CALL TO ORDER OF PUBLIC HEARING: By Vice Chairman Rondeau at 1:01 PM. 2. ROLL CALL: Jardine, Miller, and Rondeau, present; Beeksma, absent/excused; Maki, absent. 3. AFFIDAVIT OF PUBLICATION: Read by Director Karl Kastrosky. 4. REVIEW OF MEETING FORMAT: By Vice Chair Rondeau. It was noted at this time that the speaker system was out of order, therefore, no audio would be available for the public hearing / meeting. 5. PUBLIC HEARING: A. SCOTT / SUE WALD CONDITIONAL USE REQUEST: Sawmill / Planer, Woodworking located on a parcel in the S ½ of the NE ¼, West of the Town Road in Section 14, Township 43 N, Range 8 W, Town of Cable. Applicant was not present (arrived late, after public hearing). Support / Opposition: None. Director Kastrosky: File Report-- Town Board recommended approval is on file, stating “it fits with the land use plan and supports home-based business and is consistent with the future land use plan.” AZA Furtak said this business has been occurring on the property for years without any complaints; plan is to have their son join the business and additional aspects will be added to current business; they will have more than one non-resident employee, therefore, does not qualify for a home-based business; sales will occur at their greenhouse as well as internet sales. 6. ADJOURNMENT OF PUBLIC HEARING: Motion at 1:06 PM by Jardine / Miller to adjourn; carried. 7. CALL TO ORDER OF ZONING COMMITTEE MEETING: By Vice Chairman Rondeau at 1:07 PM. 8. ROLL CALL: Jardine, Miller, and Rondeau, present; Beeksma, absent/excused; Maki, absent 9. MINUTES OF PREVIOUS MEETING(S): Motion by Jardine / Miller to approve the Jan. 21, 2010 minutes as pre- pared; carried 3 yes / 0 no. 10. BUSINESS: A. SCOTT / SUE WALD CONDITIONAL USE REQUEST: Sawmill / Planer, Woodworking located on a parcel in the S ½ of the NE ¼, West of the Town Road in Section 14, Township 43 N, Range 8 W, Town of Cable. Motion by Jardine / Miller to approve. Discussion: Rondeau stated he is familiar with this business, and doesn’t see any problems with noise, etc.; Wald had contacted neighbors, none had a problem with this. Carried 3 yes / 0 no. - Agenda Review and Alteration - B. BAYFIELD STORAGE LLC (JON NELSON) SPECIAL USE REQUEST: Boat Storage Building parcel (04- 006-02-50-04-04-000-12100) located in Lot 2 of CSM 1674, Section 22, Township 50 N, Range 4 W, Town of Bayfield. Jon Nelson said the purpose is to fill a demand for indoor heated boat storage. Kastrosky stated the Town placed conditions and asked if Mr. Nelson could abide by them. Nelson answered ‘yes’. (Conditions follow): • Building is to be painted ‘forest colors’ to blend with the wooded background. • Is to have a year ‘round tree barrier’ (conifers) to shield it from Hwy 13 to the extent possible. Lights are to be directed downward and shielded so they do not glare at or onto Hwy 13. • No outside boat storage is allowed with this permit. • If boat maintenance or repair is conducted, any waste fluids or materials from the maintenance or repair process are to be disposed of in accordance with applicable regulations and in a safe/non- polluting manner. • In any construction, Bayfield Storage LLC must avoid building upon any wetlands that may be present on, or near the property. • The Plan Commission found the special use request to be in accordance with the Comprehensive Plan; recommended Town Board approval; requested the aforementioned conditions be permanently attached to the special use permit. AZA Casina noted there are some wetlands on the property, however not on the building site, but concern would be at the rear of the property. Nelson commented that there might possibly be canvas work on site, however, limited room wouldn’t allow for much maintenance; in the future sanding / varnishing work is planned for another building. He plans to ‘rough in’ a restroom but fixtures won’t be put in at this time. Jardine made a motion to approve with the conditions placed by the Town of Bayfield; second by Miller; carried 3 yes / 0 no. C. BREMER BANK NA PRELIMINARY PLAT (7 Lots) NW ¼ NE ¼ of SW ¼, Section 17, Township 49 N, Range 5 W, Town of Bayview. Agent Richard Geisen said currently they own three rental cabins on a 10-acre parcel. They have attempted to sell the property as a whole but there were no interested buyers; there has been interest if it is subdivided. He said there is no change in dynamics except to be owned by several individuals instead of just one; once sold, Bremer will be done but is taking care of until that time. Kastrosky said the lots cannot be further subdivided; this is in the preliminary state; it will be noticed for final plat next month; Town approved this Feb. 9, 2010, however, Town of Bayview doesn’t have a comp plan; it meets preliminary Dept. review, is compatible with the county comp plan. Motion by Jardine / Miller to approve the preliminary plat. Kastrosky said he will proceed to have the final drafted for the surveyor’s office and final map presentation next month. Carried 3 yes / 0 no. D. RICH WSZALEK (postponed from 1/21/10 meeting) CONDITIONAL USE PERMIT: Woodworking, Glass Etching Studio, Gift Shop: Agents, Megan and Larry Racheli noted this was formerly a plumbing storage building and said some things have changed since they first applied; they now are owners of the property; plans are to turn it into a woodworking shop, however, they will “hold off on opening a gift shop and glass etching”. AZA Casina reminded them that covenants of the golf course apply to this lot. Mr. Racheli said there is older plumbing and a drain field present, but they won’t use it until they can tie into a sewer or put in a new system; it is zoned R- RB; the storage building has been there for 15 years. Racheli clarified that they are retracting the gift shop / glass etching portion of the business shop at this time; he was aware that they are required to reapply when/if they want to continue with the original plans. Kastrosky reported the Town approved this request; with ‘findings of fact and conclusion’ attached to their approval form as follows: • Applicant indicated he alone will conduct business on the property; Mr. Wszalek was asked to remove his business signs; Wszalek will ‘apparently’ store items in another bldg. on the property but will not conduct business there. Racheli will not conduct retail sales or glass etching until a later date when sewer / water are obtained. • Applicant was informed by the Plan Commission that he is apparently subject to Apostle Highlands Golf Assoc. covenants which limit some uses of the property which apparently affect the number of businesses (one) and the size of signage (less than Town of Bayfield ordinance). The Town noted to Racheli that such density in an area zoned R-RB and intended (future land use map) as Residential, would run counter to the Town of Bayfield Comprehensive plan. Bayfield County Planning / Zoning Public Hearing & Meeting – Feb. 18, 2010 Page 3 of 4 • With recognition that the conditional use permit solely requests permission to utilize one bldg. as a woodshop, and remaining aspects of the original conditional use permit no longer are requested, the Plan Commission finds that this request complies with the Comprehensive Plan and recommends the Town Board recommend approval to Bayfield County Planning / Zoning. Motion by Miller / Jardine to approve just the woodworking shop, with conditions placed by the Town of Bayfield. Discussion: Kastrosky said the Town noted this is compatible w/ their land use plan. Carried 3 yes / 0 no. E. CITIZENS’ CONCERNS / INPUT: None F. DISCUSSION / POSSIBLE ACTION RE LANGUAGE TO INCREASE TOWER HEIGHT (300’): Director Kastrosky reported he has not had much time to deal w/ this and noted that with the last few tower requests, it wasn’t imperative to change it. Discussion was that perhaps it should be 199 ft. or to 300 ft. if needed but applicant would have to show justification; other agencies set standards and regulations on higher towers. Consensus was to place this Item on the April agenda, as March already has quite a long agenda. Motion by Jardine / Miller to bring this to the April public hearing as a potential ordinance amendment. Carried 3 yes / 0 no. G. DISCUSSION / POSSIBLE ACTION RE PROCEEDING WITH PUBLIC HEARING LANGUAGE REQUIRING REZONES FOR APPROVAL OF ‘ALTERNTIVE DEVELOPMENTS’ OR ‘RESIDENTIAL SUBDIVISIONS’: It was noted that in previous meetings Supervisor Maki requested this change. Following discussion, and in lieu of Maki’s absence, no action was taken. H. DISCUSSION / POSSIBLE ACTION – ‘COMPREHENSIVE PLANNING’: Kastrosky said there will be a show of maps for all towns future land use, overlays, and soils, etc. to add to the land use plan (March 18th meeting). I. DISCUSSION / POSSIBLE ACTION – ‘COURT RULING RE CFS, LLC REZONE’: Kastrosky reported the County Board heard this (Tues. night) with a portion in closed session; it has been sent back to the Zoning Committee to be reheard through public hearing process (the old application plus entering of new information). Kastrosky said he will obtain the DNR letter notifying the stream is not navigable; he plans to place this Item first on the agenda. This will be reviewed against land use plans at town / county levels; the Town will rehear it as well. Kastrosky said he would like the fact to be determined at the hearing that the Zoning Dept. did not err, and that “we got stuck in the wrong process”. He also noted a technicality which deems intermittent streams navigable until proven otherwise. There was discussion RE limitation of comments at the future public hearing; Supervisor Miller suggested a limit of three minutes per person. J. OTHER ITEMS THAT MAY COME BEFORE THE COMMITTEE (discussion only): • Kastrosky discussed with new Corp Counsel would like a change in the provision in the code (now: before legal action can be taken, the item comes to the Zoning Committee) but would like it changed to “and/or the Zoning Dept.” He said he could draft an amendment to add when there are other ‘fixes’ in future. • Kastrosky reported on the Telemark sale in progress and noted a “couple contingencies” (remove the 18% slope issue; Town to correct future land use map). He said they would like to build an ‘environs area’ to develop as they see fit; the Dept. came up w/ a policy statement; would like it to “go through but they don’t have an ‘open checkbook’ to do as they want w/ permits”. 11. MONTHLY REPORT: After brief discussion, motion by Jardine / Miller to approve; carried 3 yes / 0 no. 12. BUDGET / REVENUE: None 13.
