MINUTES
BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE
PUBLIC HEARING AND PUBLIC MEETING
DECEMBER 21, 2017
1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order
at 4:00 pm.
2. Roll Call: Bussey, Pocernich, Rondeau, Silbert and Strand – all present.
Others present were: Director-Rob Schierman, Jennifer Croonborg-Murphy-AZA,
Tracy Pooler-AZA, and Krystal Hudachek - Secretary.
3. Affidavit of Publication: Schierman showed the audience the affidavit of publication
and the certified mailing receipts.
4. Public Comment – 3 minutes per citizen
5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the November
2017 meeting.
Strand motioned to approve. Silbert seconded. No further discussion.
Motion carried.
6. Review of Meeting Format – Chairman Rondeau explained the procedure of the
meeting. He asked everyone who wished to speak to fill out a form; and stated they will
be asked to come forward and speak into the microphone.
7. Public Hearing:
A. David Simonson & Ronda Thalacker (Delta) – EIA [1.81-acre parcel (Tax ID
#37332) described as a parcel of land in the E ½ of the SW ¼ of the SW ¼ and
W ½ of the W ½ of the SE ¼ of the SW ¼, in V. 1154 P. 1000-1001 Section 12,
Township 46 North, Range 8 West, Town of Delta, Bayfield County, WI.
Schierman stated the EIA was approved in 2006. It was found that there were
sites just North of the property line which is now purchased by the applicant.
There are no changes to the EIA or to the campground. Bussey asked if these
sites were taken into account when this EIA was approved. Schierman stated
yes. Ronda Thalacker spoke in support stating the sites were there and they
thought they owned the property, now they have purchased the land where the
sites are. Silbert stated the EIA is not in drop box, could Schierman read a
summary of the EIA. Schierman read the summary of the EIA.
Discussion ended.
B. David Simonson & Ronda Thalacker (Delta) – expansion of land to existing
campground (no new sites requested) (after-the-fact) [1.81-acre parcel (Tax
ID #37332) described as a parcel of land in the E ½ of the SW ¼ of the SW ¼
and W ½ of the W ½ of the SE ¼ of the SW ¼, in V. 1154 P. 1000-1001 Section
12, Township 46 North, Range 8 West, Town of Delta, Bayfield County, WI.

David Simonson spoke in support explaining they haven’t changed anything.
They had a survey done and it was found that there are a few sites that are over
the property line. That land is now owned by them.
Myron Anderson spoke in support stating he supports this and the regulations
proposed by Fred Strand.
Discussion ended.
C. Joseph & Mary Chramosta (Iron River) – rezone F-1 to Ag-1 [a 13.38-acre
parcel (Tax ID #18964) described as S 275’ of the NW ¼ of the NW ¼ and NE ¼
of the NW ¼, in V. 929 P. 699 Section 5, Township 47 North, Range 8 West,
Town of Iron River, Bayfield County, WI
Joe Chramosta spoke in support explaining he wanted to put up a pole shed on
his 13 acres once it was looked into it was found that the auto body shop is
illegal. Schierman stated the property was divided and the auto body shop is on
a separate parcel than the home so it wouldn’t be considered a home-based
business. Bussey asked if an auto body shop is allowed in Ag-1 and the reply
was yes. Schierman went on to explain there is no Town board approval and
they did not change their future land use map. It is better to do a text change to
the classification list. Rondeau agrees with Schierman that the list is a little
outdated. Schierman stated since there is no TBA and that is one of the things
the Committee heavily relies on this item should not be acted on. There could be
an ordinance amendment to amend the classification list. Strand stated he is
familiar with this property and it is better zoned as forestry not ag. Chromosta
added that he was at the plan commission meeting and they didn’t make a
decision because they were waiting on what this committee was going to do.
Discussion ended.
8. Adjournment of Public Hearing:
Pocernich made a motion to adjourn, Bussey seconded. Motion carried.
Adjourned at 4:19 pm.

11. Business:

Bussey motioned to approve. Pocernich seconded. No further
discussion. Motion carried.

Pooler stated the property line has been changed. Schierman stated there is
Town board approval and letters of support. The only concern is that he asked
the committee to consider combining the 1.8-acre parcel with the other parcel to
create on lot.
Silbert motioned to approve with the condition of the survey
recommended by Schierman and with the conditions written by Fred Strand that it
is consistency with both the Town's and the County's Comprehensive Plans, The
Town Board's recommendation, Relevant public input, Community welfare and
economic impacts. Strand seconded. [conditions: 1. Fireworks by permit only.
2. No discharge of pyrotechnic ammunition or Non-Incendiary Binary Reactive
Targets (Pyrotechnic ammunition contains chemicals for producing smoke or
light, as for signaling, illuminating or screening. Non-incendiary Binary Reactive
Targets are exploding targets, for example the trademarked product Tannerite) 3.
Quiet hours: from 10:30 pm to 7 am. 4. Noise must be kept at a level that is not
disturbing to neighbors of the campground. Excessive noise is anything such as
voice, radio, television, instruments, pets, vehicles, firearms discharge, etc. that
can clearly be heard by neighbors of the campgrounds. Pocernich asked if the
new tax ID would be combined by Land Records. Schierman stated Lynn would
combine them to create a new parcel number. Strand clarified that this is for the
whole campground not just the 1.8-acre parcel and there will be no new
campsites. Silbert stated that is ok with his motion. No further discussion.

Pocernich motioned to postpone until the February meeting. Strand
seconded. Croonborg-Murphy explained the applicant has paid fees for this
application and has worked really well to come into compliance, the Committee
should entertain the idea of allowing the applicant to transfer the fees to a
different application. At some point this application will be denied if the committee
decided to take a different route. Strand asked if there is an ordinance
amendment in February can this be dealt with at the same time. Schierman
answered yes. Pocernich added that the Zoning Committee is the week before
full board so the committee could fast track this and get it on the agenda for full
board. Strand agrees. No further discussion. Motion carried.
D. Start Line Inn LLC, Owner & Michael Furtak, Agent (Cable) – home-based
business (bicycle repair, accessories and sales, cross country ski repair,

accessories and sales, massage therapy, yoga classes) (after-the-fact) [a
5.11-acre parcel (Tax ID #8925), described as S ½ of Lot 4 CSM #1095, Section
20, Township 43 North, Range 7 West, Town of Cable, Bayfield County, WI]
Pocernich motioned to suspend the rules and allow for public comment.
Silbert seconded. No further discussion. Motion carried.
Mike Furtak, representing the owners, explained there are two residents on the
property. They thought by getting the permit for the short-term rental they were
allowed other commercial activities. The property is zoned R-RB and this would
be perfect for that. There is no activity in the main home. The garage is divided
and the front is used for their vehicles. The back is where the ski waxing
equipment is. Upstairs is the classroom area. This totals to 46% of the space.
Massage therapy would be for people that stay at the rental for the Birkie. The
second residence is the short-term rental and the basement is the bike shop.
There may be a small amount of inventory in the bike shop but no bikes for sale.
They live year-round on the property and there are no employees. They have
paid the ATF fees. Strand asked if this would impact the short-term rental. The
reply from Schierman was no. Schierman added that there is Town board
approval and it supports economic development with the condition that this
applies to the current owner only.
Bussey motioned to approve with the Town’s condition that it applies to
current owner, based on Town Board Approval, consistency with Town
comprehensive plan, and community or general welfare and economic impacts of
the proposal. Strand seconded. No further discussion. Motion carried.
E. Discussion possible action regarding update on general zoning regulations
Schierman stated this is on the agenda for Kim Bro and his committee but there
is no feedback from them yet.
F. Committee Members discussion regarding matters of the planning and
zoning department.
Silbert asked about the Oulu game farm, Reicks, and Boulder Point. Schierman
stated he heard from Dirk about a month ago. Nothing new about Reicks or
Boulder Point.
Silbert noted that there is a new mining bill. Strand stated that is something that
should be on the agenda for next meeting.
12. Monthly Report
Schierman noted the department is $26,076.49 above projected budget. Land
use are up by 32 and sanitary is down by 7. There are $28,026,342 worth of
projects permitted in the county this year.
Silbert motioned to receive and place on file, Pocernich seconded. No
further discussion. Motion carried.
