MINUTES
BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE
PUBLIC HEARING AND PUBLIC MEETING
JANUARY 17, 2019
1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order
at 4:00 pm.
2. Roll Call: Rondeau, Strand and Zepczyk – all present. Silbert, Pocernich – absent.
Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-
AZA, and Krystal Hagstrom - Secretary.
3. Affidavit of Publication: Schierman showed the audience the affidavit of publication
and the certified mailing receipts.
4. Public Comment – 3 minutes per citizen
5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the November
15, 2018 meeting.
Strand motioned to approve. Zepczyk seconded. No further discussion.
Motion carried.
6. Review of Meeting Format – Chairman Rondeau explained the procedure of the
meeting. He asked everyone who wished to speak to fill out a form; and stated they will
be asked to come forward and speak into the microphone.
7. Public Hearing:
A. Mark & Kimberly Otto (Barnes) – rezone R-2 to R-3 [a 2-acre parcel (Tax ID
#2835), described as S 140’ of N 700’ of Govt Lot 1, Section 26, Township 45
North, Range 9 West, Town of Barnes, Bayfield County, WI]
Kimberly Otto, owner, spoke in support stating the current zoning district does
not allow them to build on the property as the set back is 75 feet and the lot is
only 139 feet wide. Rezoning it would allow us to build a cabin.
Discussion ended.
B. Thorp Properties LLC / Mike Furtak, agent (Iron River) – Rezone R-1 to C [a
20-acre parcel (Tax ID #19461), described as SE ¼ of NW ¼ in V.1137 P.96,
Section 18, Township 47 North, Range 8 West, Town of Iron River, Bayfield
County, WI]
Mike Furtak, agent for Thorp Properties, spoke in support stating this is next to
the Town dump and gravel pit. The parcel has been clear cut. Would like to
rezone to Commercial to be able to apply for a mini storage. This fits Iron Rivers
future land use plan.
Discussion ended.

C. Across the Pond Veterans Park Inc / Mike Furtak, agent (Hughes) – rezone
R-1 to F-1 [a 10-acre parcel (Tax ID #37679), described as Lot 1 of CSM#2019 in
V.12 P.32, (Located in NW SE) Section 12, Township 47 North, Range 9 West,
Town of Hughes, Bayfield County, WI]
Mike Furtak, agent for Across the Pond Veterans Park Inc, spoke in support
explaining they would like to build a park on Hwy 2 but it is currently zoned F-2
and nothing is allowed in F-2.
Roger Johnson also expressed his support.
Discussion ended.
8. Adjournment of Public Hearing:
Strand made a motion to adjourn, Zepczyk seconded. Motion carried.
Adjourned at 4:10 pm.
9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the
meeting to order at 4:10 pm.
10. Roll Call: Rondeau, Strand and Zepczyk – all present. Silbert, Pocernich – absent.
Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-AZA,
and Krystal Hagstrom - Secretary.
11. Previous Business:
(e.) Steven Prevost & Brenda Wilkes (Cable) – home based business (firearms
sales) (Oct 18, 2018) [a .79-acre parcel (Tax ID#10959) described as Woodcrest
Addition to Wilde River Lot 63, Section 23, Township 43 North, Range 7 West, Town of
Cable, Bayfield County, Wisconsin]
Schierman explained the Committee approved this pending TBA. Town came back with
conditions.
Strand motioned to approve with the following conditions, 1] that the business be
conducted primarily off site, 2] that there be no on-site signage, 3] best management
practices be used for the presence and storage of firearms, 4] that it have limited retail
traffic, 5] for the current owner only. Zepczyk seconded. No further discussion. Motion
carried.
(a.) Brett & Ann Tully (Clover) – short-term rental (2 units) Cabin 1 and Cabin 2
(Nov 15, 2018) [a .17-acre parcel (Tax ID#12363) described as sub-div of Lot 2 of
Robert Bartlett Jr 2nd Add Lot 3, Section 8, Township 50 North, Range 7 West, Town
of Clover, Bayfield County, Wisconsin]
Schierman explained the Town of Clover also placed conditions on this application.
Strand motioned to approve with the following conditions, 1] a contact person
available 24 hours a day within 40 miles when rented, 2] quiet hours be 11 pm to 7 am,

3] no campfires after 11 pm, 4] no fireworks, 5] rules must be posted on the rental
property, 6] this is for the current owner only, 7] any complaints about this property must
be submitted in writing to the Town of Clover, 8] copy of permit and conditions be posted
on the rental property. Zepzcyk seconded. No further discussion. Motion carried.
12. New Business

Schierman stated there is no Town Board approval but the comp plan did review
this and recommend approval.
Zepczyk motioned to approve contingent upon Town Board approval.
Strand seconded. No further discussion. Motion carried.

comp plan.
Zepzcyk motioned to approve based on Town Board Approval, relevant
public input, and general welfare. Strand seconded. No further discussion.
Motion carried.

D. Diane Ketring (Eileen) – hobby farm (1 horse) [a 2.71-acre parcel (Tax ID
#15609), described as a parcel in NW ¼ of NE ¼ in Doc 2018R-572212, Section
12, Township 47 North, Range 5 West, Town of Eileen, Bayfield County, WI]
Richard Ketring explained they have a small parcel and would like to have their
horse there. They met with Land and Water Conservation and have an idea of
what the concerns would be. Built a small shed barn for it and fencing is ready to
go up.
Schierman stated there is Town Board approval.

Strand motioned to approve for the current owner only and limit to 1
horse. Zepzcyk seconded. No further discussion. Motion carried.
E. Dirk & Jane Stolz (Oulu) – hobby farm in Forestry -1 to allow maximum of 6
bovine on 385 acres of fenced area) [Properties in Forestry-1 (F-1) zoning
districts (consisting of 265-acres) are: (Tax ID#26715) described as NW ¼ of SE
¼; in V. 1116, P. 416; (Tax ID# 37342) described as the SW ¼ of the SW ¼; in V.
1116, P. 416; (Tax ID# 34280) described as S ½ of the S ½ of the SW ¼ of the
NW ¼; in V. 1140, P. 61; (Tax ID# 34850) described as S 30-acres of the SW ¼
of the NW ¼, less S ½ of the S ½ and less N ½ of the S ½ in V. 1140, P.61; (Tax

Properties in Agricultural-1 (Ag-1) properties (consisting of 120-acres) are: (Tax

described as NE ¼ of the SW ¼ in V. 1116, P. 416; and (Tax ID# 26710)
described as NW ¼ of the SW ¼ in V. 1116, P. 416 all in Section 10, Township
48 North, Range 9 West, Town of Oulu, Bayfield County, WI]
Jane Stolz, spoke in support stating they would like 6 bovine because in the past
when they have asked for deer they said it would cause too much deforestation
and erosion on the hillsides. Went to the Town meetings and they seem
uncomfortable with only 6. We have done research and to have hardy animals
they need room to roam so that is why we have chosen 6. People have stated
there are a lot of people who have livestock without permits in the forestry areas.
Now we are here to ask what everyone told us to do. Would like to recoup and
utilize what they have been dealt.
Schierman the Town Board has submitted their disapproval for two reasons.
One denies the special use that is not compatible in the forestry zones. Two,
approve the special use application for 6 bovine on the 120 acres that is zoned
Ag.
Strand motioned to Deny the Special Use application for a hobby farm
which is an agricultural activity based on: An agricultural activity is not compatible
with the zoning designation on the majority of the property, an agricultural activity
is not consistent with either the County's or Town's Comprehensive and Land
use, plans for the majority of the property, the Town Board's recommendation,
existing vegetation cover on the majority of the land, the potential impact the
proposed use would have on other lands and land use in the vicinity, approve the
Special Use application for a hobby farm with maximum of 6 bovines on the 120
acres that are zoned agricultural (Tax Id parcels: 26708, 26709 and 26710)
based on: A hobby farm which is an agricultural activity is consistent with the
zoning designation for these 3 parcels, the Town Boards' recommendation, 120
acres is a sufficient land sized to support the proposed maximum of 6 bovines.
Zepzcyk seconded. No further discussion. Motion carried.

F. Gary Thompson (Washburn) – (after-the-fact) home-based business
(appliance sales and service, HVAC, auto / truck repair & sales, small
engine repair & sales) [a 40-acre parcel (Tax ID#31207) described as NE ¼ of
NW ¼ Section 35, Township 49 North, Range 5 West, Town of Washburn,
Bayfield County, Wisconsin]
Joe Thompson stated they would like the after the fact fees waived if possible as
they didn’t know about needing a permit but when they received the letter they
applied right away.
Schierman explained they were cooperative and there is Town Board approval
with conditions. (Schierman read conditions). They are trying to make a living
running a small business.
Zepzcyk motioned to approve with the Towns Conditions and waive the
after-the-fact fees (Towns Conditions: 1] commercial activity on the property is
subject to the home-based business requirement of occurring in no more than
75% of the existing shop building, 2] There will be no outside display lots and
outdoor lighting will be limited from causing a neighborhood nuisance. 3] the
home-based business activities will not include vehicle sales. Sales and repair of
appliances, heating and air conditioning equipment, and small engines will occur
only from inside the shop, 4] vehicle repairs may occur in the shop, and there will
be no more than five vehicles at any one time parked overnight outdoor parking &
storage will be on the east or south side of the shop where they are less likely to
obstruct the agricultural character of the property, 5] the existing downward-
facing indirect lighting of the sign is appropriate for the neighborhood). Strand
seconded. Strand added that it is based upon Town Board approval, community
and general welfare, County zoning, and properties natural resources. Zepczyk
stated that was ok with motion. No further discussion. Motion carried.
G. Discussion and possible action on waiver of Environmental Impact
Analysis of Town of Cable, owner / Karl Kastrosky, agent.
Karl Kastrosky spoke stating the Town of Cable is trying to build a very small
walk in campsite on Municipal property and infrastructure exists such as sewer,
basketball court, baseball diamonds, tennis courts and the need for an EIA is
useless and costly. Walk in tent sites, no vehicle traffic.
Rondeau motioned to waive EIA for the Town of Cable. Zepzcyk
seconded. No further discussion. Motion carried.
H. Discussion and possible action regarding metallic mining.

Schierman proposed an ordinance amendment to include metallic mining.
Strand supports this going forward.

Strand stated there is a flood impact study presentation at the Norther Great
Lakes Visitor Center and if anyone would like the info he will forward it.
13. Monthly Report
Schierman stated for the month of November the department collected $252,483 in
fees. 16 more land uses, and 8 more sanitary from last year.
Strand motioned to receive and place on file, Zepczyk seconded. No further
discussion. Motion carried.
Schierman stated for the month of December the department collected $262,534 in
fees. 27 more land uses, and 8 more sanitary from last year.

14. Adjournment
