Sanitary Permit issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a permit will result in penalties. The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family dwellings requires review and approval by the local Uniform Dwelling Code (UJ)C) authority. Additions and alterations to one - and two-family dwellings may require review and approval by the UDC authority. All municipalities are required to enforce the UDC. "Impervious surface" excludes frozen soil but includes rooftops, sidewalks, driveways, parking lots and streets unless specifically designed, constructed and maintained to be pervious. Dear Bruce and Nancy. On March 26, 2025, Travis Tulowitzky and 1, from the Bayfield County Land & Water Conservation Department, visited your property to assess and discuss what would be needed for vegetation to satisfy the conditions of your Bayfield County Planning & Zoning Department open -sided structure permit application. You have 177 feet of shoreline. Wisconsin state statute and administrative code, and local and county ordinance, allows a property to use up to 30% of its shoreline for viewing and access corridor when the permit is for an open -sided structure. This means you would be allowed to use 53 feet of your shoreline for viewing and access, with an important caveat: Half the distance of the shoreland setback (which is 37.5 feet) spanning 70% of your shoreline, must be covered with native vegetation that has all the following components: ground cover, shrubs, and trees. Please note that the Wisconsin Biology Technical Note 1: Shoreland Habitat for plant spacing is the standard to follow. However, as discussed on the phone while we were on site, the primary focus for you will be installing shrubs in areas that already have trees and ground cover and vegetating bare soil areas. Specifically, we identified the following areas to target for vegetation restoration: I. The slope on the lakeward side of the boathouse needs to be vegetated and stabilized. Travis and I mentioned it would be a good candidate for vegetated mats ora vegetated geotextile bag wall set up in two tiers, where each tier is 3 feet high, and tied into the slope using the bases of existing live trees. 2. In the areas where you will be removing steps/stairs, slope those areas so they are smooth and use' either a heavy mat with seeding or a vegetated mat to cover the bare soil. 3. Plant 4 shrubs per 100 square feet. 4. Revegetate the area where the old boathouse used to sit. This can be accomplished with plant plugs and erosion matting, or vegetated mats. Plant at least one tree and two shrubs in this area. 5. Lightly smooth out and use some topsoil to fill in the equipment ruts near the patio/fire ring area and along the side of the house. Then seed the bare soil and cover it with erosion matting. 6. Travis and I measured and pointed out that you would be able to have 38 feet of viewing and access corridor that incorporates the fire pit/patio and new paver path from the deck down to the stairs accessing the shoreline, and another 15 feet for the new boathouse. *Notes or other conditions: Care shall be taken to ensure the planted vegetation is watered regularly, achieving at least I inch of water applied to the plants per week, for at least the first two growing seasons after installation, to increase the odds of plant survival. I strongly recommend animal deterrents like exclusion fencing and/or plant -safe chemical deterrents to prevent animal browsing until the plants establish in the soil. Any vegetation that is planted and dies shall be replaced with living native vegetation suitable for the site. Enclosed is a native plant list to help you determine the best native species for the site conditions in the areas that need to be revegetated. I have also enclosed the plant spacing recommendations that we follow, courtesy of the Wisconsin Biology Technical Note 1: Shoreland Habitat. The mitigation plan shall be completed by the date specified by Zoning, or within twelve months of project completion if no date is specified by Zoning. *stormwater management: Your property is currently NOT over the 15% impervious surface threshold, so any stormwater management you do at this point would be voluntary. We do, however, recommend putting gutters on your boathouse, sloping them back landward, and running the downspouts into a drywell or small rock infiltration pit OR using no gutters and then installing a rock infiltration trench along the roof dripline. Choosing and installing one of these options can provide slope stability and halt soil erosion caused by roof runoff. I have enclosed pages 19-23 from "Controlling Runoff and Erosion from Your Waterfront Property: A Guide for Landowners", which show diagrams and materials for construction of these practices. According to Bayfield County Zoning Ordinance 13-1-22 (aX5) a.7, you also need to record an affidavit with the Bayfield County Register of Deeds office, which shall include the conditions of that section of the Bayfield County Zoning Ordinance. Along with this affidavit, you will need to provide a site plan. At a minimum, the site plan shall show dimensions and location of your viewing and access corridor, the things you will be removing and areas you will be restoring, the house, former boat house location, new boat house location, dock, fire pit and patio, and the staircase/path access to the lake.
