All Land Use Permits expire Two (2) Years from the date of issuance if construction or use has not begun. Sanitary Permit, if
required, issuance needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a
permit will result in penalties.
The local Town, Village, City, State or Federal agencies may also require permits. The construction of one- & two-family dwellings
and new plumbing/electrical installation for residential use structures (accessory/principal) require review and approval by the local
Uniform Dwelling Code (UDC) authority. All municipalities are required to enforce the UDC.
If subject property is part of a Condominium Plat, applicant hereby certifies and represents that applicant has all necessary approvals
and recorded documents required to complete the project for which this permit is sought including requirements set forth in Wisconsin
statutes pertaining to condominium associations, the Declaration of the Condominium Association in which the property is located,
and all other rules, regulations and requirements pertaining to that Condominium Association.
You are responsible for complying with state and federal laws concerning construction near or on wetlands, lakes, and streams.
Wetlands that are not associated with open water can be difficult to identify. Failure to comply may result in removal or modification
of construction that violates the law or other penalties or costs. For more information, visit the Department of Natural Resources
wetlands identification web page, dnr.wi.gov/topic/wetlands, or contact a Department of Natural Resources service center (715)685-
2900.

For your perusal, I've attached the letter on STR approval process for Bayfield Co not following state
law (this is from Bayfield Co legal) that I referenced earlier, which was included in Town of Russell
meeting notes. Not sure that it will add any new info for you or relevancy to our current permit
application, but sending just in case it's useful for you to have general background.
Definitely let me know what other info I can provide to help with the application (e.g. local ppl who
want to live here in perpetuity, pay taxes here, send our daughter to school here, etc.). Our real aim is
to run multiple local businesses, so that we have income streams outside of my remote job and can
stay in the area.

As I noted during our check -in meeting this week, I need your determination on whether a bunkhouse used as an
STR can be an accessory structure if the property owner is living in the principal structure. I have already indicated
my thoughts on this issue, but I understand others in the Department may feet differently. Until you make a
decision on this matter, I can't move forward with my application review as it impacts the required application
materials, setbacks, and ordinance standards.
As I also noted when I scanned you the applications, I had not yet completed my application review, so I did not
use the review checklist. I scanned you and Deb a copy to make you aware of the application materials that I had
received. I am already aware of many of these issues with the application, but need more clarity from you on how
the application should be processed. Once I receive your determination, I will proceed with my review using the

Sorryfor the delay in reviewing these. Noted on the lack of date stamping and printing on the Welch application.

Below are items that should be addressed on the Welch applications before this item is placed on a meeting
agenda.
1) Need upper right box on application completed by department staff.
2) Wrong Tax ID on CUP application.
3) Let applicant know they will need to submit separate application for the STR. The STR request should be
removed from CUP application.
4) Need conceptual drawing for CUP application, majority of information needed seems to be included in the
site plan with the LUP. Need to add stories of existing residence.
5) Need Dana's signature on applications or a letter of authorization.
6) Need to add Dana's name under property owner on LUP application.
7) Why are legal descriptions different on CUP vs LUP applications, LUP legal looks to be the most accurate.
8) West lot line measurement in site drawing Looks inaccurate based on CSM 2172, 607' not 942'. Need to
update north and south setbacks since these measurements would exceed total length of lot.
9) Property is zoned F-1 and is a residence, which is a principal structure and requires a 75 -foot setback.
Proposed structure is not compliant because it is only 30 feet from west property line.
10) Based on elevations max height of house seems to be approx. 21.5' but they indicated 25' on the LUP
application.
11) Deck should not be noted as "Other" on LUP application but should be part of the 15t floor.
12) Is the applicant proposing a holding tank for the new residence? Is it being tied into the existing drainfield?
13) Need town board recommendation form, 300 -foot public notice map, and other maps noted on the
attached checklist.
Did you use the attached checklist when you were reviewing this application? This should be used to help staff do
complete and consistent reviews.

Emily,
I have a question on what's required for the John Welch project as far as the sanitary goes.
There is an existing 4 bedroom At Grade septic system installed. The existing house is 3 bedrooms. The
proposed new cabin is 1 bedroom, so the system is sized correctly.
As i see it, all that should be required is a sanitary reconnection. The elevation of the new cabin won't
allow a gravity sewer line so it will require a lift station. A tank with a grinder pump will be installed near
the new cabin and then a 2" discharge line will be run over to the inlet of the existing septic tank.
If we're on the same page, then I will fill out the reconnection form and draw a plot plan.
