The Bayfield County Board of Supervisors was called to order at 6:02 p.m. by Bayfield County
Chairman, Dennis Pocernich. A roll call was taken by County Clerk, Scott Fibert, as follows: George
Newago- absent; Thomas Gordon- present; Larry Fickbohm- present; Harold Maki- present; Jeremy
Oswald- present; Jeffrey Silbert- present; Dennis Pocernich- present; Fred Strand- present; Thomas
Snilsberg- present; Marty Milanowski- absent; David Zepczyk- present; James Crandall- present; Brett
Rondeau- present. Total: 11 present, 2 absent. A quorum was present to conduct business.
The following were also present for today’s meeting: County Clerk- Scott Fibert; County
Administrator- Mark Abeles-Allison; Clerk III- Allison Radke; Zoning Director- Rob Schierman; Current
Bayfield County Economic Development Corporation Director- Scottie Sandstrom; Upcoming Bayfield
County Economic Development Corporation Director- Cole Rabska.
3. Pledge of Allegiance; The Pledge of Allegiance was recited by all in attendance.
4. Moment of Silence for Tom Frizzell, former Bayfield County Supervisor;
There was a moment of silence in honor of Tom Frizzell, former Bayfield County Supervisor.
5. Motion Regarding Minutes of the October 30, 2018 Bayfield County Board of Supervisors’
Meeting;
Motion by Rondeau, Crandall to approve the minutes of the October 30th, 2018 meeting. No
corrections or additions. Motion carried.
6. Public Comment – No public comment was received.
7. The State of Wisconsin, Office of the Governor, Certificate of Commendation; Honoring
Scottie Sandstrom, Director of Bayfield County Economic Development Corporation for his
successful career in business; County Administrator, Mark Abeles-Allison;
The award was presented to Scottie Sandstrom, current Bayfield County Economic Development
Corporation Director, by County Administrator Abeles-Allison and the Bayfield County Board of
Supervisors. The Certificate from the Office of Governor was read to all. Sandstrom was thanked
for his work for Bayfield County and congratulated on his retirement. Sandstrom gave a short
speech of thanks to Bayfield County.

WHEREAS, after a successful career in business, Scottie Sandstrom was hired as Executive
Director of the Bayfield County Economic Development Corporation on March 14, 2011; and
WHEREAS, Scottie Sandstrom has been a tireless advocate for Bayfield County, promoting
community cooperation, business retention and expansion, and development of the Bayfield
County Business Park; and
WHEREAS, in the spirit of collaboration, Scottie Sandstrom work with other area economic
development organizations to initiate Business of Stage events featuring local businesses,
providing education and networking opportunities for entrepreneurs; and
WHEREAS, Scottie Sandstrom has had a statewide effect on expansion and adoption of
broadband by his instigation of both Broadband Forward! And Telecommuter Forward!
Certification; and
WHEREAS, Scottie Sandstrom is retiring on December 31, 2018;
NOW, THEREFORE, I, Scott Walker, Governor of the State of Wisconsin do hereby commend
Scottie Sandstrom for his long and successful career, and wish him well in his retirement.
8. Introduction of the new Bayfield County Economic Development Corporation Director; Cole
Rabska;
Cole Rabska, the new Bayfield County Economic Development Corporation Director, was
introduced by Scottie Sandstrom. Rabska also gave information about his previous experiences and
commented that he looks forward to working together with Bayfield County.
9. Report of the Bayfield County Planning and Zoning Committee No. 2018-16; Petition to
amend the Bayfield County Zoning Ordinance regarding the Zoning of a Bayfield Electric,
Inc. parcel from Industrial to Commercial; Rob Schierman, Planning and Zoning Director;
Zoning Director Schierman gave information regarding this report. This was recommended by the
Town of Iron River and by the Bayfield County Planning and Zoning Committee.

Bayfield County Zoning Ordinance.
The Planning and Zoning Committee of the Bayfield County Board of Supervisors, having held a
public hearing pursuant to Section 59.69(5)(e), Wisconsin Statutes; notice thereof having been
given as provided by law; and having been duly informed of the facts pertinent to the following
changes; hereby recommends the following action on said petition:
The Zoning of Bayfield Electric Cooperative, Inc. 6.89-acre parcel (ID# 37856) (V. 721 P. 28),
described as Lot 2, of Certified Survey Map (CSM) #2051 in Section Eight (8), Township Forty-

Seven (47) N, Range Eight (8) W, Town of Iron River, Bayfield County, WI be changed from

Motion by Silbert, Zepczyk to receive and place on Report No. 2018-16. Motion carried.
10. Bayfield County Ordinance No. 2018-16; Amendment regarding the Zoning of a Bayfield
Electric, Inc. parcel from Industrial to Commercial; Rob Schierman, Planning and Zoning
Director;
This is a re-zone request by Bayfield Electric in the Town of Iron River from Industrial to
Commerical.
The Bayfield County Board of Supervisors ordains as follows:
That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same, is hereby
amended as follows:
The Zoning of Bayfield Electric Cooperative, Inc. 6.89-acre parcel (ID# 37856) (V. 721 P. 28),
described as Lot 2, of Certified Survey Map (CSM) #2051 in Section Eight (8), Township Forty-
Seven (47) N, Range Eight (8) W, Town of Iron River, Bayfield County, WI be changed from
Industrial (I) to Commercial (C).
Motion by Strand, Gordon to adopt Amendatory Ordinance No. 2018-16. Motion carried.
11. Report of the Bayfield County Planning and Zoning Committee No. 2018-17; Petition to amend the
Bayfield County Code of Ordinances Sections 13-2-11 adding the Drummond Mill Pond Failure
Analysis to Official Analysis; Rob Schierman, Planning and Zoning Director;
Director Schierman gave information on Zoning Report No. 2018-17, which is a dam failure analysis. The
Zoning Committee has unanimously recommended approval.

12. Bayfield County Ordinance No. 2018-17; Amendment regarding the Bayfield County Code
of Ordinances Sections 13-2-11 adding the Drummond Mill Pond Failure Analysis to
Official Analysis; Rob Schierman, Planning and Zoning Director;
The Bayfield County Board of Supervisors ordains as follows:
That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same, is hereby
amended as follows:
AN ORDINANCE AMENDING SECTIONS 13-2-11 CODE OF ORDINANCES,
BAYFIELD COUNTY, WISCONSIN
WHEREAS, Wisconsin Statutes §59.69 (5) authorizes the County Board to adopt a zoning
ordinance; and

WHEREAS, Wisconsin Statutes §59.69(5)(e) authorizes the County Board to amend an
ordinance; and
WHEREAS, Section 13-1-104 Code of Ordinances, Bayfield County, Wisconsin authorizes the
County Board to make amendments to Title 13, Chapter 1 of the Code of Ordinances, Bayfield
County, Wisconsin pursuant to Wisconsin Statutes §59.69; and
WHEREAS, it is deemed in the best interest of the County of Bayfield to also amend Sections
13-2-11 to include a dam failure analysis for Drummond Mill Pond Dam and the re-lettering of
(a) to (g); and
WHEREAS, it is deemed in the best interest of the County of Bayfield that the Code of
Ordinances, Bayfield County, Wisconsin be further modified and amended in the manner
hereinafter set forth;
NOW, THEREFORE, the Bayfield County Board of Supervisors does hereby ordain as
follows:
Section 1. Subparagraph (a) of Subheading (2) [Official Analysis] of Subsection (b)
[Official Maps] of Section (13-2-11) [District Boundaries] of Article B [General Provisions] of
Chapter 2 [Floodplain Zoning] of Title 13 [Zoning Code] of the Code of Ordinances, Bayfield
County, Wisconsin is hereby amended to read as follows, with additions highlighted by the

Section 2. Except as specifically modified and amended by this ordinance, the Bayfield
County Code of Ordinance shall remain in force and effect exactly as originally adopted and
previously amended. All ordinances or parts of ordinances inconsistent with or in contravention
of the provisions of this ordinance are hereby repealed.
Section 3. SEVERABILITY. If a court of competent jurisdiction adjudges any section,
clause, provision, or portion of this ordinance unconstitutional or invalid, the remainder of this
ordinance shall not be affected thereby.
Section 4. EFFECTIVE DATE. This ordinance shall take effect and be in full force from and
after its passage.
Motion by Rondeau, Strand to adopt Amendatory Ordinance No. 2018-17. Motion carried.
13. Electronic Zoning Permit Process Announcement; Rob Schierman, Planning and Zoning
Director;
Planning and Zoning Director Schierman announced that the Planning and Zoning Committee
issued their 1st permit online through a paperless process. Schierman described the program as
cutting edge. It is in the roll-out phase.
County Administrator Abeles-Allison gave a brief introduction of the new Bayfield County website.
14. Bayfield County Resolution No. 2018-91; Designation of Authorized Depositories for Bayfield
County;
This Resolution designates where Bayfield County funds are located. Bremer Bank is Bayfield
County’s main bank.
WHEREAS, Section 34.05 of the Wisconsin Statutes authorizes counties to invest any of their
funds not immediately needed, in time deposits, in banks, or savings and loan associations, in
accordance with and subject to the limitations of Wisconsin Statute §66.0603(1m), and also
authorizes counties to engage in financial transactions in which the public depository agrees to
repay funds advanced to it by the county plus interest, if the agreement is secured by bonds or
securities issued or guaranteed as to principal and interest by the Federal Government; and
WHEREAS, it appears to be to the financial benefit of the County and its citizens to invest
funds not immediately needed in such deposits and to enter into such financial transactions from
time to time; and

NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors,
assembled this 13th day of November 2018, hereby authorizes and directs the Bayfield County
Treasurer to invest 2019 County funds, not immediately needed, either in time deposits in
accordance with and subject to the limitations of Wisconsin Statute §66.0603, or by entering into
financial transactions in which a public depository agrees to repay funds advanced to it by the
County plus interest, if the agreement is fully secured by securities issued or guaranteed as to
principal and interest by the Federal Government, with any of the following financial
institutions, which have been designated as public depositories for Bayfield County: Bremer
Bank & Bremer Trust; Security State Bank; Northern State Bank; Chippewa Valley Bank; and
the Local Government Investment Pool, investing in public instruments as approved by the
County Executive Committee in accordance with county and state investment policies and laws;
BE IT FURTHER RESOLVED, that County funds not so invested shall be deposited in
checking or savings accounts at any of the foregoing institutions.
Motion by Rondeau, Crandall to approve Resolution 2018-91. There was one abstention.
Motion carried.
15. Bayfield County Resolution No. 2018-92; Holding of Meetings as may be necessary to
conduct business in 2019;
Resolution No. 2018-92 allows Bayfield County to hold meetings as necessary, when necessary
to conduct business. There was discussion and a language clarification was made. Without
Resolution No. 2018-92, the Bayfield County Board of Supervisors would only be authorized to
meet 10 times a year.
WHEREAS, Wisconsin Statute §59.13(2)(a) requires counties containing less than 25,000
population, to 20 days, not more than 10 of which shall be for services on any one committee,
except that the Board may increase the number of committee meetings under par. (b) and
similarly fix the compensation of the members for the additional meetings; and
WHEREAS, the committees of the Bayfield County Board of Supervisors are required to
conduct business of said Bayfield County, to hold and conduct committee meetings in excess of
the number permitted by State Statute §59.13(2)(a); and
WHEREAS, by action of the Bayfield County Board of Supervisors, the number of meetings of
said committees beyond the statutory limit may be extended.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 13th day of November 2018, agree that the committees of the Bayfield County
Board of Supervisors be and are hereby authorized to hold such meetings during the year 2019,
as may be necessary to conduct the business of said Bayfield County.

Motion by Rondeau, Gordon to approve Resolution 2018-92. Motion carried.
16. Bayfield County Resolution No. 2018-93; Authorization for the County Board Chair, County
Clerk, and County Treasurer from Bayfield County to make Short Term Loans;
County Administrator Abeles-Allison explained the purpose of Resolution No. 2018-93. It
authorizes the County Board Chair, County Clerk, and County Treasurer to issue short-term loans of
up to $300,000.
WHEREAS, it may be necessary to borrow funds on a short-term basis, in order to meet payrolls
and other obligations including current and ordinary expenses within the next year.
NOW, THEREFORE, BE IT RESOLVED, by the Bayfield County Board of Supervisors of
Bayfield County in annual session, assembled this 13th day of November 2018, directs and
authorizes the County Board Chairman of the County of Bayfield, the County Clerk, and the County
Treasurer, to borrow funds on a short term basis for 2019, in an amount not to exceed Three
Hundred Thousand Dollars ($300,000.00) in aggregate if in their opinion it should be to the
County’s best interest to make such loan or loans.
Motion by Rondeau, Maki to approve Resolution 2018-93. Motion carried.
17. Bayfield County Amendatory Ordinance No. 2018-18; Creating Chapter 3: Broadband
Network Projects in Title 9 of the Bayfield County Code of Ordinances; County Administrator,
Mark Abeles-Allison;
County Administrator Abeles-Allison explained some of the benefits of this Amendatory Ordinance.
It was approved by the Executive Committee and would comply with the State’s goal of
streamlining broadband networks on County highways.
Creating Chapter 3: Broadband Network Projects in Title 9 of the Bayfield County
Ordinances
WHEREAS, Wisconsin Statutes §59.03(2) provides that, except as elsewhere specifically
provided in the statutes, the board of any county is vested with all powers of a local, legislative
and administrative character; and
WHEREAS, Wisconsin Statutes §59.02(2) permits the enactment of ordinances by the County
Board of Supervisors; and
WHEREAS, Section 2-2-3, Code of Ordinances, Bayfield County, Wisconsin, authorizes
County Board committees or individual supervisors to introduce proposed ordinances; and
WHEREAS, it is deemed to be in the best interest of the County of Bayfield to create Chapter 3:
Broadband Network Projects in Title 9 “Licenses” of the Code of Ordinances, Bayfield County,
Wisconsin; and

WHEREAS, it is deemed to be in the best interest of the County of Bayfield that the Code of
Ordinances, Bayfield County, Wisconsin, be further modified and amended in the manner
hereinafter set forth.
NOW, THEREFORE, the Bayfield County Board of Supervisors does hereby ordain as
follows:
Section 1. Chapter 3 [Broadband Network Projects] of Title 9 [Licensing] of the Code of
Ordinances, Bayfield County, Wisconsin is hereby created to read as follows; with additions
highlighted by the double underline feature (additions):
TITLE 9 – Chapter 3
Broadband Network Projects
Sec. 9-3-1 General Provisions
(a) General Provisions.
(1) Purpose and policy. The purpose of this chapter is to encourage the development
of broadband access in Bayfield County by reducing administrative obstacles to
broadband service providers and coordinating the review of applications to ensure
such applications are timely processed. This chapter shall at all times be construed
consistent with the aforestated purpose.
(2) Definitions. In this chapter:
a. “Applicant” means a person applying for a permit for a broadband
network project.
b. “Broadband network project” means the construction or deployment of
wireline or wireless communications facilities to provide broadband
communications services in the [political subdivision].
c. “Permit” means any local permit, license, certificate, approval,
registration, or similar form of approval required by policy, administrative
rule, regulation, ordinance, or resolution with respect to a broadband network
project.
d. “Written” or “in writing” means information that is inscribed on a tangible
medium or that is stored in an electronic or other intangible medium and is
retrievable.
(3) Point of contact. Bayfield County shall appoint a single point of contact for all
matters related to a broadband network project. Bayfield County shall provide on its
public website the contact information, including the e-mail address, for the point of
contact authorized to receive a broadband network project application.
(b) Electronic submission of Applications. An applicant may sign and file all forms,
applications and documentation related to a broadband network project electronically.

(c) Review of Applications. Notwithstanding any other provision in Bayfield County
ordinances, resolutions, regulations, policies or practices to the contrary, the following
process shall apply exclusively upon receiving a broadband network project application:
(1) Completeness review. Upon receiving a broadband network project application
Bayfield County shall:
a. Determine whether an application is complete and notify the applicant of
the determination by Bayfield County in writing within 10 calendar days of
receiving an application. If Bayfield County does not notify the applicant in
writing of its completeness determination within 10 calendar days of receiving
the application, the application shall be considered complete.
b. If Bayfield County determines that an application is not complete, the
written notification to the applicant shall specify in detail the required
information that is not complete. The applicant may resubmit an application as
often as necessary until the application is complete.
(d) Approval or denial of complete applications.
(1) Within 60 calendar days of receiving an application that is complete, or
considered complete under sub. (1), Bayfield County shall approve or deny the
application and provide the applicant written notification of the approval or denial. If
Bayfield County does not notify the applicant of its approval or denial within 60
calendar days of receiving a complete application, the application shall be considered
approved and any required permit shall be considered issued.
(2) If Bayfield County denies an application, the written notification of the denial
under sub. (1) shall include evidence that the denial is not arbitrary and capricious.
(e) Fees. Any fee imposed by Bayfield County to review an application, issue a permit, or
perform any other activity related to a broadband network project shall be reasonable. An
application fee that exceeds $100 is unreasonable.
(f) Initial Applicability. The treatment of this ordinance first applies to applications
received by Bayfield County on or after the effective date of this ordinance.
Section 2. Except as specifically modified and amended by this ordinance, the Bayfield County
Code of Ordinance shall remain in force and effect exactly as originally adopted and previously
amended. All ordinances or parts of ordinances inconsistent with or in contravention of the
provisions of this ordinance are hereby repealed.
Section 3. SEVERABILITY. If a court of competent jurisdiction adjudges any section, clause,

Motion by Rondeau, Fickbohm to approve Amendatory Ordinance No. 2018-18. Motion
carried.
18. Bayfield County Resolution No. 2018-94; 2018 & 2019 Budget Amendment for Network
Switches, Department of Information Technology; County Administrator, Mark Abeles-
Allison;
This budget amendment would change both the 2018 and 2019 budgets. Instead of spending
$175,687 in 2019, the early purchase savings would reduce the expense by $18,007. The total
expense would be $154,680 for 2018.
WHEREAS, the Bayfield County Board included $175,687 funding for upgraded network
switches and equipment supporting the switches in the Information Technology department in
2019, and;
WHEREAS, if the purchases are made in the year 2018, a savings of $18,007 will be observed.
WHEREAS, fund balance will be used for this purchase regardless of the year the purchase is
made.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 13th day of November 2018 does hereby authorize that the purchase of network
switches be made in 2018 and that the budget be reduced by $18,007 to reflect the early purchase
savings.

19. The Bayfield County Board of Supervisors may entertain a motion to move in and out of
Executive/Closed Session pursuant to: §19.85(1)(e), deliberating or negotiating the purchasing
of public properties, the investing of public funds, or conducting other specified public business,
whenever competitive or bargaining reasons require a closed session; or

Motion by Rondeau, Silbert to enter Executive/Closed Session at 6:38 p.m.
The following were allowed to remain in Closed Session: County Clerk- Scott Fibert; County

Discusssion took place with topics including: 2019 Teamsters Union Contract, WPPA Contract, Red
Cliff Zoning lawsuit, and Cooperative Law Enforcement Services.
There being no further business to conduct in Executive/Closed Session, a motion was made by
Rondeau, Crandall to return to Open Session at 7:12 p.m. Motion carried.
20. Bayfield County Resolution No. 2018-95; Cooperative Law Enforcement Services between the
Bayfield County Sheriff’s Office and the Red Cliff Tribe;
County Board Supervisor George Newago arrived at 6:55 p.m. during Closed Session.
In past years Bayfield County has given 100% of the funds to Red Cliff. This year Bayfield County
is asking to divide the funds 50/50. An agreement needs to be reached by 11/31/2018. A factor is the
changing financial dynamics of Bayfield County. It was mentioned that approximately 30% of the
inmates in the jail are from Red Cliff. The average daily jail fee is approximately $51 per day in
Wisconsin. There was discussion regarding Resolution No. 2018-95 and its implications.
WHEREAS, the Red Cliff Band of Lake Superior Chippewa Indians is a federally recognized
Indian Tribe, organized under a Constitution adopted August 25, 1938, and approved on November
9, 1938, pursuant to section 16 of the Indian reorganization Act; and
WHEREAS, the Tribal and Bayfield County Law Enforcement Agencies have had a history of
cooperation in striving to meet the Red Cliff Community’s law enforcement needs; and
WHEREAS, Wisconsin Statute 165.90 provides for the establishment of cooperative law
enforcement efforts between County and Tribal Law Enforcement Agencies; and
WHEREAS, County and Tribal Law Enforcement Officials have worked together to develop the FY
2016 County-Tribal Law Enforcement (CTLE) Plan and grant application.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 13th day of November 2018, does hereby encourage continued cooperation between
the County and Tribal Law Enforcement Agencies and approve the 2019 County-Tribal Law

Enforcement Plan and Grant Application.

24. Administrator’s Report:
a) Northern Lights;
A short report was shared. Northern Lights had a great Veteran’s Day service. County
Administrator Abeles-Allison reported that the Northern Lights Ad-Hoc Committee has met 3
times and will make a full report at the January 2019 County Board Meeting.
b) Future County Board Meeting Dates:
✓ No December meeting anticipated at this time. If required, it will be held on December 11th.

A Bayfield County lunch holiday party is expected. The date was not finalized. All County Board
Supervisors will be invited.
c) EMT Services Report;
No update was provided. There has not been a meeting in the past month.
d) Board Room Safety Exercise;
The evacuation route for the County Board room was explained.
e) Reminder to turn in all mileage + per diems by December 14th to the County Clerk’s Office.
County Clerk Fibert gave information regarding the November 6th, 2018 election. There are
approximately 15,000 people in Bayfield County. 11,000 people are registered to vote and in the
last election 9,000 people voted. That means there was over 80% voter participation.

It was reported that there is a monthly podcast called Bayfield County Wild.
