Bayfield County Board of Supervisors’ Meeting
January 31, 2023 6:00 p.m.
Meeting Held in the Bayfield County Board Room, Courthouse, Washburn, WI
The meeting of the Bayfield County Board of Supervisors was called to order at 6:00 p.m. by Bayfield
County Chairman Dennis M. Pocernich. A roll call was taken by County Clerk- Lynn Divine, as follows:
Steve Sandstrom-present virtually; Mary Dougherty-present; Larry Fickbohm-present; Charly Ray-present;
Jeremy Oswald-present; Jeff Silbert-present; Fred Strand-present; John Rautio-present; Marty Milanowski-
present; Madelaine Rekemeyer-present; Jim Crandall-present; Brett Rondeau-present virtually; Dennis
Pocernich-present. Total: 13 present, 0 absent. A quorum was present to conduct business.
The following were also present for today’s meeting: County Administrator- Mark Abeles-Allison; County
Clerk- Lynn M. Divine; Child Support Director- Jen Jones; Highway Commissioner- Bob Anderson;
County Conservationist- Ben Dufford; Conservation Technician- Travis Tulowitzky; Forest Administrator-
Jason Bodine; GIS Technician- Carmen Novak; Planning and Zoning Director- Ruth Hulstrom; Emergency
Management Director- Meagan Quaderer; Senator Romaine Quinn; Stacey Hessel; Bayfield High School

3. Pledge of Allegiance: The Pledge of Allegiance was recited by all in attendance.
4. Public Comment:
Mardea LaPointe, Bayfield High School, introduced herself to the board and expressed an
interest in the inner workings of local government. Abeles-Allison asked if LaPointe was active
in any activities at school. LaPointe responded that she was formerly on the volleyball team.
Crandall asked about LaPointe’s interest in the scholarship. LaPointe responded that she will be
pursuing a degree in cosmetology the following fall at an institute in Madison and the
scholarship will help with costs.
Kaiya Haveri, Washburn High School, introduced herself to the board and stated that her
grandmother currently sits on the Ashland County Board which inspired her to run for class
treasurer, a position she has held for the past three years. Haveri explained that she will be
attending UW Madison in the Fall of 2023 to pursue a degree in nursing and that she currently is
a CNA at Northern Lights. Haveri concluded by stating she will be attending Superior Days for
the first time in 2023 and is interesting in learning more about the lobbying process of such an
event.
5. Presentation, Senator Quinn’s Office: Senator Romaine Quinn introduced himself to the board
and gave the board a history of his experience with local government that he gained as the Mayor of Rice Lake. Quinn addressed some of his top priority goals as senate and answered questions
posed by the board.
6. Presentation, Delta Landfill: Bob Anderson, Carmen Novak, Travis Tulowitzky, and Jason
Bodine delivered a presentation on the history of the Delta Landfill and the completion of the
Delta Landfill Project.

7. Bayfield County Resolution 2023-01:
In Recognition and Appreciation for the Completion of the Delta Landfill
Restoration Project
WHEREAS, in 2018, severe flooding washed out the former Delta Landfill and uncovered landfill
debris; and,
WHEREAS, the Bayfield County Forestry & Parks Department and the Land Records Department were
instrumental in submitting FEMA flood damage reports which resulted in funding approval; and,
WHEREAS, the Bayfield County Forestry & Parks Department worked in close collaboration with the
Bayfield County Land Water Conservation Department and the Wisconsin Department of Natural
Resources; and,
WHEREAS, the Bayfield County Land Water Conservation Department shared plan documents with
the Bayfield County Highway Department and the Bayfield County Highway Department agreed to take
on the restoration project; and,
WHEREAS, the Bayfield County Highway Department planned and built the flood control structure
and developed a unique Gambion structure along the waterway to prevent future flooding; and,
WHEREAS, during this process, Bayfield County worked in collaboration with the Town of Delta and
the town was a partner in completing this project;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January, 2023, extends its sincere appreciation and recognition to the Bayfield County
Forestry & Parks, Land Records, Land Water Conservation, and Highway Departments for their unique
collaboration and completion of the Delta Landfill restoration.
Motion by Milanowski, seconded by Ray to adopt Resolution No. 2023-01 In Recognition and
Appreciation for the Completion of the Delta Landfill Restoration Project. Motion carried, 13-0.
8. Discussion and Possible Action, Minutes from November 15, 2022:
Motion by Milanowski, seconded by Fickbohm to approve the Minutes of the Monthly Bayfield
County Board of Supervisors Meeting held on November 15, 2022. Motion carried, 13-0.
9. Discussion and Possible Action, Consent Agenda:
a) Bayfield County Resolution No. 2023-02; Congratulating New DNR Secretary Adam
Payne:

WHEREAS, Bayfield County has a strong working relationship with the Wisconsin DNR; and,
WHEREAS, the county forest and motorized trail programs rely on the DNR for assistance; and,
WHEREAS, Local DNR staff collaborate with Planning and Zoning, Land Water Conservation, and
Land Records on coastal and water resource issues; and,

WHEREAS, the Wisconsin DNR has supported critical policy initiatives associated with Chronic
Wasting Disease, Artesian Well research and invasive species control;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023, welcome new DNR Secretary Adam Payne and pledges to continue
Bayfield County’s strong collaborative partnership with the Wisconsin Department of Natural
Resources.
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors formally invites
Secretary Payne to address the Bayfield County Board at one of its meetings in 2023. The Board meets
the last Tuesday of the month. Scheduled meetings this summer are June 27, July 25 and August 29.
b) Bayfield County Resolution No. 2023-03; Congratulating New Wisconsin Secretary
of Veterans Affairs James Bond:
Congratulating New Wisconsin Secretary of Veterans Affairs James Bond
WHEREAS, Bayfield County has a strong working relationship with the Wisconsin Department of
Veterans Affairs; and,
WHEREAS, the County Veterans Service Department relies on the Department of Veterans Affairs for
assistance; and,
WHEREAS, the Wisconsin Department of Veterans Affairs provides critical assistance to both veterans
directly and County Veteran Services Officers; and
WHEREAS, the Bayfield County Veteran population continues to grow making up over 13% of the
county population; and
WHEREAS, Bayfield County has a strong and expanding Veteran Services Program and welcomes new
ideas on how to address veteran health and housing issues.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023, welcome new Wisconsin Veterans Affairs Secretary James Bond and
pledges to continue Bayfield County’s strong collaborative partnership with the Wisconsin Department
of Veterans Affairs.

WHEREAS, Peggy Kman has served Bayfield County with distinction, honor and dedication in the
Bayfield County Coroner’s Office for 23 years,
NOW, THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January, 2023, honors Peggy Kman for her 23 years of public service to Bayfield County
and expresses gratitude for her efforts, wishing her well in the years ahead.

d) Bayfield County Resolution No. 2023-05; In Support of Increased County Child
Support Funding:
In Support of Increased County Child Support Funding
WHEREAS, Bayfield County administers the Child Support Enforcement Program on behalf of the
state, providing a holistic set of services to Bayfield County children and their parents, including
paternity establishment, assistance with finding employment, obtaining child support and establishing
health insurance orders for children, and enforcing and modifying those orders; and,
WHEREAS, Child support is one of the most effective anti-poverty programs in the state, with county
child support agencies serving approximately 347,000 children and collecting roughly $906 million in
financial support for Wisconsin families in 2021; and,
WHEREAS, Child support is proven to reduce childhood poverty rates, lead to better educational and
behavioral outcomes for children, and have a positive effect on food security, health and housing
stability; and,
WHEREAS, County child support agencies work closely with both parents to ensure that they have the
help they need to be successful, including assistance with finding employment, referrals to other social
service programs and right-sizing orders for individuals impacted by substances use disorders or other
challenges; and,
WHEREAS, State funding for county child support services has failed to keep up with county agency
costs, which have steadily increased due to a high number of caseloads per worker, increased
complexity of cases, inflation and new regulations; and,
WHEREAS, An abrupt federal interpretation change in June 2019 eliminated $4.2 million in federal
birth cost recovery matching funds for Wisconsin; and,
WHEREAS, Wisconsin’s strong performance in child support is at risk without additional funding. The
state has already dropped from 2nd in the nation for the collection of current support in 2016 to 6th in
the nation in 2021; and,
WHEREAS, Without additional state funds, county child support agencies may need to eliminate
positions, further increase caseloads, or reduce services, further impacting federal performance
measures, which would result in the loss of additional federal funds; and,
WHEREAS, The individuals most impacted by insufficient funding for child support are the children
and families served by county child support agencies, who will need to seek out public assistance
programming absent the financial security provided by the child support program; and,
WHEREAS, State investments in child support are amplified by a generous federal match. Every $1 of
state GPR invested in the Child Support Program generates roughly $2 in federal matching funds; and,
WHEREAS, Wisconsin’s Child Support Enforcement Program is incredibly cost-effective, collecting
an average of $6.43 in support for every dollar invested in the program;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023, respectfully requests that state funding for county child support agencies
be increased by $5 million GPR in each fiscal year of the 2023-25 Wisconsin state budget, which will

generate approximately $9.7 million in additional federal funding each year. This investment will ensure
that Wisconsin counties can continue to effectively provide economic support to our children; and,
BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded by the County Clerk to the
Governor of the State of Wisconsin, State Senators and State Representatives representing Bayfield
County, the Secretary of the Wisconsin Department of Administration, and the Wisconsin Counties
Association for consideration.
e) Bayfield County Resolution No. 2023-06; State of Emergency Declaration for
December 16th, 2022, Snowstorm Event:
State of Emergency Declaration for December 16th, 2022, Snowstorm Event
WHEREAS, A prolonged heavy ice and snow storm commencing December 13th, 2022 through
December 17th, 2022 impacted several townships in Bayfield County; and,
WHEREAS, The heavy ice and snow caused major damage to powerlines; and,
WHEREAS, Caused damage to several trees making several roadways impassable; and,
WHEREAS, Several Bayfield County residents were left without power for up to 72 hours; and,
WHEREAS, A state of Emergency was declared on December 16th, 2022;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023 confirms the emergency declaration by County Board Chairman, Dennis
Pocernich for the heavy snow event on December 16th, 2022.
f) Bayfield County Resolution No. 2023-07; Joint BART Resolution:
City Of Ashland, Ashland County, Bad River Reservation, Bayfield County, City of
Washburn, City of Bayfield, Red Cliff Reservation, and Price County
WHEREAS, the Bay Area Rural Transportation Commission (hereinafter “BART”) is
a commission formed under Wisconsin Statutes Chapter 66; and,
WHEREAS, the Red Cliff and Bad River bands of Lake Superior Chippewas; the Cities
of Bayfield, Washburn, and Ashland; and the Counties of Bayfield and Ashland (hereinafter
“Members”) are the current members of the Commission; and,
WHEREAS, Price County has passed an ordinance accepting the Charter and its rights
and responsibilities and filed a certified copy of the ordinance with the BART Commission; and,
WHEREAS, Price County has designated a representative to the BART Commission
Board; and,
WHEREAS, Members executed a Charter on August 21, 1984 (Exhibit A); and,
WHEREAS, Article X of the Charter states it may be amended by a two-thirds vote of
the Board and upon ratification by a majority vote of the governing bodies of Members; and,
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled

this 31st day of January, 2023, approves the amendment to the BART Charter attached as Exhibits A and
B and directs the Bayfield County Board Chair to sign charter amendments.
g) Forestry & Parks 2023 Annual Work Plan

2022 YEAR END BUDGET AMENDMENTS FORESTRY AND PARKS
DEPARTMENT
WHEREAS, as per Wisconsin State Statute 28.11(9)(d), Bayfield County is required to distribute 10%
of net timber sale proceeds to towns that contain county forest lands; and,
WHEREAS, the 2022 expense budget for the 10% net timber sale receipts due to Towns (100-34-
56125-50590) was $319,000.00; and,
WHEREAS, the combined 2022 revenue budget for county forest stumpage (100-34-46811 & 100-34-
46815) was $3,190,000.00; and,
WHEREAS, the actual county forest timber sale revenue for CY 2022 was $4,679,087.06; and,
WHEREAS, the required 10% timber sale payment due to the towns totaled $467,908.78; and,
WHEREAS, the required 10% timber sale payment due to the towns exceeded the expense budget by
$148,908.78; and,
WHEREAS, the Department administers over 450 miles of designated, state funded snowmobile trails
in Bayfield County; and,
WHEREAS, maintenance of the snowmobile trails is funded by the Wisconsin DNR at a rate of
$300.00 per mile; and,
WHEREAS, when general maintenance costs exceed the base funding amount, supplemental
snowmobile trail aid funds are made available, by the Wisconsin DNR, to cover up to 100% of the
overage; and,
WHEREAS, for the 2021/2022 snowmobile season, actual maintenance expenses exceeded the
budgeted amount by roughly $117,200; and,
WHEREAS, the supplemental snowmobile trail aids funds covered the overage at the rate of 100%;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January, 2023, approve the following 2022 budget amendments:

i) Bayfield County Resolution No. 2023-09; Withdrawal of Land from County Forest
Law and Sale of Land to Address an Encroachment:
Withdrawal of Land from County Forest Law and Sale of Land to Address an
Encroachment
WHEREAS, Bayfield County Forestry and Parks Department (hereafter, the Department) discovered an
encroachment of county forest land located in Section 19, T47N-R9W, in the Town of Hughes; and,
WHEREAS, upon further inspection, it was established that the adjacent landowners, Lon and Elizabeth
Anderson (hereafter, the Landowners), of 66460 Wills Rd, Brule, Wisconsin, were responsible for the
encroachment; and,
WHEREAS, as part of the inspection, the Department determined that the primary dwelling, LP tank
and septic, were in violation of Bayfield County Zoning ordinances; and,
WHEREAS, the Department concluded that the most efficient way to address the encroachment was to
sell a portion of the encroached upon land to the Landowners; and,
WHEREAS, the portion of encroached upon property considered for sale was calculated to be 0.05
acres, and only included enough land to comply with local and state ordinances (see Exhibit A, Plat of
Survey); and,
WHEREAS, the value of the encroached upon land was determined to be $3,200.00 per acre; and,
WHEREAS, Bayfield County (hereafter, the County) agrees to sell the approximately 0.05 acres of
encroached upon land to the Landowners for $3,200.00/acre, in addition to all other terms outlined in the
real estate sales agreement (Exhibit B), including the Landowners paying all expenses associated with a
survey, including the development of a CSM (if necessary), and all recording fees, as well as all legal
and administrative fees incurred by the County as part of the transaction; and,
WHEREAS, in addition to compensating the County for the cost of land and other associated expenses,
as outlined in the real estate sales agreement (Exhibit B), the Landowners will be required to remove all
personal items/property from the encroached upon land not included in the transaction, and will need to
obtain a ten-year temporary access permit, from the Forestry and Parks Department, to address their
existing driveway; and,
WHEREAS, as part of the Forestry and Parks Committee’s recommendation to sell the land, as
described above, to the Landowners, all net proceeds from the sale are to be reinvested in forest land and
made part of the County Forest; and,
WHEREAS, the sale of County Forest land currently enrolled in County Forest Law is inconsistent with
the purposes set forth in ss. 28.11, Wisconsin Statutes (County Forest Law); and,
WHEREAS, any proposal to sell County Forest land will first require filing an application, to the DNR,
to withdraw said parcel from County Forest Law; and,

WHEREAS, the Forestry and Parks Committee has recommended the sale of the approximately 0.05
acres of land to the Landowners, as described above, and the withdrawal of said land from County
Forest Law, with all net proceeds being reinvested in land that would eventually be enrolled in County
Forest Law;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January, 2023, authorizes the Bayfield County Forestry and Parks Administrator, on
behalf of the County, to make application to the Wisconsin Department of Natural Resources, pursuant
to Section 28.11(11), Wisconsin Statutes, to withdraw the real estate described above from the
provisions of the County Forest Law (Section 28.11, Wisconsin Statutes); and,
BE IT FURTHER RESOLVED, that, if the application for withdrawal from County Forest Law is
approved by the Wisconsin Department of Natural Resources, the Bayfield County Board of Supervisors
approves the sale of the above described property to the Landowners, in the amount of $3,200.00/acre,
including all other terms as outlined in the real estate sales agreement; and,
BE IT FURTHER RESOLVED, that all net proceeds from the sale of the above described property
must be reinvested in forest land that will be enrolled in County Forest Law and made part of the County
Forest and that the Forestry and Parks Department will search for other lands suitable for addition to the
County Forest; and,
BE IT FURTHER RESOLVED, the following budget amendments will be made to the 2023 Forestry
and Parks Budget:

WHEREAS, the 2022 Sheriff’s Squad Car Fund expense budget is used for squad related expenses with
revenues coming from insurance recoveries, sale of vehicles and depreciation (squad mileage charges);
and,
WHEREAS, Repair and Maintenance service costs exceeded budgeted expenses; and,
WHEREAS, the Sheriff’s Squad Fund account has a sufficient balance to cover these expenses;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January, 2023, does hereby authorize the 2022 Sheriff’s Squad Car Fund budget to be
amended to reflect the expenses from unexpected costs to:

WHEREAS, UW-Madison Extension received a number of grants in 2022 that experienced extension
past their original end dates, which resulted in additional expense and revenues; and,
WHEREAS, revenue and expenses for other program funds were not reached and a budget amendment
is now needed;
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023, does hereby authorize the following budget amendments:

10. Discussion and Possible Action Regarding LATCF Project Authorization: Abeles-Allison
informed the board that the county will be received $1.04 million in Local Assistance and Tribal
Consistency Funds (LATCF) over the next two years. Five projects have been proposed to utilize
the funds: replace the Cable highway garage, replace the Grand View highway garage, waiving
the Bayfield County Fair exhibitor fee in 2023, installing protective glass in the Courtroom for
court security, and contributing funds to the consolidated dispatch implementation plan. Abeles-
Allison reviewed each of the projects with the board. Discussion took place regarding the
proposed projects.

Motion by Silbert, seconded by Rautio to authorize the LATCF Projects as presented. Roll Call

yes. Motion carried, 12-0, 1 absent.
11. Bayfield County Resolution No. 2023-12:
Supporting and Authorizing Matching Funds for Bayfield County “RAISE” Grant
Project on County Highways A & N
WHEREAS, Bayfield County maintains 172 miles of county highways; and,
WHEREAS, Forestry is a critical industry for Bayfield County; and,

WHEREAS, Bayfield County annually places road weight limit restrictions on county highways during
the spring break-up to protect roads which negatively impact the ability of the logging industry to access
and transport forest products; and,
WHEREAS, County Highways A and N provide access to thousands of acres of forestland that supplies
timber for forest products; and,
WHEREAS, County Highways A and N are used by local industry; and,
WHEREAS, Bayfield County uses highways for multi modal purposes with County Highway A
designated as a bike route and County Highway N designated as an ATV route; and,
WHEREAS, funding for highways is important. Scarce resources make funding difficult. Bayfield
County has annually dedicated additional resources to highway projects but does not have the ability to
contribute to fund this entire project; and,
WHEREAS, over the past five years both the Bayfield County Board and the Citizens of Bayfield
County have ranked Highways as a top priority of the County during the annual budget process and
budget survey; and,
WHEREAS, maintenance and upkeep of roadways are of regional concern to support the forest
industry; and,
WHEREAS, alternate funding mechanisms are important to supplement the county’s ability to properly
maintain county roads; and,
WHEREAS, Bayfield County has proposed a “replace in kind” construction method to keep costs to a
minimum; and,
WHEREAS, the US Department of Transportation RAISE program offers matching funds for economic
development projects and in March of 2022 the Bayfield County Board authorized submittal of an
application to the RAISE grant program for reconstruction of County Highways A and N to all season
road standards; and,
WHEREAS, the estimated cost for the project is Seventeen Million, Three Hundred Thirty-one
Thousand, Four Hundred Sixty-eight dollars (17,331,468), encompassing sixteen (16) miles of county
highway reconstruction on County Highway N and conversion of six (6) miles of County Highway N
from A to Highway 27 making this entire route (US 2 to State Highway 27) an All-Season Road; and,
WHEREAS, this improvement project would have a significant economic development impact on
Bayfield County communities, businesses, bikers, ATV users and tourists in addition to improving
safety and reducing maintenance costs;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023, will commit and hereby encumbers 10% or $1,733,147 towards this
project over a period of up to five years; and,
BE IT FURTHER RESOLVED, that Bayfield County has previously supported efforts at the state
level to raise additional funds for county highway reconstruction and that the Bayfield County Board
hereby petitions the Governor, the Assembly, and the Senate of the State of Wisconsin to pursue
supplemental funding for county highways in Wisconsin.

FORESTRY AND PARKS DEPARTMENT 2022 AND 2023 BUDGET
AMENDMENT ACCEPTING WISCONSIN DNR ARPA GRANT AND
TRANSFERRING UNEXPENDED 2022 EXPENDITURES TO 2023 FOR THE
REPLACEMENT OF COUNTY FOREST LANDS
WHEREAS, via Resolutions 2022-06 and 2022-76, the County Board gave the Forestry and Parks
Department (Department) authorization to develop a roughly 2,001-acre Sand River land acquisition
project (Sand River), in part, to replace the roughly 1,439 acres of county forest lands that were
previously sold to the Red Cliff Band of Lake Superior Chippewa (Red Cliff); and,
WHEREAS, proceeds from the sale of county forest lands are required to be re-invested in the purchase
of replacement lands, that will be enrolled in County Forest Law and managed as part of the county
forest; and,
WHEREAS, the Department has partnered with the Trust for Public Land (TPL) on the development of
the Sand River project, who are now holding said land until Bayfield County has secured full funding;
and,
WHEREAS, the final value of the Sand River project is approximately $2.552 million, which includes
the value of the land and all closing costs; and,
WHEREAS, as part of the Sand River project, two external funding sources had been targeted: the
Knowles-Nelson Stewardship Grant for County Forest Land Acquisitions and the USFS Community
Forests Grant; and,
WHEREAS, as of 1-1-2023, the non-lapsing Land Acquisition account balance was roughly $1.77
million; and,
WHEREAS, the Department has secured $1.90 million in grants, including $1.30 million from the State
of Wisconsin’s American Rescue Plan Act (ARPA) Conservation Land Acquisition Program grant and
$600,000 from the Federal Community Forests grant; and,
WHEREAS, the ARPA grant has served as a replacement of the previous Stewardship grant
application; and,
WHEREAS, with $1.90 million in total grant funding secured, the Department needs roughly $652,000
in Land Acquisition account balance to complete the Sand River project; and,
WHEREAS, the Department is also in negotiations with another landowner on the purchase of roughly
1,581 acres in the Town of Clover (see Exhibit A); and,
WHEREAS, when including closing and other expenses, the Town of Clover acquisition is estimated to
cost $1.032 million; and,

WHEREAS, when combined, and considering the value of grants already awarded, the Sand River and
Town of Clover land acquisition projects would require a total of roughly $1.681 million in cash from
the Land Acquisition account, leaving a balance of a little under $100,000; and,
WHEREAS, when combining the recent 160-acre purchase at Lost Creek in the Town of Bell
(authorized via Resolution 2022-83) with the Sand River and Town of Clover land acquisition projects,
a total of roughly 3,740 acres would be added to the county forest; and,
WHEREAS, additional funding sources are also still being pursued that, if awarded, would reduce the
cash contributions required by the county, allowing the Department to pursue other land acquisition
projects; and,
WHEREAS, the Sand River and Lost Creek acquisition projects were both budgeted for completion in
2022, but will require budget amendments to address activities that will occur in 2023;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January, 2023, approves accepting the State of Wisconsin’s ARPA grant, completing the
roughly 2,001 acre Sand River project with TPL, purchasing the roughly 1,581 acres in the Town of
Clover and allocating the additional funds required to complete both transactions, and approves the
following amendment to the 2022 and 2023 Forestry and Parks Department budget:

Chapter 3: All-Terrain Vehicles and
Off-Road Motor Vehicle Operation
Sec. 10-3-1 State All-Terrain Vehicle Laws Adopted.
The provisions describing and defining regulations with respect to all-terrain vehicles in §23.33, Wis.
Stats., and any future amendments or revisions, are hereby adopted by reference and made part of this
Section as if fully set forth therein.
Sec. 10-3-2 Purpose.
Taking consideration of the economical and recreational value weighted against possible dangers,
liability aspects, terrain involved, traffic density and public health, this ordinance has been created to
designate certain all-terrain vehicle routes on portions of existing county highways, to identify the
procedure for establishment of additional all-terrain vehicle routes in the county, to set forth conditions
of operation of all-terrain vehicles on the county trunk highway system and signage, suspension and
revocation of all-terrain vehicle routes, and to specify penalties for violation of this ordinance.
Sec. 10-3-3 Authority.
This ordinance is enacted pursuant to County Board authority under Wis. Stat. 59.02, as authorized by
23.33 (11)(am) and 23.33 (8)(b).
Sec. 10-3-4 Establishment of ATV Routes.
County Trunk Highways designated as ATV routes shall be established and approved by the Bayfield
County Board upon recommendation by the Highway Committee. The Highway Committee shall
develop policies and procedures for the designation of ATV routes including appropriate criteria for
making a designation.
Sec. 10-3-5 Operation of All-Terrain Vehicles on the County Trunk Highway
System
(a) All ATV’s shall operate only on the extreme right side of the paved portion
of the roadway. Operation of an ATV on the shoulder, ditch or right-of-
way is prohibited and illegal.
(b) All ATV operators shall observe and obey posted speed limits. The speed
limit for ATVs traveling on designated routes is 40 mph unless otherwise
posted.
(c) All ATV operators shall ride in single file.
(d) ATV operators shall yield the right-of-way to other vehicular traffic and
pedestrians.
(e) All ATV operators shall have their headlight and taillight illuminated at all
times while operating on a county highway.
(f) All persons under the age of 18 must wear a helmet when operating or
riding an ATV.
(g) All ATV operators will be in compliance with Statutory Regulations.
(h) All ATV operators assume all the usual and normal risks of ATV operation
while on the approved County Highway route(s).
Sec. 10-3-6 Signage of ATV Routes.
Any ATV signage on County Trunk Highway right-of-way will be installed by the Bayfield County
Highway Department which shall be reimbursed for time and materials by the Route Sponsor. All
signage will be in accordance with Wisconsin Administrative Code NR 64.12 (7). Any removal, damage,
defacing, moving, or obstructing of signage is illegal and prohibited.

Sec. 10-3-7 Enforcement.
This ordinance shall be enforced by the Bayfield County Sheriff’s Department or any other law
enforcement official as set forth in Wis. Statute 23.33(12).
Sec. 10-3-8 Violations.
(a) Wisconsin state All-Terrain Vehicle penalties as found in s. 23.33 (13) (a) Wis. Stats.,
are adopted by reference.
(b) Forfeiture: The penalty for violation of any provision of this Chapter shall be a forfeiture,
in accordance with Title 1, Chapter 2 of the Bayfield County Code of Ordinances,
together with the court costs and fees and the applicable penalty assessment. Forfeiture
for violation of any ATV regulation(s) set forth in the Wisconsin Statutes adopted by
reference in this Chapter shall conform to the forfeiture penalty permitted to be imposed
under the applicable statute(s).
Sec. 10-3-9 Maintenance. Approval of highway segments as ATV routes does not imply that
additional maintenance will be provided by the Bayfield County Highway Department. These segments
will be maintained like any other segment of County Highway, and Bayfield County makes no
representation as to their condition or fitness for ATV use.

Sec. 10-3-11 Suspension and Revocation of Route
(a) The Bayfield County Highway Commissioner shall have the authority to suspend operation of
any ATV route for up to ninety (90) days due to hazard, construction or emergency
conditions in any highway segment listed as a designated route.
Any ATV route may be revoked at any time by the Bayfield County Highway Commissioner. At
the next Bayfield County Highway Committee meeting following the revocation, the committee
shall take action to either uphold the revocation or overturn it.

16. Bayfield County Resolution No. 2023-14:
County Support for a Consolidated Dispatch and Implementation Plan

WHEREAS, Bayfield and Ashland Counties each operate PSAPs (911 dispatch centers), the centers are
nine miles apart; and,
WHEREAS, Bayfield and Ashland Counties often have just one person working in the PSAP; and,
WHEREAS, Emergency Medical Dispatch and s. DMA 2.04 (6) requires each PSAP to have a
minimum of two telecommunicators on duty to be available to receive and process requests for
emergency assistance, including life-saving medical instructions, while the designated public safety
answering point is in operation; and,
WHEREAS, Bayfield and Ashland Counties undertook a consolidated dispatch feasibility study, the
study concluded that consolidated dispatch was feasible and that the counties would be better served by
consolidating the two PSAPs; and,
WHEREAS, Both counties applied for the Department of Military Affairs Consolidated Dispatch
Grant; and,
WHEREAS, Although the grant was initially denied the DMA stated that if both counties supported
joint dispatch and agreed to complete an implementation/consolidation plan, funding would be
considered;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023, agrees to pursue an implementation plan and pay 50%, ($11,000) of the
cost; and,
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors goes on record
supporting and endorsing a consolidated dispatch center.
Quaderer clarified that the resolution is not to enact the consolidation of the two dispatch centers,
but it is to give the county’s support for the development of the implementation plan for the
project.
Chairman Pocernich suggested that the word “Study” in the title of the resolution be changed to
the word “Plan.”
Motion by Oswald, seconded by Fickbohm to adopt Resolution No. 2023-14 County Support for
a Consolidated Dispatch and Implementation Study with the correction to change the word

on December 8, 2022;
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January, 2023, approves the additional expense of $9,607; and
BE IT FURTHER RESOLVED, that the following line-item adjustments be made to the 2022 budget:

19. Discussion and Possible Action Regarding Board of Adjustment Resignation and

Abeles-Allison informed the board that Mark Hoefling has turned in his resignation from the
Board of Adjustment, effective June 2023 and stated there are parties interested in the position
that would not be available until March. Dennis Rasmussen has also resigned from the Board of
Adjustment but has agreed to stay in the position until a replacement can be found. Abeles-
Allison asked the board to approve Hoefling’s resignation and to reappoint Rasmussen to the
board until a replacement is found.
Motion by Crandall, seconded by Rautio to confirm the appointment of Dennis Rasmussen to the
Board of Adjustment until a replacement is found and to accept the resignation of Mark Hoefling

20. Bayfield County Resolution No. 2023-19:
Northern Lights Debt Repayment Schedule
WHEREAS, Bayfield County and Northern Lights have a close working relationship; and,
WHEREAS, Northern Lights continues to struggle to fill all shifts and as a result, has a lower census
than desired with lagging reimbursements; and,
WHEREAS, Northern Lights makes monthly payments to Bayfield County to make bond and loan
repayments;
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors assembled
this 31st day of January 2023, authorizes the Bayfield County Board Chair and Bayfield County
Administrator to waive debt payment relief payments for up to four months in 2023. Debt payments

Silbert asked that the words “if needed” be added to the Now Therefore clause after “the
Bayfield County Board Chair and Bayfield County Administrator to waive debt payment relief
payments.”
Motion by Silbert, seconded by Dougherty adopt Resolution No. 2023-19 Northern Lights Debt
Repayment Schedule with the change to add the phrase “if needed” to the Now Therefore clause.
Motion carried, 12-0, 1 absent.

b) Safety Practices: Abeles-Allison reviewed safety practices for the boardroom should an
emergency take place.

d) County Ambassador Program Review: Abeles-Allison reported that some of the key topics of
the program included Local Government Funds, Mental Health, and District Attorney Funding.

22. Supervisors’ Reports: Oswald reported that the Sheriff’s Office had received their new
Emergency trailer.

23. The Board may entertain a motion to move in and out of Closed Session pursuant to
§19.85(1) (c) to consider the employment, promotion, compensation or performance
evaluation data of any public employee over which the governmental body has jurisdiction or
exercises responsibility (e) to deliberate or negotiate the purchasing of public properties, the
investing of public funds, or conducting other specified public business, whenever competitive
or bargaining reasons require a closed session:
Motion by Milanowski, seconded by Oswald to enter Executive/Closed Session at 8:19 p.m.

Discussion took place regarding the Closed Session Minutes from October 25, 2022, the
County Administrator Evaluation, and a WPPA Union Contract Ratification.
There being no further business to conduct in Executive/Closed Session, a motion was made by
Oswald, seconded by Dougherty to return to Open Session at 8:29 p.m. Motion carried, 12-0, 1
absent.
