 years. Fahl is interested in economic development, tourism, has served on the Phillips
Area Chamber of Commerce Board of Directors, and has interest in working towards better internet.
6. Bayfield County Resolution 2018-73; Retirement of Thomas Renz from the Sheriff’s Office;

WHEREAS, Thomas Renz has served Bayfield County with distinction, honor and dedication in the
Sheriff’s Office for over 17 years,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 28th day of August 2018, honors Thomas Renz for his over 17 years of public service to Bayfield
County and expresses gratitude for his efforts, wishing him well in the years ahead.
Motion by Rondeau, Gordon to approve Resolution 2018-73. Motion carried.
7. Bayfield County Proclamation 2018-01 Recognizing County Fair Office Staff for the 2018 Fair;
Fair Director- Mary Motiff and Fair Secretary- Ursula Garrison did an activity to educate about the
Bayfield County Fair and highlight the contributions of the Bayfield County Board members to the
Fair. They also gave information about Fair finances and figures and presented a slide show about
the Fair. County Administrator- Mark Abeles-Allison and County Board members thanked the fair
staff, especially Motiff and Garrison for all their successful work.
WHEREAS, Holding a county fair is a major endeavor involving planning, coordinating, organizing
and a little bit of luck with the weather; and,
WHEREAS, As Director of the Tourism Department, Mary Motiff has led the Fair effort for six
years now; and,
WHEREAS, In 2017 Ursula Garrison, Fair Secretary, began working for the Bayfield County Fair;
and,
WHEREAS, Scott Williams, Fairgrounds Caretaker, has done an exemplary job of maintaining and
improving the fairgrounds; and,
WHEREAS, The county fair involves hundreds of volunteers, community participants, contractors
and paid staff; and,
WHEREAS, The county provides utilities and services to participants 24 hours a day; and,
WHEREAS, The event lasts three nights and four days; and,
WHEREAS, Bayfield County recognizes the intricacies involved in putting on an event like this.
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of August 2018, applauds the efforts of the Tourism Department, other
County Staff and all of the volunteers for a successful event in 2018 and hereby proclaims Friday,
August 31, 2018 as County Fair Appreciation Day.
Motion by Rondeau, Crandall to approve Proclamation 2018-01. Motion carried.

8. Presentation: 25th District Senate Candidate, James Bolen;
Candidate Bolen introduced himself and his qualifications. He is the owner of Lake Owen Resort. He
also serves on the Board of Directors for the Cable Area Chamber of Commerce. Some of the priorities
he mentioned included: working together, taking care of the elderly, schools, roads, the drug epidemic,
and economic development.
9. Presentation; State Representative 74th Assembly District, Beth Meyers;
Meyers, a former Bayfield County Supervisor, gave updates from Madison. Representative Meyers
applauded the Fair. Meyers spoke about storm damage, climate change, and chronic wasting disease.
She pledged to work more for deer health. She informed that US Highway 2 will be opening Friday,
August 31st. There was also discussion about topics including: farming, seasonal work, the tourism
industry, the environment, the aging population, healthcare reimbursements, and affordable healthcare.
10. Clerk of Courts Annual 2017 Report; Clerk of Court, Kay Cederberg;
Clerk of Court, Kay Cederburg, explained the 2017 Annual Clerk of Courts Report. One of the main
topics was debt and debt collection. Judge Anderson also provided information regarding juvenile
secure detention.
Motion by Newago, Crandall to receive and place the 2017 Annual Clerk of Courts Report on file.
Motion carried.
11. Discussion and possible action regarding Bayfield Wireless Partnership Agreement and Fire Hill
and Star Route Tower agreements;
County Administrator, Mark Abeles-Allison and Mike Cariveau from Bayfield Wireless gave
information about the Bayfield Wireless Partnership, Fire Hill, and Star Route Tower agreements.
Cariveau spoke about the benefits of telecommuting and broadband networks for Bayfield County.
Motion by Newago, Gordon to enter into the Bayfield Wireless Partnership Agreement and Fire Hill
and Star Route Tower agreements. There was also authorization for County Administrator- Mark
Abeles-Allison and County Clerk- Scott Fibert to sign on the Bayfield County Board’s behalf. Star
Route Tower agreement is contingent upon the State approving the withdrawal from County Forest
Law.
A roll call was taken as follows: Newago-yes, Gordon-yes, Fickbohm- yes, Oswald-yes, Silbert-yes,
Pocernich-yes, Strand-yes, Snilsberg-yes, Milanowski-yes, Zepczyk-yes, Crandall-yes, Rondeau-yes,
Maki-absent. Motion carried. (12-yes, 0-no, 1-absent) Motion carried.
12. Bayfield County Resolution No. 2018-74; Regarding County Forest Law Withdrawal Request.
Discussion and possible action regarding the withdrawal and approximately 2.71 acres of
County Forest Land, from County Forest Law, for the construction of a communications tower
in the Town of Bayfield, Forestry & Parks Director, Jason Bodine;

WHEREAS, cell phone coverage and broadband network services in the northern portion of Bayfield
County is very poor,
WHEREAS, citizens will benefit from the construction of radio transmission towers in areas where
coverage and/or availability is limited,
WHEREAS, Bayfield County is interested in establishing a radio transmission tower on Bayfield
County Forest land in the Town of Bayfield,
WHEREAS, a 2.71 acre parcel of County Forest land described as part of the W½ NW¼ of Section
22, T50N R5W, Town of Bayfield, Bayfield County, Wisconsin, has been identified as a lease space
for radio transmission tower development (see Exhibit A),
WHEREAS, the construction of radio transmission towers on County Forest land is inconsistent with
the purposes set forth in County Forest Law, s. 28.11, Wis. Stats
WHEREAS, any proposal to locate radio transmission towers on County Forest land will first require
filing an application to withdraw said parcel from County Forest Law,
WHEREAS, the Bayfield County Forestry and Parks Committee has recommended the withdrawal
of the 2.71 acre parcel of County Forest land for the purpose of developing a radio transmission
tower,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of August 2018, recommends the withdrawal from County Forest Law the
above described 2.71 acre parcel for the purpose of developing a radio transmission tower.
Motion by Newago, Rondeau to approve Resolution 2018-74, with one correction regarding the
physical description. It should read R5W, instead of R4W. Motion carried.

Bayfield County Zoning Ordinance regarding 4 parcels located in shoreland with wetlands to W

Health Department;
County Administrator- Mark Abeles-Allison explained the State Targeted Response (STR) grant through
Marshfield Clinic.
WHEREAS, the Bayfield County Health Department has received grant funding in the amount of $6,575
from Marshfield Clinic Health System, Center for Community Health Advancement to provide

prescription drug lock boxes and deactivation units throughout Bayfield County and provide addiction
education to the community. Funding is received by reimbursement. Total award to be expended by April
30, 2019; and
WHEREAS, the 2018 Budget does not contain any projections to account for any revenue or
expenditures for said grant; and
WHEREAS, it is the desire of the Bayfield County Board of Health to accept and expend said grant in
2018.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled

Bayfield County. The Bayfield County Health Department is also responsible for timely public
notifications of beach conditions via web application and posting appropriate signs or colored flags at
the beach. Total award to be expended by November 30, 2018; and
WHEREAS, the 2018 Budget does not contain any projections to account for any revenue or
expenditures for said grant; and
WHEREAS, it is the desire of the Bayfield County Board of Health to accept and expend said grant
in 2018.

19. Bayfield County Resolution No. 2018-77; Supporting Regional Planning for Autonomous
Vehicles:
WHEREAS, Governor Walker signed Executive Order #245 on May 18, 2017 to create the
Governor’s Steering Committee on Autonomous and Connected Vehicle Testing (CAVs) and
Deployment to have a coordinated effort on how the state would advance testing and operation of
autonomous and connected vehicles in Wisconsin; and
WHEREAS, the final report of the Committee recommended Promoting the entire state of Wisconsin
as “Open for Connected and/or Autonomous Vehicles” and urged pursuit of existing, near-term
strategic partnerships while continuing to explore new strategic social, economic, and environmental
partnerships though the creations of a CAV working group; and
WHEREAS, Wisconsin is designated as one of 10 sites by the US Department of Transportation for
an Autonomous Vehicle Proving Ground; and
WHEREAS, the Wisconsin Area Agency on Aging notified county Aging and Disability Resource
Centers CAVs have the potential to positively impact the lives of the people we serve changing the
delivery of meals or escort services; and
WHEREAS, the senior population is growing in Bayfield County with a doubling of the over 65
population from 20% to 40% between the years of 2010 and 2030.
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of August 2018, do hereby urge the Bayfield County ADRC to learn about
how this technology could be valuable to our residents; and
BE IT FURTHER RESOLVED, that the Northwest Regional Planning Commission be contacted to
include Autonomous Vehicle Planning efforts in future planning documents, and
BE IT FURTHER RESOLVED, to contact the Wisconsin Department of Transportation and urge
consideration of pilot programs in Bayfield County, relating to AV signage, mapping and road
technology.

20. Bayfield County Resolution No. 2018-78; Authorizing application for Department Natural
Resources Tree Planting Grant submittal;
WHEREAS, the applicant, Bayfield County, is interested in obtaining a cost-share grant from the
Bay-Lake Regional Planning Commission for the purpose of funding tree planting under funding
originating from the U.S. Forest Service, Great Lakes Restoration Initiative;

WHEREAS, the applicant attests to the validity and veracity of the statements and representations
contained in the grant application; and
WHEREAS, the applicant requests a grant agreement to carry out the project;
WHEREAS, Bayfield County plans to plant trees in erodible areas on county properties to control
runoff and sedimentation.
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of August, 2018, do hereby attest that they will comply with all local, state,
and federal rules, regulations, and ordinances relating to this project and the cost-share agreement;
BE IT FURTHER RESOLVED, Bayfield County will budget a sum sufficient to fully and
satisfactorily complete the project and hereby authorizes and empowers the Bayfield County
Administrator, its official or employee, to act on its behalf to: 1. Sign and submit the grant application.

21. Bayfield County Resolution No. 2018-79; Highway Budget Amendment Resolution;
County Administrator Abeles-Allison gave information regarding Bayfield County Resolution No.
2018-79. The resolution is regarding the financial impact of the storm damage from June 16-18,
2018. There was estimated amount of damage of around $3.7 million from the June storm. The State
and FEMA were expected to contribute 87.5% and Bayfield County will incur an estimated expense
of $72,183 or 12.5% of the total cost. Additional resolutions regarding the highway budget were
anticipated.
WHEREAS, County Highway crews responded in full force the weekend of June 16, 2018 as record
rains undermined and destroyed road infrastructure.
WHEREAS, an unprecedented number of county highway roads and bridges were damaged;
WHEREAS, County crews worked around the clock to ensure highway safety.
WHEREAS, County Highway incurred substantial overtime, hauled and placed extra materials from
our pits and purchased materials from private pits and quarries, rented extra equipment and entered

into emergency contracts with contractors and other counties to open roads as quickly and safely as
possible for the public.
WHEREAS preliminary estimates place the damage to County Highway infrastructure at over $3.7
million (61% of the Highway Department’s annual budget).
WHEREAS the County Highway Commissioner is working closely with the Wisconsin Department
of Transportation on emergency restoration funds. The County is anticipating an 87.5%
reimbursement of County Highway emergency repairs;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of August 2018, does hereby accept formal notice of the extent of damages
and needed repairs to the County Highway System.

There being no further business to conduct in Executive/Closed Session, a motion was made by
Crandall, Rondeau to return to open session at 9:07 p.m. Motion carried.
23. Discussion and possible action regarding Corporation Counsel Contract;
Motion by Rondeau, Crandall to approve the Corporation Counsel Contract for Carlson and
Coleman for the next 3 years. Motion Carried. (Supervisor Gordon left the meeting during Closed
Session.)
24. Administrator’s Report:
County Administrator Mark Abeles-Allison provided updates regarding:
a) Future County Board Meeting Dates:
✓ September 26th (Wednesday, one day later due to WCA Conf. ending on Tuesday);
✓ October 30th, 2018
✓ November 13th, 2018
b) 2019 Budget Update; All Departments have submitted their budgets.
c) Cervid Committee Report; Vice-Chair Strand gave a brief update. The committee will meet on
October 3rd.
d) Census 2020, Bayfield County Land Records Update; The census is a critical document for
counties per Administrator Abeles-Allison. Census day will be April 1st, 2020.
e) Boardroom safety exercise; County Administrator- Mark Abeles-Allison gave information
regarding emergency exits and safety in the Bayfield County Board Room.
25. Supervisors’ Reports; County Board Members provided updates regarding their committees. There was
discussion regarding Pigeon Lake.
26. Future Agenda Items; None identified.
27. Adjournment; There being no further business to come before the Bayfield County Board of
Supervisors, Chairman Pocernich adjourned the meeting at 9:15 p.m.
