Sanitary Permit issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a permit will result in penalties. The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Before you start your project, you must first obtain any permit or approval that may be required for your project by local zoning ordinances and by the U.S. Army Corps of Engineers. Erosion control measures (such as silt fence and straw bales) must meet or exceed the technical standards of ch. NR 151, Wis. Admin. Code. The technical standards are found at: http://dnr.wi.gov/topic/stormwater/standards/const_standards.html. 14. Unless part of a permanent storm water management system, all temporary erosion and sediment control practices shall be removed upon final site stabilization. Areas disturbed during construction or installation shall be restored. 15. All equipment used for the project, including but not limited to tracked vehicles, barges, boats, silt or turbidity curtain, hoses, sheet pile, and pumps shall be de -contaminated for invasive and exotic viruses and species prior to use and after use. The following steps must be taken every time you move your equipment to avoid transporting invasive and exotic viruses and species. To the extent practicable, equipment and gear used on infested waters shall not be used on other non -infested waters. 1. Inspect and remove aquatic plants, animals, and mud from your equipment. 2. Drain all water from your equipment that comes in contact with infested waters, including but not limited to tracked vehicles, barges, boats, silt, or turbidity curtain, hoses, sheet pile and pumps. 3. Dispose of aquatic plants, animals in the trash. Never release or transfer aquatic plants, animals, or water from one waterbody to another. 4. Wash your equipment with hot (>1041 F) and/or high-pressure water, - OR - Allow your equipment to dry thoroughly for 5 days. 16. To protect fish habitat during spawning seasons, no general permit activity shall take place during the time period specified: a. For trout streams identified under s. NR 1.02 (7) and perennial tributaries to those trout streams, September 15 through May 15. b. For all waters not identified under subd. 3. a. and located south of state highway 29, March 15 through May 15. c. For all waters not identified under subd. 3. a. and located north of state highway 29, April 1 through June 1. d. The applicant may request that the requirements in a., b. or c. be waived by the department on a case -by -case basis, by submitting a written statement signed by the local department fisheries biologist, documenting consultation about the proposed project, and that the local department fisheries biologist has determined that the requirements of this paragraph are not necessary to protect fish spawning for the proposed project. 17. The structure may be located in an area of special natural resource interest. 18. The structure may be placed and maintained only by a riparian. 19. The project will not result in removal of greater than 20% of the aerial coverage of natural bank vegetation, emergent vegetation or floating vegetation, not including the area covered by the footprint of the riprap, or any access corridors necessary for the placement of the riprap. 20. Any grading, excavation and land disturbance shall be confined to the minimum area necessary for the construction and may not exceed 10,000 square feet. 21. Erosion control measures shall meet or exceed the technical standards for erosion control approved by the department under subch. V of ch. NR 151, Wis. Adm. Code. Any area where topsoil is exposed during construction shall be immediately seeded and mulched or riprapped to stabilize disturbed areas and prevent soils from being eroded and washed -into -the waterway. No waterward extension of the property is permitted other than what is reasonably necessary to conduct the project and protect the existing bank. No soil or similar fill material may be placed in a wetland or below the ordinary high water mark of any navigable waterway. 25. Dredging under s. 30.20(1g)(b)1., Wis. Stats., is not allowed for the placement or maintenance of any shore erosion control structure under this section. 26. Riprap replacement may not exceed 100 linear feet of shoreline located on an inland lake or flowage. 27. Riprap replacement may occur no more than once every 5 years. 28. A deposit of sand, gravel or stone under s. 30.12(1g)(a), Wis. Stats., may be associated with the riprap replacement provided the deposit is limited to the area immediately underneath the riprap and is less than 2 cubic yards, not including the riprap itself or clean washed gravel provide under Condition 36 listed below. 29. The replacement will not disturb sensitive areas identified in ch. NR 107, Wis. Adm. Code. 30. The applicant can document, using historical information and photos, the previous placement of riprap. 31. The applicant can demonstrate that the replacement structure is within the footprint of the previous structures. 32. Riprap may not be placed at an elevation higher than the ordinary high water mark plus the storm -wave height as calculated in s. NR 328.08(1), Wis. Adm. Code. 33. The toe of the riprap may not extend more than 8 feet waterward of the ordinary high water mark. 34. The final riprap slope may not exceed (be steeper than) 2 feet horizontal to one foot vertical. 35. Riprap shall be clean fieldstone or quarry stone 6 to 24 inches in diameter. 36. Filter cloth or clean -washed gravel shall be used as a filter layer under the riprap to extend the life of the structure, improve effectiveness and prevent soil erosion behind the riprap. 37. Riprap or other vegetated armoring shall be re -vegetated above the ordinary high water mark by using native plantings which may include native non -woody plants, native shrub plantings, native live stakes or native jointed plantings. Jack Noble has filed an application for a permit to replace existing lakeshore rock riprap on Middle Eau Claire Lake located in the SE'/, of the SE '/, of Section 07, Township 44N, Range 09W, Town of Barnes, Bayfield County. 2. The project will consist of replacing 100 feet of existing rock riprap with filter fabric and rock to prevent erosion. The area above the rock will be revegetated with native plants including Black Eyed Susan, Bergamot, Big Leaf Aster, and Blue Vervain. 3. The Department has determined that the project site and project plans meet the standards in s. Ch 30.12(1), Wis. Stats., as well as NR 328, Wis. Adm. Code, to qualify for this General Permit. 4. The Middle Eau Claire Lake is a navigable water. 5. The proposed project, if constructed in accordance with this permit will not adversely affect water quality, will not increas� water pollution in surface waters and will not cause environmental pollution as defined in s. 283.01(6m), Wis. Stats. SEP a 2OZ4 6. The proposed project, if constructed in accordance with this permit will not adversely affect wetlands. 7. The proposed project will not injure public rights or interests, cause environmental pollution as defined in s. 299.01(4), Wis. Stalls., or result in material injury to the rights of any riparian owner, if constructed in accordance with this permit. 8. The Department of Natural Resources and the applicant have completed all procedural requirements and the project as permitted will comply with all applicable requirements of Section Ch 30.12(1), Wis. Stats. and Chapters NR 102, 103, 150, 299, 310, and 328, Wis. Adm. Code. 9. The structure will not be detrimental to the public interest because the project has been designed and will be constructed in a manner than minimizes adverse impacts to fish and wildlife habitat, water quality, navigation, and natural scenic beauty. 10. The structure will not materially obstruct navigation because the rock will be placed against the existing bank and not extend out to impede navigation. 11. The structure will not materially reduce the flood flow capacity of Middle Eau Claire Lake because the rock will be placed against the existing bank and it will not create a dam or impoundment in Middle Eau Claire Lake. CONCLUSIONS OF LAW 1. The Department has authority under ch. 30, Wis. Stats., and ch. 328, Wis. Adm. Code, to issue a permit for the construction and maintenance of this project. 2. The Department has complied with s. 1.11, Wis. Stats. Dated at the Cumberland Service Center, Cumberland, Wisconsin on September 30, 2024. In the 2 pictures with my contractors machine in them, you can see the original width of the path. His machine is 7 feet wide and as you can see, the path was wider than that on both sides, and gets even wider up the hill near the bend in the path. The new path is basically the same width. In another recent picture from the top of the path, you can see that the path was gravel with weeds growing through it. I'm sure weeds will eventually come through the new gravel as well. Finally, I did not find any old pictures of the path from the original owners, but I did find a document from 2005 that looks to be a receipt of work done on, or creation of, that path. As you can see, gravel, sand, and rock were used on that path back in 2005. will do whatever necessary to make this right (French drain?) and hopefully get the permit for the new storage building. We do plan to work with you and the DNR next spring to get something done to our lake -facing hill that works for everyone and approved by you. We also believe the DNR will allow us to replace the remaining riprap on the shoreline. All of that work will require the path to be used by heavy machines again, thus really making it still a work in progress. I also did video tape the heavy rain this morning and how it drained off the driveway. The videos are too big to send, but I can show you if interested. They withdrew the second permit for 100 feet of new riprap as that was not something the fisheries and lakes biologist wanted to see at that site. There is nothing in this permit that allows fill, other than the rock and filter fabric. Any disturbance above the ordinary high water mark, on the upland, would be the county's jurisdiction unless there are wetlands involved. In my cover letter for the permit, we remind people they need to contact the county, Corps of Engineers, and local authorities to see if permits from them are needed. This structure needs to be removed back to at least the original location of the previous retaining wall. An After -the -Fact Land Use Permit will be needed if the retaining walls is desired at the original location. It was stated that the driveway/walkway was installed around 2005 with a mix of rock, gravel and sand. Since at least 1994 Bayfield County Ordinance 17.07(1)(f)4 Stairways and walkways were exempted from the shoreland setback requirement provided, "The structure shall be no more than 4'wide". In looking into the permit history of this property, there is a permit in 1997 for rebuilding of a dwelling, no other permits have been requested since then till your requests in development of the property. Only one stairway / walkway is permitted per parcel, if this walkway is desired to be retained, the walkway needs to be reduced to less than 5 feet wide per current limitations in the most current ordinance Article 13, Sec 13-1-22(a)(5)g. The Rip -Rap that was placed above the Ordinary High Water Mark (OHWM) are structures that have been passed from the State to the oversight of the County. Zoning Dept. Final plan for Nobles lake front project will be to properly vegetate lake front as agreed between County representative Tracy Pooler, Priemo Construction, and M&M Construction. Vegetation plan: 35% of lake front visible access, the remaining 65% will be vegetated. Width of vegetation area will be 35ft inland from ordinary high water mark. This process of vegetation establishment will be a mix of shrubs, bushes, and trees that have the best chance of survival given the area is high acid content due to surrounding pine trees, and soil being almost pure sugar sand. Vegetation options: We will be planting these trees every 100 square feet from each other within the 35 ft from ordinary highwater mark, bushes, shrubs, and grass between each tree spaced 1-4 every 100 square ft apart. These trees may very between a few species such as Birch trees, white oak, red oak, and or pine species. Red pine, white pine, and balsam fir. Bush options very between buttonbush, black chokeberry, red twig dogwood, and American cranberry bush. Shrubs may be planted as well and a few options the homeowner may pick from will be, speckled alder, sweet pepperbush, common elderberry, and wild rose. Lake front layout for visibility, and vegetation rebirth: Starting at west side of property, 10 ft from west property line to the edge of the walking path will be vegetated, from the west edge of the walking path past the east side of the boat house will be 75 ft of visibility access to lake, the remainder 131 ft of lake front will be vegetated to the county's biological lake front vegetation standards. Process: We will plant trees, 1 every 100 square feet of each other, surrounding the trees will be shrubs, bushes, and grass planted to vegetate entire lake frontfallowingthe lake front riprap replacement permits requirements. ( bush and shrubs every 1-4 every 100 square feet around trees) This comes to 141 ft of vegetated lake front and 75 ft of visibility use. Exactly 65 percent of take front being vegetated meeting the standards of Bayfield County and Dnr permit requirements. Walking Path: Once vegetation is established on lake front next will be returning walking paths west side to its original sate by removing riprap, excavate bank and remove materials to bring the width of the path back to its original state, install the sand bags that was agreed upon for erosion control and bank stabilization, and establish vegetational growth across the path instead of gravel. Process for walking pack: We will begin by removal of rock retaining wall along west side of walking path, rock will be relocated to north side of property for future possible use. Once rock is removed, we will remove approximately 15 yards of subsoil along west bank of the walking path shrinking path down to its original width that is visible by the old wooden retaining wall that is still present. Once the walking path is back to its original width Geotextile bags will be placed on the west bank of the walking path for stability and erosion control. Once the path is back to original width, we will remove the gravel on the path and install 10 yards of topsoil. Once topsoiled, we will plant native grass species for vegetation replacement for the entire path. I expect this sums up everything we agreed upon and is a clear walk through of the final stage of this lake front project.
