Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk – all present. Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood- AZA, and Krystal Hagstrom - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Public Comment – 3 minutes per citizen 5. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the September 2019 meeting. Silbert motioned to approve. Strand seconded. No further discussion. Motion carried. 6. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 7. Public Hearing: A. Bolder Point LLC / Wayne Nelson (Russell) – reclamation plan [a 20-acre parcel (Tax ID #34741), described as SE ¼ of the NE ¼ in V.971 P.722 Less par in Doc #2016R-565223, Section 22, Township 51 North, Range 4 West, Town of Russell, Bayfield County, WI] Schierman explained the plan was approved in 2008, 2014 and now again on November 5, 2019 by Travis and Todd. No one spoke in support or opposition. Discussion ended. B. Bolder Point LLC / Wayne Nelson (Russell) – continue operating existing non-metallic mine in F-1 zone [a 20-acre parcel (Tax ID #34741), described as SE ¼ of the NE ¼ in V.971 P.722 Less par in Doc #2016R-565223, Section 22, Township 51 North, Range 4 West, Town of Russell, Bayfield County, WI] Schierman explained the pit has been in existence since 2008 and he would like to continue use of it. Bayfield Properties LLC / Todd Bonney (Russell) – rezone from Ag-1 to Commercial [a 4.5-acre parcel (Tax ID #29514), described as that part of NE ¼ of the NE ¼ lying N of Hwy 13 in V.895 P.697, Section 36, Township 51 North, Range 4 West, Town of Russell, Bayfield County, WI] Schierman explained that Todd owns the property and it is consistent with the future land use plan for the county and for the tribe. No one spoke in support or opposition. Discussion ended. 8. Adjournment of Public Hearing: Pocernich made a motion to adjourn, Zepczyk seconded. Motion carried. Adjourned at 4:05 pm. 9. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:05 pm. 10. Roll Call: Pocernich, Rondeau, Silbert, Strand and Zepczyk –all present. Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-AZA, and Krystal Hagstrom - Secretary. 11. Business: A. They pit is already in existence. Norwood mentioned there are only a few more years left of the pit, Wayne has a few stock piles of material for projects and once that is gone the pit will be reclaimed. Strand asked if the previous conditions are ok. Schierman answered yes. On the previous application he requested an asphalt plant but that is not being requested this time around. Strand motioned to approve with the condition of a 5-year duration (until December 31, 2024) for a non-metallic mine only and with the same conditions of Page 3 of 4 ZC Planning and Zoning Public Hearing and Meeting – November 21, 2019 the previous permit. (Conditions are: [1] Site will be a maximum of 20 acres. [2] Stock pile material will be limited to 5 acre area. [3] Excavation depth not to exceed 20 feet below grade. [4] Hot mix plant to be located with the 20 acre area. [5] Storage materials not to exceed 5 years from the date modified permit is issued. [6] Stock piling and/or mining pit material shall be only between 6 am – 6 pm daily. No work on Sundays or federal holidays. [7] A minimum of 10 days prior to crushing stockpiled materials or operating hot mix plant, owner shall notify adjacent property owners, contact the Town of Russell to schedule a public meeting with the Town Board, owner and contractor to discuss volume of materials, times and other matter pertinent to the activity. Crushing and hot mix operation shall be limited to 6 am to 6 pm daily and not allowed on Sunday or Federal Holidays. Hauling from 6:00 am to 5:30 pm. [8] The duration of the Conditional use permit shall be to December 31, 2019 December 31, 2024. [9] Will meet with the Town of Russell every July to review condition of road.) Zepczyk seconded. Schierman asked about the hot mix plant. Strand clarified that it was for the non-metallic mine only and that excluded the hot mix plant and its conditions for that hot mix plant. Zepczyk agreed. No further discussion. Motion carried. 5/0 C. Bayfield Properties LLC / Todd Bonney (Russell) – rezone from Ag-1 to Commercial [a 4.5-acre parcel (Tax ID #29514), described as that part of NE ¼ of the NE ¼ lying N of Hwy 13 in V.895 P.697, Section 36, Township 51 North, Range 4 West, Town of Russell, Bayfield County, WI] Schierman explained this is consistent with the Counties future land use map as well as the tribal future zoning map. Silbert asked if he wanted to parcel this off. Schierman stated yes, he may but it would have to be with a certified survey and it would have to meet dimensional requirements in order to approve. Silbert motioned to approve based on Town Board Approval, that it meets the Comprehensive Plan, and community and general welfare. Zepczyk seconded. No further discussion. Motion carried. Agenda Alteration D. Robert & Leigh Young (Bell) – convert existing structure to a residence and either use existing or construct a new garage in commercial zone [a 0.244- acre parcel (Tax ID #8141), described as Village of Cornucopia Lot 10-12 Block 5 in V.1038 P.926, Section 34, Township 51 North, Range 6 West, Town of Bell, Bayfield County, WI] Mike Furtak explained he was representing the Young’s, and they received a letter from zoning stating their non-conforming use has lapsed. The house has been there for over 70 years but in 2002 is was turned into a real estate office. When the Youngs purchased it as a vacation home they didn’t know they needed a special use to use it as a residence again. They added a deck without permits and that is how it was discovered. There is also a garage that is partially on the neighbor’s property. They might tear this garage down and build a new one which would meet setbacks, or they will continue to tear off part of the garage until it meets setbacks. Silbert asked if this was a stand-alone garage or will they be using this as a second residence. Furtak stated there will be one residence, one garage, and one shed on the property. Page 4 of 4 ZC Planning and Zoning Public Hearing and Meeting – November 21, 2019 Pocernich motioned to approve with the condition they abate encroachment of the garage within 1 year based on Town Board Approval, that it meets the Comprehensive Plan. Zepczyk seconded. No further discussion. Motion carried. 5/0 E. Committee members discussion regarding matters of the planning and zoning department. No discussion. 12. Monthly Report Schierman stated the department is a head of budget projection by 2,000. Land use permits are ahead by 23 and sanitary are ahead by 10. 21 million worth of projects permitted. Pocernich motioned to receive and place on file, Zepczyk seconded. No further discussion. Motion carried. 13. Adjournment Rondeau called adjournment at 4:29 pm.
