HomeMy WebLinkAboutTribal-County Relations Committee - Minutes - 4/18/2002Minutes of the Bayfield County Tribal Study Committee Meeting 2:00pm, Thursday, April 18, 2002 Red Cliff Bingo Hall The meeting of the Bayfield County- Red Cliff Band of lake Superior Chippewa Tribal Study Committee was called to order at 2:00pm, Thursday, April 18, 2002, at the Red Cliff Bingo Hall. Members present: Dave Good, Ray DePerry, Phil Gordon, Bill Kacvinsky and Leo LaFernier. Members Excused: Richard Compton Public Present: Donna Lynk, Mark Abeles-Allison, Elizabeth Skulan, Jan Karlen Motion by Good to call Meeting to order, seconded by Kacvinsky. Motion carried. Motion by Kacvinsky to approve minutes of February 14 meeting with modification substituting Patty Derrigan and Jake Geisler for Martin Gordon’s name in section B, seconded by Gordon. Motion carried The agenda was modified to move item 5 to 3 and 7 to 4 to allow Skulan and Karlen to address Human Services related issues. UNDERAGE DRINKING Gordon reported an increase in the number of underage drinkers over the past year, noting that more 13 – 15 year olds appeared to be coming in with 2nd and 3rd offenses. Good inquired whether this was due to more incidents or increased enforcement. The group discussed the use of citations and the general feeling was that these were not effective. It was mentioned that the tribal council was considering allowing youth center workers to give out citations for underage drinking at the youth center. It was noted that it appears that the source of the alcohol is adults, not underage sales. The following actions were taken 1. The Red Cliff Police Chief would be asked to attend the next meeting along with Officer Kangas. 2. Statistics from the legal and HS departments on underage drinking will be researched to see what trends are actually out there. 3. Bayfield County Human Services will share information on teen court activities with Deperry. This method seems to be effective as a peer review. Skulan inquired about extending teen court to address first offense underage drinking. A report will be made at the next meeting on this. HUMAN SERVICE ISSUES A brief update of HS issues was made. These included the status of the county policy on voluntary detox payments. The policy is under review and the county committee is working towards getting more quantifiable data so that it is less subjective. A final policy should be completed by May. The payer of last resort issue is resolved based on previous action. Related issues discussed included the limitation of AODA dollars only being used for service and not facility improvements. It was noted that additional funds are still needed for the Mishomis house. A variety of work programs were mentioned that might assist with labor. COOPERATIVE EFFORTS A number of cooperative efforts were listed for the future including: 1. Skulan noted that the county has 1900 MA eligible residents who need dental care. The tribe recently received a $400,000 grant. DePerry said that the tribe would be willing to cooperate in opening this up to county residents. The program may be operating by the end of the Summer. 2. Dave Good noted the veteran service officer was establishing outreach hours in Red Cliff once a month. 3. Land use plan efforts continued. Input from tribal members is welcome. The group is now meeting twice a month. 4. Good noted that additional $ for the Red Cliff library might be available through a local diversion program. 5. DePerry noted that FEMA might be providing funds for a new ambulance with some local match. 6. A report of the county law enforcement software was made. It was noted that police agencies would be able to hook onto the program from their offices in the future. LAND SALE Donna Lynk presented information on several different land issues. 1. Cecellia DePerry property. This is a fee property, no longer in the tribal trust. It is delinquent on taxes. Gerald DePerry and now the tribe is paying the taxes. Two parcels at the north end, across from York Island are at issue. The tribe would like to bring these properties back into the reservation. If they go back to the county however the tribe could be in a position of bidding against private citizens, which could get cost prohibitive. They asked if there was a way for this property to revert back to them. 2. A second type of property was listed as Bayfield County Lands located within Red Cliff Reservation. A total of 1764 + acres were listed in this category. The vast majority of this property is timbered by BC and is a source of revenue. It was suggested that this list be broken down into two groups, one with large tracks and the second with the smaller tracks. It was noted that the smaller tracks were within the Red Cliff Community and likely unused. Returning these small parcels to Red Cliff was discussed. 3. A third category of property was included on a sheet entitled Trust Allotments Shown on Town of Russell Tax Roles. These are properties that are in the trust, not taxed but which BC may have a fractional interest in. Donna is going to determine what interest if any BC has in these properties and report back. The discussion generated several actions. Red Cliff would go ahead and pay this year’s taxes on the Cecelia DePerry property. A draft letter would be prepared by Ray for the land sale committee on these various issues. Additional information will be gathered in addition to the county reviewing legal issues including returning land to the tribe just as it could return land to a municipality as well as legal issues as they relate to procedures for returning land to the trust. Other issues discussed including swapping land. The next meeting will be June 20 at the Annex Conference Room at 2:00pm. Motion by LaFernier, second by DePerry to adjourn. Motion Carried.
