All Land Use Permits expire Two (2) Years from the date of issuance if construction or use has not begun. Sanitary Permit, if
required, issuance needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a
permit will result in penalties.
The local Town, Village, City, State or Federal agencies may also require permits. The construction of one- & two-family dwellings
and new plumbing/electrical installation for residential use structures (accessory/principal) require review and approval by the local
Uniform Dwelling Code (UDC) authority. All municipalities are required to enforce the UDC.

These calculations are REQUIRED per WI Admin Code NR 115.05(1)(e) and Section 13-1-32(g) and 13-1-
40(h) of the Bayfield County Code of Ordinances. The undersigned hereby makes application for construction,

Impervious Surface: An area that releases as runoff all or a majority of the precipitation that falls on it.
"Impervious surface" excludes frozen soil but includes rooftops, sidewalks, driveways, parking lots and streets
unless specifically designed, constructed and maintained to be pervious.
Calculation of Impervious Surface: Percentage of impervious surface shall be calculated by dividing the
surface area of existing and proposed impervious surfaces on the portion of a lot or parcel that is within 300
feet of the ordinary high water mark by the total surface area of the lot or parcel, multiplied by 100.
Impervious Surface Standard: Allow up to 15% impervious surface but not more than 30% impervious
surface on the portion of a lot or parcel that is within 300 feet of the ordinary high water mark. A permit can be
issued for development that exceeds 15% impervious surface but not more than 30% impervious surfaces with
a mitigation plan that meets the requirements of the Bayfield County Ordinance(s).
Existing Impervious Surfaces: For existing impervious surfaces that were lawfully placed when constructed
but that do not comply with the standards in Section(s) 13-1-32(g) and Section 13-1-40(h), the property owner
may do any of the following:
a. Maintenance and repair of all impervious surfaces:
b. Replacement of existing impervious surfaces with similar surfaces within the existing building footprint;
c. Relocation or modification of existing impervious surfaces with similar or different impervious surfaces,
provided that the relocation or modification does not result in an increase in the percentage that existed
on the effective date of the county shoreland ordinance, and meets the applicable setback
requirements in Section 13-1-32.

The Shoreland Mitigation/Restoration Plan must be implemented within 1 year from the issuance date of the
land use permit and remain in place for the foreseeable future.
The use of the property is subject to the following terms and conditions, designed to meet the requirements of the Bayfield
County Zoning Ordinance.
A deck4anding (10x24) was placed without a permit, see violation letter dated August 27, 2023, on life In
the Planning and Zoning Department. A 10 O' portion of this deckdanding was required to be removed to
meet the minimum 40 square foot standards for a landing.
As an inducement to Bayfield County to issue a Land Use Permit for the above described property, we agree to the
following:
1. Owner(s) agree to conform to the conditions of the aforementioned Land Use Permit and will follow the shoreland
restoration standards. Owner(s) agrees that removal of the structures authorized by the Land Use Permit will not void
this agreement or the conditions placed hereon.
2. Said Permit shall remain and be preserved upon this described property in perpetuity.
3. Owner(s) agree to allow authorized representatives of Bayfield County to enter upon the owner's property at the
above description to inspect the structure(s) authorized by permit and to determine if agreed conditions are met.
4. By signing this affidavit the owner(s) hereby agree that said permit inures to the benefit of, and said terms and
conditions are binding upon, the owner(s) and all successors and assigns of the owner(s) interest in the

RE: Mitigation to Correct Violation at the Property Described as: LOT 2 CSM #2080
(LOCATED IN GOVT LOT 5) IN DOC 2019R-577585, Section 29 Township 44 North, Range
06 West, Town of Grand View, Bayfield County, Wisconsin (Tax ID 38008) (Parcel ID 404-
021-2-44-06-29-2 05-005-12000).
Dear Thomas & Lynne,
Thank you for meeting with Travis and I on October 8, 2020 at your property on Diamond Lake,
Fire # 47650 N Diamond Lake Rd. to discuss options for required mitigation. The actions and
recommendations we made reference the notice and order from Tracy Pooler's letter on behalf of
Bayfield County Planning & Zoning Department (Zoning), dated August 27, 2020. This letter
will focus on the shoreland restoration and revegetation aspects of Tracy's letter.
The following actions must be taken:
1) Decrease the size of the deck/landing platform onshore near the dock so it is no larger
than 40 square feet, measuring five feet wide as a walkway and eight feet back not
parallel to the shore. Leave the concrete footings in place, as attempting to remove them
will create disturbance.
2) In the area where the deck/landing platforn will be removed, stabilize the shoreline by
laying down erosion matting and planting native plants (see native plant list enclosed).
3) For the fire ring and the deck attached to the house, refer to Tracy's letter for guidance
and contact Tracy with questions about these.
4) The restored areas are not to be mowed or landscaped with wood chip paths and/or art.
5) Since the proposed viewing corridor is to be split, provide a map to Zoning showing the
areas that will be used as a viewing corridor, as well as the area in between that will
remain as natural shoreline. Be sure to include the measurements of those areas to
demonstrate that you are within the allowable 70 feet of viewing corridor.
The following is a recommendation:
1) From the turf grass edge near the shoreline measuring five feet landward and running 50
feet parallel to the shoreline, plant native low -growing shrubs to help stabilize the
shoreline and reduce erosion and runoff.
Implementing the practices described above should bring you back into compliance for the
shoreland vegetation portion of the order from Zoning. If you have any questions about this
letter, please let us know. Thank you for working with us.

1. Include sanitary site drawing and photos of existing deck prior to removal -evidence of
non -conforming structure replacement.
One item that we did not get to touch on was how to address 35-foot buffer removal that occurred. The photos from
2019 and aerial photography show considerably more vegetation within the 35-foot buffer. The property owner is
allotted a 70-foot-wide viewing corridor.
As such, we will need a site plan showing the proposed viewing corridor, no greater than 70-feet wide, and the 35-foot
shoreland vegetative protection or buffer area to be restored. A mixture of trees, shrubs and ground laying vegetation
should be installed, see link to Shoreland Restoration Guide that include plant types, spacing, etc. Restoration of this
buffer should occur within a year and will need to be included in the affidavit.

Hi Ruth,
Correct the stairs are not considered in the floodplain if they are above 1395.4 NGVD-29. If the 2-ft contour elevations
for the stairs were close to this elevation I would recommend a survey. However, it seems they are fairly above this
elevation based on the contour data. As for the grading work, they are technically in violation if it was done below the
elevation of 1395.4-ft. 1 would also take into consideration how possible it is to return the grade to pre-existing
elevations or match to adjacent grade. If that is not known or is not clear, may need to use some best judgement on
enforcement.

Thanks for your insight regarding the McNutt property and the applications under review.
I have attached complete copies of these applications. Please clarify whether I understood you properly on the phone.
Per the document you previously attached, the stairs to the lake would not be deemed Zone A if county contours
indicated they are above 1395.4 ft., correct? Looks like they would be somewhere between 1396-1398 per 2-foot
contours on county mapping program.
Does that mean, they would not need to submit elevations etc.
As for the deck replacement, can you point me in the direction of the application related to the LOMA approved for the
residence? I want to confirm that it was included in the LOMA.
Finally, you indicated that grading done in the past should have completed an H and H, correct? What do we do now
that they have already graded the site?

A hydrologic and hydraulic analysis of Diamond Lake was done to determine a
RFE of 1395.4 ft. NGVD-29. Historical lake elevations were not utilized
because of the replacement of the inflow -and outflow culverts and survey
information prepared by Mr. Nelson indicated a bust in the elevations between
B•.M. "X" and B.M. 1623-A:
This was confirmed by the survey circuit done by your office. Your extra
effort prevented delaying this RFE determination and is appreciated.
Benchmark "X" , which was located on the inlet culvert, was lost. The
elevation of the remaining local benchmark (1623-A) was tied to NGVD-29 at
1397.47 ft.

In finalizing my review and getting all paperwork together, it was an oversight on my part that an impervious surface
form should have been required for the stairs to lake because this will be a newly permitted structure not a non-
conforming structure to be replaced. Attached is a form that I pre -filled, please review with the McNutts to verify the
information that I put together is accurate. Below is the map showing how I calculated the impervious surface for
existing structures. I used the land use applications for the proposed stairs to lake and reconfigured deck. Feel free to
edit as needed.
There is a $25 fee associated with the impervious surface form. This can be paid by check, card, or cash. Again, apologies
for this oversight.

Good Morning Ruth,
Following up on our conversation yesterday, the McNutts are agreeable to cutting the deck down to the layout shown in
the attached depiction to finalize the remedy of all outstanding zoning violations for this property. My understanding is
that once this is approved and they cut the deck back, then all of the outstanding issues with their property have been
resolved and the permits will be issued for (1) grading, (2) walkway, and (3) deck.
One question that I wanted to clarify is what they do with the ground under the deck area that is being
removed. Should they keep it as the landscaping rock that is currently there, or should they remove the landscaping
rock and re -seed that area as they had done with other sections?
Karl will mark the deck where it is going to be cut down and he will also meet you at the property tomorrow for your site
visit so that you can confirm the final layout of the approved deck. What time will you be at the property? If its possible
to do the site visit in the morning, Tom would be able to meet at the property as well.
Please confirm that my understanding on this matter is correct and let us know if you need anything else to get this
matter wrapped up.
