MINUTES
BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE
PUBLIC HEARING AND PUBLIC MEETING
JUNE 20, 2019
1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order
at 4:00 pm.
2. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk – all present.
Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-
AZA, and Krystal Hagstrom - Secretary.
3. Affidavit of Publication: Schierman showed the audience the affidavit of publication
and the certified mailing receipts.
4. Public Comment – 3 minutes per citizen
Furtak spoke on Bob Walters application giving an update that they are still working
towards getting a storm water management plan.
5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the May 16,
2019 meeting.
Pocernich motioned to approve. Zepzcyk seconded. No further
discussion. Motion carried.
6. Review of Meeting Format – Chairman Rondeau explained the procedure of the
meeting. He asked everyone who wished to speak to fill out a form; and stated they will
be asked to come forward and speak into the microphone.
7. Public Hearing:
A. Town of Cable / Bob Lang, Agent (Cable) – reclamation plan [a 6.0–acre
parcel (Tax ID# 9018), described as a parcel in the NW ¼ of the SE ¼; S of Rd in
V. 217 P. 103, in Section 22, Township 43 North, Range 7 West, Town of Cable,
Bayfield County, WI]
Bob Lang spoke in support stating he met with Travis from Land and Water
Conservation department and this portion of the pit was already covered in the
original plan.
Discussion ended.
B. Town of Cable / Bob Lang, Agent (Cable) – expand existing non-metallic
mine in municipal zone [a 6.0–acre parcel (Tax ID# 9018), described as a
parcel in the NW ¼ of the SE ¼; S of Rd in V. 217 P. 103, in Section 22,
Township 43 North, Range 7 West, Town of Cable, Bayfield County, WI]

Bob Lang spoke in support stating that when the GIS mapping came out to map
the pits it was found that we were close to a line. The parcel is 46 acres and only
40 acres is covered in the permit, so we are looking to expand the permit.

C. Karen Sorensen, Jeffery Jackson, Linaya Sorensen / Michael Furtak
(Barnes) – rezone a portion of property from R-3 to R-1 (shoreland
wetlands) [a 38.40-acre parcel (part of Tax ID #1202) described as a parcel in
Gov’t Lot 1, recorded as Doc# 2017R-569266, the portion to be rezoned is North
of Smith Lake Rd, Section 2, Township 44 North, Range 9 West, Town of Barnes,
Bayfield County, WI]
Mike Furtak spoke in support stating there is over 300 feet of frontage and they
have two kids. They would like to rezone the North portion of the property to R-1
to be able to split that land and create two lots one for each kid.
Discussion ended.
D. Mathy Construction / Candy Anderson (Drummond) – temporary asphalt
plant in Ag-1/F-1 zone [a Parcel #1 is zoned F-1; a 34.49–acre parcel (Tax ID#
14089), described as SE ¼ of the NE ¼, less Lot 1, CSM#1001. Parcel #2 is
zoned Ag-1; a 40.0-acre parcel (Tax ID# 14103), described as the NE ¼ of the
SE ¼, both in V. 945 P. 793, and in Section 30, Township 44 North, Range 7
West, Town of Drummond, Bayfield County, WI]
Candy Anderson spoke in support requesting a temporary asphalt plant for 3-4
weeks in August – September for the Highway 63 project. Hours of operation
being start up at 6 am (7 am begin) Monday - Saturday.
Discussion ended.
E. Mathy Construction / Candy Anderson (Iron River) – EIA [a 40–acre parcel
(Tax ID# 19717); described as the NE ¼ of the SW ¼ and Parcel #2 is an F-1
zoning district; a 40–acre parcel (Tax ID# 19719); described as SE ¼ of the SW
¼, both in V. 780 P. 650; and both parcels are in Section 26, Township 47 North,
Range 8 West, Town of Iron River, Bayfield County, WI]
Candy Anderson spoke in support to renew the CUP in a shoreland. This pit is
in operation since the 1990’s but they needed an EIA since it is in a shoreland
area. They set a 500-foot setback from the water for themselves. No disturbance
of trees or vegetation. It will be internally drained and top soil saved. This is only
a seasonal pit.
Discussion ended.

ID# 19719); described as SE ¼ of the SW ¼, both in V. 780 P. 650; and both
parcels are in Section 26, Township 47 North, Range 8 West, Town of Iron River,
Bayfield County, WI]
Candy Anderson spoke in support stating this is 80 acres and has been in
operation since 1990. There is a 10-year duration and it is coming due next week.
There will be no changes.

H. Ross Darst (Iron River) – rezone R-1 to C [a 6.89-acre parcel (part of Tax ID
#37856), Doc# 2018R-575603 described as the front portion (off District
St) of Lot 2, CSM#20151 in V. 12 P. 107, Doc# 2018R-574117, Section 8,
Township 47 North, Range 8 West, Town of Iron River, Bayfield County,
WI from Residential-1 to Commercial.
Larry Roecker spoke in support stating the owner would like to build storage
sheds and Bayfield Electric is in favor.
Rob Schierman stated this property went through a rezone last year and a
portion was missed so it is now being rezoned to commercial.
Discussion ended.
8. Adjournment of Public Hearing:
Silbert made a motion to adjourn, Strand seconded. Motion carried.
Adjourned at 4:15 pm.
9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the
meeting to order at 4:15 pm.
10. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk –all present.

11. Business:
A. Town of Cable / Bob Lang, Agent (Cable) – reclamation plan [a 6.0–acre

Schierman stated there is Town Board approval. The plan already contains this
area requested and was approved 2/8/2012. The ordinance requires a survey of
the boundaries for pits. There is no survey for this pit.
Silbert motioned to approve. Strand seconded. No further discussion.
Motion carried.
B. Town of Cable / Bob Lang, Agent (Cable) – expand existing non-metallic

Schierman stated there is Town Board approval and no letters of support or
opposition.
Silbert motioned to approve based on Town Board Approval, and that it
follows all dust, noise, and nuisance regulations with a survey as required by
County Ordinance. Strand seconded. Silbert amended motion to include a 10-
year duration and 1 year to get clarification of the one line that needs surveying.
Strand seconded. No further discussion. Motion carried.

Schierman stated there is Town Board approval and reviewed with comp plan
and they have approved similar requests in the past. Schierman has a different
interpretation of the comp plan that is also Bayfield Counties comp plan, there is
a statement in there and the Town has identified concerns about densities on
lakes. This rezone would allow the increase in density and causes concern.
Strand if this is granted how many parcels could be created. Schierman stated
two.
Pocernich motioned to suspend rules and allow for public comment.
Silbert seconded. No further discussion. Motion carried.
Furtak stated if you have more than 200 ft of frontage and more than 2 acres you
can do a multiple unit development. If this is rezoned and split there wouldn’t be
enough acreage to create that. They only want to split it to allow each child to
have their own property without having two residences on a parcel.
Strand motioned to approve for the portion of the land that is North of
Smith Lake Rd based on the Towns recommendation. Zepczyk seconded. No
further discussion. Motion carried.
D. Mathy Construction / Candy Anderson (Drummond) – temporary asphalt

Schierman stated the Town approved with the stipulation be the hours 6 am start
up, 7 am begin to 8 pm stop work Monday through Saturday.
Pocernich motioned to approve with the hours 6 am start up, 7 am begin
to 8 pm stop work Monday through Saturday from the month of August through
October. Zepczyk seconded. Schierman questioned the timing of the plant.
Pocernich amended motion to say through the end of the year. Zepczyk
seconded. No further discussion. Motion carried.
E. Mathy Construction / Candy Anderson (Iron River) – EIA [a 40–acre parcel
(Tax ID# 19717); described as the NE ¼ of the SW ¼ and Parcel #2 is an F-1
zoning district; a 40–acre parcel (Tax ID# 19719); described as SE ¼ of the SW
¼, both in V. 780 P. 650; and both parcels are in Section 26, Township 47 North,
Range 8 West, Town of Iron River, Bayfield County, WI]
Pocernich motioned to approve the EIA for Primrose Lane Town of Iron
River. Zepczyk seconded. No further discussion. Motion carried.
F. Mathy Construction / Candy Anderson (Iron River) – reclamation plan [a 40–
acre parcel (Tax ID# 19717); described as the NE ¼ of the SW ¼ and Parcel #2
is an F-1 zoning district; a 40–acre parcel (Tax ID# 19719); described as SE ¼ of
the SW ¼, both in V. 780 P. 650; and both parcels are in Section 26, Township
47 North, Range 8 West, Town of Iron River, Bayfield County, WI]
Schierman explained this was reviewed and approved on May 29, 2019
contingent on financial assurance.
Silbert motioned to approve based on negotiations with Travis and Land
Conservation for Primrose Lane. Pocernich seconded. No further discussion.
Motion carried.

Schierman explained there is Town Board approval and reviewed with comp
plan. No letters of opposition
Pocernich motioned to approve and including crushing, screening,
washing and loading, and stock piling in relation to Town Board Approval, and
comprehensive plan approval with a duration of 10 years. Zepczyk seconded.
Strand amended to require a boundary survey or accurate identification of
exterior boundaries. Pocernich seconded. No further discussion. Amended
motion carried. Original motion as amended carried.
H. Ross Darst (Iron River) – rezone R-1 to C [a 6.89-acre parcel (part of Tax ID

Schierman explained there is Town Board approval. No concerns. Strand stated
there is a large mapped wetland on the property and this could affect the
proposed commercial use of the property. This is not a condition but wanted it on
record.
Silbert motioned to approve based on Town Board Approval, that it meets
the Comprehensive Plan, and relevant public input. Strand seconded. No
further discussion. Motion carried.
I. Holly family (IRR Trust) Louis & Sandra Holly (Cable) – hobby farm 2 horses
in F-1 zone [ a 40-acre parcel (Tax ID#9621) described as the SW ¼ of the SW
¼ in V.1062 P.53 Section 23 Township 43 North Range 8 West Town of Cable
Bayfield County WI]
Schierman explained there is Town Board approval no letters of opposition.
Rondeau stated you can’t see the horses from the road and there used to be a
mink license on the property in 1988. Town approved with 2 horses only.
Strand motioned to approve based on Town Board Approval, with the
following conditions: setbacks for building and feed lots as per County Ordinance
must be maintained, for two horses only, and for current property owner only.
Silbert seconded. No further discussion. Motion carried.
J. Jeffrey & Holly Riordan (Hughes) – hobby farm 30 hens (no roosters) in an
R-1 zone [ a 2.52- acre parcel described as Lot 2 of Swensons First Iron Lake
Being a par in Govt. Lot 1 V.1149 P.547 Section 23, Township 47 North, Range 9
West Town of Hughes Bayfield County WI].
Schierman explained the Town Tabled as some questioned weren’t answered.
There are two letters of concern about the small lot sizes. The Chickens are
already there, this will be after the fact. This is dense property, close to the lake,
free range in the neighbor’s property. This coop does not meet the setbacks.
Pocernich motioned to deny based on town input and public input and
environmental impact. Zepczyk seconded. No further discussion. Motion
carried.
K. Committee members discussion regarding matters of the Planning and
Zoning Department.
Schierman stated he went to wetland training last week.
Strand asked about the delegation of permitting wells. Schierman stated he has
not met with Sarah yet. Strand requested that he do so and report back to the
Committee in the next few months.

Pocernich asked about the letters they receive in the mail regarding the
applications. He would like just an agenda sent to him. It was discussed and
came the agreement that agendas be emailed to the committee.
Pocernich asked about UDC.
12. Monthly Report
Schierman stated the permits are down but fees are up.
Pocernich motioned to receive and place on file, Zepczyk seconded. No further
discussion. Motion carried.
13. Adjournment
Rondeau called adjournment at 5:05 pm.
