Call to Order Planning and Zoning Committee Meeting: Director Schierman called the meeting to order at 4:10 pm. 2. Roll Call: Dave Zepczyk & Brett Rondeau - present. Fred Strand & Jeff Silbert – by phone. Charly Ray - Absent Others present were: Director Rob Schierman, Tracy Pooler-AZA, and Krystal Hagstrom-Secretary. Director Schierman announced election of Chairman and Vice Chairman will take place. ➢ Election of Chairman Strand made a motion to elect Rondeau as Chairman. Motion carried. ➢ Election of Vice-Chairman Strand made a motion to nominate Silbert as Vice Chairman. Motion carried. 3. Adjournment of Zoning Committee Meeting: Silbert made a motion to adjourn at 4:10 pm, seconded by Zepczyk. Motion carried. 4. Call to Order of Public Hearing: Chairman called the public hearing to order at 4:10 pm. 5. Roll Call: Dave Zepczyk & Brett Rondeau - present. Fred Strand & Jeff Silbert – by phone. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 7. Public Comment 8. Minutes of Previous Meeting: (February 20, 2020) Strand motioned to approve the minutes from the February meeting. Zepczyk seconded. No further discussion. Motion carried. 4/0 9. Review of Meeting Format – Chairman explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. Dale Voigt / Allen Amundson (Cable) – non-metallic mine [Parcel #1 is an R-RB zoning district (V.988 P.482); a 12.18-acre parcel (Tax ID# 9007); described as W ½ NE SW less N 450’ in V. 642 P. 258 & Less that part lying N of Frels Rd in V. 676 P. 265. Dale Voigt is the current owner who obtained it from his father and Allan Amundson run the pit and has an immaculate operation. He would like to transfer the pit from Voigt to Amundson. Discussion ended. C. Anton Stempel / Sandra Kuchenmeister / Fred & Patricia Pahl (Drummond) – EIA [Parcel #1 is owned by the Pahl’s an F-1 zoning district (V.405 P.250); a 4.15-acre parcel (Tax ID# 13874); described as W 175’ of the NW SE; and Parcel #2 owned by Anton and Sandra an F-1 zoning district (V.405 P. 250) is a 16.924-acre parcel (Tax ID# 13866); described as NW SE less V.162 P.538; V.301 P.314; V.312 P.196 and V. 405 P.250), all in Section 18, Township 44 North, Range 7 West, Town of Drummond, Bayfield County, WI] Anton Stempel was on an audio call and expressed his support. Pooler stated the privies need to be brought up to code. Brian Ripp (audio call), wasn’t opposed but expressed his concern about the ATV trail that goes from the Stempels property through his to the National Forest. (Schierman showed the callers a photo that was submitted and is in the file). Stempel address the concern and stated the trail was abandoned last fall. Anton Stempel / Sandra Kuchenmeister / Fred & Patricia Pahl (Drummond) – after- the-fact private campground (existing 3 campers to 10 campers) [Parcel #1 is owned by the Pahl’s an F-1 zoning district (V.405 P.250); a 4.15-acre parcel (Tax ID# 13874); described as W 175’ of the NW SE; and Parcel #2 owned by Anton and Sandra an F-1 zoning district (V.405 P. 250) is a 16.924-acre parcel (Tax ID# 13866); described as NW SE less V.162 P.538; V.301 P.314; V.312 P.196 and V. 405 P.250), all in Section 18, Township 44 North, Range 7 West, Town of Drummond, Bayfield County, WI] Brian Ripp (audio call) has concerns about the parcel survey. Stempel replied it was surveyed in 1984. Johnson’s (in attendance) expressed concern about which road they will use to access the property. Stemple stated they will be using Blue Moon Rd only. Silbert asked about sanitation. Schierman stated the satellite privies need to be pumped by a licensed pumper. If the campers have transfer station, they need to be driven to a licensed campground with an approved dump station. There is no discharge of any gray or black water on the ground. Discussion ended. E. Jason Hieb / Renee Maki (Hughes) – rezone 4 parcels from R-1 to R-RB [Parcel #1 is a 1.65-acre parcel (Tax ID# 18830); described as Lot 4, Bear Paw Acres in Doc #2019R-576574. Parcel #2 is a 2.26-acre parcel (Tax ID #18831); described as Lot 5, Bear Paw Acres in Doc #2019R-576574. Parcel #3 is a 2.09-acre parcel (Tax ID# 18836); described as Lot 10, Bear Paw Acres in Doc #2019R-576574. Parcel #4 is a 2.06-acre parcel (Tax ID# 18837); described as Lot 11, Bear Paw Acres in Doc #2019R-576574 all in Section 10, Township 47 North, Range 9 West, Town of Hughes, Bayfield County, WI Jason Hieb & Renne Maki, both spoke in support stating they would like to rezone to be able to build a mini-storage unit. Strand motioned to approve with the conditions: That it is for a private, non- commercial campground, no more than 10 campers, and that all solid and water waste requirements are met. Parcel #2 is a 2.26-acre parcel (Tax ID #18831); described as Lot 5, Bear Paw Acres in Doc #2019R-576574. Parcel #3 is a 2.09-acre parcel (Tax ID# 18836); described as Lot 10, Bear Paw Acres in Doc #2019R-576574. Parcel #4 is a 2.06-acre parcel (Tax ID# 18837); described as Lot 11, Bear Paw Acres in Doc #2019R-576574 all in Section 10, Township 47 North, Range 9 West, Town of Hughes, Bayfield County, WI Schierman stated the Town approved and noted that this would serve the Town well. There is one letter expressing concerns that there is nothing of value to rezoning these parcels and that it would be detrimental. Dave Gerdies (audio call) spoke in opposition with concerns about the community that this is a small rustic area and a mini-storage would ruin it. Strand motioned to approve the rezone for parcel #18830 only. Silbert seconded. No further discussion. Motion carried.4/0 F. Northern States Power / Sarah Schwartz (Cable) – power sub station in R-1 zone (wetland/floodplain boundary) [.23 acre parcel (Tax ID# 10082) described as Assessor’s plat No. 2 Lot 2 Block 10 Par 100’ x 100’ in SE ¼ of the NE ¼ in V. 158 P. 639 Section 18, Township 43 North, Range 7 West, Town of Cable, Bayfield County WI] Schierman introduced the application and reminded the Committee of the rezone that was approved the month prior and discussed the fact that the current location has an aging substation that needs to be replaced. There is Town Board approval. Silbert motioned to approve based on Town Board Approval, health and general welfare of the community. Zepczyk seconded. No further discussion. Motion carried.4/0 G. Benjamin & Shawndel Spader (Barnes) – mini-storage in F-1 zone (after-the-fact) [40 acre parcel (Tax ID# 2829) described as the SW ¼ of the NE ¼ less that pt of Lot 1 of CSM #787 filed in V.5 P. 224 Section 26, Township 46 North, Range 9 West, Town of Barnes, Bayfield County, Wi] Schierman stated there is Town Board approval and it is consistent with comp plan. Zepczyk seconded. No further discussion. Motion carried.4/0 H. BRB Recycling / Dan Sullivan (Russell) – storage warehouse in Commercial zone (shoreland/wetlands) [5 acre parcel (Tax ID# 29343) described as a parcel in W ½ of the E ½ of the SE ¼ of the NE ¼ in Section 26, Township 51 North, Range 4 West, Town of Russell, Bayfield County, WI] Schierman stated this is for the Town of Bayfield, Town of Russell, and City of Bayfield, it will be one recycling center for all three to use which would eliminate the need for multiple locations. Silbert motioned to approve based on town recommendation, community and general welfare. Zepczyk seconded. No further discussion. Motion carried.4/0 I. Discussion and possible action regarding Town of Iron River letter (shipping containers). Schierman read letter from Town of Iron River (see attachment) All Committee members in favor to have Schierman look into options and come back with 2 options for the Town. J. Discussion and possible action regarding a vote to reconsider the condition of the excavation depth for Bolder Point / Wayne Nelson non-metallic mine in Bayfield. Silbert noted the minutes from the previous meetings and is wondering if there is new evidence and is asking the reasoning why this should be reconsidered. Rondeau stated Wayne just wanted it reconsidered. Silbert stated there needs to be new evidence that there is new information to be able to reconsider the decision. Schierman agreed and stated he thought Wayne would be at the meeting to discuss and he was made aware of the meeting. Roll Call vote to reconsider the condition for Bolder Point Silbert – No. Strand – No. Rondeau – No. Zepczyk – No. K. Committee members discussion regarding matters of the P & Z department. Jeff Silbert thanked the Zoning Department for all the work during this pandemic. 15. Monthly Report Schierman explained there are three months of reports. For February the department collected $19,355 land use permits are up by 19 and sanitary are up by 2. For March the department collected $65,752 and land use permits are up by 50 from last year and sanitary permits are up by 4. For April the department collected $80,642 in fees. Land use permits are up by 50 and sanitary are up by 7. Total project value permitted is $2,292,525. Silbert motioned to receive and place on file all three reports. Zepczyk seconded.
