The Bayfield County Board of Supervisors was called to order at 6:00 p.m. by Bayfield County
Chairman, Dennis Pocernich. A roll call was taken by County Clerk- Scott Fibert, as follows: George
Newago- present; Thomas Gordon- present; Larry Fickbohm- present; Harold Maki- absent; Jeremy Oswald-
present; Jeffrey Silbert- present; Dennis Pocernich- present; Fred Strand- present; Thomas Snilsberg- present;
Marty Milanowski- present; David Zepczyk- present; James Crandall- present; Brett Rondeau- present. Total:
12 present, 1 absent. A quorum was present to conduct business.
The following were also present for today’s meeting: County Administrator- Mark Abeles-Allison;
County Clerk- Scott Fibert; Clerk III- Allison Radke; Members of the Cervid Study Committee; Members of
an ATV group.
3. Pledge of Allegiance; The Pledge of Allegiance was recited by all in attendance.
4. Public Comment;
Mary Motiff, Bayfield County Tourism Director, spoke to represent the Bayfield County Fair. It is
celebrating its 125th Anniversary. The Bayfield County Fair will be taking place next week: August
8-11th, 2019.
Bayfield County resident, John Olson, spoke in support of the Cervid Committee Resolution. Olson
thanked the Bayfield County Board and the Cervid Committee for their important work to protect
natural resources.
5. Motion Regarding the Minutes of the June 25, 2019 Bayfield County Board of Supervisors’
Meeting;
Motion by Rondeau, Milanowski to approve the Minutes of the June 25, 2019 Bayfield County
Board of Supervisors’ Meeting. No additions or corrections. Motion carried.
6. Bayfield County Resolution No. 2019-47; In Appreciation of Joseph Warren for over 6 years of
dedication and service in the Bayfield County Highway Department;
Joseph Warren was recognized for over 6 years of dedication and service in the Bayfield County
Highway Department.

WHEREAS, Joseph Warren has served Bayfield County with distinction, honor and dedication in
the Highway Department for over 6 years,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 30th day of July 2019, honors Joseph Warren for his over 6 years of public service to
Bayfield County and expresses gratitude for his efforts, wishing him well in the years ahead.
Motion by Crandall, Fickbohm to approve Resolution No. 2019-47, in appreciation of Joseph
Warren for over 6 years of dedication and service in the Bayfield County Highway Department.

7. Reports of the Bayfield County Planning and Zoning Committee No. 2019-12; No. 2019-13;
Petitions to amend the Bayfield County Zoning Ordinance regarding the Zoning of the

a) Ross Darst parcel in the Town of Iron River from Residential-One/Commercial to
Commercial;
The Ross Darst parcel was formerly owned by Bayfield Electric. This rezone is to correct a portion
of the property that was previously overlooked.

That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same, is hereby
amended as follows:
WHEREAS, Wisconsin Statutes §59.69 (5) authorizes the County Board to adopt a zoning
ordinance; and
WHEREAS, Wisconsin Statutes §59.69(5)(e) authorizes the County Board to change district
boundaries; and
WHEREAS, it is deemed in the best interest of the County of Bayfield that the District
Boundaries be further modified and amended in the manner hereinafter set forth;
NOW, THEREFORE, the Bayfield County Board of Supervisors does hereby ordain as follows:

Motion by Gordon, Rondeau to adopt Ordinance No. 2019-13, Amendment regarding the Karen
Sorensen, LE, Jeffrey Jackson, Linaya Sorensen parcel in the Town of Barnes from Residential-
Three (R-3) to Residential-One (R-1). (Less the following parcels listed in the Ordinance.) Motion
carried.
10. Bayfield County Resolution No. 2019-48; Regarding Cervid Study Committee
recommendations and Funding Authorization; Fred Strand, Bayfield County Board Vice-
Chair;
Motion by Strand, Silbert to suspend the rules to allow John Gilbert, a Cervid Committee
Member, to speak. Motion carried.
Cervid Committee Member Gilbert gave information regarding the findings of the Cervid
Committee. The spread could take place through the transport of infected live deer and infected dead
deer. Gilbert recommended remaining vigilant through testing for early detection.
County Administrator Abeles-Allison provided financial information regarding Resolution No.

2019-48. The budget includes approximately $14,000 for a Chronic Wasting Disease (CWD)
Educator position. Several Departments are willing to contribute funds towards the Educator
position. Community financial involvement will be required for the adopt-a-dumpster program.
Cervid Study Committee Chair, Fred Strand, made a statement regarding the continued work by
the Cervid Study Committee. Numerous partners have indicated their interest in helping to
implement the report recommendations this fall and in future years.
WHEREAS, Bayfield County established a Cervid Study Committee in the Summer of 2018 to
examine the impact of communicable diseases on cervids and other animals, humans and soil in
Bayfield County, and;
WHEREAS, the Cervid Study Committee compiled a list of recommendations, which the County
Board forwarded to the Planning and Zoning Committee and Executive Committee for discussion
and action, and:
WHEREAS, after reviewing the recommendations forwarded to them, the Bayfield County
Planning and Zoning Committee recommends that the County Board create and adopt County
Ordinances that would:
• Require all existing captive cervid operations to comply with the States fencing standards
• Require an annual fence inspection of all captive cervid operations, and
• Require all new captive cervid operations to comply with the State fencing standards and
implement one of three additional secondary fencing requirements listed in the Cervid
Report.
WHEREAS, after reviewing the recommendations forwarded to them, the Bayfield County
Planning and Zoning Committee recommends that the County Board create and adopt a County
Ordinance that would require all live cervids imported into the county to:
• Come from a herd enrolled in the State Herd Status Program
• Have a State Certificate of Veterinary Inspection, and
• Come from a location that is not within 10 miles of a known positive CWD detection
within the last 5 years.
WHEREAS, after reviewing the recommendations forwarded to them, the Bayfield County
Planning and Zoning Committee recommends that the County Board create a list of conditions,
including:
• additional various fence and gate requirements
• additional health assurance requirements before any cervid can be moved into the county
• required testing for CWD of all testable captive cervids 12 months or older that are killed
or found dead
• additional requirements for any captive cervid facility that has any cervid that test
positive for CWD
which the Planning and Zoning Committee may require when granting a conditional use permit
(CUP) for the citing of a new captive cervid operation.
WHEREAS, after reviewing the recommendations forwarded to them, the Bayfield County
Executive Committee recommends that the County Board implement recommendations # 1 & 2
of the Cervid Study Committee by:

• Creating a Limited Term or Intern position in the Land Conservation or Extension
Department.
• With the employee/Intern working from about mid-August to about mid-January 2020
• For about 720 hours of time in 2019. Estimated labor cost at $15/hour is about $11,000,
plus expenses of about $3,000 for travel, material, etc., for a total estimated cost of
$14,000.
• And that all possible sources of grants, cost-sharing, donations, etc. be sought and applied
for to reduce the cost to the county.
• And urging all county departments to cooperate and support this effort to keep county
costs to a minimum.
WHEREAS, after reviewing the recommendations forwarded to them, the Bayfield County
Executive Committee recommends that the County Board approve resolutions that request the
Legislature to fund additional CWD research and to enact more stringent regulations to prevent
the spread of CWD in Wisconsin and to share our report with our State Legislators, other counties
in northwest Wisconsin, Red Cliff Tribal Nation and the Great Lakes Indian Fish & Wildlife
Commission.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 30th day of July 2019, hereby approves the recommendations of the Planning and
Zoning Committee and Executive Committee as identified in this resolution.
BE IT FURTHER RESOLVED, that the County Board directs the respective committees to
prepare ordinances and resolutions so noted above and provide actionable items to the County
Board as soon as possible but no later than the end of December 2019.
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors authorize the
use of up to $14,000 of Contingency Funds to hire a limited term intern to design and implement
a CWD Awareness/Education program beginning in August 2019 and that an adjustment be made
to the budget to reflect this. Donated funds may also be received for the Adopt A Dumpster
Program increasing this amount however the total county hard dollar contribution will not exceed
$14,000.

11. Big Top Chautauqua Presentation; Ruth Goetz, Terry Meyer-Matier;
Ruth Goetz and Terrry Meyer-Matier gave updates about the Big Top Chautauqua. There is now a
shell exterior for the tent. There is a possibility of a strategic alliance with Mt. Ashwabay. Big Top
Chautauqua will be relocating their office to the former Northern Edge facility, just South of

Bayfield. Comments were received from County Board Supervisors, regarding the new protective
shell for the tent. Questions were received, including the future for the current Washburn Big Top
Chautauqua Office and tribal representation in the Big Top brochure.
12. Census 2020 Presentation; Dan Foth, Local Government Specialist, UW-Madison;
Dan Foth, Local Government Specialist, provided an overview of the 2020 Census and the impact it
will have on local governments and communities. The Census is done every 10 years and it helps to
allocate funding. There are resources that help interpret the Census data. An example is the website
Get Facts, which can be found at www.getfacts.wisc.edu
April 1st, 2020 is the Census Date. The following year, on April 1st, 2021, the data will reach the
States. The internet response is a predicted change this year. Undercount is a continual issue,
especially in certain communities. Wisconsin had the highest count rate of 82% for the 2010 Census.
There is a current focus on confidentiality for the 2020 Census. Local redistricting might be an
outcome from the 2020 Census. Complete Count Committees (CCCs) are being formed throughout
counties, municipalities, and communities. There is still a need for more staff for the 2020 Census.
Contact information was given for resources regarding Census data. Increasing education about the
Census and its importance is known to increase responses.
13. Bayfield County Resolution No. 2019-49; Creating a Census 2020 Complete Count Committee;
County Administrator’s Office, County Clerk’s Office, Land Records’ Office;
This Resolution would establish a Complete Count Committee. The purpose of the Committee will
be to meet, gather information, and share with communities. The goal is to increase awareness,
educate about the importance and confidentiality, and explain the process of completing the 2020
Census.
To plan and conduct Local Educational Initiatives, Publicity, and Promotional Activities to increase
Community Awareness and Participation in the 2020 Census
WHEREAS, the United States of America has performed a nationwide census every ten years
since 1790, with the last census being in 2010; and
WHEREAS, an accurate census is essential for the allocation of representatives to serve in the
legislative bodies of the U.S. House of Representatives, the Wisconsin State Legislature, and
within Bayfield County voting districts; and
WHEREAS, accurate census information is critical to planning for future growth, development,
and the social needs of Bayfield County; and
WHEREAS, the more informed that residents become about the 2020 census operations, the
better their understanding of the census process becomes, thus increasing their willingness to the
2020 Census; and
WHEREAS, the Census Bureau is not permitted to publicly release responses furnished by any
individual, or on behalf of an individual, or release information to other governmental agencies,
including the Internal Revenue Service, the Immigration and Naturalization Service, law
enforcement agencies or welfare agencies. In addition, per the Federal Cybersecurity
Enhancement Act of 2015, census data is protected from cybersecurity risks through screening of
the systems that transmit this data; and

WHEREAS, the purpose of the Complete Count Committee will be to advise and assist Bayfield
County in obtaining the most accurate and complete population count for Census 2020 by
increasing the number of County responses through a focused, structured neighbor-to-neighbor
program. The committee will also utilize the local knowledge, expertise and influence of each
committee member to design and implement a census awareness campaign targeted to the
Bayfield County community.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Bayfield County,
Wisconsin that:
1. A Census 2020 Complete Count Committee is hereby established to advise and assist Bayfield
County in obtaining the most accurate and complete population count for Census 2020.
2. The Committee shall discuss and formulate strategies and techniques, working with County
staff and census bureau officials, to enhance and increase the response rate to Census 2020. The
Committee shall be responsible for planning and conducting local educational initiatives, and for
preparing of obtaining posters, flyers and handouts for use by the media and others. The
Committee will also prepare materials for public service announcements on radio and social
media.
3. The Committee shall consist of representatives from Bayfield County Economic Development,
Bayfield, Washburn, South Shore and Drummond School Districts, the Bayfield/Ashland Towns
Association, Washburn Business Alliance, Bayfield, Iron River, Washburn and Cable Chambers
of Commerce shall each appoint a member to serve on the Committee.
4. The Committee members shall serve from August 2019 through and including June 2020 at
which time the Committee, having completed its work, shall dissolve, unless extended by the
Board of County Board of Supervisors.
5. Meetings: The Committee shall meet at least every three months (quarterly) but may meet more
often as needed.
Motion by Silbert, Gordon to approve Resolution No. 2019-49, creating a Census 2020 Complete
Count Committee. Motion carried.
14. UW-Extension Annual Report; Mary Pardee, Area Extension Director;
Mary Pardee, Area Extension Director, summarized Extension’s work through their Annual Report
and a PowerPoint. Pardee gave information about the changes within Extension and the highlights
and accomplishments of the Bayfield County Extension staff over the past year. The five main areas
within Extension that were discussed were Community Development, Human Development and
Relationships, Agriculture/Horticulture, 4-H and Youth Development, and the FoodWIse program.
Numerous County Board Supervisors thanked Extension employees for the important work they do
throughout Bayfield County.
Motion by Fickbohm, Crandall to receive and place on file the UW-Extension’s Annual Report.
Motion carried.
15. Bayfield County Resolution No. 2019-50; Amending the 2019 UW-Extension Budget due to a
grant received by 4-H; Mary Pardee, Area Extension Director;

The grant funding was used to purchase canoe equipment for the Potential Adventures program. It
should be able to be used for multiple years. The Extension Committee has reviewed and
recommended approval of this Resolution.
WHEREAS, the Bayfield County UW-Extension Office has received a grant, which will start on
June 13, 2019, from the Washburn Community Education Foundation in the amount of $1,990 for
the program “Potential Adventures Through 4-H.”
WHEREAS, the 2019 Bayfield County UW-Extension 292 budget needs to be amended to reflect
these increases and expenses:
Revenue Accounts to increase for a total of: $ 1,990
# 292-25-48516-001 Potential Adventures Grant Revenue in the amount of: $ 1,990
Disbursement Accounts to increase for a total of: $ 1,990
# 292- 25- 556536- 50340 Operating Supplies in the amount of: $ 1,990
NOW, THEREFORE, BE IT RESOLVED that the Bayfield County Board of Supervisors
assembled this 30th day of July 2019, does hereby amend the 2019 292- UW-Extension budget to
reflect the increase in revenues by $ 1,990 and the increase in expenditures by $ 1,990.

16. Bayfield County Amendatory Ordinance No. 2019-14; Amending Title 10, Chapter 3: All-
Terrain Vehicles and Off-Road Motor Vehicle Operation; Adding 6 Sections to Sec. 10-3-10
Designated Routes; Approximately 9 miles in the Town of Bayfield; .25 miles in the Town of
Bell; Approximately 2.25 miles in the Town of Grand View; and approximately 2 miles in the
Town of Iron River; Paul Johanik, Bayfield County Highway Commissioner;
Please see the below numbers 1-6 for updated mileages for the 6 sections in this Amendatory
Ordinance.
Motion by Gordon, Oswald to suspend the rules and allow Tom Kovachevich to speak. Motion
carried.
Clarification was provided by citizen member Tom Kovachevich to help understand the Town of
Bayfield’s routes of CTH J and CTH I.
The changes would be to add the following 6 routes to Sec. 10-3-10:
1. Town of Bayfield: CTH J (Highway 13 to Highway 12) – 8.24 miles
2. Town of Bayfield: CTH I – .7 miles
3. Town of Bell: CTH C (Big Pine Trail to Siskiwit Lake Road) – .25 miles
4. Town of Grand View: CTH D (Highway 63 to Camp 8 Road) – 3.25 miles
5. Town of Iron River: CTH H (McCarry Lake Road to McCarry Lake Road) – .79 miles
6. Town of Iron River: CTH H (Buskey Bay Drive to Wayside Road) – 1.2 miles

17. Bayfield County Resolution No. 2019-51; Approving the Use of Contingency Funds for Re-
design of Additional Jail Cells;
County Administrator Abeles-Allison gave an overview of the Jail re-design, as well as the
specific plumbing issue which would lead to a $6,000 increase in the current budget amendment:
Resolution No. 2019-51. Comments were received regarding the fees and the re-design. This
Resolution was reviewed and recommended for approval by the Executive Committee and the
Sheriff’s Committee.
WHEREAS, the 2019 budget includes funds for addition of special needs cells in the jail.
WHEREAS, at the June 2019 County Board meeting the scope was modified at the
recommendation of the Sheriff’s Office and Architects.
WHEREAS, both the Executive and Sheriff Committee have recommended inclusion of a
repair/remodel design of two cells with steel doors in order to get firm prices and benefit from a
contractor already mobilized for the larger project.
NOW, THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 30th day of July 2019, do hereby approve the Executive and Sheriff Committee
recommendations to utilize $5,000 from the contingency budget for the re-design of two cells in
the county jail to be included as add-alternatives on the larger re-design project. This is for
design only.
BE IT FURTHER RESOLVED, after further discussion and recommendations, the Bayfield
County Board increased the amount from $5,000 to $11,000.

18. Discussion and Possible Action / Ratification regarding Northern Lights Loan;
The Executive Committee approved a Promissory Note for a temporary loan to Northern Lights in
the amount of $50,000. The amount was repaid in full on July 25th. Corporation Counsel
recommended seeking ratification from the County Board for this loan.
Motion by Crandall, Rondeau to ratify Northern Lights Loan that was approved by Executive

Discussion then took place to give the Executive Committee the authority to approve short-term
loans for Northern Lights for no more than $50,000 for 30 days. If approved, loans will not need to
be ratified by the County Board.
2nd motion: Motion by Rondeau, Gordon to authorize the Executive Committee to approve short-
term loans for Northern Lights for 30 days for no more than the amount of $50,000. Motion
carried.
19. Ratification of County Board Chair State of Emergency Declaration for Pigeon Lake, Town of
Drummond, Bayfield County;
County Board Chair Pocernich signed an Emergency Declaration for Pigeon Lake, in the Town of
Drummond, Bayfield County. Jan Victorson, Emergency Management Director, gave information
about Pigeon Lake. The water level is very high; a solution has not yet been found. Comments
were received about the present conditions and the impact on homes, septic, sewers, wells, and
transportation.
WHEREAS, an ongoing disaster, namely heavy rains commencing on June 15th, 2018 causing
the water table surrounding Pigeon Lake to rise, continuing to impact the Town of DRUMMOND
in Bayfield County; and
WHEREAS, the water table has raised Pigeon Lake more than four feet above the normal high-
water mark, and
WHEREAS, the high water of Pigeon Lake had made County Highway N impassable due to high
water; and
WHEREAS, the County of Bayfield has had to reconstruct County Highway N in several places
on two occasions raising it over 4 feet; and
WHEREAS, the road to the north of Pigeon Lake has portions that are underwater; and
WHEREAS, structures, primary homes and cabins, surrounding Pigeon Lake have been severely
impacted, including some being filled with water since June 2018; and
WHEREAS, no solution has been identified to remediate the Pigeon Lake water level;
NOW, THEREFORE, BE IT RESOLVED, pursuant to State Statute 323.11 and 323.14 (4)(b)
of the Wisconsin State Statutes it is necessary and expedient for the health, safety, welfare and
good order to proclaim that a state of emergency exists in the area surrounding Pigeon Lake.
BE IT FURTHER RESOLVED, that these conditions continue to threaten the transportation
infrastructure, create health hazards due to water in homes, and impact the economics of this area.

Motion by Oswald, Rondeau to ratify the Emergency Declaration for Pigeon Lake, Town of
Drummond, Bayfield County by the County Board Chair. Motion carried.

Budgets are due from Departments on Thursday, August 23rd, 2019. In September, a balanced
budget will be submitted to the Executive Committee.
