Fifth Street, PO Box 878, Washburn, WI 54891 Minutes of the: Bayfield County Board of Supervisors’ Meeting August 30, 2022 6:00 p.m. Meeting Held in the Bayfield County Board Room, Courthouse, Washburn, WI The meeting of the Bayfield County Board of Supervisors was called to order at 6:01 p.m. by Bayfield County Chairman Dennis M. Pocernich. A roll call was taken by County Clerk- Lynn Divine, as follows: Steve Sandstrom-present; Mary Dougherty-present; Larry Fickbohm-absent (excused); Charly Ray-present; Jeremy Oswald-present; Jeff Silbert-present; Fred Strand-present; John Rautio-present; Marty Milanowski- present; Madelaine Rekemeyer-present; Jim Crandall-present; Brett Rondeau-absent; Dennis Pocernich- present. Total: 11 present, 2 absent. A quorum was present to conduct business. The following were also present for today’s meeting: Human Resources Director- Kris Kavajecz; County Clerk- Lynn M. Divine; Tourism Director- Mary Motiff; Fair Coordinator- David Eades; UW Extension Area Director- Mary Pardee; Public Service Commission Chairperson- Rebecca Valcq; CheqBay Renewables President- Bill Bailey; Norvado CEO- Chad Young; Bayfield Wireless CEO- Mike Cariveau; UW Extension Justice Involved Families’ Specialist- Liz Lexau; Trails North ATV Club President- Jim Bender; and Clerk III- Paige Terry. 3. Pledge of Allegiance: The Pledge of Allegiance was recited by all in attendance. 4. Wisconsin Public Service Commission Presentation, Bill Bailey, CheqBay Renewables, Chad Young, Norvado and Mike Cariveau, Bayfield Wireless and PSC Chairperson Rebecca Cameron Valcq: Bill Bailey, CheqBay Renewables President, delivered a presentation regarding the renewable energy projects that have been completed by Bayfield County. Bailey gave an update on the Northern Lights Services solar project that is underway and stated that the projects has surpassed a $23,000 value in donated solar panels. Bailey commended Northern Lights CEO, Pauline Darling, for her support of the project. Chad young, Norvado CEO, gave a summary of Norvado’s service area and available services. Young reported that the entire Norvado network will be fiber-to-home by the end of the year and spoke about future projects that Norvado is anticipating. Mike Cariveau, Bayfield Wireless CEO, gave a brief history of Bayfield Wireless. Human Resources Director, Kristine Kavajecz, thanked the presenters and introduced Public Service Commission Chairperson, Rebecca Valcq to the board. Valcq reviewed the responsibilities and roles of the Public Service Commission as well as her role as Chairperson. The three goals for 2022 of the Public Service Commission are: to continue to close the digital divide; to build a roadmap for a responsible and cost-effective transition to zero carbon by 2050; and to center the PSC’s actions and decisions on inclusion, diversity, equity, and affordability. Valcq talked about all the projects being undertaken to meet the three goals and funding options that are available for entities looking to pursue renewable energy and broadband expansion. Sandstrom questioned what plans the PSC has for moving renewable energy from where it is produced to where it is needed. Valcq explained the PSC’s process for reviewing transmission plans and goals for transmitting energy throughout the state. Silbert thanked Valcq for visiting. Oswald asked Valcq if it would be best for a private industry to reach out to local government to assist with contacting the PSC or to reach out to the PSC directly. Valcq replied that it is always best to start local. 2 5. Public Comment: Jim Bender, Trails North ATV Club President, spoke on behalf of Item 11 on the agenda and informed the board that the Club has opened two sections of highway to add two new ATV routes. Bender explained that the Club is dedicated to the safety of the sport and the club will drive a proposed route to ensure its safety and encouraged the board to approve Item 11. 6. Discussion and Possible Action, Minutes from July 26, 2022: Motion by Milanowski, seconded by Sandstrom to approve the Minutes of the Monthly Bayfield County Board of Supervisors Meeting held on July 26, 2022. Motion carried, 11-0, 2 absent. 7. Bayfield County Resolution No. 2022-86: Bayfield County 2022 Fair Recognition and Proclamation WHEREAS, the County Fair celebrates Bayfield County, its people and culture; and, WHEREAS, People of all ages participate in the Fair, from the very young exhibiting their projects, to the superintendents with years of experience; and, WHEREAS, Any resident of the State of Wisconsin can enter items for judging at the Bayfield County Fair; and, WHEREAS, the Fair attracts and involves a diverse group of participants ranging from the members of the county’s 4H clubs, implement dealers, Tuff Truck racers, Dirt Dash organizers and participants, youth pedal tractor pull contestants, 3 on 3 basketball teams, volunteers, and sponsors; and, WHEREAS, Holding a county fair is a major event requiring a full year of planning, coordinating, organizing and promoting; and, WHEREAS, the Bayfield County Fair has a major impact on the Town of Iron River and the Fair’s success would be impossible without the help of the Town, Fire Department, Emergency Medical Services and the whole Community; and, WHEREAS, the Bayfield County Fair Committee and staff worked tirelessly in 2022 to prepare for this year’s event; and, WHEREAS, In addition to normal events and activities, the 2022 Fair had major staffing changes, from the fairgrounds Caretaker and maintenance staff to the Fair Coordinator; and, WHEREAS, As Director of the Tourism Department, Mary Motiff has led the Fair effort for twelve years now with a team that this year included: David Eades, Molly McCool, Ursula Garrison, McKenzie Tuura, Harvey Anderson, John Kurak, and Steve Marefka, along with Jessica Soulier from DHS, staff from the Highway Department, dozens of volunteers and temporary staff; NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, do hereby recognize the Bayfield County Fair Committee members Chair Larry Fickbohm, Vice Chair Steve Sandstrom, Jim Crandall, Jeremy Oswald, John Rautio AND the Bayfield County Fair Staff; and, 3 BE IT FURTHER RESOLVED, that in anticipation of the 2023 Bayfield County Fair, the Bayfield County Board of Supervisors, do hereby Proclaim the month of June 2023 as Fair Engagement Month in Bayfield County. Tourism Director, Mary Motiff, reviewed a summary of the fair’s revenue numbers compared to previous years and gave a brief overview of the fair. Motiff presented a trophy to Jim Crandall for his efforts and contributions to the fair. Pocernich suggested that Ursula Garrison’s name be added to the resolution. Motion by Crandall, seconded by Milanowski to adopt Resolution No. 2022-86 Bayfield County 2022 Fair Recognition and Proclamation with the correction to add former fair coordinator Ursula Garrison to the resolution. Motion carried, 11-0, 2 absent. 8. Bayfield County Resolution No. 2022-87: Appreciation for Elizabeth “Liz” Lexau and Her Service to Bayfield County Through Extension Education WHEREAS, Liz Lexau has served Bayfield County with honor and dedication as an Extension Educator for 13 years; and, WHEREAS, Liz has provided high quality and significant programming through collaboration and partnerships with local agencies and organizations; and, WHEREAS, Liz’s work has directly impacted the issues faced by citizens of Bayfield County and the Red Cliff Band of Lake Superior Chippewa; and, WHEREAS, Liz found innovative ways to reach underserved audiences through the development of programs such as Parents Connect, Money Matters, and Literacy Link; and, WHEREAS, Liz’s educational efforts around family resilience, parenting, financial capability and reducing the damaging effects of Adverse Childhood Experiences (ACEs) for children has helped families deal with problems associated with addiction and incarceration; and, WHEREAS, Liz has excelled in Extension education and outreach at the local, regional and state levels, while upholding the highest standards of collegiality and professionalism. NOW, THEREFORE, BE IT RESOLVED that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, honors Elizabeth Lexau for her years of public service to Bayfield County and expresses gratitude for her efforts, wishing her well in the years ahead. UW Extension Area Director, Mary Pardee, read Resolution No. 2022-87. Liz Lexau spoke favorably of her years with Bayfield County. Motion by Silbert, seconded by Rekemeyer to adopt Resolution No. 2022-87 In Recognition and Appreciation of Liz Lexau. Motion carried, 11-0, 2 absent. 9. Bayfield County Resolution No. 2022-88: In Appreciation of Verne Gilles 4 WHEREAS, for 73 years, Verne Gilles was a 4-H member and 4-H volunteer whose leadership and endless enthusiasm at the local and state level influenced countless youth in Bayfield County and across the State of Wisconsin; and, WHEREAS, Verne organized and led the Woodland Workers 4-H Club, was active in the Bayfield County 4-H Leaders Association, Wisconsin State 4-H Leader Council, State Plant Science Program Committee, 4-H Policy Committee and teams that developed resources for 4-H volunteers statewide; and, WHEREAS, during his 30-year career with the United States General Accounting Office, Verne returned to Bayfield County every summer to serve as the livestock superintendent at the Bayfield County Fair; and, WHEREAS, Verne Gilles passed away, at the age of 84, on August 5, 2022. His remarkable character, warm and engaging personality and positive attitude will be deeply missed by many whose lives he touched over the years; NOW, THEREFORE, BE IT RESOLVED that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, honors the life and memory of Verne Gilles for his many years of service to the people and communities of Bayfield County. Motiff, spoke in honor of Verne Gilles and his work and dedication to the Bayfield County Fair. Motion by Crandall, seconded by Milanowski to adopt Resolution No. 2022-88 In Recognition of Verne Gilles. Motion carried, 11-0, 2 absent. 10. Bayfield County Resolution No. 2022-89: Bayfield County Celebrates National Preparedness Month September 2022 WHEREAS, Bayfield County’s participation in the September 2022 National Preparedness Month activities creates an important opportunity for residents of Bayfield County to be prepared for natural and other disaster emergencies where they live, work, and play; and, WHEREAS, taking steps toward personal preparedness and ensuring that our households, workplaces, schools, institutions of higher learning, houses of worship, and community-based organizations are prepared for natural and other disasters can reduce fatalities and economic devastation following a major crisis; and, WHEREAS, participating in the September National Preparedness Month’s activities will increase the number of citizens who understand which natural and other disasters could happen in our community; and, WHEREAS, our citizens will learn what to do to be safe and mitigate damages; and, WHEREAS, the citizens of Bayfield County learn how to take action to increase their preparedness; and, WHEREAS, other federal, state, local, tribal, territorial, private, and volunteer agencies are working to increase public activities in preparing for natural disaster emergencies and to encourage individuals to act; and, 5 WHEREAS, emergency preparedness is the responsibility of every citizen of the County and all citizens are urged to make preparedness a priority and work together to ensure that individuals, families, and communities are prepared for disasters and natural disaster emergencies of any type; and, WHEREAS, the Federal Emergency Management Agency (FEMA)’s annual September National Preparedness Month’s activities will ensure that our community becomes a leader in preparedness and contributes to our nation’s resilience. NOW, THEREFORE, BE IT RESOLVED that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, does hereby proclaim the month of September 2022 as National Preparedness Month in Bayfield County. Motion by Oswald, seconded by Ray to adopt Resolution No. 2022-89 Bayfield County Celebrates National Preparedness Month, September 2022. Motion carried, 11-0, 2 absent. 11. Bayfield County Amendatory Ordinance No. 2022-09: To Add 2 Routes to the All-Terrain Vehicles Designated Route in the Bayfield County Code of Ordinances, Title 10 – Chapter 3 Title 10, Chapter 3, Motor Vehicles & Traffic Chapter 3: All-Terrain Vehicles and Off-Road Motor Vehicle Operation Sec. 10-3-1 State All-Terrain Vehicle Laws Adopted. The provisions describing and defining regulations with respect to all-terrain vehicles in §23.33, Wis. Stats., and any future amendments or revisions, are hereby adopted by reference and made part of this Section as if fully set forth therein. Sec. 10-3-2 Purpose. Taking consideration of the economical and recreational value weighted against possible dangers, liability aspects, terrain involved, traffic density and public health, this ordinance has been created to designate certain all-terrain vehicle routes on portions of existing county highways, to identify the procedure for establishment of additional all-terrain vehicle routes in the county, to set forth conditions of operation of all-terrain vehicles on the county trunk highway system and signage, suspension and revocation of all-terrain vehicle routes, and to specify penalties for violation of this ordinance. Sec. 10-3-3 Authority. This ordinance is enacted pursuant to County Board authority under Wis. Stat. 59.02, as authorized by 23.33 (11)(am) and 23.33 (8)(b). Sec. 10-3-4 Establishment of ATV Routes. County Trunk Highways designated as ATV routes shall be established and approved by the Bayfield County Board upon recommendation by the Highway Committee. The Highway Committee shall develop policies and procedures for the designation of ATV routes including appropriate criteria for making a designation. 6 Sec. 10-3-5 Operation of All-Terrain Vehicles on the County Trunk Highway System (a) All ATV’s shall operate only on the extreme right side of the paved portion of the roadway. Operation of an ATV on the shoulder, ditch or right-of-way is prohibited and illegal. (b) All ATV operators shall observe and obey posted speed limits. The speed limit for ATVs traveling on designated routes is 40 mph unless otherwise posted. (c) All ATV operators shall ride in single file. (d) ATV operators shall yield the right-of-way to other vehicular traffic and pedestrians. (e) All ATV operators shall have their headlight and taillight illuminated at all times while operating on a county highway. (f) All persons under the age of 18 must wear a helmet when operating or riding an ATV. (g) All ATV operators will be in compliance with Statutory Regulations. (h) All ATV operators assume all the usual and normal risks of ATV operation while on the approved County Highway route(s). Sec. 10-3-6 Signage of ATV Routes. Any ATV signage on County Trunk Highway right-of-way will be installed by the Bayfield County Highway Department which shall be reimbursed for time and materials by the Route Sponsor. All signage will be in accordance with Wisconsin Administrative Code NR 64.12 (7). Any removal, damage, defacing, moving, or obstructing of signage is illegal and prohibited. Sec. 10-3-7 Enforcement. This ordinance shall be enforced by the Bayfield County Sheriff’s Department or any other law enforcement official as set forth in Wis. Statute 23.33(12). Sec. 10-3-8 Violations. (a) Wisconsin state All-Terrain Vehicle penalties as found in s. 23.33 (13) (a) Wis. Stats., are adopted by reference. (b) Forfeiture: The penalty for violation of any provision of this Chapter shall be a forfeiture, in accordance with Title 1, Chapter 2 of the Bayfield County Code of Ordinances, together with the court costs and fees and the applicable penalty assessment. Forfeiture for violation of any ATV regulation(s) set forth in the Wisconsin Statutes adopted by reference in this Chapter shall conform to the forfeiture penalty permitted to be imposed under the applicable statute(s). Sec. 10-3-9 Maintenance. Approval of highway segments as ATV routes does not imply that additional maintenance will be provided by the Bayfield County Highway Department. These segments will be maintained like any other segment of County Highway, and Bayfield County makes no representation as to their condition or fitness for ATV use. Sec. 10-3-10 Designated Routes. CTH A (Summit Street in the Town of Iron River south to Kolling Road) – 2.1 miles Sec. 10-3-11 Suspension and Revocation of Route (a) The Bayfield County Highway Commissioner shall have the authority to suspend operation of any ATV route for up to ninety (90) days due to hazard, construction or emergency conditions in any highway segment listed as a designated route. Any ATV route may be revoked at any time by the Bayfield County Highway Commissioner. At the next Bayfield County Highway Committee meeting following the revocation, the committee shall take action to either uphold the revocation or overturn it. Crandall reviewed the request to add two additional ATV routes. Silbert questioned why one of the suggested routes appears to be longer than usual. Crandall deferred to Bender, who explained that an ATV route currently exists from CTH H to CTH E and connects to Ino, but there is no route to connect to Mason and the longer route would connect Mason. Discussion took place regarding the Highway Committee’s process for evaluating suggested routes. Motion by Crandall, seconded by Sandstrom to adopt Amendatory Ordinance No. 2022-09 To Add 2 Routes to the All-Terrain Vehicles Designated Routes in the Bayfield County Code of Ordinances, Title 10 – Chapter 3. Motion carried, 11-0, 2 absent. 12. Bayfield County Resolution No. 2022-90: Request to Amend the 2022 UW-Extension Budget WHEREAS, a contract has been made between the State of Wisconsin Department of Agriculture, Trade and Consumer Protection and the University of Wisconsin-Madison and the University of Wisconsin-Madison, Division of Extension Bayfield County Office (as a contractor), for a USDA Agricultural Marketing Service’s Specialty Crop Block Grant CDFA#10.170 Award #21SCBWI1051- 00 “Establishing Table Grape Performance Trials in Wisconsin” over the 2022 and 2023 fiscal years for a total of $6,455.00; and, WHEREAS, the 2022 University of Wisconsin-Madison, Division of Extension Bayfield County budget needs to be amended to reflect these increases in revenues and expenses: Increase Revenue: Table Grape Grant 292-25-43261 by $5,646.00 Total Revenue: $5,646.00 9 Increase Expenditures: Mileage 292-25-55658-50322 by $ 610.00 Operating Supplies 292-25-55658-50340 by $5,036.00 Total Expenditures: $5,646.00 NOW, THEREFORE, BE IT RESOLVED that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, does hereby amend the 2022 UW-Extension budget to reflect the increase in revenues by $5,646.00 and the increase in expenditures by $5,646.00. Pardee explained that UW Extension will be receiving additional money for the 2022 budget year as part of a table grape grant. Motion by Oswald, seconded by Rautio to adopt Resolution No. 2022-90 Request to Amend the 2022 UW Extension Budget. Bayfield County Resolution No. 2022-91: Request to Amend the Bayfield County Land & Water Conservation 2022 Budget WHEREAS, the Bayfield County Land and Water Conservation Department requests that their 2022 budget be amended as follows to reflect grant funding modifications; and, WHEREAS, the Land & Water Conservation was awarded additional grant dollars in the GLRI Boat Washer Grant (NWCMA) grant and in the DNR-WMA Grant (NCWMA) after the 2022 budget was submitted; NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, approves the following budget amendments to reflect modifications to the grant, cost-share and/or cooperative agreements: Increase Revenues: (GLRI-Boat Washer Grant) 100-28-43273-003 by $ 14,383 (DNR-WMA Grant) 100-28-43590-103 by $ 8,500 Total Revenue: $ 22,883 Increase Expenses: (GLRI-Boat Washer Grant) 100-28-56102-50290 by $ 14,383 (DNR-WMA Grant) 100-28-56139-50290 by $ 8,500 Total Expenses: $ 22,883 Motion by Ray, seconded by Strand to adopt Resolution No. 2022-91 Request to Amend the Bayfield County Land & Water Conservation 2022 Budget. Bayfield County Resolution No. 2022-92: 10 DNR Lake Monitoring & Protection Network Grant Bayfield County Aquatic Invasive Species Project 2023 WHEREAS, Bayfield County is committed to provide high quality water resources for use by the public for recreation and enjoyment of natural beauty; and, WHEREAS, Bayfield County is presently implementing the Bayfield County Aquatic Invasive Species Strategic Plan, revised and adopted in November 2016, to protect all water resources in the county from introductions of aquatic invasive species, to control those aquatic invasive species populations that exist, and to help safeguard water quality, wildlife habitat, property values and the tourism industry; and, WHEREAS, we recognize some activities of the plan need to be altered to strengthen the overall prevention and containment strategies, and improve the risk assessment of AIS in the majority of high use water bodies in the county; and, WHEREAS, we are committed, experienced, networked, and qualified to carry out the responsibilities of a lake monitoring & protection network grant; NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, requests grant funding and assistance available from the Wisconsin Department of Natural Resources under the “Lake Monitoring & Protection Network” and hereby authorizes the County Conservationist, Land and Water Conservation Department, to act on behalf of Bayfield County to: • submit an application to the State of Wisconsin for financial aid for lake monitoring and protection purposes; and • sign documents; and • take necessary action to undertake, direct, and complete an approved lake monitoring and protection network grant; and • submit reimbursement claims along with necessary supporting documentation within three months of project completion date; and, BE IT FURTHER RESOLVED THAT Bayfield County will meet the obligations of the lake monitoring and protection network project including timely publication of the results and meet the financial obligations of a lake monitoring and protection grant. Motion by Ray, seconded by Rautio to adopt Resolution No. 2022-92 DNR Lake Monitoring & Protection Network Grant Bayfield County Aquatic Invasive Species Project 2023. Bayfield County Resolution No. 2022-93: Bayfield County Refueling Readiness Budget Amendment for the Bayfield County Highway Garage in Washburn WHEREAS, Bayfield County applied for and received a refueling readiness grant for a backup generator at the Bayfield County Highway Garage; and, WHEREAS, this project will improve resilience of the Bayfield County Highway Department in the event of a power outage; and, 11 WHEREAS, this project will also project backup fueling assistance to other emergency service providers as needed in the event of an extended power outage; and, WHEREAS, $40,000 was budgeted in 2022 for this project; and, WHEREAS, Grant funds will pay for two thirds of the cost of the installation. NOW, THEREFORE, BE IT RESOLVED that the Bayfield County Board of Supervisors assembled this 30th day of August 2022, does hereby approve the following budget amendments: Increase Revenues 430-00-43510-001: $37,500 Increases Expenses: 430-71-57100-50820 $ 37,500 Motion by Strand, seconded by Ray to adopt Resolution No. 2022-93 Bayfield County Refueling Readiness Budget Amendment for the Bayfield County Highway Garage in Washburn. Discussion and Possible Action Regarding the Appointment of Ken Disher, Xcel Energy Community Service Manager, to the Bayfield County Business Park Planning Committee: Motion by Milanowski, seconded by Dougherty to confirm the appointment of Ken Disher, Xcel Energy Community Service Manager, to the Bayfield County Ad Hoc Business Park Planning Committee. Supervisors’ Reports: Oswald reported that the Sheriff’s Committee meeting has been rescheduled to September 26, 2022, at 4:00 PM in the EOC due to scheduling conflicts with the WCA Annual Conference. Crandall reported that the Highway Committee will be discussing the topic of opening all roads to ATV use at the next several meetings. Kavajecz informed the board that there will be no Personnel Committee meeting the following week and no Executive Committee meeting the week after. Silbert reported that he recently attended a Diversity workshop hosted by the WCA and commended the county as well as Kavajecz on the efforts to expand diversity so far. 12 18.
