The Bayfield County Board of Supervisors meeting was called by Bayfield County Chairman, Dennis M.
Pocernich. A roll call was taken by County Clerk- Scott Fibert, as follows: Steve Sandstrom-present; Mary
Dougherty-present; Larry Fickbohm-present; Charly Ray-present; Jeremy Oswald-present; Jeffrey Silbert-
present; Dennis Pocernich-present; Fred Strand-present; Thomas Snilsberg-present; Marty Milanowski-
present; David Zepczyk-absent; James Crandall-present; Brett Rondeau-present. Total: 12 present, 1 absent.
A quorum was present to conduct business.
The following were also present for today’s meeting: County Administrator- Mark Abeles-Allison, County

3. Pledge of Allegiance; The Pledge of Allegiance was recited by all in attendance.
4. Minutes: Discussion and Possible Action, Minutes from April 21, May 19, May 26 and June 30, 2020
(change Zoning ordinance number from #5 to #8).
Motion by Milanowski, Rondeau to approve minutes from April 21, May 19, May 26, and June 30,
2020 with the change in the ordinance number at the June meeting. Motion carried, 12-0, 1 absent.
5. Public Comment: Shari Eggleson from the League of Woman Voters stressed the importance of
Resolution 2020-65. Ellen LaFors from the Town of Grand View also stressed the importance of fair
district maps which is part of Resolution 2020-65.
6. Public Health Update, COVID-19; Sara Wartman updated the Board with the current state of
COVID-10 in Bayfield County: 18 confirmed, up 5 from 1 week ago, 13 of them recovered, 1 death, 4
active. Monitoring 113 suspect cases. Working closely with other counties on weekly testing events in
the region, will keep social media sites up to date with testing details. Discussion ensued regarding
proper masking requirements.

14. Resolution, No 2020-67, Health Department Budget Amendment Authorizing COVID-19,
Plan/Test/Tracing Grant.
WHEREAS, the Bayfield County Health Department has received a grant in the total amount of
$220,508.00 from the State of Wisconsin, Department of Health Services as part of the “Coronavirus
Aid, Relief, and Economic Security Act” (CARES Act) of 2020. The purpose of this funding is to

support local efforts toward the shared mission of stopping the spread of this virus with the “Box It
In” strategy of Testing, Isolation, Contact Tracing and Quarantine. The Grant breaks down as
follows: Local Testing Coordination $48,400.00; COVID 19 Preparedness Pandemic Planning
$30,000.00; COVID 19 Contact Tracing $129,408.00. Start date of grant is March 1, 2020; Total
award to be expended by December 31, 2020; and
WHEREAS, the 2020 Budget does not contain any projections to account for any revenue or
expenditures for said grant; and
WHEREAS, it is the desire of the Bayfield County Board of Health to accept and expend said grant
in 2020.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of July, 2020, hereby authorizes the use of Revenue Account Number 100-
20-43550-145 and Expense Account Number 100-20-54145 for the Covid 19 Plan/Test/Tracing
Grant; and
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors hereby amends the
2020 budget by $220,508.00 for grant revenue/expenses.

15. Resolution No 2020-68, Health Department Budget Amendment Authorizing ELC CARES COVID19
Grant.
WHEREAS, the Bayfield County Health Department has received a grant in the amount of
$12,700.00 from the State of Wisconsin, Department of Health Services as part of the “Coronavirus
Aid, Relief, and Economic Security Act” (CARES Act) of 2020, the Epidemiology and Laboratory
Capacity for Infectious Diseases (ELC) program awarded Wisconsin funds for COVID-19 response
activities. The intent of this funding is to rapidly establish and monitor key activities related to
COVID-19 in the areas of epidemiology, laboratory and informatics. Start date of grant is February
1, 2020; Total award to be expended by September 30, 2021; and
WHEREAS, the 2020 Budget does not contain any projections to account for any revenue or
expenditures for said grant; and
WHEREAS, it is the desire of the Bayfield County Board of Health to accept and expend said grant
in 2020.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of July, 2020, hereby authorizes the use of Revenue Account Number 100-
20-43550-144 and Expense Account Number 100-20-54144 for the ELC CARES Covid 19 Grant;
and
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors hereby amends the
2020 budget by $12,700.00 for grant revenue/expenses.

7. County Office Candidate Presentations. District Attorney, Register of Deeds, Treasurer,
Clerk: Kim Lawton, Jenna Galligan, Kevin Korpela, Lynn Divine, and Amanda Shuga Metzinger
addressed the board with which positions each was running for, work histories, and educations.
8. Resolution 2020-65: To conduct countywide advisory referendum on creation of
nonpartisan procedure for the preparation of legislative and congressional re-districting
plans and maps. Abeles-Allison explained this resolution and whether or not to allow this issue on a
ballot.
WHEREAS, the Bayfield County Board of Supervisors on October 31, 2017 passed a resolution
calling for nonpartisan legislative and congressional redistricting maps; and
WHEREAS, pursuant to Article IV, Section 3 of the Wisconsin Constitution, the Wisconsin
Legislature is directed to redistrict state legislative districts “according to the number of inhabitants”
at its next session following the decennial federal census. The legislature also reapportions
congressional districts at the same interval pursuant to federal law; and
WHEREAS, there are numerous indicators that the citizens of Wisconsin are concerned about the
practice of redistricting by whichever party holds the majority, because it may stifle political
participation and competition, discourage collaboration and compromise, and lack the fairness
necessary to our democratic process, by undermining the principle of one-person-one vote.
WHEREAS, the current procedure allows the legislature of the majority party to prepare
redistricting plans and maps that may result in unfair partisan plans and maps, allowing the
legislature to choose its voters rather than the voters choosing their representatives, which is
commonly called gerrymandering.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors, in
legal session assembled, does hereby approve that the following question be placed on the
November 3, 2020 ballot as an advisory referendum question:
Question: Should the Wisconsin legislature create a nonpartisan procedure for the preparation of
legislative and congressional district plans and maps?

AND BE IT FURTHER RESOLVED, that the Corporation Counsel prepare a Notice of
Referendum to be published by the Bayfield County Clerk in accordance with statutory
requirements;
AND BE IT FURTHER RESOLVED, that this resolution and the referendum shall be filed with
the Bayfield County Clerk no later than 70 days prior to the November 3, 2020 election at which the
question will appear on the ballot.
AND BE IT FURTHER RESOLVED, that the County Clerk is directed to send results of the
referendum to the Governor of the State of Wisconsin, the Wisconsin Counties Association, the
Wisconsin Towns Association, the Wisconsin League of Municipalities, all members of the State
Legislature, and to each Wisconsin County Board.

FISCAL NOTE: There will be minimal cost to the County depending on the size of the ballot.

9. Bayfield County Resolution No. 2020-66; In Recognition and Appreciation of Donna
Ganson for 26 years of commitment and service in the UW-Extension Office
WHEREAS, Donna Ganson has served Bayfield County with distinction, honor and dedication as a
UW-Extension Educator for 26 years,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of July, 2020, honors Donna Ganson for her 26 years of public service to
Bayfield County and expresses gratitude for her efforts, wishing her well in the years ahead.
A Motion by Fickbohm, Strand to appoint approve Resolution 2020-66. The Motion Carried, 12-, 1
absent. The Board recognized Donna with a standing ovation.
10. UW Madison Extension, 2019 Annual Report
Mary Pardee presented the annual report (via Teams). She reported 2019 participation, partners, and
highlights of the agriculture, 4-H, youth development, individual, family, FoodWIse programs. She
presented funding sources.
A Motion by Silbert, Sandstrom to receive the annual report and place on file. The Motion Carried,
12-0, 1 absent.
Rondeau left the meeting at 7:27 p.m.
11. Annual Report, Bayfield County Clerk of Court, Kay Cederberg
Kay presented the annual report for the County Circuit Court. She presented the budget, caseload,
accounts receivables, history of receivables and the efforts for collecting receivables.
A Motion by Crandall, Fickbohm, to receive the annual report and place on file. The Motion
Carried, 11-0, 2 absent.
12. Report of the Bayfield County Planning and Zoning Committee No. 2020-09; Petition to amend
the Bayfield County Zoning Ordinance regarding the Zoning of Beth Forbord, Frank Stageberg,
Lucy Stageberg, Jane Stageberg, Sally Adams and Anne O’Keefe parcel in the Town of Barnes,
from Residential one (R-1) and Residential three (R-3) to all Residential one (R-1). Robert
Schierman, Planning and Zoning Director.
A Motion by Silbert, Ray, to receive and place on file. The Motion Carried, 11-0, 2 absent.
13. Bayfield County Ordinance No. 2020-09; Amendment regarding the Zoning of Beth Forbord,
Frank Stageberg, Lucy Stageberg, Jane Stageberg, Sally Adams and Anne O’Keefe parcel in the
Town of Barnes from Residential one (R-1) and Residential three (R-3) to all Residential one (R-
1). Robert Schierman, Planning and Zoning Director. Silbert explained the mixed zoning on this
lakefront property. Applicants looking to change zoning to all R-1, consistent with other zoning.
The Bayfield County Board of Supervisors ordains as follows:
That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same, is
hereby amended as follows:
WHEREAS, Wisconsin Statutes §59.69 (5) authorizes the County Board to adopt a zoning ordinance; and
WHEREAS, Wisconsin Statutes §59.69(5)(e) authorizes the County Board to change district boundaries; and

WHEREAS, it is deemed in the best interest of the County of Bayfield that the District Boundaries be further
modified and amended in the manner hereinafter set forth;
NOW, THEREFORE, the Bayfield County Board of Supervisors does hereby ordain as follows:
The Zoning of Stageberg Family Cabin, LLC, owner, Beth Forbord, Frank Stageberg, Lucy Stageberg,
Jane Stageberg, Sally Adams, Anne O’Keefe, agents; located in part of Gov’t Lot 3, of V. 1030 P. 351
(Doc# 2009R-530058), described as follows: Commencing at the Southeast comer of Government Lot Three
(3) and proceeding NOO°00'E, a distance of 298.5 feet to the actual point of beginning; thence NOO°OO’E,
699.5 feet to an iron pipe; thence N88°57'W, a distance of 655.1 feet to an iron pipe on the shore of Upper
Eau Claire Lake; thence in a Southwesterly direction along the shore of Upper Eau Claire Lake a distance of
220 feet plus to a point on the shore of said lake; thence S47°09'E, a distance of 796.5 feet to an iron pipe;
thence S88°57'E, a distance of 224.5 feet to the actual point of beginning, Section 10, Township 44 North,

A Motion by Silbert, Strand, to approve Ordinance 2020-09. The Motion Carried, 11-0, 2 absent.
16. Resolution number 2020-69, Purchase of Land within the Town of Bayfield and Enrollment in
County Forest Law. Jason Bodine (via Teams) explained this parcel of land has a snowmobile
trail/bridge on it. Purchasing this land with the bridge would be cheaper than having to reroute the
bridge onto other land. Funding may come from a snowmobile grant. There is also lumber to harvest.
The Forestry Committee recommended purchasing this parcel.
WHEREAS, Bayfield County manages the third largest County Forest program and one of the
largest state funded snowmobile trail programs in the state of Wisconsin,
WHEREAS, maintaining network connectivity on hundreds of miles of trail and providing
accessibility to most of the major communities in Bayfield County is often a challenge, as land
ownership and objectives change regularly,
WHEREAS, when situated on private land, the trails are at a greater risk of being closed or re-
directed, thus creating additional challenges, as finding suitable, safe and enjoyable alternate routes
can be extremely difficult, impractical, and/or expensive,
WHEREAS, roughly a quarter mile of Snowmobile Trail 1 travels through a 30 acre, privately
owned parcel located in the Town of Bayfield (see Exhibit A), and a snowmobile trail bridge (over
the Sand River) is also located on the property,
WHEREAS, this trail provides a vital connection to the communities of the Bayfield Peninsula,
WHEREAS, no practical alternate route exists, so if a new private landowner does not want the trail
on the property, the cost of relocation (including removing and replacing the bridge) could be
substantially more than the cost of the land,

WHEREAS, though not a long-term sustainable model for the management of the entire program,
but where practical and feasible, land acquisition can be a cost effective means to maintain trail
connections,
WHEREAS, the 30 acre property listed above (further described as the NW NW less North 330’,
Section 16, T50N-R5W, Town of Bayfield) is also located within the County Forest blocking and
adjacent to existing County Forest land,
WHEREAS, acquiring said property would not only secure the snowmobile trail and existing
associated infrastructure (bridge), but it also contains merchantable timber and could become part of
the County Forest program,
WHEREAS, an offer of $15,000 for the acquisition of said property has been accepted by the
current landowner, contingent upon securing full funding and approval by the County Board, while
an additional $775.00 was spent on an appraisal,
WHEREAS, the Forestry and Parks Department has made an application to the DNR Snowmobile
Trail Aid program for funds to assist in the purchase of said property,
WHEREAS, if the application is approved, the County would be required to contribute $4,000
towards the acquisition and the Trail Aids would cover the remaining amount, with the County
portion coming from funds already secured in a non-lapsing Land Acquisition account,
WHEREAS, if the Trail Aids application is not approved, the land could be acquired with funds
received from an in-progress, potential future sale of County Forest land to the Red Cliff Band of
Lake Superior Chippewa,
WHEREAS, during their meetings on April 13, 2020 and July 13, 2020 the Forestry and Parks
Committee unanimously approved the purchase of said property and subsequent entry into County
Forest Law, to be managed as part of the County Forest,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of July, 2020, authorizes the Bayfield County Forestry and Parks
Administrator, on behalf of Bayfield County, to purchase the above listed property with either the
DNR Snowmobile Trail Aids, as described above, or, if the application for DNR aid is not approved,
with funds from the sale of land to Red Cliff, if completed, and subsequent entry of said land into
County Forest Law,
BE IT FURTHER RESOLVED, the following amendments will be made to the 2020 Forestry and
Parks Department Budget:

17. Resolution number 2020-70, Sale of County Forest Land to the Red Cliff Band of Lake Superior
Chippewa and Withdrawal from County Forest Law and Application for a Knowles-Nelson
Stewardship Program County Forest Land Acquisition Grant. Jason Bodine (via Teams) explained
the sale of this 220 acres is located in the reservation and would be sold to Red Cliff. As with any land
purchase/sale involving forestry, the property needs to be withdrawn from County Forest Law and
proceeds will have to be used to purchase County Forest Law land. The Forestry Committee
recommended this sale to Red Cliff.
WHEREAS, Bayfield County received a request to sell approximately 210 acres of County Forest
land to the Red Cliff Band of Lake Superior Chippewa (hereafter, the Tribe) in the Town of Russell,
WHEREAS, County Forest land, described as the following parcels (all located in Section 7, T51N-
R3W, in the Town of Russell), have been identified as the parcels of interest: the SW ¼ located
N/NW of Emil Road and E/NE of Blueberry Road; S ½ NW ¼; and the NW ¼ NW ¼ located West
of Blueberry Road (see Exhibit A),
WHEREAS, Bayfield County and the Tribe ratified a Memorandum of Understanding (hereafter,
MOU) addressing, in part, lands within the reservation,
WHEREAS, one goal of the County Tribal Relations Committee is to facilitate the repatriation of
county owned lands located within the reservation to the Tribe, as per the MOU, while fostering
mutual respect and cooperation,
WHEREAS, as part of any potential land transaction Bayfield County is subject to exercising
reasonable business judgement in the conveyance of real estate,
WHEREAS, during their meetings on February 12, 2018 and July 13, 2020, the Forestry and Parks
Committee approved the Tribe’s land acquisition proposal, for the above described property, in the
amount of $1,500.00 per acre, or $315,000.00 total, and recommended the issue be sent to the
County Board for consideration,
WHEREAS, as part of the Forestry and Parks Committee’s recommendation to sell the land to the
Tribe, all proceeds from the sale are to be reinvested in forest land and made part of the County
Forest,
WHEREAS, the sale of County Forest land currently enrolled in County Forest Law is inconsistent
with the purposes set forth in ss. 28.11, Wisconsin Statutes (County Forest Law),
WHEREAS, any proposal to sell County Forest land will first require filing an application to
withdraw said parcel(s) from County Forest Law,
WHEREAS, the Forestry and Parks Committee has recommended the sale of the above parcel(s),
with all proceeds being reinvested in land that would be enrolled in County Forest Law,
WHEREAS, the Forestry and Parks Committee has also recommended the development of an
application for funding from the Knowles-Nelson Stewardship Program - County Forest Land
Acquisition grant (hereafter, Stewardship) to assist in the replacement of lands that were sold to the
Tribe,
WHEREAS, the funds received from the sale of land to the Tribe would be used as a match in the
Stewardship grant and potentially result in significantly more acreage purchased (than what was sold
to the Tribe),

WHEREAS, the Stewardship grant would be developed to incorporate all proceeds received from
the sale of land to the Tribe as the required match (as per terms of the Stewardship grant), with a
goal of minimizing any additional out of pocket expense to the County,
WHEREAS, as part of the Stewardship grant application, an appraisal is required on all parcels of
land being considered for purchase,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors
assembled this 28th day of July, 2020, authorizes the Bayfield County Forestry and Parks
Administrator, on behalf of Bayfield County, to make an application to the Wisconsin Department of
Natural Resources, pursuant to Section 28.11(11), Wisconsin Statutes, to withdraw the real estate
described above from the provisions of the County Forest Law (Section 28.11, Wisconsin Statutes),
BE IT FURTHER RESOLVED, that, if the application for withdrawal from County Forest Law is
approved by the Wisconsin Department of Natural Resources, the Bayfield County Board of
Supervisors approves the sale of the above described property to the Tribe, in the amount of
$1,500.00 per acre, or $315,000.00 total,
BE IT FURTHER RESOLVED, that all proceeds from the sale of the above described property
must be reinvested in forest land that will be enrolled in County Forest Law and made part of the
County Forest and that the Forestry and Parks Administrator will search for other lands to add to the
County Forest,
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors authorizes the
Forestry and Parks Administrator and County Administrator to act on behalf of Bayfield County to:
submit an application to the State of Wisconsin for land acquisition grant funding; sign and submit
documents; and take all necessary and required action(s) to undertake, direct, and complete an
approved land acquisition project.
BE IT FURTHER RESOLVED, the following amendments will be made to the 2020 Forestry and
Parks Department Budget:
REVENUES: Increase Land Acquisition NL: 430-34-46813 by $315,000.00
EXPENSE: Increase Purchase of Land NL: 430-34-57100-50252 by $4,000.00

18. Bayfield County Ordinance No. 2020-10; Amendment regarding the Transportation of Aquatic
Plants and Animals. Strand explained this was requested by lake owners’ association. The goal is
education.
Chapter 2: Aquatic Invasive Species
Sec. 16-2-1 Purpose.
The purpose of this chapter is to establish a local program to prevent the spread of aquatic invasive
species in Bayfield County.
Sec. 16-2-2 Definition of Aquatic Plants and Animals.

(a) “Aquatic plant” means any nonwoody submergent, emergent, free-floating, or floating-leaf plant
or and includes any part thereof. “Aquatic plant” does not mean wild rice.
(b) “Aquatic animal” means zebra or quagga mussel, or any other aquatic invasive animal restricted
or prohibited by the state.
(c) “Aquatic invasive species” has the meaning given in s. NR 40.02 (3m), Wis. Admin. Code that
aquatic invasive species are any invasive species that dwells in water or wetlands.
(d) “Decontamination” means the process of removing invasive species, including aquatic invasive
species or materials that may contain or transmit any type of invasive species, by disinfection or
other methods.
(e) “Decontamination station” means a device provided at a public or private waterway access to
remove all potential invasive species. The station may consist of high temperature water (140
degrees Fahrenheit or more) applied with a pressure washer by trained personnel, a recommended
chemical solution applied with a low-pressure sprayer, or other techniques.
Sec. 16-2-3 Prohibited Transport of Aquatic Plants and Animals.
(a) No person may transport any watercraft and its associated trailer or boating equipment from
navigable waters onto a public highway if aquatic plants or animals are attached, or to do so in
violation of an order from a law enforcement officer who has reason to believe that aquatic plants or
animals are attached, except as provided in Section 16-2-4.
(b) If a decontamination station is available for use at a public or private access, the boater shall
decontaminate per posted directions and / or inspection protocol using the decontamination station
provided.
(c) This section shall not apply to bait used on that particular waterbody in accordance with
Wisconsin Department of Natural Resources (DNR) rules and regulations.
Sec. 16-2-4 Exceptions to Transport of Aquatic Plants and Animals.
Unless otherwise prohibited by law, a person may transport aquatic plants:
(a) for disposal as part of a harvest or control activity conducted under an aquatic plant management
permit (NR 109).
(b) when transporting commercial aquatic plant harvesting equipment to a suitable location, away
from any water body, for purposes of cleaning any remaining aquatic plants or animals.
(c) when harvested for personal or commercial use, as to be used as compost or mulch, and in a
sealed container.
(d) When conducting an aquatic plant study for the purposes of vouchering specimens or conducting
an educational workshop.
Sec. 16-2-5 Penalties.
Any person who violates a provision of this ordinance shall be subject to a base fine of not less than
$50 for a first offense, not less than $100 for a second offense, and not less than $1,000 for a third
and each subsequent offense. All surcharges, assessments and costs will be added to base fines as
applicable by law.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors,
meeting this 28th day of July, 2020, approve the following amendments to Title 16 of the Bayfield
County Ordinance.
