Fifth Street, PO Box 878, Washburn, WI 54891 Minutes of the: Bayfield County Board of Supervisors’ Meeting November 9th, 2021 6:00 p.m. Meeting Held in the Bayfield County Board Room, Courthouse, Washburn, WI & Remotely The meeting of the Bayfield County Board of Supervisors was called to order at 6:00 p.m. by Bayfield County Chairman Dennis M. Pocernich. A roll call was taken by County Clerk- Lynn Divine, as follows: Mary Dougherty-present virtually; Jeremy Oswald-present; Charly Ray-present; Steve Sandstrom-present; Brett Rondeau-present; Tom Snilsberg-present virtually; Marty Milanowski-present; Fred Strand-present; Jeff Silbert-present; Larry Fickbohm-present; David Zepczyk-present; Jim Crandall-present; Dennis Pocernich-present. Total: 13 present, 0 absent. A quorum was present to conduct business. The following were also present for today’s meeting: County Administrator- Mark Abeles-Allison; County Clerk- Lynn M. Divine; Land Records Administrator- Scott Galetka; Chief Deputy- Andrew Runice; Corporation Counsel-John Carlson virtually; Landmark Conservancy Conservation Manager- Erika Lang; and Clerk III- Paige Terry virtually 3. Pledge of Allegiance: The Pledge of Allegiance was recited by all in attendance. 4. Public Hearing, Bayfield County Final Redistricting Plan: Abeles-Allison reviewed the tentative plan that was previously approved by the County Board. Land Records Administrator, Scott Galetka, reviewed the redistricting process after the tentative plan was sent to the municipalities, explaining that three municipalities needed to approve ward boundaries and others needed to approve boundaries where the municipality would be split between multiple districts. Galetka informed the board that the Town of Drummond suggested some changes be made to the proposed map that would keep all residents in the sanitary district in the same ward to limit the number of ballot styles needed for elections. Abeles-Allison explained that the final map is still in compliance with redistricting statutes. Discussion took place regarding the changes proposed surrounding the Town of Drummond. Motion by Rondeau, seconded by Milanowski to close the public hearing and open up the meeting as a whole. Motion carried, 13-0. 5. Bayfield County Resolution No. 2021-94: Bayfield County Final Supervisory Redistricting Plan WHEREAS, Bayfield County received the population figures for Bayfield County for the State of Wisconsin on August 12, 2021; and, WHEREAS, §59.03(3), (b), of the Wisconsin Statutes states that the creation of supervisory districts shall entail the adoption of a tentative Supervisory District Plan and a Final Supervisory District Plan; and, 2 WHEREAS, a public hearing was held on September 21, 2021 at the Bayfield County Courthouse in Washburn, Wisconsin, to review and adopt the tentative plan; and, WHEREAS, the statutory requirements for creation of a tentative plan have been met by Bayfield County; and, WHEREAS, on October 1, 2021, Bayfield County sent the tentative Supervisory District Plan to all local municipalities in Bayfield County; and, WHEREAS, the municipalities that are to be divided for the purpose of establishing supervisory districts have been notified; and, WHEREAS, those municipalities by State Statute, had sixty (60) days to create such wards for the purpose of redistricting; and, WHEREAS, those municipalities have responded to the County Clerk with resolutions establishing set wards by census block; and, WHEREAS, Bayfield County will hold its final hearing on November 9, 2021, at the Bayfield County Courthouse, Washburn, Wisconsin. NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, adopts said Final Redistricting Plan; and, BE IT FURTHER RESOLVED, that the Bayfield County Board Chairman shall send the Final Redistricting Plan to the Secretary of State and the Legislative Reference Bureau. After discussion and amendment, a motion was made by Rondeau, seconded by Sandstrom to adopt Resolution No. 2021-94 Bayfield County Final Supervisory Redistricting Plan. Motion carried, 13-0. 6. Public Health Update: Abeles-Allison reported that all schools in Bayfield County currently have a high transmission rate. 27 new COVID-19 cases had been reported in children over the past week. The CDC and Health Department are advising sick children to stay home and that school staff and the general public increase efforts to disinfect commonly touched surfaces. ICU bed availability for nearby hospitals is still extremely limited. Abeles-Allison reviewed the number of cases per school district. 7. Public Comment: None. 8. Discussion and Possible Action, Minutes from October 26, 2021: Motion by Milanowski, seconded by Rondeau to approve the Minutes of the Monthly Bayfield County Board of Supervisors Meeting held on October 26, 2021. Motion carried, 13-0. 9. Bayfield County Resolution No. 2021-95: Retirement of John Gary WHEREAS, John Gary has served Bayfield County with distinction, honor and dedication in the Bayfield County Sheriff’s Office for 21 years, 3 NOW, THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, honors John Gary for his 21 years of public service to Bayfield County and expresses gratitude for his efforts, wishing him well in the years ahead. Chief Deputy, Andrew Runice, commended John Gary for his years of service and informed the board that Andrew Mika will be replacing John in the position. Motion by Rondeau, seconded by Crandall to adopt Resolution No. 2021-95 In Recognition and Appreciation of John Gary for 21 Years of Commitment and Service in the Bayfield County Sheriff’s Office. Motion carried, 13-0. 10. Bayfield County Resolution No. 2021-96: In Recognition of Veteran’s Day 2021 WHEREAS, the 11th of November, 2021 is celebrated as Veteran’s Day; and, WHEREAS, the freedoms ensured to our nation’s citizens have been vigilantly maintained for 245 years by our men and women in uniform; and, WHEREAS, we remember the countless sacrifices that our country’s valiant veterans have made throughout our history to not only preserve our liberty and prosperity, but to fight for freedom, liberty, and prosperity for countries around the world; and, WHEREAS, the United States military instills a sense of honor, duty, leadership, commitment and respect, evident in the millions of Veterans who have returned home to their communities as productive citizens, strengthened by their military experiences; and, WHEREAS, we must all strive to ensure that ours remains a land worthy of the boundless devotion our veterans have shown for it. NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November, does hereby recognize and respect the contributions of our veterans to the ideologies of individual freedom, civil liberties, and the preservation of our constitutional republic. Motion by Crandall, seconded by Milanowski to adopt Resolution No. 2021-96 In Recognition of Veteran’s Day 2021. Motion carried, 13-0. 11. Bayfield County Resolution No. 2021-97: Designation of Authorized Depositories in 2022 for Bayfield County WHEREAS, Section 34.05 of the Wisconsin Statutes authorizes counties to invest any of their funds not immediately needed, in time deposits, in banks, or savings and loan associations, in accordance with and subject to the limitations of Wisconsin Statute §66.0603(1m), and also authorizes counties to engage in financial transactions in which the public depository agrees to repay funds advanced to it by the county plus interest, if the agreement is secured by bonds or securities issued or guaranteed as to principal and interest by the Federal Government; and, WHEREAS, it appears to be to the financial benefit of the County and its citizens to invest funds not immediately needed in such deposits and to enter into such financial transactions from time to time. 4 NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors, assembled this 9th day of November 2021, hereby authorizes and directs the Bayfield County Treasurer to invest 2022 County funds, not immediately needed, either in time deposits in accordance with and subject to the limitations of Wisconsin Statute §66.0603, or by entering into financial transactions in which a public depository agrees to repay funds advanced to it by the County plus interest, if the agreement is fully secured by securities issued or guaranteed as to principal and interest by the Federal Government, with any of the following financial institutions, which have been designated as public depositories for Bayfield County: • Bremer Bank & Bremer Trust; • Security State Bank; • Northern State Bank; • Chippewa Valley Bank; and the • Local Government Investment Pool, investing in public instruments as approved by the County Executive Committee in accordance with county and state investment policies and laws; and, BE IT FURTHER RESOLVED, that County funds not so invested shall be deposited in checking or savings accounts at any of the foregoing institutions. Motion by Crandall, seconded by Zepczyk to adopt Resolution No. 2021-97 Designation of Authorized Depositories in 2022 for Bayfield County. Motion carried, 13-0. 12. Bayfield County Resolution No. 2021-98: Holding of Meetings as may be Necessary to Conduct Business in 2022 WHEREAS, Wisconsin Statute §59.13(2)(a) requires counties containing less than 25,000 population limit the number of days for which compensation and mileage may be paid to Committee members to 20 days, not more than 10 of which shall be for services on any one committee, except that the Board may increase the number of committee meetings under par. (b) and similarly fix the compensation of the members for the additional meetings; and, WHEREAS, the committees of the Bayfield County Board of Supervisors are required to conduct business of said Bayfield County, to hold and conduct committee meetings in excess of the number permitted by State Statute §59.13(2)(a); and. WHEREAS, by action of the Bayfield County Board of Supervisors, the number of meetings of said committees beyond the statutory limit may be extended. NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, agree that the committees of the Bayfield County Board of Supervisors be and are hereby authorized to hold such meetings during the year 2022, as may be necessary to conduct the business of said Bayfield County and be compensated for any such meetings. Motion by Crandall, seconded by Rondeau to adopt Resolution No. 2021-98 Holding of Meetings as may be Necessary in 2022. Motion carried, 13-0. 13. Bayfield County Resolution No. 2021-99: 5 Authorization for the County Board Chair, County Clerk, and County Treasurer of the County of Bayfield to Make Short Term Loans WHEREAS, it may be necessary to borrow funds on a short-term basis, in order to meet payrolls and other obligations including current and ordinary expenses within the next year. NOW, THEREFORE, BE IT RESOLVED, by the Bayfield County Board of Supervisors of Bayfield County in annual session, assembled this 9th day of November 2021, directs and authorizes the County Board Chairman of the County of Bayfield, the County Clerk, and the County Treasurer, to borrow funds on a short term basis for 2022, in an amount not to exceed Five Hundred Thousand Dollars ($500,000.00) in aggregate if in their opinion it should be to the County’s best interest to make such loan or loans. Motion by Rondeau, seconded by Sandstrom to adopt Resolution No. 2021-99 Authorization for the County Board Chair, County Clerk, and County Treasurer from Bayfield County to Make Short-Term Loans with the proposed change that the word “Make” in the title be changed to the word “Borrow.” Motion carried, 13-0. 14. Report of the Bayfield County Planning and Zoning Committee No. 2021-13: Motion by Strand, seconded by Rondeau to receive and place on file Report No. 2021-13 Petition to Change District Boundaries of a parcel owned by the Across the Pond Veterans Park, Inc., Town of Hughes, from Forestry-Two (F-2) to Forestry-One (F-1). Motion carried, 13-0. 6 15. Bayfield County Ordinance No. 2021-13: Motion by Zepczyk, seconded by Rondeau to adopt Ordinance No. 2021-13 Petition to Change District Boundaries of a parcel owned by the Across the Pond Veterans Park, Inc., Town of Hughes, from Forestry-Two (F-2) to Forestry-One (F-1). Motion carried, 13-0. 7 16. Report of the Bayfield County Planning and Zoning Committee No. 2021-14: Motion by Strand, seconded by Rondeau to receive and place on file Report No. 2021-14 Petition to Change District Boundaries of a parcel owned by Jerome Tompkins, Town of Hughes, from Forestry-One (F-1) to Residential-One (R-1). Motion carried, 13-0. 8 17. Bayfield County Ordinance No. 2021-14: Motion by Strand, seconded by Zepczyk to adopt Ordinance No. 2021-14 Petition to Change District Boundaries of a parcel owned by Jerome Tompkins, Town of Hughes, from Forestry- One (F-1) to Residential-One (R-1). Motion carried, 13-0. Chairman Pocernich moved ahead to Item 20 on the agenda to allow Erika Lang, Landmark Conservancy Conservation Manager, time to travel to the meeting. 18. Bayfield County Resolution No. 2021-102: To Thank Senator Bewley and Representative Meyers for Their Support for Increased Payments to Towns with County Forest WHEREAS, Towns in Bayfield County have thousands of acres enrolled in County Forest Law; and, 9 WHEREAS, State payments to Towns with County Forest has been $0.30 per acre since 1989; and, WHEREAS, The Wisconsin County Forest Association has advocated for an increase in the payment for many years; and, WHEREAS, Superior Days efforts have advocated for an increase for the past five years; and, WHEREAS, the Wisconsin legislature increased the payment to $0.63 per acre in 2021; and, WHEREAS, as a result, starting in 2022, over $57,000 in additional funds will be distributed to Towns with County Forest lands. NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors, assembled this 9th day of November 2021, extends its sincere appreciation to Representative Meyers, Senator Bewley, the Wisconsin Legislature and Governor Evers for considering and passing this legislation. Discussion took place regarding the impact that payment for county forest lands has on municipalities in the county. Motion by Oswald, seconded by Sandstrom to adopt Resolution No. 2021-102 To Thank Senator Bewley and Representative Meyers for Their Support for Increased Payments to Towns with County Forest. Motion carried, 13-0. 19. Bayfield County Resolution No. 2021-100: Support for Landmark Conservancy’s Telemark Preserve Project WHEREAS, Bayfield County will be contacted by the Wisconsin Department of Natural Resources related to Landmark Conservancy’s grant application to the Knowles-Nelson Stewardship Program for its Telemark Preserve project, inviting Bayfield County to adopt a non-binding resolution of support for the project; and, WHEREAS, this project, if funded, would involve the acquisition of approximately 218 acres (see Exhibit A) adjacent to Randysek Road in the Town of Cable for natural resource protection and public recreational access including hiking, cross-country skiing, hunting, fishing and trapping, and would help create a larger block of undeveloped forest land contiguous to County property; and, WHEREAS, Bayfield County is interested in improving land protection with public access to nearby and/or similar natural areas as supported by Bayfield County’s Comprehensive Land Use Plan and the Bayfield County Forest Comprehensive Land Use Plan, as well as the Town of Cable’s Comprehensive Plan; and, WHEREAS, the Bayfield County Forestry and Parks Committee voted to support this project during their meeting on November 8, 2021; and, WHEREAS, as part of the vote of support, the Forestry and Parks Committee also requested that Landmark Conservancy continue to support maintaining the existing recreation occurring on the property, including, but not limited to, the CAMBA mountain bike trails and the snowmobile trail, once it is acquired. 10 NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, does hereby support Landmark Conservancy’s Telemark Preserve Knowles-Nelson Stewardship project, as described above. Landmark Conservancy Conservation Manager, Erika Lang, spoke on behalf of the two Landmark Conservancy projects. Both projects have received tentative approval by the Wisconsin DNR pending the resolutions of support. The Big Ravine 10 Project is located in the Big Ravine Forest at the headwaters of the Big Ravine in the City of Bayfield. This parcel consists primarily of wetlands and serves to attract many different wildlife species, especially migratory birds. The Telemark Preserve project consists of approximately 218 acres located in the Town of Cable area. The Landmark Conservancy intends to keep the parcel forested to preserve wildlife as well as the Namekagon River. Recreational opportunities will still be available on the property. Lang explained that management of the property will be minimal. Motion by Fickbohm, seconded by Silbert to adopt Resolution No. 2021-100 Support for Landmark Conservancy’s Telemark Preserve Project. Motion carried, 13-0. 20. Bayfield County Resolution No. 2021-101: Support for Landmark Conservancy’s Big Ravine 10 Project WHEREAS, Bayfield County will be contacted by the Wisconsin Department of Natural Resources related to Landmark Conservancy’s grant application to the Knowles-Nelson Stewardship Program for its Big Ravine 10 project in partnership with the Town of Bayfield, inviting Bayfield County to adopt a non-binding resolution of support for the project; and, WHEREAS, if funded, this project would involve the acquisition of approximately 10 acres in the headwaters of the Big Ravine Forest (see Exhibit A) adjacent to Meyers Olson Road, in the Town of Bayfield, for natural resource protection and public recreational access including hiking, cross-country skiing, hunting, fishing and trapping; and, WHEREAS, the property would also support a potential future trail connection between the Big Ravine trail system and Bayfield County’s Fire Hill Forest Preserve, as identified by the Bayfield Area Trails system; and, WHEREAS, Bayfield County is interested in building on land protection efforts and public access to the Big Ravine Forest and other nearby and/or similar natural areas as supported by Bayfield County’s Comprehensive Land Use Plan and the Bayfield County Forest Comprehensive Land Use Plan, as well as the Town of Bayfield’s Comprehensive Plan; and, WHEREAS, the Bayfield County Forestry and Parks Committee voted to support this project during their meeting on November 8, 2021. NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, does hereby support Landmark Conservancy’s Big Ravine 10 Knowles- Nelson Stewardship project, as described above. Motion by Sandstrom, seconded by Strand to adopt Resolution No. 2021-101 Support for Landmark Conservancy’s Big Ravine 10 Project. Motion carried, 13-0. 21. Bayfield County Resolution No. 2021-103: Snowplow Awareness and Operator Appreciation 11 WHEREAS, Bayfield County contains over 2,100 miles of roads; and, WHEREAS, snowplowing is a critical service to ensure that emergency services can safely travel as required, and that citizens are able to access work, school and necessary services; and, WHEREAS, County and Local Roadway maintenance, mechanic and support employees are dedicated to keeping roadways clear at all times of the year, but have additional burdens during the winter season; and, WHEREAS, Bayfield County reminds all persons to: • Be cautious when they encounter snowplows • Limit driving during bad weather to avoid becoming stuck or stalled in their vehicles. • Be aware that Wisconsin state law requires drivers to be at least 200 feet behind a working snowplow. • Please observe the Move Over Law and use caution when passing a working snowplow. They often create a cloud of snow that can obscure a driver's vision. NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, does hereby recognize the importance of the work of County and Local Roadway Maintenance Employees, Mechanics and Support Staff and thanks them for their efforts to keep County and Local Roadways safe during heavy snow events. Motion by Crandall, seconded by Milanowski to adopt Resolution No. 2021-103 Snowplow Awareness and Operator Appreciation. Motion carried, 13-0. 22. Bayfield County Resolution No. 2021-104: Allocation of General Fund, Fund Balance to Pave Gravel Sections of County Highway N Around Pigeon Lake Due to Flooding, #2 WHEREAS, Record rainfalls in 2018 overflowed Pigeon Lake; and, WHEREAS, the Bayfield County Highway Department has raised sections of County Highway N by over four feet over the past three years; and, WHEREAS, the Bayfield County Highway Department must maintain this section of County Highway N on a weekly basis; and, WHEREAS, a temporary overlay will improve rideability and safety for all travelers; and, WHEREAS, on August 31, 2021 the Bayfield County Board of Supervisors approved a budget amendment allocating up to $80,000 in General Fund Balances to be used to complete the initial paving of County Highway N; and, WHEREAS, total costs for the project came in $14,050.75 higher than originally estimated; and, WHEREAS, an additional budget amendment is required to allocate the remaining costs. NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, does hereby allocate up to $14,050.75 in General Fund Balances for an initial paving of County Highway N in the Fall of 2021. 12 Increase Revenues: 100-00-49301 by $14,051 710-71-49201 by $14,051 Increase Expenditures: 100-00-59710-50998 by $14,051 710-71-53311-50375 by $14,051 Motion by Rondeau, seconded by Sandstrom to adopt Resolution No. 2021-104 Allocation of General Fund, Fund Balance to Pave Gravel Sections of County Highway N Around Pigeon Lake Due to Flooding, #2. Roll Call Vote: Rondeau-yes; Silbert-yes; Oswald-yes; Ray-yes; Fickbohm-yes; Dougherty-yes; Sandstrom-yes; Strand-yes; Snilsberg-yes; Milanowski-yes; Zepczyk-yes; Crandall-yes; Pocernich-yes. Motion carried, 13-0. 23. Bayfield County Resolution No. 2021-105: Correction to Bayfield County Resolution No. 2021-90 – Bridge Aid Allotment Resolution to the Town of Lincoln for 2016 Flood Damage and Budget Amendment WHEREAS, On October 26, 2021, Resolution No. 2021 – 90 - Bridge Aid Allotment Resolution to the Town of Lincoln for 2016 Flood Damage and Budget Amendment, was adopted by the Bayfield County Board of Supervisors; and, WHEREAS, after adoption of said Resolution No. 2021-90, it was discovered that a typographical error was contained in the document referring to budget year 2022 when it should accurately be referred to as budget year 2021. NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 9th day of November 2021, approves the budget year for Resolution No. 2021-90 - Bridge Aid Allotment Resolution to the Town of Lincoln for 2016 Flood Damage and Budget Amendment, is corrected to 2021 BE IT FURTHER RESOLVED, that the 2021 budget is modified as follows: Increase Expenditures: 100-00-53319-50790 by $19,606 Increase Fund Balance: 100-00-49301 by $19,606 Motion by Strand, seconded by Crandall to adopt Resolution No. 2021-105 Correction to Bayfield County Resolution No. 2021-90 – Bridge Aid Allotment Resolution to the Town of Lincoln for 2016 Flood Damage Budget Amendment. Motion carried, 13-0. 24. Bayfield County Resolution No. 2021-106: To Authorize Northern Lights to Proceed with Solar Infrastructure WHEREAS, Bayfield County is the owner of the Northern Lights Health Services facility and leases the building to Northern Lights; and, WHEREAS, Northern Lights is investigating solar installation on the roof of the facility; and, WHEREAS, Northern Lights plans to hire an engineer to verify the building structural integrity; and, 13 WHEREAS, Northern Lights understands that they are responsible for roof maintenance as part of the lease agreement and that any roof modifications will be Northern Lights’ responsibility. NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors, assembled this 9th day of November 2021, approves this facility modification provided engineering approval is received. NOW, THEREFORE, BE IT FURTHER RESOLVED, If the project proceeds the County and Northern Lights Services will execute a Memorandum of Understanding regarding the project. Discussion took place regarding the cost effectiveness of the project and potential financial responsibility of the project. Multiple board members expressed concern regarding the viability and financial responsibility of the project. Motion by Sandstrom, seconded by Silbert to adopt Resolution No. 2021-106 To Authorize Northern Lights to Proceed with Solar Infrastructure with the correction that the phrase “, to be approved by the County Board” be added to the end of Now Therefore Be It Resolved clause in the resolution. Motion carried, 13-0. 25. Reports; a) Future County Board Meeting Dates: a. December – To Be Decided as Necessary b. January 25, 2022 c. February 22, 2022 b) Elections Update: Divine reported that the Type A notices for the Spring Election will be published in the Daily Press on November 23, 2021. The Clerk’s Office has begun receiving election notices from a few school districts. Divine informed the board that all of the election equipment has been ordered and is expected to be delivered by January 10, 2022. The following Thursday, after receiving the election equipment, all of the municipal clerks and their chief inspectors will come to the courthouse to be trained on the new equipment. Divine asked that the board supervisors turn in all mileage and per diem sheets to make sure the payroll office receives them before the end of the year. c) HowAreWe? Survey: Abeles-Allison reported that Bayfield County is cooperating with the Wisconsin Development Corporation to put out a HowAreWe? Survey. The survey focuses on socioeconomical aspects of living in Bayfield County. The survey can be accessed at www.howarewe.org. d) County Highway Paving Projects: Abeles-Allison reported that the repair work to County Highway M is nearly complete. 26. Supervisors’ Reports: Strand reported that the semi-annual timber sale has been approved to begin and 25 timber sales have been authorized for a little over $1.3 million. Prices and revenue for timber are down due to a decrease in demand. The two timber sales for 2021 would total an estimated $3 million. Estimated timber sale revenues are to average $3 million every year, which will be down from previous years. Abeles-Allison reported that the President and Congress approved a new $1 trillion stimulus bill. Funds from the bill will be distributed for infrastructure improvements. Fickbohm reported that repairs to the fairgrounds arena is at a standstill as multiple contractors have been contacted, but no progress has been made. Fickbohm stated that Highway Commissioner Bob Anderson has taken the time and initiative to look at alternatives to repairing the arena, but repairs will not happen this year. 14 27. The Board may entertain a motion to move in and out of Closed Session pursuant to §19.85(1) (c) to consider the employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility ,(e) to deliberate or negotiate the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, and (g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved.
