Minutes of the
Bayfield County
Development and Land Sales Committee
January 21, 2013
Bayfield County Emergency Operations Center-Bayfield County Annex Building
Washburn, WI
1. The meeting was called to order by Acting Chairman Shawn Miller at
4:00 p.m.
Members present were Harold Maki, Shawn Miller, Brett Rondeau, & Dennis Pocernich
Absent was Rusty Williams.
Also present were Mark Ables-Allison, Bayfield County Administrator; Scott Galetka,
Bayfield County Land Records Administrator; Lynn Divine, Bayfield County Real
Property Lister, Perri Shuga, Bayfield County Tax Deed Clerk, Scottie Sandstrom,
Executive Director of the Bayfield County Economic Development Corporation, Boyd
Carlson, Vickie Richardson, and Board Member Kenneth Jardine arrived at 4:26 p.m.
2.Election of Officers. Pocernich nominated Miller for the position of Chairman.
Motion by Rondeau to close nominations and cast a unanimous ballot for Miller.
Seconded by Pocernich. Motion carried. Rondeau nominated Pocernich for Vice
Chairman. Motion by Miller to close nominations and cast a unanimous ballot for
Pocernich. Seconded by Rondeau . Motion carried..
3.Motion regarding the minutes of the March 27, 2012 Meeting. A motion
was made by Rondeau and seconded by Pocernich to approve the minutes as
presented. Motion carried.
4.Discussion and Possible Action Regarding a Property Concern; Boyd
Carlson. This issue stems from a parcel purchased at the 1989 Land Auction in the
Town of Hughes. The parcel was advertised and sold as a ten acre parcel, but the
description was erroneous and the parcel actually has only 2.9 acres. In addition a
building placed there by Mr. Carlson is not in fact on his property. Mr. Carlson
submitted a letter requesting the county do one the following: 1) procure for him
from neighboring parcels the land he thought was his; or, 2) refund his money
invested including all taxes, or, 3) provide another parcel to replace this parcel.
After much discussion, motion by Rondeau, seconded by Miller to deny the request
as invalid due to the legal confines the Quit Claim Deed process offers by statute on
all county land sales. This motion was denied. After more discussion it was referred
back to the County Administrator and Land Records Department in order to find a
solution acceptable to both the Committee and Mr. Carlson.

These parcels were taken In Rem in December of 2011 and 2012. Motion by Rondeau
seconded by Maki authorizing the Land Records to send the parcels for abstracting and
begin preparation for sale in the summer and/or fall of 2013. Motion carried.

6.Discussion and Possible Action Regarding Policy of Special Assessments
on parcels with delinquent taxes taken In Rem. The County has been
required to foreclose on several parcels recently with large municipal special
assessments affixed to them. Subsequently, the potential exists that will put the
county in the “red” when selling the parcels in order to get them back on the tax roll.
Information was presented that was obtained from the Winnebago County
Treasurer’s office that outlined a “Gentlemen’s Agreement” for sharing costs with the
charging municipality. It was noted that no legal basis for refusing the parcels on the
foundation of high special assessments has been uncovered in the statues. It was
the consensus of the Committee that land records staff should research the matter
further in order to find a solution.
7.Discussion and Possible Action Regarding Sale of Land in the Town of
Bayfield adjacent to County J as approved by the Highway Committee.
This item involves a parcel of land at the intersection of Torbick Road and Co
Highway J and has been made by Curtis and Lisa Johnson through their Attorney,
William D. Bussey. Motion by Maki to approve the request as long as the Johnsons
pay all costs involved with the transaction. Seconded by Rondeau. Motion carried.
8. Motion by Rondeau and seconded by Pocernich to move into
Executive Session pursuant to Wisconsin Statutes 19.85 (1) (e) for the
purpose of deliberating or negotiating the purchase or sale of public
properties. Motion carried at 5:06 p.m. Motion by Pocernich seconded
by Rondeau to adjourn from Executive Session. Motion carried at 5:44
p.m.
7. Meeting adjourned at 5:46 p.m.
