Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call: Ray, Rondeau, Strand and Zepczyk – all present. Silbert – by phone Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-AZA, and Krystal Hagstrom - Secretary. 3. Affidavit of Publication: Schierman showed the audience the affidavit of publication and the certified mailing receipts. 4. Public Comment – 3 minutes per citizen Kate Eldred (by phone) spoke in opposition of the White Feather Forest. Its very different than the campground that was just approved on Hwy J based on the access road. The Town denied and it does not meet the future land use plan of Bayfield. Concerned about water and noise pollution. The County needs to take this more seriously. 5. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form; and stated they will be asked to come forward and speak into the microphone. 6. Public Hearing: A. R Douglas O’Leary, owner & Michael Furtak, agent (Cable) – EIA & MUD in R- RB zone (consisting of 3 existing units, private resort/family compound) [a 9.23-acre parcel (Tax ID #10218), in Doc # 2015R-559378, Vol. 1145, P.20; described as Goff’s Subdivision of Govt Lot 2 Lot 10 Less par in V.586 P.230, Section 4, Township 43 North, Range 7 West, Town of Cable, Bayfield County, WI] Mike Furtak, agent, spoke on behalf of the request stating this used to be the old Island View Campground back in the 1940’s. In the mid 70’s it turned into a private family compound. 5 years ago, the O’Leary’s purchased the property and use it as a private resort for the family. They remodeled the inside of the main house and are looking to start remodeling the other two cabins, adding a screen porch and deck to the one cabin. The property is deemed non-conforming. The impervious surface on the property is low and there is a new septic system. They are going through the CUP process so the property can become conforming and they can add the screen porch and deck to the one cabin. They have no plans of adding any other cabins to the property. Douglas O’Leary spoke in support, stating they would like to renovate one cabin and add a porch and deck, so the place is more enjoyable for the guests. Adjournment of Public Hearing: Strand made a motion to adjourn, Zepczyk seconded. Motion carried. Adjourned at 4:10 pm. 8. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:10 pm. 9. Roll Call: Ray, Rondeau, Strand and Zepczyk – all present. Silbert – by phone Others present were: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood-AZA, and Krystal Hagstrom - Secretary. 10. Previous Business: A. Alisia Ray (Bayfield) – EIA & Campground in R_RB zone (tabled 10/15/2020) [a 10-acre parcel (Tax ID #4595), described as N 10A of W 15A of SE SW in Doc 2020R-581509, Section 12, Township 50 North, Range 4 West, Town of Bayfield, Bayfield County, WI] Alisia Ray spoke in support explaining this is a tree house village that will have 10 camping cabins. Main lodge will have a cafeteria and gift shop. There will be a sauna house and hot tubs outside. Schierman stated there are a few new letters of opposition in the file from Kate Kitchel, the Comptons, Anne Olson, and Liz and Larry Fentress. There is Town Board recommendation of denial and it was reviewed with the Towns comp plan. Silbert motioned to deny based on Town Board recommendation, consistency with the Town comprehensive plan, relevant public input, maintenance of safe and healthful conditions, location of the site with respect to existing or future access roads, and potential impact of the proposed use on other lands and land uses in the vicinity and the extent to which it would be compatible or incompatible therewith. Strand seconded. No further discussion. Motion carried. 5/0 11. New Business A. Zepczyk seconded. No further discussion. Motion carried. 4/1 (Silbert opposed) Schierman explained there is Town Board approval and consistent with the comp plan. There is a set of the architectural plans in the file. Strand motioned to approve with the condition that the parcel is limited to 3 human habitable structures and there be no short-term rentals, based on Town Page 3 of 3 ZC Planning and Zoning Public Hearing and Meeting – December 17, 2020 Board Approval, consistent with both the Town and County comp plan, that it will not adversely affect the natural resources of the area, and that it will not adversely affect other lands in the vicinity and the existing uses of those lands. Zepczyk seconded. Ray asked if the no short-term rental was a Town Condition. Rondeau stated that it was mentioned at the Town level and we left it to the Committee to add that as a condition. The applicants were ok with it at the Town meeting. No further discussion. Motion carried. 5/0 B. Discussion and possible action regarding “farm store permitting” Schierman explained there are “farm stores” popping up in Ag-1 districts that are not necessarily farm stores. They have nothing farm related in them. I would like to see at least some farm related items that were either grown on that farm or on another farm. The Committee agreed and asked that Schierman draft some language regarding permitting of farm stores and a farm store definition. C. Minutes of Previous Meeting(s): Rondeau stated the minutes are from the November 19, 2020 meeting. Strand motioned to approve as presented. Zepczyk seconded. No further discussion. Motion carried. 5/0 D. Committee members discussion regarding matters of the Planning and Zoning department Strand discussed receiving and placing on file EIA instead of approving or denying them. Discussion about having a third-party review instead of the Zoning department. Ray stated he would like to have on a future agenda campground regulation. Silbert asked about shipping containers. 12. Monthly Report Schierman stated there are 94 more land use compared to last year and 37 more sanitary permits. The department I $67,428 above budget projection. And there was $36,112,555 declared value in permits issued. Silbert motioned to receive and place on file, Ray seconded. No further discussion. Motion carried. 5/0 13.
