Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Ray, Rondeau, Silbert, Strand and Zepczyk – all present. Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood- AZA, and Krystal Hagstrom - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Public Comment – 3 minutes per citizen 5. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 6. Public Hearing: A. James McKim IV Trust (Barnes) – multiple structures in R-1 zone [a ?–acre parcel (Tax ID# 1990), described as a parcel in Gov’t Lot 3 in V. 1136 P. 487, in Section 16, Township 44 North, Range 9 West, Town of Barnes, Bayfield County, WI] Schierman introduced the application stating there is 3.39 acres with a house and a garage. Applicant would like to convert garage into a house and build a new garage. Has applied for these land use permits and septic permits. Rondeau asked if there was anyone that would like to speak in favor or opposition. No one spoke. Discussion ended. B. Dean Findley (Port Wing) – rezone Ag-1 to F-1 [a 20-acre parcel (Tax ID #28328), described as E ½ of the SE ¼ of the NW ¼, in V. 944 P. 280 (Doc# 2006R-506721), Section 25, Township 50 North, Range 8 West, Town of Port Wing, Bayfield County, WI] Schierman introduced the application stating this property is completely wooded parcel zoned Ag-1 on Touve Rd. This is the first step in the process to be able to have a family campground which is not allowed in Ag-1 zone. Rondeau asked if there was anyone that would like to speak in favor or opposition. Apostle Island Camping LLC, owner & Zach & Jennifer Krivoshein, agents (Bayfield) – EIA and campground in R-RB zone [a 10–acre parcel (Tax ID# 4636), described as SE ¼ of the SW ¼ of the SW 1/4 in Doc# 2019R-579285, Section 14, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Zach Krivoshein spoke on behalf of the request stating they own 10 acres adjacent to their campground that they would like to use to expand the campground with additional 49 sites with RV hook ups, water, and sewer. There will be a camp store, and shower facility, swimming pond and malt shop. This will provide additional jobs in the community. They strive for a clean quiet campground to attract families to the area. The swimming pond will be open to the public. This is 100% funded by him and his wife, there are no investors. There will only be 49 sites opposed to the 100 that could potentially be there according to the ordinance standards. Schierman asked if they worked with an architect to design the sites and if they have a wetland delineation. Krivoshein stated yes both. Rondeau asked if there was anyone that would like to speak in favor or opposition. No one spoke. Discussion ended. 7. Adjournment of Public Hearing: Ray made a motion to adjourn, Zepczyk seconded. Motion carried. Adjourned at 4:11 pm. 8. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:11 pm. 9. Roll Call: Ray, Rondeau, Silbert, Strand and Zepczyk –all present. Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-AZA, and Krystal Hagstrom - Secretary. 10. Business: A. James McKim IV Trust (Barnes) – multiple structures in R-1 zone [a ?–acre parcel (Tax ID# 1990), described as a parcel in Gov’t Lot 3 in V. 1136 P. 487, in Section 16, Township 44 North, Range 9 West, Town of Barnes, Bayfield County, WI] Schierman stated there is Town Board approval (showed email). Strand motioned to approve based on Town Board recommendation and Plan Commission, that it meets the Comprehensive Plan, with the condition that there be no short-term rental allowed on the property. Schierman stated that is a standard condition of the land use permit. No further discussion. Motion carried. 5/0 B. Silbert motioned to approve based on Zoning ordinances, Town Board recommendation, community and general welfare and economic impacts of the proposal. Zepczyk seconded. Ray asked about the term “family campground”. Schierman stated that more than 3 campers are considered a campground. Ray asked if they should place conditions on the campground. Schierman stated we can at the time that request comes forward. Zepczyk asked if this was going to be year-round or seasonal. Schierman stated all those details will come out in the CUP request. No further discussion. Motion carried. 5/0 C. Apostle Island Camping LLC, owner & Zach & Jennifer Krivoshein, agents (Bayfield) – EIA and campground in R-RB zone [a 10–acre parcel (Tax ID# 4636), described as SE ¼ of the SW ¼ of the SW 1/4 in Doc# 2019R-579285, Section 14, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Schierman stated there are two letters of opposition, one from Joyce Anderson and one from Arnie and Patty Carver with concerns about noise, traffic, and possible trespassing. The scope does not compliment the area. Tom Gordon the Town Chair asked that the Committee table this item until the Town can hold a public hearing to allow input from the public. There is email correspondence from Mary echoing the request to table. Strand motioned to Table until the October 2020 meeting based on request from Town of Bayfield. Silbert seconded. Strand stated he believed the correct word would be to postpone. Silbert seconded. Rondeau stated since it is postponed there can be discussion. No further discussion. Motion carried. 5/0 D. Northern States Power (Eileen) – electrical substation in F-1 zone [a 38-acre parcel (Tax ID #15372), described as NE ¼ of the SE ¼ less 2 A RR in Doc 2017R-571033, Section 3, Township 47 North, Range 5 West, Town of Eileen, Bayfield County, WI] Schierman stated this is part of the second circuit project to help facilitate a reoccurring circuit so when a line goes down not everyone is out of power on that line, so they are proposing new substations. There is Town Board approval. Silbert motioned to approve based on Town Board Approval, economic impacts of the proposal, and community and general welfare. Zepczyk seconded. No further discussion. Northern States Power (Bayfield) – electrical substation in R-1 zone [a 10- acre parcel (Tax ID #36549), described as NW ¼ of NE ¼ of the NE ¼, Section 21, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Schierman stated there is a letter from the Town of Bayfield that they recommend approval including the buffer as conceived in the drawing submitted pending final approval from the Town Board. A letter from Jay (?) stating he has concerns about the location and thinks it should be on the property that already has a substation just down the road. Silbert motioned to approve based on Town planning committee, community and general welfare with the condition that fencing, or screening, buffer be placed as recommended by the planning committee. Zepczyk seconded. Ray asked about lighting. Silbert amended motion to add if there is lighting that it be in a downward position. Zepczyk ok with seconded. Ray questioned wetlands. Schierman stated DNR approval would be needed. Todd Norwood stated they are working with DNR. Ellen H? explained what they were working on with the DNR. No further discussion. Motion carried. 5/0 F. Staudemeyer Four Seasons Resort LLC (Namakagon) – mini-storage in R- RB [a 19.4-acre parcel (Tax ID #24400), described as 870’ of SE ¼ of the SW ¼ Exc E 400’ of S 653’ in V.1062 P.823, Section 4, Township 43 North, Range 6 West, Town of Namakagon, Bayfield County, WI] Amanda Staudemeyer identified herself and Brandon/Brenden (?) (via phone). Brandon/Brenden spoke on behalf of the request. The building is already there, and they would just like to be able to rent to guests that are staying at the resort to store their boats and snowmobiles. Pooler added a comment and stated there are no issues with this request. Schierman explained there is no Town Board Approval. Amanda Staudemeyer stated she was at the Town Board meeting and they approved the request. Strand motioned to approve pending receipt of Town Board Approval and all storage must be stored inside building and that lights be facing downward. Zepczyk seconded. No further discussion. Motion carried. 5/0 G. Don & Jennifer Simmons (Iron River) – hobby farm (2 miniature horses, other small farm animals, chickens with rooster, 1 goat in R-1) [a 1-acre parcel (Tax ID #20780), described as the subdivision of SW lot 19 in V.1157 P.922, Section 7, Township 47 North, Range 8 West, Town of Iron River, Bayfield County, WI] Jennifer Simmons explained she would like to have one miniature horse for her daughter. The goat is to keep the horse company in the winter months. She also has chickens with one rooster and the other small farm animals refers to the rabbits that they have for showing. They horse will be moving between their place and a family members place. There is adequate fencing and shelter. Schierman stated there is Town Board approval (via email from Town Chairman) but no rooster. Lorina Boss (by phone) commented stating they are in support of request and have no issues. Schierman stated there is one letter of opposition with concerns about pigs. Simmons stated she has no intentions of getting pigs. Page 5 of 5 ZC Planning and Zoning Public Hearing and Meeting – September 17, 2020 Strand motioned to approve for 1 miniature horse, 1 goat, chickens, no rooster, and a total limit of one animal unit, and for current property owner(s) only based on Town Board recommendation. Silbert seconded and asked if Fred would include rabbits. Strand asked if rabbits are needed. Schierman read definition of hobby farm. Strand stated he would like to add rabbits to the motion. Silbert okd second. Ray asked about hogs and if they should be excluded. Strand stated he did not include that in the motions so hogs would not be included. No further discussion. Motion carried. 5/0 H. Minutes from the August 19, 2020 meeting. No minutes available I. Committee members discussion. Schierman discussed budget. 11. Monthly Report Schierman stated the department has collected $208,140 in fees. 88 land use above last year and 41 sanitary above last year. We have been very busy.
