It is comprised of three substandard lots, which would need to be combined via a Certified Survey Map (CSM) if the existing building footprint changed and the alteration or addition could not meet 5-foot setbacks from the internal lot lines of the substandard lots. The proposed uses of the MUD are allowed in the C zoning district but because there are three or more of them, Bayfield County Section 13-1-29 applies and a conditional use permit and environmental impact analysis CEIA) are required, see code below. (a) Introduction. A Multiple Unit Development Is a development on a single lot consisting of three or more units. It may be a condominium (in which case the lot consists of the condominium property); or a lot improved with a multiple unit dwelling; or a lot improved with a hotel/motel; or a lot improved with three or more units of other types. It requires a conditional use permit under See. 13-1-41 and an environmental impact analysis under See. 13-1-42, and shall also meet the following requirements: (®®4/3/2oo7) Additionally, each MUD requires a certain amount of open space. It is unlikely that the proposed project would be able to meet the required open space unless waived or greatly reduced. Per Bayfield County Section 13-l-29(b)(3), see code below, each unit would require 30,000 square feet of open space. Hard copies are in the mail. Note that the Committee required a certified survey map combining the three lots be approved. Please work with a licensed surveyor to get this item addressed as soon as possible so we can move forward with issuing the conditional use permit and the land use for the residential unit. As for the deck, a land use permit should be submitted unless this deck is moved at least 5 feet from the existing building. An after-the-fact fee would apply to this permit application. Attached is a land use 2 application. Fee is $0.75/sq ft if it is within 5 feet of the principal building as it would be deemed part of I the principal building.
