Meeting: December 16, 2004
County Courthouse Board Meeting Room
Minutes complied by Beth Armstrong, Red Cliff Co-Chair
Committee Members present: Beth Armstrong, Lynne Basina, Lynn Divine, Dave
Good, Paul Lundberg, Mark Abeles-Allison. Absent: Jean Buffalo-Reyes
The appointment of co-chairs and establishing meeting protocol was discussed at the
outset of the first meeting of the Tribal/County Land Sub- Committee.
David Good will serve as the County Co-Chair
Beth Armstrong will serve as the Red Cliff Co-Chair
Meetings will alternate between the County offices and Red Cliff.
The Co-chair who is not running the meeting will serve as minutes scribe.
The next meeting is slated for January 13th, 2005 at 9:00 am at the First American
Prevention Center, Red Cliff
New Business
Discussion regarding the Memorandum of Understanding began the meeting. This
document is the foundation for this committee. From it we will work toward resolving
tribal/county land issues.
It was determined that the committee will invite Donna Lynk to the next meeting to
discuss fractionalized interest as they pertain to tribal lands. It is our hope that she will
present a clear definition of fractionalized interest, discuss several specific parcels of
tribal land that directly relate to fractionation, and bring light to this often times
confusing land issue.
Chairman David Good asked Paul Lundberg to prepare an overview of lands held by the
County within the Red Cliff reservation boundaries. He will provide numbers and maps
for the next meeting. Specific attention will be given to Forest Block versus other lands.
Discussion regarding the Cecilia DePerry parcel ensued. Questions regarding the Statute
59.62.8 and the definition of a municipality as it relates to this parcel were discussed.
Mark Abeles-Allison will research the Statute and definition of municipality for the next
meeting. Lyn raised the question regarding if there exists federally related instances
where tax delinquent real estate was given back to a tribe. Beth will enquire with Red
Cliff Legal Counsel, David Ujke regarding this issue.
Beth Armstrong will bring the title search done on the Cecilia DePerry parcel for the next
meeting.
Lyn Divine will prepare a timeline for the C. DePerry parcel in regards to tax delinquent
status and procedure.
In looking at other land transfers on behalf of the County to the Red Cliff Tribe, Paul
Lundberg will research the transfer of Forest County land gifted to the Tribe for use as a
cemetery.
Beth Armstrong will prepare and present a land priority list as determined by the Red
Cliff Land Recovery Project as it pertains to any County Lands. She informed the
committee that the Land Recovery Project has concentrated its land recovery efforts on
lakeshore parcels, and other significant watershed parcels, as well as cultural or
ceremonial lands. Both a written list and maps will be provided.
A date was set for the next meeting: January 13, 2005 at 9:00 am at the First American
Prevention Center, Red Cliff.
Chairman David Good adjourned the meeting at 10:00 am.
