Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:06 pm. 2. Roll Call: Jardine, Pocernich, and Rondeau – all present. Schultz – By phone. Miller – Absent. Others present were: Director-Rob Schierman, Mike Furtak-AZA, and Krystal Hagstrom - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 5. Public Hearing: A. Rick Gruel (Cable) – rezone Ag-1 to C [Parcel (1) is a 1.47-acre parcel (part of Tax ID #9970), described as a parcel of land in the NW ¼ of the NW ¼, in Section 36, Township 43 North, Range 8 West; and Parcel (2) is a 0.06-acre parcel (part of Tax ID #9970), described as a parcel of land in the SW ¼ of the SW ¼, in Section 25, Township 43 North, Range 8 West, both in Town of Cable, Bayfield County, WI] Schierman explained this is similar to the Glen Harvey rezone. Mr. Gruel acquired additional land that was part of the highway right of way. He would like to rezone the parcel to Commercial to expand is landscaping operations. Jardine asked about the conditions. Schierman asked if he meant the restrictive covenant on the deed. (Schierman read the deed restrictions [to review the deeds see V.1115 P.961 & 2 in the Bayfield County Register of Deeds]). No one spoke in support or opposition. File Report: Schierman stated there is Town Board approval and it is consistent with the Town’s comp plan. They would like to the applicant to consider rezoning existing structure zoned Industrial to Commercial if indeed it is zoned Industrial. This would take another application. Discussion ended. B. Lois Beaudrea / Robert Terrel / Robert Andersen (Cable) – rezone R-1 to C [a 0.57-acre parcel (Tax ID #10784), described as the Westerly 125’ of Lots 5-8, Block 1, Village of Cable, Section 18, Township 43 North, Range 7 West, Town of Cable, Bayfield County, WI] Page 2 of 4 ZC Planning and Zoning Public Hearing and Meeting – December 19, 2013 Schierman stated this is in the village of cable and applicants are requesting a rezone for operation of a commercial business in current building. Rondeau stated this is right next to the bank across the street from McKinney Realty. Martin Hogland, agent with Remax by the Bay in Ashland, spoke in support. Hogland explained he was representing Jen and Bob Jacobs, the perspective buyers who would like to purchase and fix it up the building and start a coffee shop / bakery which would add tax dollars to the community. It would also clean up the area. Jardine asked if the area around it is Commercial. Reply was yes. Discussion ended. C. Town of Tripp / Scott Hipsher (Tripp) – rezone from C to M [a 4.12-acre parcel (Tax ID #30308), described as two (2) parcels located in the SW ¼ of the SE ¼, Section 20, Township 48 North, Range 8 West, Town of Tripp, Bayfield County, WI] Schierman stated this is the current location of the Town Hall that is zoned Commercial and would like to rezone it to Municipal because they would like to build a salt shed. They could go through the special use process but would like to rezone to avoid coming forward in the future with more special use permits. Rondeau stated that is all part of the process of getting all the Town buildings zoned Municipal. Jardine stated all the Towns are doing this and Herbster just got done doing this. No one spoke in support or opposition. Discussion ended. 6. Adjournment of Public Hearing: Jardine made a motion to adjourn, Pocernich seconded. Motion carried. Adjourned at 4:15 pm. 7. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:15 pm. 8. Roll Call: Jardine, Pocernich, and Rondeau –all present. Schultz – By phone. Miller – Absent. Others present were: Director-Rob Schierman, Mike Furtak, AZA, and Krystal Hagstrom - Secretary. 9. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the November 21st meeting. Jardine motioned to approve, Pocernich seconded. No further discussion. Motion carried. 10. Rondeau seconded. No further discussion. Motion carried. 4/0 B. Jardine seconded. Jardine asked if there was a TBA. Schierman answered yes, the request is compatible with the Town of Cable comp land use plan and they recommend approval. Pocernich would like to include that to his motion. Jardine seconded. No further discussion. Motion carried. 4/0 C. Town of Tripp / Scott Hipsher (Tripp) – rezone from C to M [a 4.12-acre parcel (Tax ID #30308), described as two (2) parcels located in the SW ¼ of the SE ¼, Section 20, Township 48 North, Range 8 West, Town of Tripp, Bayfield County, WI] Jardine motioned to approve. Pocernich seconded. Schierman stated the Town has reviewed with comp plan and would like to reflect the current use. No further discussion. Motion carried. 4/0 Agenda Review and Alteration D. Donn / Lydelle Berquist (Barnes) – storage (boats, mini-storage) (in existing building) [a 5.37-acre parcel (Tax ID #3335), described as Lot 3 of Assessor’s Plat except that portion lying N of Lake Rd in V.1110 P.420, Section 7, Township 44 North, Range 9 West, Town of Barnes, Bayfield County, WI] Schierman stated the department received a letter from the applicant asking to table the application due to not receiving the notification of a Town meeting. (Schierman read the letter. See attachment A). Jardine stated that he remembers this same thing happening a few years ago. He doesn’t want to table he would like to get this done and over with. Pocernich agrees, just because they didn’t show up at a Town meeting doesn’t mean they have to deny it. He asked Furtak about the property. Furtak explained that the previous owner erected the buildings to store his antique farm equipment. There is an RV park there with 21 sites and the Health department thought his antiques were hazards being stored outside. It was understood that whoever rented an RV space could store their boat in the buildings but they couldn’t do a mini storage. The chairman of Barnes has sent photographs of the property and a lot of the stuff that was stored in the buildings is now back being stored outside and feel it is unsightly. It is a high residential area on Middle Eau Clair Lake. Also we tell the applicants it Page 4 of 4 ZC Planning and Zoning Public Hearing and Meeting – December 19, 2013 is their responsibility to find out when the plan commission meetings are and when the Town meetings are. We noticed them of our meeting and when they come see me and I tell them. They can also talk with the Town Clerk. Schierman stated this application has been in the office since October 22nd. Jardine stated ten years ago didn’t the zoning committee and the town and the people around there sign a waiver that they were not going to use it for a rental type thing. Rondeau stated this is the Buck –N-Bass. There were problems in the past and it is important to table and hear from the people and once they give us what they want to do we have to check up on it. Jardine agrees and remembers the buildings didn’t meet setbacks. Furtak explained the buildings did meet setbacks but they wanted to create another lot and couldn’t. Jardine motioned to table regretfully since he would like to deal with this but seeing that the applicants were out of town and the Town acted without them. Rondeau seconded. No further discussion. Motion carried. 3/1 Rondeau, Jardine, Schultz – favor. Pocernich – opposed. 11. Monthly Report Schierman explained that through November there are 409 land use permits down 57 from last year, 136 sanitary permits down 5 from last year. Budgeted 186,000 and taken in 195,000 in fees. Difference between last year and this year is $17,709. Jardine motioned to receive and place on file, Pocernich seconded. No further discussion.
