Emily, Sorry it took so long to get back to you...I feel like I just can't catch-up here at work and that spills over into not having time to do these sort of things. I've attached an updated map showing the two threes you indicated and wrote the distance from the OHWM. I'm discussing with my wife, but likely will either be maple or birch trees. There are a lot of birch trees on the property and they may do better than the maple. I'm going to do a bit more research using DNR/county data before selecting the type of tree, but it will be native and deep rooted. It's definitely helpful to know more about the conversations previous inspectors had with land owners. I've learned that the county's records don't always reflect these conversations. We can adjust the requirements to have one tree at approx. 15 ft from the OHWM and one tree at 35 ft from the OHWM. I certainly understand your comment about the aerial photography. When I met McKenzie Slack out at the property prior to my initial application she did conclude that the aerial photography of the Lot 1 was not altered by the previous owner of the property (mainly the cabin was removed), however, lot 2 was significantly altered. I actually shared photos with McKenzie of the changes on lot 2 from my phone. We discussed what trees would need to come down for my build as well as placement of the rain garden (which is larger than the permit required by about 2X). I'm operating from memory but I think the rain garden required 3X30 or so. I made it 6X28. I'm actually leaving town for spring break Thursday (kids are off school Friday and next week so either my wife and I split taking time off work or we go on vacation — we opted to go on vacation S) - We can reconnect when I get back. In the meantime, is there any restriction on trees? Given the topography I would suspect that a tree at 8-10 feet from OHWM would have to like wet roots and sandy conditions or it won't survive. The first 8-10 feet are fairly flat to the lake and the water table might only be 2-3' below the tree in that 8-10' range. Aerial photography from 2020 indicates there was significant vegetation (including tree coverage) along that section of the shoreline. The old stairs were removed without a permit and county staff were not able to verify the amount of impervious surface or what the vegetation was like before the removal. Therefore, to issue a permit for a new staircase outside the disturbed area, the department needs to see plans to restore some deep-rooted vegetation along the shore in the area that was disturbed. Planting two trees (at 8-10 feet and 35 feet from the OHWM) in the area that was graded and replanted with grass would increase the deep rooted vegetation, while still maintaining a viewing corridor. I plan to be out in the field on Wednesday, but I currently plan to be in the office on Thursday and Friday. Please feel free to give me a call or stop by if you'd like to chat. I want to make sure we're on the same page. I removed an impervious stairway which I would estimate at 105 square feet with an additional concrete walkway to those stairs that was about another 40 square feet (close to 150 square feet impervious surface in total was removed). The stairs and walkway had grass around them, so I revegetated the old stair way area making sure the erosion control materials sufficiently covered the entire area (existing and revegetated). I'd like to replace that with pervious stairs, however it has only 4 posts about 3" in diameter, so virtually no soil disturbance. (IL' q6, 0 i44 � 2 F-4 o 1 ra In summary, the impervious surface removal is clearly a preferred shoreline improvement. Replacing it with something that is pervious with nearly zero disturbance. From my perspective it would seem that we've already made quite a bit of progress by this change and extra planting should not be a requirement for the permit. This plan should include native plants (like wildflowers), and at least two trees. One tree should be planted 8-10 feet from the ordinary high water mark (OHWM) and one should be planted 35 feet from the OHWM. The plans do not have to include every species you plan to plant, but should include examples of the species you plan to plant (like New England Asters for wildflowers) and should generally show where you plan to plant wildflowers, where you plan to plant shrubs, and where you plan to plant trees . A combination of flowers, shrubs, and trees tends to be most beneficial for shoreline health and stabilization. My initial thoughts are to put some wildflowers like the New England Aster along the edge of where the stairs were. We planted several things (butterfly weed bluberies, etc.) in our rain garden and along our eastern property line to help with drainage and landscaping. Adding flowers is a natural extension of what we've already done. I do have a photo of the stairs if you wanted to see it, if that helps with the concept of replacing existing. There was also a concrete walkway that led to the stairs that was removed to allow the yard to go back to more natural state instead of having an impervious walkway at the top of the stairs for 20 feet or so. In order to permit your proposed new stairs and follow the state shoreline regulations, we will need to see a plan that includes any vegetation that will be removed to build the new stairs and how you plan revegetate the approximately 35 foot area where the old concrete stairs were removed. If the concrete stairs were still in place, we could permit new stairs within existing footprint. However, since they were removed, we don't have a way to confirm the existing footprint. Revegetating with some combination of deep rooted native plants, shrubs, and trees is important for shoreline health and stabilization. While grass can seem like a nice feature for a shoreline, it is significantly better for property values, water quality, and wildlife to have a natural shoreline buffer. I'm attaching an image by UW-Extension that explains the benefits of shoreland buffer with diverse plant life. Here's another resource that explains in more detail the benefits of natural shorelines. The plan can be a simple diagram of the shore that marks any trees that need to be removed to install the stairs, and where different types of plants will be grown/planted in the area that is currently reseeded with grass. Existing stairs — I reseeded with grass. It was all grass around the stairs originally so I just kept it as it was. One other item I forgot to mention about location. The old concrete stairs were probably 40' long along that slope. I think that could have been reduced some (per my previous comment of estimating 30' if I had to do stairs in the old location). The extra length would require that I do more posts (would likely be 6 but possibly 8). Where I proposed to do the stairs I believe I only need 4 posts (2 on the top and two on bottom) — essentially one on each side of the stringer both top and bottom. The way the stairs are designed they are not notched for the treads which adds strength and given the angle where I proposed to put the stairs I only anticipated needing the 4 posts (less disturbance). I would agree that the slope to access the water is acceptable for me and my children (it is challenging when wet even for us). However, I have elderly family that have struggled with it, yet they can do stairs more easily. I'd like to make the lake accessible for those that are elderly as well. These stairs cost money, I don't want to throw money away just to have a set of stairs if it wasn't "needed" — but I do want to allow elderly family/friends the opportunity to traverse down to the lake safely and be able to go on the boat with us. 2. I plan to disturb the earth as little as possible. 1. Part of this is installing the stairs on posts that screw into the ground (requires no post holes/footings to be dug). The posts that screw in utilize an adjustable system for securing the stair stringers to the posts, this allows the stairs to be adjusted with potential frost heaving or fluctuations. A more typical approach to constructing stairs would be to place a post below frost line to achieve keeping the stairs stable — this approach requires much more disturbance of the soil. The approach I'm taking essentially prevents soil disturbances except for drilling the post into the ground (which is practically almost no soil disturbance). 2. This next comment may be open to interpretation/opinion, but I believe that placing the stairs where I suggested makes them more inconspicuous. If we put them on the "slope" then they "stick out". Placing them between trees within a canopy hides them better. Again, this is likely a subjective thought, but it is the way I initially interpret the "visually inconspicuous" requirement. i. Also, placing them on that slope would require the stairs to be longer as that area has more gradual slope that what I proposed. I suspect we'd go from stairs around 22 feet long to probably 30 feet long to accommodate the more gentle approach. The stairs will be KDAT lumber, which is a brown treated lumber. Again, this decision is two fold. It is more dimensionally stable preventing typical problems you see when installing "wet" green treat wood and the movement from it that is experienced. Second, I believe it blends in better with the environment than the green treat. 2. My desire to utilize wood instead of concrete was also part of considering disturbance to the land. Of course we could have taken the route of replacing the concrete stairs that were in disrepair with similar concrete stairs, but I'd like to be supportive of leaving the ground permeable and allow water to soak in rather than run off into the lake. I hope that helps provide some insight into my reasoning for the stairs and how I tried to consider my design to meet the requirements of the county. I believe I've modified everything properly, note that I did update a few more items on page 3 to include the existing house (does have pressurized water). I took the original site plan I submitted and added the stairs to it to try to best identify location of the new stairs (note the stairs are highlighted in blue on the original permit sketch). As for the existing concrete stairs I have already had the concrete stairs removed, they were unsafe and a hazard and insurance didn't allow them to remain so when the heavy equipment for the foundation excavacting was on site they pulled the concrete stairs from the property. I smoothed out the location of those stairs, seeded, and did erosion control matting. You can actually still see some of the erosion control matting in place if the snow melts enough. I'm also including two photos. One is the east property marker with a pink ribbon on it, still marked from pine ridge (this is essentially adjacent to the stair location), with the stairs starting 11' to the west of that marker. The other is a stake representing the approximate location of the "west" edge of the stairs. I had this marker in place last fall so I figured I'd take a photo to help with visual approximation of the stairs. Measuring that actual OHWM is difficult with the snow, but the bottom of the stairs will be approximately 20' from the OHWM. This is utilizing a known reference. The range based upon what I have available with the ground covered is likely 18'-22'. Please let me know if you need additional information or anything clarified. At this time of year, if there are trees/brushes/posts etc. along the lot line, flagging tape is often the easiest option. Depending on the frozen ground and snow levels, some landowners use wooden stakes or marking flags. If you think it's easiest for me to meet you at the site, that's another option. Just make sure to make it clear on the application that this is what you'd like to do. Under Section G, where it asks if you've marked the lot line, you can check "no" and then in the section where it says "if no what date will this be completed," write in that it is difficult to mark the lot lines and you'd like to meet the inspector on the property. The stairs are further than 10' from lot line but closer than 30' (about 15-20' I can measure this weekend). The surveyor's posts are still in the ground, but covered with snow. I have a very good idea of where they are relative to features/tress of the land. I actually have a rock "wall" landscaping along the east lot line so it's very easy for me to identify the lot line even with the snow. As for marking the lot line, obviously the weather makes it a bit dynamic. What would be your preferred method for me to identify the lot line? Do you typically see a stake on the corners and you just draw a line with your line of sight? Would it be easier for me to meet you there and review it together so that we aren't dependent on weather not impacting the lot line markings? I can adjust the sanitary permit information, I wasn't sure it was relative to the stair permit so I didn't want to assume it needed to be checked and make it seem like I was re -applying for a sanitary permit as well. Here's a few additional things we'd need: -on page. 2 please fill out the relevant setbacks, including the closest lot line(s). We'd also want to know how close the stairway is to any other structures and to the OHWM (mainly, we want to know how close the stairs are getting to the water) -on page 3, I suggest checking "yes" for staking the proposed project, or, if it's not currently staked, write in what date you will stake the project. If the stairs you plan to add are not expanding the footprint of the current concrete stairs and it's difficult to stake the concrete, explain that on the application. I won't be able to make a site visit (which is part of the process of reviewing your application) until the site is staked or marked in some way. -If the stairs are within 10 feet of a lot line, you need a licensed surveyor to to mark the lot lines. If the stairs are within 30 feet of a lot line, you will need to mark the lot lines. If the stairs will be further than 30 feet from a property line, you do not need to stake the lot lines. -also on page 3, you checked there was no sanitary system on the property but a quick search on our records shows you have an in ground septic system. Please check "yes" that you have a sanitary system on the property. Along with filling out the site plan, we would also want a drawing of the stairs (it can be hand drawn but it should clearly show the size, shape, and material of the stairs). It is lot 1 of CSM 2264 (attached). When we purchased the lot there were concrete stairs that are noted on the CSM. They were not safe and in disrepair, so we chose to remove them. Being concrete they were obviously impervious and I'd like to replace the stairs with wood stairs. I'm aware of the requirements of stairways, such as no wider than 60", handrails only for safety reasons, no/minimize landings, etc. My question id... do I need a permit for the stairs or am I allowed to replace the existing stairs under my existing land use permit for the new dwelling? For what it is worth I also plan on using KDAT lumber (so it is brown kiln dried treated lumber), which will be the best product to blend in with the natural environment yet remain impervious and minimize impact to the environment.
