Sanitary Permit issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a permit will result in penalties. The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Additions and alterations to one - and two-family dwellings may require review and approval by the UDC authority. All municipalities are required to enforce the UDC. McKinney and Barbara J. McKinney, createfi the McKinney Revocable Trust dated January 3, 2002. Pursuant to Article VII.A. of said Trust, we are permitted to amend the Trust at any time, and we now wish to restate and amend the Trust as follows: 1. Delete all provisions of the McKinney Revocable Trust dated January 3, 2002 in their entirety and now restate and amend the Trust to read as follows: We, Jon M. McKinney and Barbara J. I. TRUSTEE DESIGNATIONS A. Definitions. As used in this instrument, the word "trustee" shall refer to either or both of us except in the event of the death, resignation, or incapacity of one or both of us as provided below. "Incapacity" shall mean the inability to manage one's business and personal affairs resulting from physical and/or mental disability as certified in writing by a licensed physician who is not related by blood or marriage to either senior or any beneficiary of this trust. B. Resignation, Incapacity, or Death. 1. Upon the resignation or incapacity of one of us, the other shall serve as sole trustee of the original trust. Upon the resignation or incapacity of both of us, Henry Rieckhoff shall serve as trustee of the original trust. In the event Henry Rieckhoff cannot act, William McKinney shall serve as trustee of the original trust. 2. Upon the death of one of us, the survivor shall continue to serve as trustee of the original trust. The survivor shall also serve as trustee of the survivor's trust and as trustee of the disclaimer trust, except as hereinafter set forth. In the event the survivor fails or ceases to act as trustee of an trust created by this instrument, Henry Reickhoff shall serve as trustee. No successor trustee shall be liable for any act, omission, or default of a predecessor trustee. II. ADMINISTRATION DURING OUR LIFETIMES A. Nature of Property. All marital property transferred to this trust and the proceeds of that property shall be known as the "marital property estate" and shall remain our marital property after it is transferred to this trust. All individual property transferred to this trust and the proceeds of that property shall be known as the "individual property estate" of the settlor who transferred the property and shall remain that settlor's individual property. The trustee shall segregate the marital property estate and individual property estates and shall maintain appropriate books and records to avoid the commingling of that property. For convenience, the trustee may at any time (including after the death of one of us) allocate the marital property estate and the individual property estates, if any, to separate trusts under this instrument, which may be known as the "McKinney Marital Property Trust", "Jon M. McKinney Individual Property Trust" and "Barbara J. McKinney Individual Property Trust", respectively. B. Settlors' Rights to Income and Principal. 1. While both of us are living, the trustee shall pay to us or our agents as our marital property as much of the net income and principal of the marital property estate as either of us or his or her agent directs, and shall pay to each of us or his or her agent as that settlor's individual property as much of the net income and principal of that settlor's individual property estate as that settlor or his or her agent directs. 2. In the absence of such direction, or if either of us is or both of us are incapacitated or otherwise unable to direct the trustee with respect to such payments of income and principal, the trustee shall pay to us or our agents as our marital property as much of the net income and principal of the marital property estate, and shall pay to each of us or his or her agent as that settlor's individual property as much of the net income and principal of that settlor's individual property estate, as shall be reasonably necessary to provide for the support and maintenance of us, or either of us, including all medical, dental, hospital and nursing expenses, and expenses of invalidism. The trustee shall exercise such powers liberally, taking into consideration the lifestyle to which we are accustomed. 3. If the trust estate consists of the individual property of both of us and the trustee is making distributions for the purposes stated in Subparagraph II(B)(2), the trustee shall charge the distributions equally to our respective individual property.
