MINUTES
BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE
PUBLIC HEARING AND PUBLIC MEETING
MAY 17, 2018
1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order
at 4:00 pm.
2. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk – all present.
Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-AZA,
and Krystal Hudachek - Secretary.
3. Affidavit of Publication: Schierman showed the audience the affidavit of publication
and the certified mailing receipts. Rondeau noted that item D has been withdrawn.
4. Public Comment – 3 minutes per citizen
Jennifer Croonborg-Murphy spoke regarding the Departments handling of the deer farm
in Oulu.
5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the April
meeting.
Silbert motioned to approve. Strand seconded. No further discussion.
Motion carried.
6. Review of Meeting Format – Chairman Rondeau explained the procedure of the
meeting. He asked everyone who wished to speak to fill out a form; and stated they will
be asked to come forward and speak into the microphone.
7. Public Hearing:
A. Todd & Nina Bucher (Delta) – rezone from F-1 to R-RB [ a 8-acre parcel (Tax
ID #12815), described as NW ¼ of SE /4 N & W of River in V.751 P.355, Section
17, Township 46 North, Range 7 West, Town of Delta, Bayfield County, WI]
Todd Bucher spoke in support stating that he would like his property rezoned to
go along with all the other properties that are already zoned R-RB. The request
has been reviewed by the Town. They have not amended their future land use map
as they would like to amend it all at once.
Neil Schultz spoke in support as it is in the best interest of the Town of Delta.
Discussion ended.
B. Magdalen & Jen Dale (Bayfield) – dog kennel business (over 40 dogs) [a 40-
acre parcel (Tax ID #5134), described as NW ¼ of NE ¼ , Section 9, Township 50
North, Range 5 West, Town of Bayfield, Bayfield County, WI]

Jen Dale spoke in support explaining that the current owners, John and Mary Thiel,
have owned Wolf Song for about 20 years. Jen would like to move the dogs from
their current location to her property to continue the business.
Discussion ended.
C. Mathy Construction Co (Barnes) – temporary asphalt plant [a 40-acre parcel
(Tax ID #2246), described as SE ¼ of NE ¼ , Section 21, Township 44 North,
Range 9 West, Town of Barnes, Bayfield County, WI]
Eric Brye spoke in support asking for a temporary asphalt plan in the Town of
Barnes quarry for about 5-6 weeks in July through August.
Discussion ended.
D. Bolder Point LLC (Russell) – private airstrip [a 40-acre parcel (Tax ID #29362),
described as SW ¼ of SE ¼ , Section 26, Township 51 North, Range 4 West, Town
of Russell, Bayfield County, WI]
Withdrawn
E. Michael Nelson (Bayfield) – second residence on a parcel [ a 10.26-acre parcel
(Tax ID #35467) described as Lot 1 of CSM #1614 in V.9 P.314 (Located in SW
NW) Section 28, Township 50 North, Range 4 West, Town of Bayfield, Bayfield
County WI]
Susan Nelson spoke in support asking to grant a studio / guest house on their
parcel. All permits are in place and a connection to the existing sanitary system will
be done. The project is expected to be completed in October of 2018 pending
approval by the Zoning Committee.
F. A petition by Robert Schierman, Director of Planning and Zoning, on behalf
of the Bayfield County Planning and Zoning Committee, requesting an
ordinance amending sections (Title 13-1) 13-1-29; 13-1-40; 13-1-62 code of
ordinances, Bayfield county, Wisconsin.
Schierman spoke in support explaining the changes in the ordinance.
Jayson Nohl spoke in support of the MUD changes as he is the owner of Mission
Springs Resort and would like the ability to rebuild some buildings that were in
existence for many years.
G. A petition by Robert Schierman, Director of Planning and Zoning, on behalf
of the Bayfield County Planning and Zoning Committee, requesting an
ordinance creating section (Title 13-1) 13-1-61A code of ordinances, Bayfield
county, Wisconsin.
Schierman spoke in support explaining the addition of a moratorium that would be
in place for 12 months and could be extended for an additional 12 months.

Pocernich made a motion to adjourn, Zepczyk seconded. Motion carried.
Adjourned at 4:26 pm.
9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the
meeting to order at 4:26 pm.
10. Roll Call: Pocernich, Rondeau, Silbert, Strand, and Zepczyk –all present.
Others present were: Director-Rob Schierman, Tracy Pooler-AZA, and Krystal
Hudachek - Secretary.
11. Business:

Schierman stated there is Town Board Approval and they have reviewed this
request with the comp plan.
Silbert motioned to approve. Strand seconded. Silbert asked if the
applicant has any specific plans for the property. The reply from applicant was, no.
No further discussion. Motion carried.

Schierman stated the Town meets after our meeting but an email was sent stating
they expect to approve. Strand asked if this application will approve two requests.
Schierman answered yes, dog kennel and a home-based business. Silbert asked
if the Sand River runs through the property. Schierman stated that according to
the map it looks like it does.
Pocernich motioned to suspend rules and allow for public comment.
Strand seconded. No further discussion. Motion carried.
Dale stated there is no drainage on her property that runs towards the river. Across
the street they have 40 head of cattle. Silbert has concerns about manure. Dale
stated the best way to dispose of it is to spread it out evenly and it will degrade.
Pocernich motioned to approve based on consistence of the Town Board
Approval, that it meets the Comprehensive Plan, and relevant public input. Strand
seconded. No further discussion. Motion carried.

Schierman stated there is Town Board Approval and it meets the comp plan.
Strand noted that the previous conditions were from 6 am – 6:30 pm, is this still
the case.

Pocernich motioned to suspend rules and allow for public comment.
Strand seconded. No further discussion. Motion carried.
Candy Anderson spoke stating the current condition of from 6:30 and to 6:30 pm
Monday through Friday. And 6:30am to 3 pm on Saturday. Crushing is from 7 am
to 5 pm Monday through Friday. Strand asked about the duration. Anderson
replied with about 5-6 weeks depending on weather. Maybe 8-10 weeks.
Schierman stated that a condition of now till about October would be sufficient.
Strand motioned to approve with the condition that the hours of operation
be 6:30 am to 6:30 pm Monday through Friday and 6:30 am to 3:30 pm on Saturday
with it expiring on October 30, 2018, based on Town Board Approval, that it meets
the Comprehensive Plan, and relevant public input. Pocernich seconded. No
further discussion. Motion carried.

Strand asked if there was a definition of historic resort. Schierman read the
definition. Rondeau stated that resorts are dying off and he is in favor of supporting
these changes. Strand asked, in Section 2, if approved the footprint can’t change?
Schierman stated that it would only be allowed to rebuild within the existing
footprint.
Silbert motioned to recommend to the Full Board. Pocernich seconded.
No further discussion. Motion carried.
G. A petition by Robert Schierman, Director of Planning and Zoning, on behalf
of the Bayfield County Planning and Zoning Committee, requesting an

Linda Coleman explained there is a person aware that the County is proposing
the draft language. If this is going to pass today, they are prepared to instigate new
litigations. Coleman wanted the Committee to be aware and stated that if they
Committee decided to wait this may resolve itself.
Strand motioned to approve creation and move to Full Board with
corrections (as presented see Exhibit A). Silbert seconded. No further
discussion. Motion carried.
H. Joel & Amanda Schlitz (Barnes) – residence in a commercial zone [a 3.073-
acre parcel (Tax ID #1761), described as a parcel in Lot 7 in V.1136 P.121, Section
9, Township 44 North, Range 9 West, Town of Barnes, Bayfield County, WI]
Pooler explained he was at the site and did the measurements and they are
applying for a garage in the future but it will be in the R-1 zone. Schierman added
that this is one of those properties that has multiple zoning districts.
Silbert motioned to approve based on Town Board Approval and
community and general welfare. Strand seconded. No further discussion.

I. Discussion and possible action regarding flood and erosion group
No discussion
J. Discussion and Possible Action regarding metallic mining
Silbert wants to act on the guidelines from WCCA. Would like feedback from
citizens. The document is under 50 pages and it is not technical terms. Would like
the Committee to ask Linda Coleman to read and come up with suggestions.
Silbert motioned to approve Linda Coleman to review current Bayfield
County and WCCA suggestions on metallic mining ordinance and make
suggestions at a future meeting. Strand seconded. Pocernich asked if this is
something that can be done internally. Schierman stated he does not have the
time and there are very limited deposits in Bayfield County that can be mined.
Zepzcyk noted that maybe limiting the time and money spent on this. No further
discussion. Motion carried.
