MINUTES
Bayfield County Planning / Zoning Committee Public Hearing / Meeting
July 16, 2009 - 4:00 PM
Board Room, County Courthouse, Washburn WI 54891
1. CALL TO ORDER OF PUBLIC HEARING: By Vice Chair Brett Rondeau at 4:00 PM.
2. ROLL CALL: Jardine, Maki, Miller, Rondeau – all present; Beeksma – absent / excused.
3. AFFIDAVIT OF PUBLICATION: Read by Director Karl Kastrosky
4. REVIEW OF MEETING FORMAT: By Vice Chair Rondeau.
5. PUBLIC HEARING:
A. ERICK / BROOK JAEGER (owners); KENNETH ABERNATHY (agent) REZONE REQUEST Forestry-1
(F-1) to Residential -1 (R-1) on 1.40-acre parcel (part of) ID #04-021-2-45-06-22-3-04-000-60000,
described as being in the S ½ of the SE ¼ of the SW ¼, further described as a small portion lying West of
County Hwy “D” Section 22, Township 45 North, Range 6 West, Town of Grand View. (Metes and Bounds
description available at the Zoning Dept).
Director Kastrosky / AZA Mike Furtak / Agent Abernathy commented on this rezone, which is split by 1.4
acres west of CTH ‘D’. Owner wants to create one buildable parcel. Kastrosky pointed out the pie-shaped
piece which is to be rezoned (area W. of CTH D).
Support / Opposition: None
File Report: Kastrosky noted there was no Town Approval form on file; Agent noted he attended the
meeting – there was no opposition.
6. ADJOURNMENT OF PUBLIC HEARING: Motion by Jardine / Miller at 4:09 PM to adjourn; carried; 4 yes / 0 no.
7. CALL TO ORDER OF ZONING COMMITTEE MEETING: By Rondeau at 4:09 PM.
8. ROLL CALL: Jardine, Maki, Miller, Rondeau – all present; Beeksma – absent / excused.
9. MINUTES OF PREVIOUS MEETING(S): Motion by Miller / Jardine to approve the May 21, 2009 minutes
without additions or corrections. Carried 4 yes / 0 no.
10. BUSINESS:
A. ERICK / BROOK JAEGER (owners); KENNETH ABERNATHY (agent) REZONE REQUEST Forestry-1

Motion by Maki, seconded by Miller to approve rezoning above property from F-1 to R-1 contingent
upon Town Board approval; carried 4 yes / 0 no.
AGENDA REVIEW / ALTERATION:
B. SANDRA FAYE SPECIAL USE REQUEST: Dairy Products, Mfg. Sales Facility to produce / sell cheese
/ other products) on their 40.45-acre parcel (04-006-2-50-05 05-1-03-000-10000) in the SW ¼ of the NE ¼,
Section 5, Township 50 N, Range 5 W, Town of Bayfield.

Fred Faye explained this request which is under control / licensing by Dept. of Agriculture; building is
existing – may need additional building in future on his 160-acre farm. Motion by Maki / Jardine to approve.
File report: Kastrosky noted Town approval w/ no conditions. Motion then carried 4 yes / 0 no.
C. JON NELSON SPECIAL USE REQUEST: Mini-Storage (1 building of 23 units) on a 4.85-acre parcel in
the N. 320 ft. of the E ½ of the NE ¼ of the SW ¼, Section 16, Township 49 N, Range 4 W, Town of
Bayview.
Tina Nelson noted this is an expansion from three to four mini-storage buildings which will be identical to the
other buildings; there is a need for additional space as they have a waiting list.
Motion by Jardine / Maki to approve. Kastrosky noted the Town approved this request with no conditions
placed. Motion carried 4 yes / 0 no.
D. CITIZENS’ CONCERNS / INPUT: None
E. DISCUSSION / POSSIBLE ACTION – ZC MEETING TIME: (1:00 or 4:00 PM) Kastrosky discussed
possible time change back to 1:00 PM. Miller stated there was an agreement made in the past and should
be upheld; he asked why this was even being discussed again. Kastrosky said the other [Committee]
members were interested in reconsidering it. Rondeau noted the schedule has been set and will change to
1:00 PM this all. Kastrosky said the two interested in 4:00 PM meetings were absent recently when it was
at 4:00 and suggested no vote be taken until the full Zoning Committee is present.
Jardine made a motion to keep the six-month [rotation] schedule as is; second by Maki; carried 4 yes / 0
no.
F. DISCUSSION / POSSIBLE ACTION – COMPREHENSIVE PLANNING: Director Kastrosky reported that
a cookout/meeting would be held twice the week of July 20th in the northern / southern portions of the County
(Towns of Bell & Cable) with a presentation of parceling of the County. Towns, Planning Commissions,
County Board, Zoning Dept. as well as guests were invited.
Kastrosky also reported that Kim Bro wants to get involved with ‘transitional soils’ info / presentations and
he was told to contact SHE, however, that did not happen and he instead talked with some Towns which in
turn brought up some ‘issues’. Kastrosky stated he would like to write a letter to Mr. Bro on the proper
protocol and proper channels in this situation. He said Bro also asked to be part of a panel discussion but the
information he has is ‘somewhat insignificant and not critical or vital’ to the process and asked the
Committee’s opinion to place some direction over situations like this noting that Bro deserves to bring his
ideas but to not take control.
G. DISCUSSION / POSSIBLE ACTION – NR115 RE-WRITE UPDATE: Kastrosky reported on the most
recent meeting of county code administrators in New Richmond; the DNR listened to input, there was a Q &
A session and negotiations w/ top DNR officials. Not all new State regulations will affect Bayfield County as
some are less restrictive than what we have now; two years will be allowed to change county ordinances but
we won’t have much to change.
H. OTHER ITEMS THAT MAY COME BEFORE THE COMMITTEE (discussion only):
o Supervisor Maki asked if Zoning. and Land Conservation have a good relationship. Kastrosky said the
County has allowed Land Conservation to actually ‘run their Dept.’ so things are working well. He noted
there have been some clashes between Land Conservation and the DNR which were unproductive.
Supervisor Rondeau reported that a group in his area was impressed how Land Conservation and the
Zoning Dept. worked together. L.U.S. Travis Tulowitzky stated the disagreements between the DNR /
Land Conservation makes it difficult because Zoning works with both and difficult as well for residents
when dealing with all three entities and their problems. Maki asked if it is necessary to deal w/ the DNR
and Kastrosky said that in some cases DNR permits are required. Tulowitzky brought up the fact that
John Spangberg has a tremendous workload right now covering positions in other counties which the
State is not filling at this time.

o Kastrosky noted the Dept. will seek to acquire authority over ‘rip rap’ issues in the future as the DNR
does not have a good handle on it.
11. MONTHLY REPORT: Motion to approve as prepared by Maki / Jardine; carried 4 yes / 0 no.
12. BUDGET & REVIEW:
o Rondeau noted there are cuts but doesn’t believe they are ‘drastic’ and he said the Board is trying to be
‘proactive’. It was noted that voluntary lay-offs probably wouldn’t save very much, better ideas are needed
such as staff sharing. The 2010 budged is kept at a ‘zero’ increase.
o Maki asked if Zoning’s vehicles are in the motor pool; Kastrosky noted Zoning has four vehicles including an
old, high mileage truck from the Sheriff’s Dept. and a low mileage Aveo.
o Kastrosky reported the Dept. is trying to double fees when legitimate and abuses occur; he also stated
there are costs to us w/ mandatory (State regulated) sanitary permitting, which all comes out of our budget;
hopefully there could be a small fee for users in the future.
