CALL TO ORDER OF MEETING [no Public Hearing items this month]: By Chairman Beeksma at 1:04. 2. ROLL CALL: Beeksma, Jardine, Miller, Rondeau, present; Maki absent. (Maki arrived at 1:08 PM.) 3. MINUTES OF PREVIOUS MEETING(S): Motion by Rondeau / Jardine to approve (Feb. 19, 2009) as Prepared; carried 5 yes / 0 no. 4. REVIEW OF METTING FORMAT: N/A 5. BUSINESS: Agenda Review and Alteration A. BRIAN / DANA HODOWANIC SPECIAL USE REQUEST – Home-Based Business (build fishing poles, odd jobs, doggie day care, fishing guide service / lake tours) located on a 1.6-acre parcel (#004-1052-10) in Govt. Lot 1, Lot 2, CSM 373, Section 4, Township 44 N, Range 9 W, Town of Barnes. AZA Mike Furtak said the Hodowanic’s were not present and noted that the “doggie daycare” was no longer planned (canceled from the request), only the fishing poles / sales, guide service, and lake tours are part of the special use request. The Town approved the special use but disapproved the dog daycare as there was opposition to it due to problems in the past. Mike said recently Brian Hodowanic took a job in Alaska therefore the business will be very limited to start with and in future will operate it as he has time. Answering a question about driveway concerns, Furtak said there is a shared easement road/ driveway that’s been there for many years and they cannot put in their own driveway due to wetlands. He said the permit came about because the Hodowanic’s erected a sign without a permit for the dog daycare, and said that they now have fencing for dogs and may watch friends’ dogs without a permit but not as a business. Director Kastrosky stated that after two (2) years the permit is invalid if it has not begun and that he will note that in the letter they are sent after this meeting. Motion by Jardine / Rondeau to approve the special use permit for all but the dog daycare; carried. 5 yes / 0 no. B. LEROY BORSELLINO / SAM (SALVADORE) BORSELLINO SPECIAL USE REQUEST – Home-Based Business (small engine / automotive repair) located in part of the SW ¼ of the SW ¼, (Parcel # 012-1039- 05)Section 15, Township 43 N, Range 7 W, Town of Cable. The Borsellinos said they have applied for a permit due to some concerns within the Town because he repairs cars for others. Jardine questioned division of their land that will be taking place and wondered how a permit could be granted when the property will be split. Borsellino said the business will only be on one of the properties; a survey will be done. Mike Furtak said there are no problems w/ setbacks or distance to the lake. Applicants had no problem w/ conditions the Town placed (of no more than three unlicensed vehicles; no accumulation of debris/tires on the property.) Borsellino said anyone is welcome to come see his property; he has no plans to have junk vehicles except perhaps occasionally as it is torn down and then removed; working hours will be normal working hours with possibly some work on personal vehicles on week ends. It was noted the closest neighbor is about +/- one mile away. Motion by Maki / Rondeau to approve w/ Town’s conditions (no more than three unlicensed vehicles and no accumulation of debris and tires on the property and the permit is to stay with LeRoy Borsellino’s property when the land is divided; carried 5 yes / 0 no. C. TOWN OF WASHBURN SPECIAL USE REQUEST – Salt Shed / Storage Building located on a 3-acre parcel (#050-1063-01) in the NW ¼ of the NW ¼, Section 36, Township 49 N, Range 5 W, Town of Washburn. Bayfield County Planning & Zoning Committee Meeting – March 19, 2009 Page 2 of 3 John Hartzell and Bruce Hokanson said there is a need for a salt shed in the Town, both for crew-safety, as well as environmental reasons; shed will be placed on the south side of the shop; will be enclosed and have an asphalt floor. Jardine / Rondeau made a motion to approve. Discussion: Kastrosky reported that the Dept. is contemplating the addition of a zoning district of “municipal” which would cover towns, schools, etc. and they would not have to apply to build something such as a salt shed but is having a difficult time to convince Corp Counsel Bussey of this. Motion carried 5 yes / 0 no. D. CITIZENS’ CONCERNS / INPUT: o Supervisor Maki RE sanitary pumping notices: He said he received notice this winter but will not pump until the snow is gone. Kastrosky stated that pumping notices/reminders are sent out for six (6) months and many choose to ignore them. Maki said he would like to put that grace period (six months) on the cards but Kastrosky noted more people would then wait until the last minute if that was the case. Miller & Rondeau both reported they have received reminder cards and said they had to pump. L.U.S. Tulowitzky informed the Committee that citizens receive a total of four (4) yellow post card notices (if they have not pumped) with the fifth one being a bright pink colored card in another 30 days. If the first one is sent in January, the next is February, and so on; they would have until May when they get the final notice and need to line something up. Furtak stated it will get easier as time goes on and predicted in approximately three years most everyone will be complying with regular pumping. Kastrosky said we have about 8000 people “in the system” at this time; the goal is to reach 10,000 & eventually the pumpers and owners will get on schedule. Rondeau asked if they [as Committee members] can tell people who complain that they have six months before they pump and Furtak answered, “no, because some people received their notices last summer and continually ignored them”. Tulowitzky added that the Committee members should call the office and/or direct people to the Dept. because there is more information involved (i.e. type of system, unique information on file, etc.) for each case. Kastrosky explained that after the pink postcard has been received, the people receive a letter from Corp. Counsel Bussey; we then wait another 30 days, a ticket is written, then there is another 30 days or six weeks until a court hearing; they do have plenty of time. He said if they comply during that time pump their system, then it is fine as we are seeking compliance. Furtak noted that some people have received help from WI Fund because of this so the program is working. Kastrosky also reported, “we have been easy on enforcement”. E. DISCUSSION / POSSIBLE ACTION ON COMP PLANNING: o Kastrosky said Mike Darrow will address the County Board on March 31st with progress updates; things are on schedule; Cable hasn’t gotten very far and has had some problems. F. DISCUSSION / POSSIBLE ACTION ON NR115 RE-WRITE UPDATE: o Kastrosky said the DNR is getting sidetracked again. Maki asked when ‘enough is enough’. Karl noted he has been at this for over five years; he volunteered for this because the bottom line affects the County immensely. He said there is lack of leadership on the DNR’s part and feels if he quits now the fear is politicians will pass a law which we won’t have input on; the latest version is very complicated. G. OTHER ITEMS THAT MAY COME BEFORE THE COMMITTEE (discussion only): o Plumbers / Pumpers Meeting: Kastrosky reported the recent meeting was a success w/ no complaints or concerns; three credits for continuing ed / licensing were earned. Eleven million gallons of pumped septage was tracked in 2008; four years ago it was only four million. o (Sanitary) Agent Status: We will apply to the State for ‘agent status’ to approve more sanitary permits in house (i.e. commercial, etc.) in addition to those we currently approve (conventionals, holding tanks). Maki asked if there was concern with State turnaround time. Karl said turnaround time is slow because the State is slow, however, that would improve with County approval and we could process the applications in about five days. Before we receive ‘agent status’ we must have the systems 100% database-tracked within two months (now about 80% complete). Karl noted it is a way we can recapture the fees although Bayfield County Planning & Zoning Committee Meeting – March 19, 2009 Page 3 of 3 will still be required to send the State their portion. CeCe Tesky will continue as a consultant, and/or to help, if needed. o Nonmetallic Mining: Tulowitzky reported nonmetallic mining fees of $21,000 with the State receiving $3,500 of that. o Ordinance Discussion / Amendments: Kastrosky said the April meeting will be longer due to this discussion on the agenda. Committee consensus was to move the April meeting to 1:00 PM (instead of scheduled change in April to 4:00 PM). o Baxter Short-Term Rental Permit (request to be reheard in April instead of May): Kastrosky said the applicant’s conditional use permit (for short-term rentals on Duck Point) was approved in June 2008, then discussed again last fall, at the request of neighbor. Mike Furtak said both the applicant and opponents want to be on the April agenda. Committee Consensus was to abide by the original decision of the Zoning Committee and their previously-approved motion “to maintain the original agreement of the conditional use with the May 15, 2009 deadline originally set, and no action to be taken until the May meeting”. 6. MONTHLY REPORT: Motion by Jardine / Rondeau to receive the report and place on file. Discussion: Kastrosky reported we are down $10,000 in revenue and are watching as we go so there are no huge problems in June or July. He noted with downscaling, and slow times, we may be asked to share staff w/ other departments. We received a D.O.A. (Dept. of Admin.) check for $20,000 [for coastal management] then another for $40,000 for comprehensive planning; we are <$60,000> but those two checks are not included yet. 7.
