BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE
PUBLIC HEARING AND PUBLIC MEETING
APRIL 18, 2019
1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order
at 4:00 pm.
2. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk – all present.
Others present were: Tracy Pooler-AZA, & Todd Norwood-AZA.
3. Affidavit of Publication: showed the audience the affidavit of publication and the
certified mailing receipts.
4. Public Comment – 3 minutes per citizen
Mike Furtak & Karl Kastrosky asked to be put on a contractor list.
5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the March 21,
2019 meeting.
Silbert motioned to approve. Strand seconded. No further discussion.
Motion carried.
6. Review of Meeting Format – Chairman Rondeau explained the procedure of the
meeting. He asked everyone who wished to speak to fill out a form; and stated they will
be asked to come forward and speak into the microphone.
7. Public Hearing:
A. Joanne Siroin (et al) (Washburn) – (atf) multiple structures on a parcel in
F-1 zone (postponed March 21, 2019) [a 5.0-acre parcel (Tax ID# 31133);
described as a parcel in the SW ¼ of the SE ¼, in V.1157 P.708, Section 32,
Township 49 North, Range 5 West, Town of Washburn, Bayfield County, WI]
Steve Siroin gave the history of the property, house, garage with living quarters,
guest house. Dad was diagnosed with cancer and when the property went up for
sale this all came to light.
Discussion ended.
B. Nathan & Char Johnson / Mike Furtak (Iron River) – microbrewery with
tasting room in commercial zone [a 0.448–acre parcel (Tax ID# 20550);
described as Lots 6-13, Block 1, Pettingills Second Addition to Town of Iron River
in Doc.# 2015R-558540 V. 1141 P. 623-624, Section 7, Township 47 North,
Range 8 West, Town of Iron River, Bayfield County, WI]
Mike Furtak explained this will be in an existing building, brewery in a third of the
building. No production, small scale, just a tasting room. Has all federal permits.

Discussion ended.
8. Adjournment of Public Hearing:
Pocernich made a motion to adjourn, Zepczyk seconded. Motion carried.
Adjourned.
9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the
meeting to order.
10. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk –all present.
Others present were: Tracy Pooler-AZA, & Todd Norwood-AZA.
11. Previous Business:
I. James M Giles (Hughes) – hobby farm in R-RB zone (1 animal unit) [a 5.08-
acre parcel (Tax ID #18607), described as a parcel in Govt Lot 3, in V.942 P.914,
Section 23, Township 47 North, Range 9 West, Town of Hughes, Bayfield
County, WI]
Pooler provided an update to the Committee, there are chickens, goats, and
ducks.
Pocernich motioned to suspend and allow public comment. Silbert
seconded. No further discussion. Motion carried.
Furtak stated the Town Board approved for amount of chickens, goats, but no
pigs, horses, or cows.
Strand motioned to approve based on zoning ordinance and other laws,
and consideration of the Town Board with the condition that it is limited to only 1
animal unit for poultry, goats, or water fowl, the $250 atf fee be paid before the
permit is issued, and good for the current owner only. Silbert seconded. No
further discussion. Motion carried.
12. New Business
A. Joanne Siroin (et al) (Washburn) – (atf) multiple structures on a parcel in
F-1 zone (postponed March 21, 2019) [a 5.0-acre parcel (Tax ID# 31133);
described as a parcel in the SW ¼ of the SE ¼, in V.1157 P.708, Section 32,
Township 49 North, Range 5 West, Town of Washburn, Bayfield County, WI]
Norwood explained both the residences and garage are permitted and
connected to a 3-bedroom septic system. The garage has been further
remodeled to contain a kitchen and bathroom, leaving us with a situation where
there are multiple residences on a parcel that can not be subdivided.
Silbert motioned to approve with the condition that there be no short-term
rental to either structures but revisit if new owner, applies to current owner, based
on zoning ordinance. Pocernich seconded. No further discussion. Motion
carried.

Strand motioned to suspend and allow public comment. Silbert
seconded. No further discussion. Motion carried.
Furtak stated this was approved at both the plan commission and Town Board
without conditions.
Strand motioned to approve zoning ordinance and consideration from the
Town Board with the note that license with be required. Zepczyk seconded. No
further discussion. Motion carried.
C. Across the Pond Veteran Park / Mike Furtak (Hughes) – roadside park /
wayside rest [a 10-acre parcel (Tax ID #37679), described as Lot 1 CSM #2019,
in V.12 P.32, Recorded Deed found in Doc #2017R-571023, Section 12,
Township 47 North, Range 9 West, Town of Hughes, Bayfield County, WI]
Jane Snilsburg spoke and introduced the project. Furtak stated that if approved
the Zoning Department stated there would need to be a shoreland grading permit
applied for but in the past when golf courses were applied for they didn’t need
permits for watering holes. It is addressed in special use permit. Rondeau agrees
with Furtak that there isn’t a need for a shoreland grading permit. It’s a great
location. Pooler stated there is Town Board approval.
Silbert motioned to approve we will just suggest that best management
practices be used for erosion control, silt fences be erected, vegetation be
reestablished, spoil piles have erosion control to prevent soil movement and the
structure may require individual land use permits based on zoning ordinance,
Town Board recommendation, and community and general welfare. Strand
seconded. Pooler has reservations on the need for a shoreland grading permit.
Also, this is a non for profit and what happens if this dissolve will it turn into a
business. Silbert stated grading and land disturbances would be conducted
using best management practices. What is the shoreland zoning differences
between best management practices and…. Pooler stated it would go in front of
the land conservation department for review. There is a cost of $175. Silbert
asked how far from the water. Pooler answered right up to the water. Walkway
and docks going right up to the water. Depending on how it designed you could
focus a lot of water in the wrong direction. Silbert asked if we could waive the
fee. Pocernich stated yes, he thinks we could waive the fee. There is a motion
on the floor so unless you are going to waive the motion I call for a vote.
Rondeau asked for an amendment to the motion to waive the fee. Pocernich
stated the motion does not state they needed to apply for the grading so there is
no fee to waive. No further discussion. Motion carried.
D. Camilla Lehr (Clover) – residence in a commercial zone / shoreland zone [a
0.16-acre parcel (Tax ID #12232), described as Plat of Orchard City Lot 6 Block

Clover, Bayfield County, WI]
Norwood spoke about the background of the property.
Pocernich motioned to approve based on Town Board Approval, zoning
ordinance, and community and general welfare. Zepczyk seconded. No further
discussion. Motion carried.
E. Bayfield County / Jason Bodine / Judy Bourassa (Barnes) – trailhead with
parking area in F-2 [a 40-acre parcel (Tax ID #2570), described as SE ¼ of the
NE ¼, Section 16, Township 45 North, Range 9 West, Town of Barnes, Bayfield
County, WI]
Pooler spoke about the background of the project.
Strand motioned to approve based on Town Board Approval, zoning
ordinance, and community and general welfare. Silbert seconded. No further
discussion. Motion carried.
F. Discussion and possible action regarding Robert Walters bond condition.
Silbert motioned to suspend rules and allow for public comment.
Pocernich seconded. No further discussion. Motion carried.
Colman spoke regarding topic. Walters spoke stating he went to half dozen
companies and all wanted $64,000 for a bond. He also stated everything will be
removed within 5 years. Rondeau stated he spoke with Walters in the store and
he has complied with all other conditions of the permit. Furtak noted that bonds
are usually for gravel pits not for a salvage yard.
Strand motioned to waive bond requirement for 3 years then come back
to the Planning and Zoning and provide review of progress. Pocernich
seconded. No further discussion. Motion carried.
G. Discussion and possible action on short-term rental occupancy versus
DSPS (sanitary sizing).
Pooler explained the background and talked about sanitary. Furtak spoke about
families not renting but could exceed through a growing family. Health
department set occupancy. Functioning systems being maintained. Pooler
further discussed the functioning septic and capacity and need for evaluation.
Pocernich is against septic ordinance. Zepzcyk spoke about a water meter.
Silbert motioned to postpone until next month and have Linda, Rob,
Tracy, and Health Department develop a short-term solution and begin work
toward a long term solution and perhaps delay that enforcement. Pocernich
seconded. No further discussion. Motion carried.
H. Discussion and possible action regarding deadline for cervid moratorium.

Strand explained committee will finalize plans and will be ready in June. Does
not think more time is needed.
I. Discussion regarding metallic mining ordinance
Silbert and Coleman discussed conditions and changes and need for a rezone
for mining. Amendment will be on next months agenda.
J. Committee members discussion regarding matter of the Planning and
Zoning Department.
Pocernich spoke about a letter from Mark AA about filter manufacturing. There
does not need to be a special meeting but get them on next months agenda.
13. Monthly Report
Pooler gave financial report.
Rondeau motioned to receive and place on file, Pocernich seconded.
No further discussion. Motion carried.
