HomeMy WebLinkAboutPlanning & Zoning Committee - Minutes - 10/15/2020 Page 1 of 6 ZC Planning and Zoning Public Hearing and Meeting – October 15, 2020 MINUTES BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE PUBLIC HEARING AND PUBLIC MEETING OCTOBER 15, 2020 1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Ray, Rondeau, Silbert, Strand and Zepczyk – all present. Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood- AZA, and Krystal Hagstrom - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Public Comment – 3 minutes per citizen Gansluckner (by phone) spoke in opposition of item 6A, stating concerns about the extra traffic on the road. 5. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 6. Public Hearing: A. Alisia Ray (Bayfield) – EIA & Campground in R-RB [a 10-acre parcel (Tax ID #4595), described as the North 10 acres of W 15 acres of SE ¼ of SW 1/4 Section 12, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] - request a conditional use permit to construct and operate a Campground, Event Center and Retreat Center; consisting of: up to (30) tent sites, (10) camping cabins/treehouses, main structure (Event/Retreat Center) with a camping store, bathrooms, showers, sauna, steam room, hot tub, lounge area, meditation room and ice plunge. The main structure will be capable of hosting weddings or other events. Alisia Ray spoke on behalf of the request and stated that when filling out the application she was told to ask for the maximum because later on it will be very hard to add to the project so taking that into consideration she asked for the maximum. Since applying she had time to talk to people and get a better idea on what she would like to do and has spoke with the neighbors. There are three stages. Her architect, Betsy Voss, has designed a lot of the higher end restaurants in the Twin Cities. She will be guiding this project. The focus is to create a healing space with a rustic spa located in the central of the 10 acres. 2-4 person groups. This will be a barndominium roughly 2800 sq. ft. The outdoor area will be 4-6 person saunas about 96 sq. ft. She will be starting with 2 of them. There will be cedar hot tubs, self-sanitizing and will be cleansed as well. Lounge area will be on concrete or gravel with gas fire pits. Vintage solar camper with grab and go food from local restaurants. There has been a lot of confusion, since this is listed as a retreat and even center and the truth there will not be 300 Page 2 of 6 ZC Planning and Zoning Public Hearing and Meeting – October 15, 2020 people on the property at once. She was just trying to cover basis and it will be more like 50 people at once. Events would be more like a business that would want to rent the space for a party. Maybe guided snowshoe walks for example. She apologizes for not filling out the paperwork correctly. There will cold plunges, salt caves, and hybrid steam rooms. The welcome area is a lounge area with a small media area and store. Phase two will be the 400 sq. ft. cabins with a small bathroom. These are all walk-ins, so there will be no cars in the forest. Worked with a forester for managing the forest with lights and trails. The parking lot will be only for a max of 35 vehicles. Want to preserve the magic of Bayfield. She has had time to walk through the forest with a neighbor she feels uncomfortable having a campground and would be willing to strike that from the application. It would be just phase one and two. Schierman stated the department steered here in the direction of an event center and read the definition. Patricia Sweeny, spoke in support, explaining she has known Alisia since she purchased the property and has no problem with it. Rondeau asked if anyone was in opposition to now speak. Wade Williams, by phone, spoke in opposition with concerns of the lack of details on the application needed to get consideration from the committee. Second is that the proposed use is incompatible with the site and would like Ms Ray to submit a new application. The development does not meet the residential aspect at all. There are no setbacks on the application. The EIA does not meet the things needed to approve. Failed to describe where there will be run off, what trees will be cut, there is no concern about the impact. Does not address light, water, and air pollution. Asks the Committee to deny and ask Ms Ray to submit an alternative plan. Liz Fentress, spoke in opposition stating concerns of it not being compatible with the residential neighborhood that she lives in. If the campground is to go, she would like to see that in writing. Allowing an establishment of a business will set a precedence. Kate (Mitchell?), by phone, spoke in opposition stating the concerns that the application has several questions that need to be answered. This proposal is incompatible with the neighborhood. There will be too much traffic on Meyers Olson Rd. This project is too large for the 10-acre parcel and will permanently change the character of the neighborhood and not compatible with the comprehensive plan. Orrin Lokken stated he is not in favor or opposition he just would like to express his concerns and handed in a letter to the Committee (see Exhibit A). Patrick Jerich, by phone, spoke in opposition stating years ago he wanted to put in a campground and did extensive research and the permitting process is administrated by the State of Wisconsin. This application is vague. He would like her to come with an approved permit before this Committee approves. He noted that the permits that he viewed online were modified with whiteout and doesn’t know if that was done before or after the fact and would like to see the originals. Page 3 of 6 ZC Planning and Zoning Public Hearing and Meeting – October 15, 2020 Charles Finn, by phone, spoke about concerns that this is R-RB and is a broad definition of what can be allowed there. With that definition he has several concerns one being it is incomplete and vague. The area around this application is a residential and this will not fit in the neighborhood. Second is a safety concern about the roads and the higher traffic that will come if this is approved. Finally, this area there are 45 parking spots for the cabins, spots for the campground, and the main lodge and could be looking at least 100 spots. This footprint is way too large for the 10-acre parcel. Cynthia Anderson, by phone, spoke in opposition and will not take anymore of the time but would like to echo the comments of concerns. The scope is way too large for the property. Discussion ended. 7. Adjournment of Public Hearing: Ray made a motion to adjourn, Zepczyk seconded. Motion carried. Adjourned at 5:01 pm. 8. Apostle Island Camping LLC, owner & Zach & Jennifer Krivoshein, agents (Bayfield) – EIA and campground in R-RB zone [a 10–acre parcel (Tax ID# 4636), described as SE ¼ of the SW ¼ of the SW ¼ in Doc# 2019R-579285, Section 14, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] - request a conditional use permit to expand the existing campground; consisting of: (6) private cabins with parking sites; (49) camping sites; shower house with small camp store for essentials, laundry room, concessions (candy bars, ice cream, chips), Mini-golf, jumping pillow; swim pond; tiki bar and restroom or dump station to the South. Page 4 of 6 ZC Planning and Zoning Public Hearing and Meeting – October 15, 2020 Schierman stated there was a public hearing on this last month and the Town requested another month. They have decided and submitted a Town board recommendation that states On Octo 12, 2020 the Plan Commission held a public hearing and the Town Board recommended approval without conditions. The Town included 2 letters of support, 2 letters of concern, and 3 letters of opposition. Silbert had concerns and conditions about lighting, trespassing (signage on the boundary), and quiet hours. He also has concerns about the pond, will it have a dirt floor or a liner, what will it be treated with, cattails, and concerns about overflow. Zach & Jennifer Krivoshein addressed the pond issue and are working with Wi lake and pond resources, there will be treatments and orgonic treatments. Pond liner and sand boarder. Daily testing. These are becoming a common thing and the professional will come in and train us. It is freshwater fed. There is a stormwater and erosion plan. There is a stormwater basin that if there is an overflow this is where the water will go, located in the Southeast corner of the property. Ray stated the elevations is 800-foot elevation. This would be useful to have as a goal in the management plan. There is no indication of where the retention pond will be. It could potentially overflow to the cabins. Krivoshein stated they are stretching the pond to flow with the elevation change. We also did soil testing. As far as quiet time, yes, it is enforced hours of 10 pm to 7 am. Clients are screened and know this before they even book a site. The current lights are facing down and so will the new ones. We will be adding signage to let people know the boundaries. We hand out a brochure at check in. Strand asked about the pond and that pools need to meet State requirements and does this pond have to meet the same as a public pool? Krivoshein stated at this time there is nothing in writing as far as the same regulations. There is a lot that goes into the water quality portion of this. Silbert asked if they will be exchanging the water in the pond. Krivoshein stated its only required every three years at max or yearly since it is monitored daily. Silbert asked about the wetland delineation. Krivoshein stated yes it was done. Ray stated he has a bunch of questions and this is a major project, and a huge impact on the environment. This is a 10-acre site and a tremendous increase in impervious surface. Where is the fill going? Krivoshein stated to elevate the cabins and build the stormwater basin. Ray asked where the stormwater plan is. It’s not in the packet. Krivoshein stated its coming. Ray asked about the 15-foot buffer between sites. Krivoshein stated it would be existing. Working with the land to fit sites with the land. The buffer will stay and may be larger in some areas. Have been working with the logger and excavator and we are all on the same page to save what we can to leave natural beauty. Ray asked how many sites now and is it both tent and rv? Krivoshein stated 60 and it is both. Ray asked if they needed this many sites to make it a go. Krivoshein it was a formula based on revenue versus sites. There may be less. Ray asked what is the expected days you will be at full capacity? Krivoshein stated very limited. There is a balance. Formula that makes it work but needs flexibility. Ray asked about the future parking. Krivoshein stated they listened to current guests and they wanted more amenities for the guests which is the main purpose of this. Attract more families. They received a letter from the Bayfield Chamber, and they pointed out this mimics and mirrors who they target to come to the area. Ray asked about the new driveway on Co Hwy J. Krivoshein stated they purchased the easement from the neighbor. This is to eliminate the pass by traffic. Silbert asked Schierman about Datca79 and regulating the campground. Schierman stated that is the Health Departments role. Page 5 of 6 ZC Planning and Zoning Public Hearing and Meeting – October 15, 2020 Silbert motioned to approve with conditions of 1] lights be unobtrusive and pointing downward. 2] Quiet time hours be enforced. 3] perimeter boundary signs indicating the boundary of the property, based on Town Board approval, consistency with Town Comprehensive plan, maintenance of safe and healthful conditions, community and general welfare and economic impacts of the proposal and prevention and control of air pollution, water pollution, and noise as they have presented to us. Strand asked if this motion includes the EIA. Silbert stated yes, move to approve EIA and conditional use with conditions as set forth. Strand seconded. Silbert asked if Ray was satisfied with the conditions. Ray stated he is not comfortable approving without seeing the stormwater plan. He also has other conditions and would like to amend the motion to add conditions of 4] require stormwater plan be placed on file with the Zoning Department. (Schierman noted that the department does impervious surface calculations within 300 feet of a body of water. DNR implements the stormwater management plan. Krivoshein stated he met with Matt at the DNR and Todd form zoning and they will abide by the plan.) 5] the native soil horizon and vegetation be retained in the 15-foot buffer between the sites. 6] optional future parking will not be included in this permit. Schierman stated they don’t permit parking areas. 6] Driveway be as per described by the applicant here accessing on Trailer Court Rd not on Co J. Silbert asked to clarify the 15-foot buffer. Ray clarified by saying the 15-foot area between the sites be maintained in existing vegetation. Silbert said “as much as possible. Ray stated yeah ok. Silbert asked to clarify on the driveway. Krivoshein stated the driveway is crucial to traffic control as mentioned before as looking at other option. The other thought is the reason is to route people off of J up this property and exit through the new property acquired. Silbert, so you need the new Co J route option. Krivoshein yes. Ray stated strike that condition. Silbert seconded amendment. No further discussion. Motion to approve as amended. Motion carried. No further discussion. Original motion carried. 5/0 C. Discussion and possible action regarding fees (requested by Mark AA) Schierman stated the administrator would like us to adjust our fees. I suggest revising fees or removing the fee schedule from the ordinance, so it doesn’t take 2 or 3 months to adjust fees. Strand would like to see both suggestions at a future meeting. D. Minutes of previous meeting (August 19 & September 17, 2020) Zepczyk motioned to approve the August 2020 minutes. Strand seconded. No further discussion. Motion carried. 5/0 Strand motioned to approve the September 2020. Silbert seconded. No further discussion. Motion carried. 5/0 E. Committee members discussion regarding matters of the P & Z Department Silbert expressed thanks for the patience on all the questions. Ray questioned why a CUP is needed for a campground. Schierman stated in any zone they are required by CUP. Ray stated there has to be a discussion on Page 6 of 6 ZC Planning and Zoning Public Hearing and Meeting – October 15, 2020 how many campgrounds there is allowed in Bayfield County. Schierman stated that is why they are permitted by CUP and not by right. 11. Monthly Report Schierman stated $244214 above budget. There are 84 more land use permits compared to last year and 33 sanitary. Permitted $29 million in projects. Zepczyk motioned to receive and place on file, Ray seconded. No further discussion.
