There will be minimal to no increased impact to the site or surrounding lands. The Town of Cable has filed a reclamation plan with the previous permit and will keep this plan in effect. 2) a. The site is located in an area of rolling topography consisting of glacial till, bordered by an esker on the southern boundary and the Namakagon River valley to the north. b. The top layer of the site consists of sandy loam with cobbled sandy soils beneath. c. Percolation tests and core samples have not been performed at the site as it has been in operation for many years. d. Groundwater at the site is 50+ feet deep. Caps Creek is approximately 1800 feet to the north with an elevated wooded area separation from the site. There are no other surface water resources in the immediate vicinity of the site. e. The site was cleared of mature vegetation when the site was first developed. There has been volunteer regrowth ofgroundcover and small trees. f. Land use of the existing site will not change. There is a vegetated buffer between the site and a residential area to the north. The other surrounding land is forest. 3) a. No new division of land is part of this plan or permit b. Elevations of land will drop as material is removed from the site. Exact final topography depends on the level of usable material found on the site. Erosion control and reclamation of the site will follow the plan filed in 2012 with the previous permit application. c. Vegetation will be removed as needed for material mining and replanted in grass to avoid erosion. Natural reforestation will be allowed to occur after the site is reclaimed. d. Storm and water runoff will naturally stay in the excavation and will soak into the ground. e/f. They are seeking renewal of a Conditional Use Permit (CUP) for a Non-Metallic Mine. The subject property is zoned F-1 The site is currently operating as a non-metallic mine under permit #12-0106 approved on May 9, 2012. The property was surveyed in 2020 as required by ordinance. This area has been a sand / gravel borrow site for many years. The footprint of activity is not much larger than it was in the 1992 air photos. There is a very tall esker located in the southwest corner of the subject site. An esker is a glacial deposit that is believed to have been formed within ice-walled tunnels by streams that flowed within and under glaciers. They tended to form around the time of the glacial maximum, when the glacier was slow and sluggish. After the retaining ice walls melted away, stream deposits remained as long winding ridges. The tallest recognized esker in North America is documented at 90 feet in height. Unofficially the esker located on thi has locations that measure over 120 feet in vertical rise. Additionally, the snowmobile/AW trail and the CAM BA trail cross the subject property and are 400 feet or more from the current active wall of the borrow area. In deciding whether to grant the CUP the Committee can consider Code Section 13-1-25(c): Bas/s of Approval. In passing upon a conditional use permit, the Planning and Zoning Committee shall consider the four (4) stages of a mining operation: exploration, prospecting, ongoing commercial operation (extraction and processing), and reclamation, their effects upon the factors listed under Section 13-1-41, and whether or not they are consistent with the purpose of this Section, In order to facilitate such considerations, the following information shall be required by the Planning and Zoning Committee: (1) A legal description of the proposed site. (2) A detailed description of the topography and vegetative cover of the area to be mined. (3) The proposed setbacks that are to be obsen/ed and a description of the access to the area. (4) A description of all phases of the contemplated operation, including types of equipment that may be used, the extent of vegetation removal, proposed dispositions of spoils, planned precautions against various types of pollution and plans for ongoing reclamation and erosion prevention where the operation is to include sand and gravel washing, the estimated daily quantity of water to be used, its source, and its disposition. (5) A site restoration plan, which shall include detailed grading and revegetation plans, and a written statement indicating the timetable for such restoration; in accordance with ABDI Land Conservation Department recommended approval and Title 16 Bayfield County Nonmetallic Mining Reclamation Ordinance. The Committee granted the previous non-metallic mining permit in 2012 without any additional conditions. Code Section 13-1-25(d) outlines conditions that the Committee shall or may apply to a CUP for a nonmetallic mine. Conditions of Approval. (1) The Planning and Zoning Committee shall require as conditions of the permit. (a) A boundary survey of exterior boundaries. (b) That appropriate setbacks and other dimensional requirements as set forth by the Planning and Zoning Committee be met. (c) That appropriate measures be taken to avoid nuisance affecting surrounding uses, pollution of any sort, and erosion. (d) That no more than a forty (40) acre parcel shall be permitted at any one time.
