MINUTES
BAYFIELD COUNTY PLANNING AND ZONING COMMITTEE
PUBLIC HEARING AND PUBLIC MEETING
JANUARY 18, 2024
1. Call to Order of Public Hearing: Chairman Rondeau called the public hearing
to order at 4:00 pm.
2. Roll Call: Pocernich, Ray, Rondeau, Silbert, and Strand – 5 present. 0 Absent.
Others present: Director-Ruth Hulstrom, Tracy Pooler-AZA, Alessandro Hall-
AZA, Marty Milanowski-District 10 Supervisor, Administrator-Mark Abeles-
Allison, Franki Gross-Secretary.
3. Affidavit of Publication: Hulstrom showed the audience the affidavit of
publication and the certified mailing receipts. Hulstrom stated the publish dates
were January 2nd & 9th, 2024 and all signature cards from the certified mailing
were received except from the Town of Barksdale.
4. Public Comment – None.
5. Review of Meeting Format – Chairman Rondeau explained the procedure of the
meeting. He asked everyone who wished to speak to fill out a form; and stated
they will be asked to come forward and speak into the microphone.
6. Public Hearing:
A. Sarah Mather (Bayfield) in Ag-1 zone requests a conditional use permit
to construct and operate an (after-the-fact) animal boarding facility;
dog kennel & home-based business consisting of utilizing existing
residence as a temporary base for dog daycare, boarding, and
grooming facility with a future expansion to accommodate those
needs in a separate building on property owned by applicant South of
the existing residence. Property consists of three (3) parcels. Parcel #1
is an Ag-1 zoning district; a 13.82–acre parcel (Tax ID# 37868); described
as a parcel in S ½ of the NE ¼ of the SW ¼ in Doc# 2018R-573709; and
Parcel #2 is an Ag-1 zoning district; a 20–acre parcel (Tax ID# 4323);
described as the N ½ of the SE ¼ of the SW ¼ in Doc # 2021R-590149;
Parcel #3 is an Ag-1 zoning district; a 0.50–acre parcel (Tax ID# 4330);
described as a parcel in SW ¼ of the SE ¼ in Doc# 2018R-573709; all three
parcels are in Section 1, Township 50 North, Range 4 West, Town of
Bayfield, Bayfield County, WI.
Sarah Mather, applicant, spoke on behalf of the request. Mather gave a
summary of her current home-based business and her request for
expansion in the near future. Mather stated her business plan and her
desire to create a business that fits well into the Towns Comprehensive

Future Plan and provide services that her community needs. Mather stated
that there were complaints regarding noise from the dogs and she believes
her business plan addresses the issue and will have measures in place to
mitigate the noise.
Rondeau asked three times if anyone would like to speak in support.
Kyleleen Cullen, a resident of Washburn, spoke in support of the applicant
and her request based on a need in the area as she is a dog owner herself.
John Boyle, a resident of Bayfield, spoke in favor of the proposal as a dog
owner and client of Mather’s services and commented that when he has
been onsite there wasn’t excessive barking from the dogs. Boyle stated that
this business benefits the whole community.
Craig Hoopman, Chairperson of the Town of Bayfield spoke and stated that
the request went before the Town of Bayfield Planning Commission and
after extensive conversation it went to the Town Board where it passed
unanimously.
Rondeau asked three times if any would like to speak in opposition.
Paula Lundberg, an adjacent property owner, spoke in opposition to the
request due to excessive noise from the dogs. Lundberg stated that she
didn’t know Mather was running a dog services business out of her home
already and would like for the Committee to deny the request to operate a
home-based dog services business with future expansion.
Nancy Takacs, an adjoining property owner, spoke in opposition to the
request. Takacs stated that over the course of time sounds of dogs barking
and fighting filled the air constantly. Takacs learned of the applicant’s
request and although she understands the need for this type of business,
she asks the Committee to deny the request based on the noise nuisance
this proposal will create in the neighborhood and for the direct neighbors.
Bruce Cornwall, a neighbor to the applicant, spoke in opposition to the
request stating excessive noise, that is only going to increase with the
proposed expansion, being an intolerable nuisance and request the
Committee protect their rights as residence of Bayfield County and their
property values, and deny the request.
Kim Tregilgas, a resident of Bayfield, spoke in opposition to the request
stating she believes the location of the proposal is the problem since all the
adjacent neighbors are complaining about constant noise from the dogs.
Tregilgas stated that a dog kennel business is not compatible with homes
in a residential neighborhood and askes the Committee to deny the
applicant’s request.

Kurt Finnie, a neighboring property owner, spoke and stated he is a dog
owner and sees a need for the services the applicant is proposing but has
many concerns and feels that this isn’t the appropriate property to run this
type of business, therefore, is in opposition to the request. Finnie stated
that he is bothered by the constant barking of the dogs and requests that
the Committee deny the application for a CUP.
Mark Tregilgas, a Bayfield resident, spoke in opposition to the request
stating that there really isn’t a need for this business in the area because
there are facilities close enough to support the dog owners. Tregilgas read
the definition of an overlay district and stated the intent of the overlay district
is to promote the public health, safety, convenience, and general welfare of
the public and to encourage planned and orderly land use development to
protect property values and property tax base. Tregilgas also commented
that The Noise Control Act of 1974 was enacted to abate and control noise,
which adversely affects health, safety, welfare of the people, the value of
property, and the quality of the environment, therefore, the Committee is
requested to deny the application based on the continual nuisance from
barking noise and protection of the rights of the neighbors to a comfortable
enjoyment of life and property.
Greg Anderson, a Bayfield property owner, expressed concern with the
number of dogs Mather already has and the size of the future expansion.
Anderson stated he has concerns with the noise coming from the property
already and feels that the location for this type of business doesn’t fit with
the residential nature of the area and askes the Committee to deny the
request. Anderson questioned what recourse the neighbors have if this
application is approved to ensure their rights to quiet & seclusion and
protections of their property values.
Kathy Cornwall, a neighbor to the applicant, spoke in opposition due to the
excessive barking and noise and asked the Committee to deny the request.
Cornwall also questioned what recourse the neighbors have should the
Committee approve. Cornwall requested that the answer from the
Committee be in writing.
Paul Lundberg, an adjacent property owner, spoke in opposition to the
request. Lundberg stated this kennel is not compatible with what has
become of that area, in a neighborhood of residences on large pieces of
land regardless of it being zoned Ag-1. Lundberg commented that the
decibel levels from the dog noise are high enough to be considered a
nuisance and should be monitored as part of the conditions should the
request be approved but hopes the Committee denies the application.

B. Betty M. Franzel, owner and Kent Ritola, agent (Kelly). Reclamation
Plan for a 6.3-acre non-metallic mine (NR 135) with possible screening

and crushing. Property is an Ag-1 zoning district; a 40–acre parcel (Tax
ID# 21201), described as the SE ¼ of the SW ¼ in Doc# 2021R-587098; in
Section 18, Township 46 North, Range 5 West, Town of Kelly, Bayfield
County, WI.
Kent Ritola spoke on behalf of the request , giving a summary of the
request, and stating the gravel pit exists and would like to continue its
operations. Ritola stated the Reclamation Plan is included in the
application.

one spoke. Rondeau asked three times if any would like to speak in
opposition. No one spoke.

C. Betty M. Franzel, owner and Kent Ritola, agent (Kelly) request a
conditional use permit to operate a 6.3-acre non-metallic mine (NR
135) with possible screening and crushing. Property is an Ag-1 zoning
district; a 40–acre parcel (Tax ID# 21201), described as the SE ¼ of the SW
¼ in Doc# 2021R-587098; in Section 18, Township 46 North, Range 5 West,
Town of Kelly, Bayfield County, WI.
Rondeau asked three times if anyone would like to speak in support. No
one spoke. Rondeau asked three times if any would like to speak in
opposition. No one spoke.

D. Laura K Waterhouse and Sarah A Carlson (Barnes)are petitioning for
a zoning district map amendment located (in a shoreland). Property is
a 4.68-acre parcel (Tax ID #1400) described as the W 150’ of Gov’t Lot 7,
in Doc# 2015R-560315; Section 4, Township 44 North, Range 9 West,
Town of Barnes, Bayfield County, WI. Rezone area includes portion of
property south of Bony Lake Rd currently zoned Residential-3(R-3).
Request is to rezone from R-3 to Residential-1(R-1).
Mark Carlson spoke on behalf of the applicant, his wife, and her sister, the
co-applicant, giving a summary of the requested proposal. The applicants
want to split the lot and to be compliant with the Code the property must be
rezoned from R-3 to R-1. Carlson stated he went to the Town Board
meeting where the request passed unanimously.

E. A petition by Ruth Hulstrom, Director of Planning and Zoning, on
behalf of the Bayfield County Planning and Zoning Committee,
requesting an ordinance amending Title 13-1-21(e)(1)-(5) and Title 13-
1-22(a)(5)b. 3,4,8,11 &14, Code of Ordinances, Bayfield County,
Wisconsin. Petition consists of deletion and Amendment of Section 13-1-
21(e) (1)-(5) Fee Schedule to move the fee schedule out of the ordinance
and instead provide that it will be available in the Planning and Zoning
Department Office, with changes to the fee schedule being permissible by
approval of the County Board other than changes to the fee schedule to
reflect changes in fees assessed by the State, which shall be allowed
without County Board approval, and amendment of Section 13-1-22(a)(5)b.
3. 4. 8. 11. & 14. Boathouse Language to reduce the allowable footprint,
specify the limitations of a loft area, provide a minimum and maximum pitch
for roofs, and limit the use of glass or transparent materials.
Hulstrom spoke on behalf of the request. This is a petition by the Planning
and Zoning Department on behalf of the Planning and Zoning Committee to
request amendments to the Bayfield County Zoning Ordinance to remove
the Fee Schedule from the ordinance and make it available as a reference
document on file at the Planning and Zoning Department. Any future
changes to the fee schedule would be reviewed and a recommendation
provided by the Planning and Zoning Committee and be approved by the
Board of Supervisors stated Hulstrom, aside from the fee increases that
result from State fee increases, which would occur without approval from
the Board of Supervisors. Hulstrom also stated the petition includes an
amendment to reduce the allowable footprint for a boathouse from 400
square feet to 200 square feet, designate a minimum and maximum roof
pitch and limit the use of glass doors or access openings to no more than
1/3 transparent. The petition would also allow for an overhead storage area
not to exceed 50% of the floor area of the boathouse. Hulstrom clarified that
in reference to the Fee Schedule Ordinance Amendment the department
feels it is necessary to better be able to make changes to the fee schedule
since the Ordinance Amendment process is costly and time consuming, and
the Department still wishes to be transparent, so we're proposing the
process still go through the Planning and Zoning Committee and the full
County Board. In reference to the Boathouse Amendment, stated
Hulstrom, the current ordinance defines a boathouse, as a permanent
structure used for the storage of watercraft and associated materials, and
includes all structures which are totally enclosed, have roofs or walls, or any
combination of these structural parts. Boathouses are deemed exempt
structures under the state statute, meaning they're allowed to be located
closer to the Ordinary High-Water Mark then the required 75-foot setback.
Current ordinance allows boathouses to be as close as 10 feet from the
Ordinary High-Water Mark, and a boathouse is meant for storage of boats,
watercraft, and boat equipment. Local jurisdictions are allowed to regulate
boathouses, stated Hulstrom if the regulations do not supersede the state
shoreland regulations and what is being proposed would not supersede

those regulations. Hulstrom commented that concerns related to the use of
a boathouse solely for boathouse purposes arose last year and led the
Department to research options to minimize the possibility of this occurring.
As such, the Department is proposing to update the existing ordinance
language pertaining to design regulations for boathouse development to
minimize the possibility of someone utilizing the structure for unintended
purposes.

7. Adjournment of Public Hearing:
Silbert made a motion to adjourn the public hearing, Ray seconded.
Motion carried, 5-0. Adjourned at 5:09 pm.

10. New Business

File Report: Hall informed the committee that the request has 2 parts to
address, an after-the-fact home-based dog services business being run out

of the residence, and the request to construct a new commercial building,
approximately 50’ x 102’ with kennels, a grooming area, indoor and outdoor
play areas, reception, and small retail area. Hall stated the home-based
business is temporary until the new building is built. After the Committee’s
packet was published, stated Hall, the Department received additional
details from the property owner on her business operations and goals as
well as an updated plan set. The updated plans do not alter the size or
placement of the proposed structure but include additional construction
details and show a proposed parking layout. Hall stated the Department
received 12 letters of support and 27 petition/letters in opposition citing
noise nuisance from barking dogs, incompatibility of the business with
existing and future land uses, and the potential impacts on property values.
The Town of Bayfield recommended approval of the proposal with
conditions:
1) all dogs associated with the animal boarding business shall be kept
indoors between 5:00 PM and 8:00 AM.
2) no animal drop-offs or pickups would be permitted between 9:00 PM and
6:00 AM.
3) all dogs associated with the business must always remain inside fenced
areas
4) property owner shall clean up metal debris on Tax ID 4323 prior to
opening new commercial facility
5) property owner shall obtain an address sign from the Bayfield County
Land Records Department prior to opening the new commercial facility
6) property owner shall submit a parking plan to the department prior to
opening the new commercial facility
7) the applicant will install an 8-foot solid wood fence to alleviate the noise.
The Department is supportive of these conditions or others that would
reduce the noise, however, we would suggest amending condition 1) to
read, if unattended, so the dogs could be let out at night to use the bathroom
if needed stated Hall. Hulstrom read a letter from Diane Judd that was
presented to her just before the meeting with the Committees permission.
Judd is in opposition to the proposal and asks the Committee to deny the
request due to the constant and amplified noise from the dogs. Judd asked
the Committee to require additional mitigation steps such as hiring a noise
abatement specialist to develop a plan that limits the noise, if approved.
Discussion was had regarding noise mitigation, limiting the number of
animals the facility can service, daytime quiet hours, the facilities sanitary
system, Bonding, nighttime light pollution, and the fact that the property is
zoned Agriculture. Silbert commented that he had questions for the
applicant and would like the meeting opened for her comments.
Silbert motion to suspend the rules to allow public comment
seconded by Pocernich. Motion carried, 5-0. The applicant was asked
about how she handles the waste generated by the large amount of dogs
she has at any given time. Mather said that the waste is either composted
in holding tanks or it’s thrown in a trash bin that is contracted with a waste

management service, which is her method of choice. Silbert asked how
many dogs the applicant services currently and how many the future facility
will hold. Mather replied 24 dogs currently, and upwards of 50 dogs would
be the ideal number given the 31 proposed kennels with many of them able
to house up to 3 single-household dogs. Silbert also asked if the applicant
would consider implementing quiet hours during the day, to which Mather
replied she felt the hours of operation were already considerate so no she
wasn’t open to that. Ray asked the applicant to explain the
boarding/daycare operation currently and if she was open to capping the
number of dogs allowed at one time. Mather said she has had up to 24 dogs
at one time, including 5 of her own, and gave the layout of her
house/business facility. Mather stated she cares for a lot of dogs in this area
at any given time during the year, so limiting the number of dogs would
hinder her opportunity to have a business in this community. Discussion
occurred regarding whether the Committee would address both parts of the
proposal in a motion. Ray asked the applicant why the proposed facility is a
far distance from her home, in which Mather replied that there are wetlands
on her property that needed to be avoided and the proposed location was
used as a mink and fox farm, so she is utilizing the space that was already
created and cleared. Abeles-Allison asked if the applicant explored sound
dampening measures. Mather confirms she has and is still exploring the
options.
Strand made a motion, based on the Town Board Recommendation
and relevant public input, to approve the conditional use permit for the
existing animal boarding facility dog kennel as a temporary home-based
business and a new commercial animal boarding facility dog kennel on Tax
ID parcels 37868, 4330 and 4323 with the following conditions:
1) payment of after the fact fee
2) temporary home-based business shall end 30 days after
substantial completion of the new commercial facility
3) all dogs associated with the animal boarding business shall be
kept indoors when unattended between 5:00 PM and 8:00 AM
4) no animal drop offs or pickups are permitted between 9:00 PM
and 6:00 AM daily
5) dogs associated with business must remain inside the fenced
areas when unattended by humans
6) property owner shall clean up metal debris on tax ID parcel 4323
prior to opening new commercial facilities
7) property owners shall obtain address sign from Bayfield County
Land Record Department prior to opening new commercial facility
8) property owner shall submit parking plan to Zoning Department
prior to opening new commercial facility
9) property owner shall install and maintain an 8-foot tall solid wood
privacy fence around the entire exterior of the outdoor play area
10) limited to 50 dogs.

Seconded by Pocernich. Silbert made an amendment motion to
limit dogs to 40. No second. Motion dies. Ray made an amendment
motion to cap the number of dogs at the home-based business to 20
and cap the number of dogs at the proposed facility at 50. Seconded
by Strand. Amendment motion carried 5-0 Ray made an
amendment motion to include implementing best management
practices for light pollution to reduce the lighting impacts on the
neighbors. Seconded by Silbert. Amendment motion carried. 5-0
Ray suggests that the motions be separated to address the home-
based business in one motion and the proposed commercial facility
in a second motion. Pocernich stated he believes that Strand has
covered both parts of the application in his motion and would like to
call for a vote on the original motion with the applied amendments.
Chair call for vote. Motion carried. 3-2

Pocernich made a motion to receive and place on file the
Reclamation Plan. Seconded by Ray. Strand note that the Reclamation
Plan was reviewed and approved by Bayfield County Land & Water
Conservation Department. Motion carried, 5-0.

File Report: Hulstrom informed the committee that the application is for
an existing non-metallic mine that expired on 4/13/2022. The original CUP
and Reclamation Plan was granted in 2007.
Silbert made a motion to approve the CUP for the Betty Franzel,
Kent Ritola non-metallic mine including the conditions of crushing and
screening are allowed, hours of operation are 7:00 AM to 7:00 PM, no
operation on Sundays, the permit expires 15 years from the date of the
Conditional Use Permit is issued, based on the Zoning Ordinance and all
other applicable laws, the consideration of the Town Board
Recommendation in favor, the maintenance of safe and healthful conditions,
and the consideration of the Department file report and site specifics.
Seconded by Ray. Motion carried, 5-0.

File Report: Hulstrom informed the committee that the Town of Barnes
did approve the request with no comments given. Pooler stated the
applicants are requesting to rezone a portion of the 4.6 acres that is zoned
R-3 and R-1 South of Bony Lake Rd to R-1 so they can split the subject
parcel. Pooler noted the R-3 zone requires a minimum of two acres and
200 feet average width, for which the slot is 150 feet, and it doesn't meet
the minimum requirement for R-3. R-1 zone, stated Pooler, has a required
minimum width of 150 feet and therefore the use would fit the standard for
that zone.
Ray made a motion to approve the petition from Laura Waterhouse
and Sarah Carlson for a Rezone of Tax ID 1400 based upon consistency
with the Town Comprehensive Plan, consistency with the Town Board
Recommendation, and consideration of the Departments file report and site
specifics. Seconded by Pocernich. Strand clarified that the motion is to
recommend approval to the full County Board. Ray confirmed that was his
motion. Motion carried, 5-0

Pocernich asked if the fee schedule change will allow for any changes to
be made administratively and not go before the full County Board. Hulstrom
stated the Ordinance Amendment is requesting to take the fee schedule
out of the ordinance and have it as a separate document that would be kept
and provided by the Planning and Zoning Department, and if any
modifications or changes were needed to it, then it would come before the

Planning and Zoning Committee for a recommendation and to the full Board
for approval instead of going through the Ordinance Amendment process.
Discussion occurred regarding the change in boathouse square footage
and Ray stated he would suggest that instead of a maximum 200 sq ft
footprint, a 250 sq ft maximum be considered, to include eaves and
overhangs in the footprint, therefore not reducing the interior square footage
of the building. Pooler stated most of the time people don’t think to include
eaves and overhangs when they declare the dimensions, or footprint of a
structure. Hulstrom stated that footprint is defined in the ordinance and
does include eaves and overhangs. Pocernich asked why the square
footage is changing. Ray replied that the change is to reduce the bulk of
what people are building right on our waterfronts and reduce the
attractiveness of using that boathouse for an outbuilding and party shack.
Silbert asked for the Ordinance Amendments be separated for voting
purposes.
Pocernich made a motion to recommend approval of the proposal
to the full County Board. Seconded by Ray. Ray asked about the Short-
Term Rental Ordinance Amendment and if it was included in the fee
schedule changes. Hulstrom replied that the new ordinance language has
not been adopted yet, so the new fee associated with it would be approved
or recommended by the Committee at the same time the ordinance
language would be adopted. The Department will continue to process short
term rentals right now with the current fee schedule, which is a Class A for
one unit and a Conditional Use Permit for two to four. Motion carried; 5-0
Discussion occurred about the proposed boathouse ordinance changes.
Ray moved to approve the proposed amendment to the boathouse
setbacks and height regulation, section 13-1-22, striking the proposed
language on no boathouse should have glass doors, and clarifying that the
footprint shall not exceed 250 square feet, including eaves, rather than the
proposed 200 square feet. Seconded by Silbert. Motion carried; 4-1
11. Other Business
F. Minutes of Previous Meeting:
Strand moved to approve the Minutes of the December 21, 2023
meeting. Seconded by Ray. Motion carried, 5-0
G. Committee members discussion regarding matters of the Planning
and Zoning Department:
Hulstrom informed the Committee of the new staff member, Trent Wiesner,
who just recently just started in the Clerk position, and that interviews are
complete for the Short-Term Rental position and hopefully will extend an
offer soon. Abeles-Allison informed the Committee that he received some
unfortunate news regarding the grants for the Zoning Code rewrite that were
applied for, and that the Department did not receive them. Pocernich stated

he has received phone calls and complaints about sanitary postcards being
sent out and that he was of the understanding the Department wasn’t going
to send out the postcards anymore. Pocernich asked the Department what
happened. Hulstrom stated that the Department sent out one last courtesy
notice before the new software program is in full implementation. Abeles-
Allison noted that the postcards were meant as a heads-up that systems
were “coming due” so there wasn’t a gap in the State required notifications
while the Department switches to the new software that will hold the Sanitary
Maintenance Program. Pocernich and Ray noted that the public is very
angry and confused by this notice. Ray asked if there will be mailed notices
with the new software program and Hulstrom stated there will not be any
more mailed notices except for the notice to all applicable individuals that
we have implemented a new software program Department wide.
12. Monthly Report
Hulstrom stated November and December’s monthly report is in Dropbox and as
you can see the Department continued to have more sanitary and land use permits
issued in November and December in comparison to last year.
Pocernich moved to receive and place on file November 2023 and
December 2023 monthly reports. Seconded by Silbert. Motion carried, 5-
0
