Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk – all present. Others present were: Director-Rob Schierman and Krystal Hagstrom - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Public Comment – 3 minutes per citizen 5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the February 21, 2019 meeting. Strand motioned to approve as presented. Zepczyk seconded. No further discussion. Motion carried. 6. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 7. Public Hearing: A. James Jr & Ellen Hauser (Bayfield) – farm winery in Ag-1 zone (ATF) [a 15- acre parcel (Tax ID #4468), described as S ½ of SE ¼ of the NE ¼ less CSM #950, Section 10, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Ellen Hauser, applicant, spoke in support stating they have been producing wine since 1996 and in 2015 when the language was changed in the ordinance they were unaware of the change so now they are applying for an after-the-fact winery. Discussion ended. B. Scott & Renate Hauser (Bayfield) – farm winery (1st floor) with hyper local food prep in Ag-1 zone (ATF) [a 40-acre parcel (Tax ID #4347), described as NE ¼ of the SW ¼ , Section 2, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Schierman introduced the application stating this farm winery is on Betzold Rd and they produce and serve wine and cider, also looking for an after-the-fact permit. Marlyce (Chris) Miller (Bayfield) – multiple structure on a parcel in R-RB zone (ATF) [a 1.54-acre parcel (Tax ID #5878), described as Deerfield Estates first Add in SW ¼ NW ¼ of N ½ NW ¼ SW ¼ Lot 11, Section 14, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Merle Johnson, applicant’s daughter, spoke in support stating they would like to sell the property and in 2002 her father didn’t apply for the permits that were needed now that they want to sell the property it has come to their attention. They would only like to rent out one unit. Discussion ended. D. Herbert Mauritz (bell) – rezone from R-1 to Ag-1 [a 10-acre parcel (Tax ID #34950), described as 2 pars in NE ¼ of the NW ¼ in V.262 P.360 & V.288 P.155 Less that portion for Rd, Section 36, Township 51 North, Range 6 West, Town of Bell, Bayfield County, WI] Faith Mauritz, applicant, spoke in support stating they would like to rezone the property to Ag so they could have a small hobby farm. Silbert stated there is a letter of concern from a neighbor about manure runoff. He asked the applicant if they would be willing to work with Land and Water Conservation Department to come up with a plan on how to mange this. Mauritz stated she would be willing to work with that department. Discussion ended. E. Joanne Siroin (Washburn) – multiple structure on a parcel in Ag-1 zone [a 5- acre parcel (Tax ID #31133), described as a parcel in SW ¼ of SE ¼ in V.1157 P.708, Section 32, Township 49 North, Range 5 West, Town of Washburn, Bayfield County, WI] Postponed by applicant F. Michael E Batten Trustee / John H Batten (Drummond) – multiple structure on a parcel in R-1 zone [a 28.952-acre parcel (Tax ID #13952), described as Govt Lot 8 Less V.253 P.516, Section 22, Township 44 North, Range 7 West, Town of Drummond, Bayfield County, WI] Rondeau stated this application was published correctly as a MUD and there is also an EIA on file that needs to be approved. Ruth Dums, agent for the Batten’s, spoke in support of the EIA and stated it is on file with the County and she also has a copy if needed. Ruth Dums also spoke in support of the application stating there is 29 acres and an existing house that is not insulated for winter use. There is a care takers house and 2 additional cabins. The 2 cabins will be tearing down and replaced with a new house that will be at the 75-foot mark. Schierman asked if a new system will be installed then Dums answered yes, it is already in the works with Rasmussen plumbing. Adjourned at 4:14 pm. 9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:14 pm. 10. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk –all present. Others present were: Director-Rob Schierman, and Krystal Hagstrom - Secretary. 11. Business: A. James Jr & Ellen Hauser (Bayfield) – farm winery in Ag-1 zone (ATF) [a 15- acre parcel (Tax ID #4468), described as S ½ of SE ¼ of the NE ¼ less CSM #950, Section 10, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Schierman stated there is Town Board approval and they have reviewed it with the comprehensive plan. There are no letters of support or opposition. Silbert motioned to approve based on Town Board Approval and that it meets the comp plan and all zoning requirements. That is also supports community and general welfare. Zepczyk seconded. Pocernich asked about the after ATF fees and why they are being charged if they have been in business since 1996. Schierman stated the language was changed in 2015 to include farm wineries and this was just found that they did not have a permit. He has the understanding that previously the wine was made at an offsite location. Pocernich amended his motion to waive the after-the-fact fees. Zepczyk seconded. Amended motion carried. No further discussion. Original motion carried. B. There are no letters of support or opposition. Rondeau asked how long this one has been in business and Schierman answered less than a year. Strand asked about the local food prep. Schierman read definition of farm winery. There is no record of the septic on this property. Strand motioned to approve based on Town Board Approval, that it meets the Comprehensive Plan, and community and general welfare with the following conditions 1] existing septic system be evaluated and brought up to code prior to the issuance of the permit. Pocernich seconded. No further discussion. Motion carried. C. Marlyce (Chris) Miller (Bayfield) – multiple structure on a parcel in R-RB zone (ATF) [a 1.54-acre parcel (Tax ID #5878), described as Deerfield Estates first Add Page 4 of 6 ZC Planning and Zoning Public Hearing and Meeting – March 21, 2019 in SW ¼ NW ¼ of N ½ NW ¼ SW ¼ Lot 11, Section 14, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Schierman stated there is Town Board approval with the condition that only one room of the annex building be rented, and they have reviewed it with the comprehensive plan. There are no letters of support or opposition. They do not have the required open space to apply for a MUD so they will have to abandon one of the units. Meaning they will need to take out the kitchen facilities. Strand motioned to approve based on Town Board Approval, that it meets the Comprehensive Plan, and community and general welfare, with the following conditions 1] from one of the existing three habitable units that the food preparation and kitchen appliances be removed from one of them 2] to permit 2 single family dwelling which only one of them be a short-term rental 3] that the existing septic system be evaluated and brought up to code if necessary prior to the issuance of permit . Silbert seconded. No further discussion. Motion carried. D. Page 5 of 6 ZC Planning and Zoning Public Hearing and Meeting – March 21, 2019 Ruth Dums stated they were at the Town meeting and they did approve the application. The large house is not going to be tore down just the two smaller cabins. Strand motioned to approve based on Zoning ordinance and applicable laws and community and general welfare with the following conditions 1] that the new structure have its own septic system 2] that the septic servicing the main residence be evaluated and upgraded as necessary prior to issuance of the permit 3] that the open space requirement minimum of 90,000 sq. ft. be maintained as long as there are three units on the property 4] the two cabins identified for removal be removed within one year. Silbert seconded. No further discussion. Motion carried. G. William Maki / Neal Schroeter (Washburn) – construct and operate a private school with living quarters in an R-1 zone [a 4.150-acre parcel (Tax ID #36565), described as Lot 1 CSM #1830 in V.11 P.1 and a 6.56-acre parcel (Tax ID #36566) described as Lot 2 CSM #1830, Section 7, Township 48 North, Range 4 West, Town of Barksdale, Bayfield County, WI] William Maki explained this property has been for sale for many years and finally there is an offer to purchase. He thinks the property should be used. Schierman stated there is Town Board approval and meets the comp plan. This will be for a private school (kayaking and environmental medicine). Josh Clark agent spoke in support stating White Cap Kayak is based in Ironwood Michigan and would be teaching sea kayak courses for 3-4 days. The bottom portion of the building would be for the storage of kayaks and the upstairs would be for the learning center. There will be a small living quarters in there in case the owner returns from a kayak trip and wanted to stay the night instead of traveling back to Ironwood. There are no intentions of short-term rental. Pocernich motioned to approve based on Town Board Approval, that it meets the Comprehensive Plan. Zepczyk seconded. Strand noted that there is no short-term rental without additional permits. Ok with motion and second. No further discussion. Motion carried. H. William & Susan Erickson (Barksdale) – home-based business (1 man construction company) [a 7.6-acre parcel (Tax ID #308), described as a parcel in Govt Lot 3 & 4 in Doc 2018R-573773 Less Hwy, Section 25, Township 48 North, Range 5 West, Town of Barksdale, Bayfield County, WI] Schierman explained this is the owner of Extreme Measures and he is currently running business out of his property on 137. He has helped many people through this process and the UDC process. Pocernich motioned to approve based on Town Board Approval, that it meets the Comprehensive Plan, and community and general welfare. Zepczyk seconded. No further discussion. Motion carried. I. Committee members discussion regarding matter of the Planning and Zoning department. Page 6 of 6 ZC Planning and Zoning Public Hearing and Meeting – March 21, 2019 Schierman stated the mining ordinance will be on the May meeting not the April meeting. Pocernich asked why there are so many pages in drop box and asked if they can only have the pertinent information. 12. Monthly Report Schierman explained the department took in $15,825 in fees, land use is up by 3 permits and sanitary is behind by 8. Pocernich motioned to receive and place on file, Zepczyk seconded. No further discussion. Motion carried. 13. Adjournment Rondeau called adjournment at 4:55 pm.
