Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:03 pm. 2. Roll Call: Bussey, Jardine, Rondeau and Strand – all present. Pocernich – Absent. Others present were: Director-Rob Schierman, Jennifer Croonborg-Murphy-AZA, Josh Rowley-AZA, and Krystal Hudachek - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication. 4. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 5. Public Comment – relevant affairs to be addressed towards Planning and Zoning Committee [ 3 minutes per citizen] 6. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the June 19, 2015 meeting. Jardine motioned to approve, Strand seconded. Bussey asked that some changes be made (Pg.11 Line 6: land uses permitted by right are allowed in indicated zoning districts provided that; Line 9: they comply with all county ordinances.; Line 21: be imposed. Is there a clause saying “notwithstanding”,; Line 23: is a land use permit,; and Pg.12 Line 2 & 3: Motion to amend carried. And Original motion as amended.). No further discussion. Motion to approve with changes carried. 7. Public Hearing: A. Michael Buran (Hughes) – second residence on a parcel [a 10.00–acre parcel (Tax ID# 34603) [V.970 P. 695], described as in the N ½ of the N ½ of the NE ¼ of the NE ¼, Section 8, Township 47 North, Range 9 West, Town of Hughes, Bayfield County, WI] Michael Buran spoke in support, explaining that he has a garage with an apartment above and he now would like to build a residence. Went to the town meeting and they stated that the apartment cannot be used as a rental and he does not intend to. No one spoke in opposition. File Report: Schierman stated there is town board approval and they indicated that it complies with their comp plan. They also indicated that the “living quarters above the garage may not be used as a rental. Meets all land use plan requirements”. Croonborg-Murphy (passed out photos) stated this is a 10 acre property with no current intension to subdivide so it is a density neutral request. Page 2 of 4 ZC Planning and Zoning Public Hearing and Meeting – July 16, 2015 The issue is that the apartment above the garage that they are living in now while they are building their new house, they cannot build 150 feet from this structure and meet the 75 foot setback so they are requesting a second residence on a parcel. The apartment is more than 500 enclosed sq. ft. so it does not meet the definition of a bunkhouse. The intended use is to use like a bunkhouse. Because of the size of the enclosed living quarters and the proximity to the garage the applicant is requesting a conditional use permit. Jardine asked if it was 43 acres, Croonborg-Murphy stated it was 10 acres. Discussion ended. 8. Adjournment of Public Hearing: Strand made a motion to adjourn, Bussey seconded. Motion carried. Adjourned at 4:12 pm. 9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:12 pm. 10. Roll Call: Bussey, Jardine, Rondeau and Strand – all present. Pocernich – Absent. Others present were: Director-Rob Schierman, Jennifer Croonborg-Murphy-AZA, Josh Rowley-AZA, and Krystal Hudachek - Secretary. 11. Business: A. Michael Buran (Hughes) – second residence on a parcel [a 10.00–acre parcel (Tax ID# 34603) [V.970 P. 695], described as in the N ½ of the N ½ of the NE ¼ of the NE ¼, Section 8, Township 47 North, Range 9 West, Town of Hughes, Bayfield County, WI] Strand motioned to approve with the condition that the existing garage / living quarters may not be a rental. Jardine seconded. No further discussion. Motion carried. B. Craig & Patti Vernon (Barksdale) – home-based business & on premise sign (country store) [i.e. on-site sales of merchandise/antiques] [a 35-acre parcel (Tax ID #517), described as NW ¼ of the SE ¼ Less par in V.591 P.252, Section 33, Township 48 North, Range 5 West, Town of Barksdale, Bayfield County, WI] Schierman stated that this application came to light after he received a phone call from Glen at Premiere Signs about a sign for a business. The department did some inquiring and found out that Patti would like to have a business a couple months out of the year and that would need a permit. The property has been surveyed and has come forward with the request. There is not town board approval. It was sent out like normal but someone was on vacation so it did not get processed. He received a call from the town chair of Barksdale who stated in a general conversation about comprehensive plan items that there was a discussion that ensued relative to this request. The town chair indicated that there was no opposition to the request. If the committee sees fit to table this due to lack of input it may not be heard again until September. This leads to the timing of the next meeting, there is only one special use request and most times Page 3 of 4 ZC Planning and Zoning Public Hearing and Meeting – July 16, 2015 the meeting is canceled, and the request is rolled over to the next month. Rondeau asked if this is rolled over to September will this be a hardship for the applicant, Croonborg-Murphy stated she is already operating the store. When the decision is made, if any, it is important to capture the fact that she is allowed only 75% of an accessory structure. They have gone through hoops to make this part of their property. It used to be kiddy corner so there was no shared property lines and they resurveyed their lines to make this part of their property. Jardine stated he was ok with approving contingent upon town board approval. Bussey asked when the town meets again. Schierman stated the first part of August. Bussey is ok with approving contingent upon town board approval. Schierman stated that if the town approved with conditions then it would need to come back to the committee. Bussey agreed. Rondeau stated that in the motion you can state that contingent upon town board approval and their conditions. Bussey disagreed and said it would have to come back to the committee if conditions were placed. How workable is this? Schierman stated that is workable, if the town does not have conditions it can be issued if conditions it would need to come back to the committee. Bussey motioned to approve contingent upon town board approval and if the town hasn’t approved it by the next meeting or recommends condition be put on then that come back to the next meeting. Jardine seconded. No further discussion. Motion carried. C. Discussion and possible action regarding electronic on line permitting process Schierman explained that phase one of the online permitting process is nearly complete. This is where the applicant enters their tax id number and select their property then the computer program auto populates the application with all the information that is needed to fill out a land use using a tax statement, information like their legal description. Have to commend the company for the level of service they provide, there are very sympathetic to our desires and wishes. They really listen to the department. Have involved Krystal since she is the one that will be working with this to issue permits and enter into the database. Everyone in the front office is satisfied. Phase two will be the drag and drop plot plan using the most recent flown photography. The computer program will come up with the dimensions of the structure that the applicant wants to build using the dimension they entered. They will then be able to drag this icon and drop where they want it on the aerial. The computer program is intelligent enough to know the scale and will scale it to size and measure the distances from property lines that are in the program along with wetlands, roads, streams etc. There will then be a summary page and if there is something wrong they can click and go to the page and make adjustments. This is also touch screen friendly. The developer just recently used this as a presentation at a national convention that is how well this program will operate. There is not a government entity anywhere in the country that is using this technology that we are aware of. This is ground breaking. Bussey asked if phase one is implemented yet or when it will be. Schierman answered, not until phase two is complete. Will share a link with the committee. Bussey asked the status on the new aerial photography. Schierman stated that is should be available by November. Croonborg-Murphy added that google maps has some overlays. Rondeau asked to have this as an update on the agenda for next month. Committee members discussion(s) regarding matters of the P & Z Department Jardine mentioned the special use permits for a residence in an Ag district that there needs to be more awareness or educations. Schierman stated on July 3rd he was on public radio talking about this issue and what is permitted by right. There also there could be some outreach done, and pamphlets may be a good idea. Strand asked about the budget bill that was signed. Schierman stated it was signed into law and now the zoning world is in chaos. Rondeau has the understanding it was only for towns that are unincorporated. Schierman explained that is not the case. Croonborg-Murphy stated that no one knows how to interpret the language. Kay Lutze is the shoreland representative and is working on how to write a model ordinance. Schierman stated this could have huge effect on the County. Croonborg-Murphy stated that when thinking about scheduling the next month’s meeting the one special use request is in Fred’s area and it is the gentleman that would like a game farm / deer yard. 12. Monthly Report / Budget and Revenue Schierman stated that there are 41 more sanitary permits issued compared to last year and 56 more land use issued compared to last year. Jardine motioned to receive and place on file, Bussey seconded. No further discussion. Motion carried. 13. Adjournment Rondeau called adjournment at 4:38 pm.
