Call to Order of Public Hearing: Chairman Rondeau called the public hearing to order at 4:00 pm. 2. Roll Call:Ray, Rondeau, Silbert, Strand and Zepczyk – present Other’s present: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood- AZA, Mark Abeles-Allison-County Administrator, and Franki Gross- Secretary. 3. Affidavit of Publication:Pooler showed the audience the October affidavit of publication and the certified mailing receipts. Published Tuesday, February 1st and Tuesday, November 8th, 2022. 4. Public Comment – 3 minutes per citizen There were no comments from the public 5. Review of Meeting Format – Chairman Rondeau explained the procedure of the meeting. He asked everyone who wished to speak to fill out a form and stated they will be asked to come forward and speak into the microphone. 6. Public Hearing: A. Russell & Nancy Iverson (Delta) – Rezone from F-2 to Ag-1 Parcel is an 8.0-acre parcel (Tax ID #12784), described as a parcel in the SE ¼ of the SW ¼, in Doc# 2017R-568712, Section 16, Township 46 North, Range 7 West, Town of Delta, Bayfield County, WI. Heather Palmquist spoke stating she was there seeking a rezone in order to purchase and develop the property which will be possible to do in Ag-1. Rondeau asked three times if anyone would like to speak in support. No one spoke. Rondeau asked three times if anyone would like to speak in opposition. No one spoke. Discussion ended. B. Joseph & Mary Horozaniecki (Bell) – a conditional use permit in a shoreland for multiple residences on a parcel [consisting of existing residence (28’ x 56’) with irregular deck (10’ x 12’ (+-) and a new garage with a 2nd story residence above (28’ x 24’) at a height of 23’. Property is an R-1 zoning district; a 2.64–acre parcel (Tax ID# 7651), described as a Page 2 of 6 Planning and Zoning Committee Public Hearing and Meeting – February 17, 2022 parcel in Gov’t Lot 1 in Doc# 361422/361561, in Section 23, Township 51 North, Range 6 West, Town of Bell, Bayfield County, WI. Bill Erickson spoke stating he is representing the Horozaniecki's who are requesting a CUP for a second residence on a parcel that can legally be subdivided but the topography won't allow for development. Rondeau asked three times if anyone would like to speak in support. No one spoke. Rondeau asked three times if anyone would like to speak in opposition. No one spoke Discussion ended. 7. Adjournment of Public Hearing: Ray made a motion to adjourn, Zepczyk seconded. Motion carried. Adjourned at 4:06 pm. 8. Call to Order of Planning and Zoning Committee Meeting: Rondeau called the meeting to order at 4:07 pm. 9. Roll Call: Ray, Rondeau, Silbert,Strand and Zepczyk – present Other’s present: Director-Rob Schierman, Tracy Pooler-AZA, Todd Norwood- AZA, Mark Abeles-Allison-County Administrator, and Franki Gross - Secretary. 10. New Business: A. Russell & Nancy Iverson (Delta) – Rezone from F-2 to Ag-1 Parcel is an 8.0-acre parcel (Tax ID #12784), described as a parcel in the SE ¼ of the SW ¼, in Doc# 2017R-568712, Section 16, Township 46 North, Range 7 West, Town of Delta, Bayfield County, WI File Report: Pooler stated the record wasn't showing there was a TBA filed. The applicant spoke, after being asked to by the Chair, informing the Committee that the Town of Delta Clerk was new, and she didn't know the application needed to go to the Planning Commission first so the Town Board didn't want to approve or disapprove the application until the Planning Commission had their say. They are having an emergency meeting to address this issue. Discussion took place with Silbert asking if Ag-1 was more appropriate for this property which Rondeau replied that the surrounding properties are zoned Ag-1, and because of lacking TBA, which has a considerable say in Rezoning, should the Committee postpone making a decision. Rondeau agreed. Schierman suggested approving the Rezone request pending TBA in which it would move on to the full board for approval. Ray asked if there was any correspondence with the DNR, who Page 3 of 6 Planning and Zoning Committee Public Hearing and Meeting – February 17, 2022 are adjacent landowners, and Schierman stated yes, we sent them notification of the requested Rezone and who the recipient was of that mailing. No letters of support or opposition in the file. Strand made a motion to approve the Rezone of the Russell & Nancy Iverson properties in the Town of Delta contingent on the Town Board approval based on Zoning Ordinances, the consideration of the Town Board Recommendation, pending, the community or general welfare and economic impact of the proposal. Zepczyk seconded. Strand stated for clarification it would be a recommendation to the full board. No further discussion. Motion 5-0. Motion carried. B. Strand motioned to approve the CUP based on consideration of the Town Board recommendation, and consistency with the town and County’s Comprehensive Plan. Ray seconded. No further discussion. Motion 5-0. Motion carried. Agenda Review and Alteration C. John Nixon & Rachel Hartshorn (Clover) - Class A (1-Unit) Short-Term Rental upgraded to Class B (1-Unit) Short-Term Rental due to Town denial. File Report: Schierman stated The Town Board denied the Class-A so it came back as a Class-B and the Town Board recommended approval of the Class-B with conditions of the permit being nontransferable and that the applicant obtain the Town Short Term Rental Permit. Schierman also stated that the Town stated the Comprehensive Plan’s goals 1-10 support recreational housing and tourism. Ray asked for the history on the application and the denial. Norwood stated the Town denied because they had questions for the applicant, who were absent, about ownership changes, and that the applicant was already renting it out without proper permitting. The applicants reapplied with the Class-B appeal, showed up to the meeting to answer questions and the Town recommended approval. Norwood also explained that for the applicant to have this request heard Page 4 of 6 Planning and Zoning Committee Public Hearing and Meeting – February 17, 2022 again, because of the denial by the town, the Class-A needed to be upgraded to the Class-B. Silbert asked if this was an ATF and Norwood stated it was and he confirmed it by seeing the rental ad online. Silbert made the motion to approve the Special-B application by the Nixon Hartshorn property based on the Town of Clover’s approval of the Special Use-B and contingent on the completion of the ATF application; based on Zoning Ordinance and all other applicable laws, community or general welfare and economic impact of the proposal, and that this Special Use-B pertains solely to the current owner and is non-transferable. Ray seconded. No further discussion. Motion 5-0. Motion carried. 11. Other Business D.Minutes of Previous Meeting(s) – Rondeau stated the minutes are from the January 2022 meeting and informed the Committee that the minutes were in Dropbox. Ray stated there was nothing in Dropbox. Strand, Silbert and Zepczyk also confirmed minutes were not in Dropbox. Ray moved to take up the minutes at the next meeting. Rondeau asked if he wanted to postpone the minutes and Ray said yes. Strand seconded. No further discussion. Motion 5-0. Motion carried. E. Committee Members discussion(s) regarding matters of the P & Z Dept. Items discussed: the artesian well and policy study and if the Board was aware of it and is it something that needs to be on the agenda for discussion and review. Board members acknowledged that they were aware of the subject and agree it should be added for discussion. Abeles-Allison was asked to summarize what he knows about the artesian well grants and analyzation. Research is ongoing and will continue into the 2022 year. Schierman added he believes the recommendations that come out of the research will be on limiting density. Limiting density is limiting the number of wells poking into the artesian condition. Might be a good idea to explore Municipal water supplies in the Town of Bell as they have a high concentration of artesian wells and will be an area for concern in limiting density and preserving the artesian condition. Committee would like to have a meeting and have it on the agenda in the future after studies and paperwork filing. Abeles-Allison stated P&Z ‘s input will be imperative along with Land & Water Conservation and Corp Council to develop ordinance and the language in regulations; Committee addressed Abeles- Allison regarding the departure and separation from the P&Z Department of Rob Schierman, Director, and Todd Norwood, AZA, and what was Administration going to do to replace these individuals. Abeles-Allison passed out a couple handouts to Committee with options in the hiring of positions and all the details in the process of the Department, from in house to contract employment. Schierman spoke on how everything is taking more time in many ways so additional personnel is paramount in the prevention of burn-out and workload processing. Silbert and the other Page 5 of 6 Planning and Zoning Committee Public Hearing and Meeting – February 17, 2022 Committee members thanked Schierman and Norwood for their years of service and superior dedication. Ray commented on the support of hiring additional staff with the evidence of growth charts and believes the Committee is close to a consensus that there should be more positions available than just Director and AZA but an additional AZA. Question came out about a Hiring Committee and who would be on that Committee and the process. Abeles-Allison summarized the hiring process for the Directors position and that the AZA position has already been advertised and an additional AZA position will be advertised shortly; Silbert made the comment that the Committee and its responsibility in imposing regulations shouldn’t be viewed as burdensome but as playing an important role in conservation of what the community values. Zepczyk asked if the Committee had thought about his comments in last month’s meeting about UDC, affordable housing availability, and limiting factors and can we/should we address this. Rondeau questioned if there was a housing study going on and it was confirmed there was one happening. Silbert talked but mic wasn’t on so Secretary couldn’t hear him. Ray asked Schierman for clarification on what, if anything, the Committee could do or change regarding UDC, and the P&Z Dept/Committee’s role in those changes. Schierman stated after talking to the Housing Authority, amendments to Ordinance 13-1-29 for Multi-Unit Development in open space requirements, giving Zoning more options in reducing or limiting open space requirements. Discussion occurred regarding Short-Term Rentals and allowing Campgrounds on Ag-1. The Committee discussed the pros and cons of allowing campgrounds in Agricultural Zoning Districts. Discussion returned to affordable housing, specifically the Mitchell Building in Iron River, and that being an example of an instance to waive the open space requirement; Zepczyk commented about permit requirements being a little out of line asking people to have a permit for everything and telling them what they can & cannot do on their own property. Schierman replied with a suggestion of “thinking outside the box’ and entertaining the idea of assisting low-income families in the cost of UDC inspection to encourage families to apply for the Conditional Use Permit to allow for a second residence on the property, facilitating them in utilizing the space and structures already on the property being used as something else. The idea is to encourage not hinder. More discussion occurred about The Homesteading Act and weather Zoning oversteps that act. 12. Monthly Report/ Budget and Revenue Pooler reported figures of the January monthly report to the committee. Silbert motioned to receive and place on file the January monthly report. Zepczyk seconded.
