HomeMy WebLinkAboutPlanning & Zoning Committee - Minutes - 10/19/2017 Page 1 of 4 ZC Planning and Zoning Public Hearing and Meeting – October 19, 2017 MINUTES BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE PUBLIC HEARING AND PUBLIC MEETING OCTOBER 19, 2017 1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Bussey, Pocernich, Rondeau, Silbert and Strand – all present. Others present were: Director-Rob Schierman, and Jennifer Croonborg-Murphy-AZA, Tracy Pooler-AZA. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Public Comment – 3 minutes per citizen Kenneth Bro, expressed his appreciation for Jen’s presentation at County Lakes Forum. The forum appointed Ellen and himself to work with the County. Would like to work with the County and Land Records. 5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the September 21, 2017 meeting. Pocernich motioned to approve. Bussey seconded. Silbert stated he would like to make a correction, Silbert made a correction, in the last part of the discussion on the rezone, he asked a different question of Erica Lang: “Silbert asked a question of Erica Lang, if the delay would threaten the approval for the grant Lang stated yes it could”. No further discussion. Motion carried. Approved with corrections. 6. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 7. Public Hearing: A. David & Mary Tillmans (Bell) – continue operation of existing marina [a 3.89- acre parcel (Tax ID #36258), described as a parcel of land North & West of River in Govt Lot 2 V.1067 P.500, Section 34, Township 51 North, Range 6 West, Town of Bell, Bayfield County, WI] David and MaryBeth Tillmans, spoke in favor of the proposal. In August, they came to zoning to ask about renovating buildings at the marina. The intention is to give the marina to their son. In order of the wellbeing of the marina they feel that some of the buildings need some renovations especially the shower and restroom building. A mobile home onsite, but want more of a permanent structure there for them to live in. When talking to Jen and Rob this was the route they told us to take. In 1976 this was a marina but not a conforming marina. Page 2 of 4 ZC Planning and Zoning Public Hearing and Meeting – October 19, 2017 No other person spoke in support or opposition. Discussion ended. 8. Adjournment of Public Hearing: Bussey made a motion to adjourn, Silbert seconded. Motion carried. 9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order. 10. Roll Call: Bussey, Pocernich, Rondeau, Silbert, and Strand –all present. Others present were: Director-Rob Schierman, and Jennifer Croonborg-Murphy-AZA, Tracy Pooler-AZA. 11. Business: A. David & Mary Tillmans (Bell) – continue operation of existing marina [a 3.89- acre parcel (Tax ID #36258), described as a parcel of land North & West of River in Govt Lot 2 V.1067 P.500, Section 34, Township 51 North, Range 6 West, Town of Bell, Bayfield County, WI] Croonborg-Murphy explained that there are 3 mobile homes that were there prior to zoning, a tackle shop, a bed and breakfast where they currently reside and a boat house or two. The uses on the property do not have permits as it was prior to zoning. The additions have a variance and there is a flood study. Their campground, speaking with the Health Department has around 22 sites and all those mobile homes are considered camp sites. (Croonborg-Murphy read the definition of marina) so all these uses can be included in a marina and make this conforming. They are going to be taking out the campsite where the mobile home is. Silbert asked if this would allow the continued use of the existing and also upgrade it. Croonborg-Murphy answered yes and also in the future they would like to upgrade their shower bathroom buildings. Silbert motioned to approve based on the zoning ordinance and all applicable laws, consistency with Town comp plan and safe and healthful conditions. Bussey seconded. Schierman stated there is Town Board approval and it meets the comp plan. Silbert amended motion to include Town Board approval. Bussey ok’d second. No further discussion. Motion carried. B. Scott King (Cable) – home-based business (portable sawmill; construct sauna & garden sheds) [a 8.51-acre parcel (Tax ID #36832), described as Lot 2 of CSM #1847 in V.1110 P.666, Section 4, Township 43 North, Range 7 West, Town of Cable, Bayfield County, WI] Scott King, spoke in support stating he used the sawmill to build his house not he would like to do artistic saunas and tiny houses or small buildings to move to site. Bussey stated we received a letter from your neighbors, what hours of operation would work for you. King stated that the Town approved daylight hours only. Strand stated daylight hours in the summer are quite long. Strand suggests something more restrictive 7 am till 7 pm. Schierman stated it is consistent with Page 3 of 4 ZC Planning and Zoning Public Hearing and Meeting – October 19, 2017 comp plan and hours of operation being daylight hours only and a buffer to screen operations from road traffic. There is one additional letter from Zack Larson and supports King’s request. Bussey asks about the buffer. King stated they don’t want me to sell tiny houses up by the road and that is not his intention. He would sell them on-line. There is thick brush and woods by the road. Silbert asked if he would be ok with reduced Sunday hours. King said yes and holidays too. Rondeau asked if Tracy had anything to add to this. Pooler relied, nope. Bussey asked if you could see the operation from the road. King stated no. It is at the back of the property. Bussey motioned to approve with condition that the sawmill continue in operation at its existing location, that sales take place at that location, any products be located at that location, and the owner maintain the property so that location is not visible from the road, that operations be restricted to 7 am to 7 pm Monday through Saturday, 11 am to 4 pm on Sunday and State and legal holidays, based on Town Board Approval, that it meets the Comprehensive Plan, and all zoning law, relevant public input and impacts of the proposal. Strand seconded. Silbert asked, in terms of keeping all the operations around the sawmill does that give him some leeway to expand and not be visible from the road. Bussey stated yes. Schierman stated from the back of the house to the back-property line. No further discussion. Motion carried. C. Discussion and Possible Action regarding update in shoreland ordinance Schierman this is moving forward to full board there will be a minor housekeeping formatting errors that will come back. D. Committee members discussion(s) regarding matters of the P & Z Department. Silbert stated that he went to the Lakes Association meeting and would like to thank Jen for going with and he received many compliments and that people said that we are lucky to have her on board. Bussey asked Schierman how to move forward with interested Lakes Associations and Towns as talked about in the open comments section. Schierman stated he didn’t know how to proceed now but suggests leaving this as an agenda item to discuss in future. Bussey stated he thinks this should be pursued, there is interest and it would help to come up with a process or a adhoc committee or just a set of meetings that interested people could attend but this should be the next step is to get a process in place to pursue this. Croonborg- Murphy stated there was interest in understanding the effects of the proposal and working with land description but what would be help would be to at least provide Kenneth Bro and everyone else with the tools and how to use the tools. Bussey stated this is something that could be done before these meetings. Silbert agrees. Strand is interested in the concerned citizens forming a group by themselves and us guiding them rather than a committee appointed by the County. Pocernich & Bussey agrees with Strand. Pocernich noted that these committee need to be aware of open meetings law. Schierman talked about the fall conference. Motion carried. 13.
