MINUTES OF
“SPECIAL MEETING”
BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE
PUBLIC MEETING
JUNE 1, 2023
1. Call to Order of Public Meeting: Chairman Rondeau called the public meeting
to order at 3:30 pm.
2. Roll Call:Rondeau, Silbert, Strand, Ray and Pocernich – all present.
Other’s present: Director-Ruth Hulstrom, Tracy Pooler-AZA
3. Public Comment – None
4. New Business
A. Hwy Garage Bayfield County / Robert Anderson requests a Special Use
Class B to construct a Public & Municipal Building in an R-RB zoning district
consisting of a municipal garage with office / storage / bathroom (45’x72’x35H)
and existing 12'x20' storage shed, existing 18'x18' storage shed, existing
34'x54' salt shed and parking area. The property is comprised of two (2) tax
parcels (Tax ID# 10045 & 10053) and total 0.73 acres. Both parcels are zoned
R-RB and are described as Lot 3, CSM# 2273 in V.13 P.148-149 in Doc#
2023R-598521 in Section 18, Township 43, Range 7 W, Town of Cable,
Bayfield County, WI.
Hulstrom gave a summary of the application. She noted the Town Board
approved the request with conditions that zoning be rezoned to municipal and
run-off water does not reach adjacent properties.
A discussion followed regarding rezoning properties to municipal zoning and
whether setting dates for completion should be necessary. It was determined
that rezoning any County owned properties to municipal could and should occur
at a future date.
Silbert motioned to approve the Special Use Permit for the Highway
Garage described in the special use narrative barring a rezoning, includes
construction of a new (45x72) Bayfield County Highway Dept Building, existing
(12x20) storage shed; existing (18x18) storage shed, existing (35x54) salt shed
and parking area for two parcels; Tax ID#’s as stated here with the condition
that the water run-off does not go onto adjacent properties. Rondeau asked if
Silbert wanted to add a date to have the property rezoned to municipal. Silbert
replied if you want me to, I was keeping it simple. Rondeau stated that was
part of the conditions to change it to municipal. Hulstrom stated the town
comments were conditioned to change the zoning to municipal and also
consideration of the stormwater. Hulstrom asked Rondeau if a date should be

added to the motion that the Town has to seek a rezone for the property.
(Recording goes out—no response was heard). Hulstrom questioned if the
special use permit could be issued before the rezoning is acquired. Ray
seconded the motion. Ray stated he wanted to correct the numbers, 34’x54’
salt shed not 35’ and the motion would be that we change the zoning to
municipal at a future date with other County properties. Rondeau asked Silbert
if he was okay with these modifications and Silbert acknowledged that he was.
Pocernich questioned what the motion was. Silbert reiterated it was for a
special use permit with the building barring the run-off. Rondeau interjected
and asked Silbert to turn his mic on. Discussion followed with Pocernich
questioning whether office should be included in the motion because motion
was for a garage, and he knows people are going to be in there. Silbert
acknowledged he was referring to the whole building (municipal). Hulstrom
explained it was described as the Bayfield County Highway Dept building and
the plans are included in with this request that includes all the internal
components of the proposed highway dept building which includes the office
space and garage space for the highway dept. (Ray spoke but the recording
went out-no response was heard). Hulstrom responded the dept received the
land use application and it was missed initially by the dept that it was a
nonconforming use, so it wasn’t until more recently that the dept realized that
because they were replacing the entirety of the structure and the use, current
ordinance requires a Class B for the use and because they were replacing the
structure in its entirety they needed to rezone to do that or follow through with
a Class B Special Use. (Ray spoke but the recording goes out-no response
was heard). Hulstrom stated yes--we received the land use the end of April
and then it wasn’t until the final step in issuing that we realized they were
replacing the structure in its entirety and again zoned R-RB technically it’s a
nonconforming use that is existing so with complete replacement they were
exceeding what would be allowed unless they made the nonconforming use
conforming or rezoned the property. No further discussion. Rondeau called
for a vote on the motion. Motion carried. 5-0
B. Committee members discussion regarding matters of the Planning and
Zoning Department
Strand asked what the status is on staffing. Hulstrom stated we received
notification that a new inspector will be starting June 19th, he accepted the offer
and we are working on finding housing and we also have our temporary office
person will be out on family leave for a period of time, so we have gotten an
offer accepted for another temporary office person while she is out, so we are
kind of moving along there, but there will be some training obviously involved,
but we will ideally be in a good place staffing wise. (Recording goes out—no
response was heard). Hulstrom replied that he is not local so he will be
relocating. He does have experience in planning and zoning, but not for county
and he doesn’t have his POWTS or soils, so there definitely will be some
training that goes along with him starting with the dept.
