To Whom It May Concern:
The following comments need to be addressed for your application to move forward.
Special Use Permit application:
1) Need completed affidavit of authority for Donald Lulich to solely act on behalf of the LLC.
2) Need to complete Classification of Uses Request on page 1 of application. Please refer to Bay field
County Ordinances Section 13-l-62(a). Based on information on application, the department would
classify the proposed use as "Storage (Campers, Boats, Mini-Storage, etc.)". Please verify department
can add this classification to page 1 of the application.
3) The site plan sheet from the Land Use Permit application is unnecessary for the Special Use B Permit
application unless you want to submit an entire Land Use Permit application for each building you are
proposing. Otherwise, please confirm that the department can remove this from your application.
4) Is the project address correct? County records indicate that there is no address for this property.
5) County records indicate the property to be in Sectionl?, Township 47 North, and Range 5 West. You
included NE SW in the "Section, Township, Range" on page 1 of application. Can you verify that the
department can remove "NE SW"?
6) Are there one or two buildings proposed with this request? Page 1 of application states you are only
building one storage building but the site plan included shows two.
7) Please verify that driveway access to the property is via a private easement road through Tax ID #39080.
8) Are there any internal driveways, parking areas, other development anticipated? If yes, this information
should be shown on the site plan.
9) How many stories/floors will be located in each of the proposed buildings? This should be included on
the site plan.
10) Are two buildings the maximum number of buildings that would be proposed for this property?
11) Need to submit a Land Use Permit application for each building proposed. The Special Use B Permit
application can proceed without a Land Use Permit application being submitted for each building but
the existing Land Use Permit application needs to be updated to indicate which building it is requesting
approval for. The setbacks listed should reflect the building setbacks for that building.

Request Summary:
DL Storage Inc, property owner, is requesting a special use permit (SUP) to have Storage
(Campers, Boats, Mini-Storage, etc.) located on his property described as a 5.91-acre parcel. Tax
ID # 39081, further described as a parcel in the NE ',4 SW IA in the Town ofEileen, hereinafter
referred to as the subject property.
The subject property is zoned Agricultural-1, A-l. The proposed use includes the construction of
two new 40' x 150' storage buildings. All adjacent properties are zoned A-l aside from the
parcel to the west, which is zoned Industrial, I. There subject property is not in the shorelands or
floodplain and there are no mapped wetlands indicated on the subject property. There may
wetlands too small to delineate on the subject property as identified on the Wisconsin
Department of Natural Resources map included with the application.
The subject property is currently undeveloped and was previously utilized for agricultural
purposes. The USDA Web Soil Survey, see attached Farmland Classification map, indicates the
subject property to be identified as "Farmland of statewide importance". The USDA describes
"Farmland of statewide importance" as follows:
In some areas, land that does not meet the criteria for prime or unique farmland is considered to
be farmland of statewide importance for the production of food, feed, fiber, forage, and oilseed
crops. The criteria for defining and delineating farmland of statewide importance are
determined by the appropriate State agencies. Generally, this land includes areas of soils that
nearly meet the requirements for prime farmland and that economically produce high yields of
crops when treated and managed according to acceptable farming methods. Some areas may
produce as high a yield as prime farmland if conditions are favorable. Farmland of statewide
importance may include tracts of land that have been designated for agriculture by State law.
Bayfield County Ordinance Sec. 13-1-62 requires a Class B Special Use Permit to have Storage
(Campers, Boats, Mini-Storage, etc.) usage located in an A-1 zoning district.
The subject property currently has no legal access to a public road, but the property owner is in
discussions with the property owner to the east about acquiring an easement to provide access to
Hnath Rd.
To date, the only correspondence received has been the town board's recommendation and a
returned public notice letter for one of the adjacent properties within 300 feet of the subject
property. The town board recommended approval but gave no reasoning.
If approved the department recommends the following conditions be added:
1. A copy of the recorded access easement or other document be provided to the department
to verify the subject property has access to a public road.
2. Any lighting installed needs to utilize dark sky lighting standards, unless otherwise
superseded by State or Federal regulations.
3. Land use permits shall be obtained prior to the initiation of construction.
The Committee could consider whether requiring a 6-foot-tall privacy fence or landscaping
would be appropriate to screen the use from the neighbors and State Hwy 2.

Be advised your special use permit shall automatically terminate 24 months from its date of issuance if the authorized

Please see attached letter and affidavit related to your approved special use permit request for two storage units
on Tax ID 39081. Hard copies are being placed in the mail today.
Note the conditions placed by the Planning and Zoning Committee. Once you submits copy of the document
showing Legal access to a public road, the department can move forward with issuing the special use permit. After
issuance of the special use permit, we can issue land use permits forthe individual buildings.
