If so, do you require a sign permit and who is responsible for enforcing the sign regulations? For a town overlay to be located within the county ordinance, like the one I provided, the town would have had to request a text amendment. The county is then responsible for overseeing and enforcing these standards once they are adopted into the county ordinance. Given that this text amendment solely applies to the Town of Namakagon, if a text amendment to it was needed to it, the town would be responsible for the fee payment and documents needed to process it. Apologies, but unfortunately the older ordinance amendment records are somewhat spotty so I am uncertain as to why your records indicate different ordinance language from what was adopted into the county ordinance. Note that ordinance amendments must be sent by certified mail to all towns. Then a public hearing and recommendation by the Planning and Zoning Committee occurs. Then the Board of Supervisors reviews and determines whether to approve or not the new language. You could reach out the County Clerk's office to see if they have additional information about this ordinance amendment since the ultimate adoption is done by the Board of Supervisors. Learn why this is imoortant I am very confused. We do not need a change in our ordinance; our ordinance is very clear on the intent. This would be a change in your ordinance. I guess I did not realize that the towns have these obligations for a change in a Bayfield County Ordinance. I have never seen any request from the county like this. On top of the hearings that you are telling me we need to do for the county ordinance change, we need to pay for the change as well? I do not recall any fees or publication requests done from the town side when this was approved by the county in 2011. What changed in zoning that requires all of this information from the town? Would you please clarify this? Once I get clarification I will bring the information to our board at the Feb meeting. The Zoning office needs the following from the town to pursue the ordinance amendment: 1) Petition to Amend (see attached example) 2) Public Hearing Notice (see attached example) 3) Ordinance Amendment Language (attached is existing ordinance language, please indicate language you wish to delete with a double strike through and language you wish to add with a double underline) 4) $300 text amendment processing fee You can submit the above information to zoning@bayfieldcounty.wi.gov. The following overlay district exists in the Town of Namakagon. Sec.13-1-67 Town of Namakagon Overlay District (opn6rAii) (a) General Provision. The Town of Namakagon Overlay District shall apply to and include all lands within the Town of Namakagon. (a)m6rwi1) (b) Intent of the Town of Namakagon Overlay District. The intent of this overlay district is to promote the public health, safety, convenience, and general welfare: to encourage planned and orderly land use developments: to protect property values and the property tax base: to encourage uses of land, water, and other natural resources which are consistent with the Town of Namakagon Comprehensive Land Use Plan: to maintain water clarity in lakes, rivers, and streams: to protect the beauty and amenities of landscape and man-made developments: and to provide healthy surroundings for recreation, tourism, and family life. (op2swil) (c) Part of the Purpose and Intent of the Town of Namakagon Overlay shall be achieved by restricting all new off -premise signs except as listed as exempt in the Bayfield County Sign Ordinance. Permanent off -premise signs in the Town of Namakagon shall also be subject to the following requirements: (%monoii) (1) All existing off -premise signs may be maintained but must be brought into compliance with the County ordinance pertaining to size and setback by July 1, 2016. (®pn6noii) (2) If the owner of the off -premise sign sells the business; the sign is considered property of the business. topi2mi 1i) (3) Existing off -premise signs may not be rented to any other business. (0)7r2612011) (4) All other County ordinances regarding signs will be enforced. (e)w2aanii) Except as specifically modified and amended by this ordinance, the Bayfield County Code of Ordinance shall remain in force and effect exactly as originally adopted and previously amended. All ordinances or parts of ordinances inconsistent with or in contravention of the provisions of this ordinance are hereby repealed. (0)7/M2011) The language in this ordinance indicates that new off -premise signs are restricted but not prohibited. Was it the intention of the town to prohibit new off -premise signs? If yes, the town should request to amend the existing ordinance language to state "prohibit' and not "restrict". In the meantime, if the department receives an off -premise sign request we will review and approve it per Article E: Signs.
