Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Bussey, Jardine, Pocernich, Rondeau and Strand – all present. Others present were: Director-Rob Schierman, Jennifer Croonborg-Murphy-AZA, Josh Rowley-AZA, and Krystal Hudachek - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. Rondeau noted at this time that item C, D, and E have been withdrawn from the agenda. 4. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. Rondeau asked the Committee members if the four items from Delta that are all related if those four could be addressed at once and if all ten items from the Town of Iron River could be addressed as one. Jardine asked if there are representatives for these items, the reply way yes and representatives were fine with addressing items as one. All Committee members were ok to address these items as one. Schierman stated that items K and L should be addresses as one as well. 5. Public Comment – relevant affairs to be addressed towards Planning and Zoning Committee [ 3 minutes per citizen] 6. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the April 16, 2015 meeting. Jardine motioned to approve, Strand seconded. No further discussion. Motion carried. 7. Public Hearing: A. Bayfield County Forestry, owner and Jason Bodine, agent (Bayfield) – reclamation plan [a 40–acre parcel (part of Tax ID# 5402) described as the SW ¼ of the SE ¼, Section 13, Township 51 North, Range 5 West, Town of Bayfield, Bayfield County, WI] Steve Probst, Bayfield County Forestry, spoke in support explaining that the plan is current and up to date. File Report: Schierman stated it was submitted and approved on March 20, 2015 by Travis Tulowitzky of Bayfield County Land Conservation. Discussion ended. Town board approved and indicated it is compatible with comprehensive plan. Discussion ended. K. Edith Merila / Karen Frechette-Zei (Bayview) – rezone F-2 to R-RB [a 0.09- acre parcel (Tax ID #6901), described as a parcel located in the SW ¼ of the NW ¼ in V.1141 P.378, Section 17, Township 49 North, Range 5 West, Town of Bayview, Bayfield County, WI] Steve Probst, representing the Bayfield County Forestry Department, explained that this situation is the result of building across property lines onto County property. This home is on the fourth owner. The department has worked with the property owner and arranged an acre for acre property swap. The land was surveyed, now just need to clean up the zoning. File Report: Schierman stated no letters of support or opposition. This situation has been through multiple committees for approval, the land has been surveyed; this is now the last step. It was either do a variance or it was suggested to clean up the towns properties and rezone them all too Municipal. These are not all of the Towns’ properties these were selected by the Town and Plan Commission mostly the parks the town’s garages. Roll Call: Bussey, Jardine, Pocernich, Rondeau and Strand – all present. Others present were: Director-Rob Schierman, Jennifer Croonborg-Murphy-AZA, Josh Rowley-AZA, and Krystal Hudachek - Secretary. 11. Previous Business: (March A) Bayfield County / Mark Abeles-Allison (Eileen) – animal boarding facility (tabled 3/19/15; 4/16/15) [a 8.12-acre parcel (Tax ID #15580), described as SE ¼ of the NW ¼ Lying North and West of State Hwy 137, Section 11, Township 47 North, Range 5 West, Town of Eileen, Bayfield County, WI] Schierman explained this request is to seek approval of the use of a property and construct an animal boarding facility for the humane society. It has been in front of the town and in front of this committee multiple times. There is a gentleman in the audience that submitted a petition with 25 signatures in opposition. The application is for the use, there is no plot plan, and there were concerns about the access to the property. Bussey asked if the Town of Eileen took a position, the answer was, yes they indicated, “we the Town Board of Eileen recommend disapproval”, they indicated no that they have not reviewed with comprehensive plan. Reasons for disapproval are location and the town needs more information on building which was not followed up on from last town meeting. Pocernich motioned to suspend rules and allow for public comment. Bussey seconded. No further discussion. Motion carried. Ted Kramolis, Chequamegon Humane Association, spoke is support explaining they are in need of a new shelter, they are unable to build at current location because of the wetlands and no proper sanitary. They came before the County Board a few months ago and were offered the 8 acres at the far East part of the research property. Attended the plan commission meeting and addressed issues. The new building will be different than the current; the dogs will be housed indoors except for the time required by the state when they need to be taken for a walk. At the shelter now, the dogs are allowed to go in and out as they please, every time a car pulls in the dogs’ bark, it’s loud, this is known. Kramolis was in contact with Dan Anderson from the DOT for about 6 weeks, and has not heard a response. There is nothing different about the building plan that was originally submitted to the Town of Eileen. Dogs will not be walked on Hwy 137 but they will be walked to the North. Every intention of putting up a clean, neat, appealing building, it will not be a pole building; there will be trees in front. There is concern about the taxes that the Town will lose; the fact is that the Humane Society is providing a service to the Chequamegon area at no cost to tax payers, supporting the care and health of animals in the area. Jardine asked if the Town gave a reason why it was denied. Kramolis answered, tax value, property value, and noise. There is a rifle range off to the side. There is also a new sauna building. The closest neighbor, Mr. Lightner, is in favor of this. As for the petition that was passed around, people know that they are only as good as the information that was provided to the people. Strand asked what type of animals will be housed there, answer from Kramolis was dogs and cats only. Croonborg-Murphy asked if there are two new board members on the town board and if the information was presented to the new members as well, the answer was yes they heard the Page 7 of 14 ZC Planning and Zoning Public Hearing and Meeting – May 21, 2015 information, they are also on the planning committee and the plan committee did approve it. Croonborg-Murphy asked if he felt that the two new members received all the information about the project, Kromolis stated he was not at the last town meeting. The information is exactly the same that was presented to the planning committee. Mark Abeles-Allison, Bayfield County Administrator, stated in late 2014 the Chequamegon Human Society approached the Executive Committee about needing a new place for their shelter and inquired about land at the Ag Station. (Mark submitted a document, see Chequamegon Human document). Bayfield County works closely with the Human Society. The executive Committee made a recommendation to the Full Board and the Full Board was enthusiastic about the idea to donate about 8 acres to the Humane Society. One of the issues is setbacks; the Humane Society has the building set back as far as allowed on the property. They worked with the County Surveyor on the driveway, and a row of trees are going to be planted in the front of the building. There are questions about the taxability; this is a nonprofit so there are no taxes generated for the Town of Eileen. At the last executive committee there is talk about selling two additional parcels which the Town of Eileen would benefit from. Jardine stated he would like to hear from the person who submitted the petition. Allen Radosevich, stated he lives in the Town of Eileen and is also on the Town Board. The petition was dropped off at his house and he does not know who brought it. It was signed by residents in that area. Main concerns being they are going to lose taxes on property, and the location of the driveway. That driveway would have to be placed on the corner; since the round-a-bout was put in there is double the traffic on Hwy 137. Many are concerned about a safety hazard and animal nuisance noise. Bussey asked if they are getting tax revenue from it now and the answer was no. Bussey stated it has been that way for many years. Rodosevich stated they would rather have a business in there that would be paying the town back. Pocernich asked to see the petition. Anne Reader, Town of Eileen resident, spoke in support, stating there was an overwhelming support from the County, which may have teed off the Town of Eileen. Reader did not know the whole process that needed to happen. She was at the plan commission meeting when they stated they would recommend approval. The Town stated they wanted more information; the Humane Association was not able to get that information back to the town before their next meeting. There was someone from Zoning at the last Town meeting and they stated that they needed an answer, so it was denied due to needing more information. Reader asks the committee to table this item until they can get more information to the town. Croonborg-Murphy stated her position at the meeting was to help the process. This item has been to two different town meetings. She encouraged the town to make a decision and that there might be a possibility that the Zoning Committee may go against that recommendation. If the town chose to deny she asked that they write the reason as to why they denied. Bussey asked if anyone reviewed to see if this is consistent with land use plan. Croonborg- Murphy stated she asked during the meeting. The future land use plan was not with the town board members at the meeting. Mark Abeles-Allison stated there was talk about the driveway, and he believes it is not at the curve, there is a site flagged and it was away from the curve farther to the West. Abeles-Allison stated it was a safety issue on that curve. Rowley stated this would still be an issue if there was a commercial business there, Abeles-Allison agreed. Bussey asked to hear from someone that is opposed and the reasons why. No one spoke. Pocernich stated he is not opposed to this but he received calls from most people on the petition. The reasons being, land value, need more tax revenue, and the noise. He spoke with half a dozen if not more. They are strongly against it. He lives next to one right now, the Ondossagon School, and he does not have a problem with it. Rondeau closed public comment. Bussey motioned to grant the conditional use permit with conditions that the animals housed at the facility remain inside except that which is required by state for walking them one at a time to comply with those state regulations. He understands the concerns but these concerns are going to be there no matter where this type of building may be located. There is a need for this. As far as the taxes from what he understands the whole experimental farm has been off the tax roll for years. Another condition that it be used to house dogs and cats only. Jardine seconded. Pocernich asked if in the future is there going to be a well or bathroom at the site. How is the animal waste handled? Reply from audience was they would install a mound system. Bussey amended motion to include that animal waste be disposed of like human waste. Jardine stated this is something that should be questioned. Croonborg-Murphy added she doesn’t know if that waste can be mixed. Commercial building will dictate how waste is disposed of. Leave it open to a code compliant system disposal for animal and human waste. Bussey will adopt that language as the condition. Jardine seconded. Pocernich asked about lighting. (April C) Terry and Patricia Pajtash / Tim Oksiuta (Delta) – final plat (preliminary 4/16/15) [a a 12.72-acre parcel (Tax ID #13479), described as Part of NE ¼ of the SE ¼, and a 14.71-acre parcel (Tax ID #13478), described as NE ¼ of the SE ¼ Less N 434’ in V.768 P.1048 & Less V.766 P.392, Section 12, Township 46 North, Range 8 West, Town of Delta, Bayfield County, WI] Schierman stated this was recommended for approval at last meeting, since that time the layout has not changed and no concerns from neighbors. Bussey asked if it looks good or if there are any problems with it. Schierman responded there are no issues or concerns, looking for approval to bring in the final for signatures. Strand seconded. Schierman stated there is town board approval and they indicated it is compatible with town comprehensive plan. Pocernich amended motion to include duration of 10 years, hours of operations Monday through Saturday no Sundays or Holidays and 6 am to 6 pm. No further discussion. Motion carried. C. Jody Kistner explained this is a request for a hobby farm for her horse, since there is an issue with setbacks and the existing wetland she has decided to find another place to board her horse and is currently looking at property in the town of Eileen. This is not the ideal spot for a horse and she does not think it would be fair to have it there. There are about 28 egg laying hens on the property. This is not a commercial production and they are not being butchered they are just egg layers. Rondeau asked how many there are, Kistner answered about 28. Bussey asked if there were any conditions, Schierman answered no. Croonborg-Murphy stated that there is a letter from the DNR dated May 4th and Nelson responded May 11th, there is a concern about possible disturbance of wetlands, the DNR never responded to Nelson, so the permit would be pending resolution of this. Bussey asked if the Town placed condition, reply was no, but there are mapped wetlands in the rear of the property. Strand asked if it met all other requirements, Croonborg-Murphy answered yes. When the DNR is on site they will make a navigability determination on the small waterway in the back of the property.
