Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Bussey, Silbert, Pocernich, Rondeau, and Strand – all present. Others present were: Director-Rob Schierman, Jennifer Croonborg-Murphy-AZA, Josh Rowley-AZA, and Krystal Hudachek - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 5. Public Comment – for issues not already on the agenda [3 minutes per citizen] 6. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the April 21, 2016 meeting. Bussey motioned to approve. Strand seconded. No further discussion. Motion carried. 7. Public Hearing: A. Stellar West Holdings LP & Stellar East Holdings LP, owners and Michael Furtak, agent (Drummond) – rezone F-2 to R-RB [a 40-acre parcel (Tax ID #13975) described as the NW ¼ of the SW ¼, in V. 1008 P. 284, Section 23, Township 44 North, Range 7 West, Town of Drummond, Bayfield County, WI] Mike Furtak, agent for Stellar Holdings, spoke in support explain this is a 40 acre parcel where the owners would like to build a garage, which is zoned F-2. He was the AZA for Bayfield County for 15 years and knows that buildings are not allowed in F-2 zone, it is reserved for large forested tracks in the county. Owners would like to rezone this to R-RB which is consistent with the future land use map and consistent with the other surrounding parcels. Rondeau asked who owned the surrounds F-2 zones, Furtak responded that the Forest Service owns most of that. Silbert asked where the building was going to be located on the parcel, Furtak stated in the North corner. Bussey asked how much of the surrounding R-RB land do Stellar Holdings own, Furtak answered all of it. Discussion ended. B. Sandra Johnson Owen (Bell) - residence in a commercial zone; to allow multiple principal structures in a commercial zone; and to allow a 1-unit short-term rental in a commercial zone [a 0.57–acre parcel (Tax ID# 8183) Page 2 of 6 ZC Planning and Zoning Public Hearing and Meeting – May 19, 2016 described as Lots 4-10, Block 12, Village of Cornucopia in V. 1146 P. 334, in Section 34, Township 51 North, Range 6 West, Town of Bell, Bayfield County, WI] No one spoke in support or opposition. Discussion ended. C. Scott and Ann Kranz, owner and Craig Haukaas, agent (Barksdale) – rezone Ag-1 to C [a 6.11-acre parcel (part of Tax ID #144) described as that parcel of land located in the SE ¼ of the SE 1/4, in V. 1152 P. 27, Section 13, Township 48 North, Range 5 West, Town of Barksdale, Bayfield County, WI] Craig Haukaas, agent for the applicant, spoke in support explaining the property is off of Nolander Road, a 6.1 acre parcel that was surveyed. The owners’ house is adjacent to this parcel. To the East is a commercial parcel along with across the highway. They would like this to be rezoned to be able to construct their dream of having their own bar and grill. Bussey stated, on the map the parcel to the East is zoned Ag-1, is this the parcel that was zoned Commercial a few months back (Cady Rezone) and has the map not been updated? Schierman stated the parcel is zoned Ag-1 and there is a commercial operation there by conditional use. Immediately East of that is the Cady property that was rezoned to Commercial. Silbert asked what type of business is in the pole barn with the vehicles, Haukaas stated some type of storage yard. Schierman stated that the Town of Barksdale did have a meeting on May 17th to amend their comp plan. Discussion ended. D. CTD, LLC (Eileen) – rezone Ag-1 to C [Parcel #1 is a 15.04-acre parcel (Tax ID #15544) described as that parcel of land in the SE ¼ of the NW ¼, less that part lying N of US Hwy 2; Parcel #2 is a 20-acre parcel (Tax ID #15549) described as the E ½ of the NW ¼ of the SW ¼; and Parcel #3 is a 14.98-acre parcel (Tax ID #35277) described as the W ½ of the NE ¼ of the SW ¼ less parcel described in V. 987 P. 834; all in V. 1158 P. 268, Section 10, Township 47 North, Range 5 West, Town of Eileen, Bayfield County, WI] Brian Custer, representing C T D LLC, spoke in support and here to answer questions and hopes that this passes. Mark Abeles-Allison, Bayfield County Administrator, Bayfield County has worked with Northern Clearing over the past couple months to find a parcel that would work with their proposed business. Went to the plan commission meeting and they adopted the proposal to change the property to a commercial use. Bussey asked what the property was to the East, reply was Ashland Ford and to the East of that is the business park. Silbert asked how far to the West is that old motel. Abeles-Allison stated about a half mile. Silbert asked if commercial activities be along Hwy 137. Abeles-Allison answered that the only thing coming before the committee today is just the Northern 14 acres boarding US 2. Schierman agreed and stated that the request is for 3 parcels but the modified version from the Town of Eileen addressed only the Northern parcel. With respect to the other parcels the applicant will still be able to fulfill what they would like to do in the Ag zoning. Bayfield County, owner and Marty Milanowski, Chairman, Town of Eileen, agent (Eileen) rezone Ag-1 to M [a 2.02-acre parcel (Tax ID #37299) described as NE ¼ of the NE ¼ S of NP RR (less 5.52 acre Omaha R-O-W in V. 69 P. 456 and less Hwy in V. 298 P. 243 and less parcel described in V. 1153 P. 90 and less parcel described in V. 1154 P. 148), in V. 1077 P. 242, in Section 10, Township 47 North, Range 5 West, Town of Eileen, Bayfield County, WI] Mark Abeles-Allison, Bayfield County Administrator, spoke in support explaining in 2015 the Bayfield County Board approved the exchange of lands between the Town of Eileen and Bayfield County, the board supported the reestablishment of the town hall in the former conference room at the Ag station. Proposed rezone is from Forestry to Municipal so this is consistent with the future land use map. Abeles-Allison corrected his statement; it is actually being changed from Ag-1 to Municipal. Discussion ended. 8. Adjournment of Public Hearing: Bussey made a motion to adjourn, Silber seconded. Motion carried. Adjourned at 4:20 pm. 9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:20 pm. 10. Roll Call: Bussey, Silbert, Pocernich, Rondeau and Strand –all present. Others present were: Director-Rob Schierman, Jennifer Croonborg-Murphy-AZA, Josh Rowley-AZA, and Krystal Hudachek - Secretary. 11. Business: A. Stellar West Holdings LP & Stellar East Holdings LP, owners and Michael Furtak, agent (Drummond) – rezone F-2 to R-RB [a 40-acre parcel (Tax ID #13975) described as the NW ¼ of the SW ¼, in V. 1008 P. 284, Section 23, Township 44 North, Range 7 West, Town of Drummond, Bayfield County, WI] Schierman stated there is town board approval on file and they have stated it is compatible with their future land use map. Bussey asked if there were any letters of support or opposition and the reply was no. Bussey motioned to recommend approval to County Board based on Town Board Approval, that it is consistent with the Comprehensive Plan and future land use map, rules and objectives of the plan and consideration of the town board recommendation, relevant public input, and community and general welfare, and consideration of the department site specific findings. Strand seconded. No further discussion. Motion carried. B. No letters of support or opposition. Croonborg-Murphy stated in 2013 she approved an 8’ x 20’ addition to the accessory structure to be used as a bathroom, after doing research on the property the use was not to be used for habitation so the condition on the permit was just that. After receiving a call this spring from the owner she said she was using the building as a long term rental. It is also the second residence on a parcel that cannot be subdivided, so those two issues are after the fact. The short-term rental is a proposed use. There are pictures in the file for the committees review. Not sure the use of the small wood structure but it is the size of a bunkhouse but it looked like there is heating but not sure if used as habitation. Bussey motioned to approve based on Town Board Approval, that it meets the Comprehensive Plan, community or general welfare. This is after the fact but it does have town board approval and the town of Cornucopia relies on tourism, this seems consistent with that. This is compatible with comp plan. Silbert seconded. Pocernich asked if there is a long term rental there now. Croonborg-Murphy answered yes, but they have moved out and she would like to use it as a short-term rental now. 30 days or less is considered short-term rental. Pocernich again stated this goes back to the after the fact, they knew they were renting this and now they are applying for a permit. The town’s approval weighs heavily on our decision, but it is still after the fact, it is not right, but if the town is willing to do it he is ok with it. Bussey asked Croonborg- Murphy if she has any sense on if the owner was doing this deliberately. Croonborg-Murphy stated she does not have much of a sense that is not factually based. She did receive a placard with the conditions. Silbert asked what the after the fact fees consist of, Croonborg-Murphy stated they are double. No further discussion. Motion carried. 4/1 (Approved – Rondeau, Silbert, Bussey, and Strand. Opposed – Pocernich) C. Scott and Ann Kranz, owner and Craig Haukaas, agent (Barksdale) – rezone Ag-1 to C [a 6.11-acre parcel (part of Tax ID #144) described as that parcel of land located in the SE ¼ of the SE 1/4, in V. 1152 P. 27, Section 13, Township 48 North, Range 5 West, Town of Barksdale, Bayfield County, WI] Schierman stated there is town board approval and they amended the comp plan and now it is consistent. There are no letters of support or opposition. Pocernich motioned to recommend approval to County Board that it meets the Comprehensive Plan and future land use map, the goals and objectives of the plan, it was approved by the town board, and consistent with the county comp plan and land use, relative public input. Bussey seconded. Silbert asked about the one residence in the area and they do not mind? Pocernich stated the applicants are the adjacent property owners and there is one other neighbor that was in support. No further discussion. Motion carried. They disapprove for parcels #15549 and 35277 to be rezoned from Ag-1 to Commercial at this time”. No letters of opposition. Silbert motioned to approve based on community and general welfare and economic inputs, Town Board Approval, that it meets the Comprehensive Plan. Bussey seconded the recommendation to the County Board. Strand wanted to clarify that it is just for parcel #15544. Ok with motion and second. Bussey included that parcels #15549 and 35277 recommend they remain as Ag- 1. Ok with motion and second. No further discussion. Motion carried. E. Bayfield County, owner and Marty Milanowski, Chairman, Town of Eileen, agent (Eileen) rezone Ag-1 to M [a 2.02-acre parcel (Tax ID #37299) described as NE ¼ of the NE ¼ S of NP RR (less 5.52 acre Omaha R-O-W in V. 69 P. 456 and less Hwy in V. 298 P. 243 and less parcel described in V. 1153 P. 90 and less parcel described in V. 1154 P. 148), in V. 1077 P. 242, in Section 10, Township 47 North, Range 5 West, Town of Eileen, Bayfield County, WI] Schierman stated this is another parcel that the town held a public hearing to amend plan. Town wrote, “The town board approves the rezone of tax ID #37299 from Commercial to Municipal without reservation”. This will complete a long drawn out process. Pocernich motioned to recommend to County Board for approval tax ID #37299 that it is consistent the Comprehensive Plan, and reviewed and recommended by the Town Board, relevant public input. Strand seconded. No further discussion. Motion carried. Agenda Review & Alteration F. Gerald Olson, Nancy Olson & Lamont Flessner / Michael Furtak (Grand View) – 1978 mobile home in a commercial zone [a 6.05-acre parcel (Tax ID #16741), described as a parcel in the NE ¼ of the NE ¼ Section 27, Township 44 North, Range 6 West, Town of Grand View, Bayfield County, WI] Schierman explained there is no town board approval and recommends this be postponed until the committee hears from the town board. Pocernich asked about the age of the mobile home. Schierman stated in the ordinance they have to be manufactured after June of ’76, this is a ’78. Rondeau explained this has been moved throughout the town for about 2 or 3 years. Rondeau agrees with Rob that town board recommendation is going to be important. Committee members discussion(s) regarding matter of the Planning & Zoning Department. Strand asked for an update on the deer farm. Schierman explained there is an appeal in the office. There will be a meeting to see how the Board of Adjustment is going to hear the case. Schierman noted he and some of the committee members went to training, learned a lot about the 17 decision making factors. 12. Monthly Report / Budget & Revenue Schierman stated the department took in $63980.87 in fees which is $30,000 less than last year as there was a $30,000 permit submitted last year. Land use is down by 29 and sanitary down by 15, but roughly one million dollars in declared value of projects were permitted. Pocernich motioned to receive and place on file. Silbert seconded.
