All Land Use Permits expire Two (2) Years from the date of issuance if construction or use has not begun. Sanitary Permit
issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a
permit will result in penalties.
The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family
dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Additions and alterations to one -
and two-family dwellings may require review and approval by the UDC authority. All municipalities are required to enforce the
UDC.
If subject property is part of a Condominium Plat, applicant hereby certifies and represents that applicant has all necessary
approvals and recorded documents required to complete the project for which this permit is sought including requirements set forth
in Wisconsin statutes pertaining to condominium associations, the Declaration of the Condominium Association in which the
property is located, and all other rules, regulations and requirements pertaining to that Condominium Association.
You are responsible for complying with state and federal laws concerning construction near or on wetlands, lakes, and streams.

Dear Jacob and Rebecca,
On September 29, 2023 I met with your contractor, Justin Christenson, at your property on
Lower Eau Claire Lake to discuss mitigation measures you would need to take so you can
demolish the old boat house and rebuild a new one in the same footprint. Your property has
approximately 284 feet of shoreline, so you are allowed to have 85 feet of viewing and access
corridor. Justin and I measured the open areas along your shoreline and calculated that you
currently have approximately 165 lineal feet of viewing corridor.
In addition to complying with all applicable parts of the Bayfield County Zoning Ordinance
Section 13-1-40, Article c, paragraph (g), you need four points of mitigation to move forward
and comply with your land -use permit. The following requirements need to be completed:
v/ 7 / 9 1. Remove one of the staircases. You are opting to demolish the staircase immediately
adjacent to the existing boat house. The space where that staircase is being removed will
also need to be revegetated. (1 point)
2. Maintain and do not remove or mow existing side yard vegetation. (1 point)
3. Restore three layers of vegetation (trees, shrubs, and forbs/grasses/wildflowers) along 80
lineal feet of the shoreline, to ensure at least 35 feet of shoreline vegetative buffer exists
perpendicular to the ordinary high water mark (OHWM). I have enclosed a native plant
list to help you decide what plants would grow well in your site conditions. (1 point)
4. The driveway/equipment access down to the waterfront will need to be replanted. Three
N layers of vegetation (trees, shrubs, and forbs/grasses/wildflowers) need to be present.
(yQ , This can be done after boat house demolition and construction is completed. (1 point)
5 ote: trees should be planted at a spacing of one for every 100 square feet, and shrubs
Z 1 should be planted with a spacing of one for every 50 square feet. Grass, sedge, forb, and
wildflower plugs/transplants should have a spacing of one for every 1.5-2 square feet. I
have enclosed a native plant list to help you determine the best species for the site
L conditions in the area that needs to be revegetated. The mitigation plan should be
completed before your Zoning permit expires or within twelve months of project

According to Bayfield County Zoning Ordinance 13-1-22 (a)(5) a.7, you will also need to record
an affidavit with the Bayfield County Register of Deeds office, which shall include the
conditions of that section of the Bayfield County Zoning Ordinance. Along with this affidavit,
you will need to provide a site plan. The site plan should show dimensions and location of your
viewing and access corridor, the areas you will be restoring, the house, boat house, and staircase
to the lake. The site plan should also show the location of the septic, well, road/driveway, dock,.
and any other human -made features of the property not listed here. If you have any questions,

As a part of your prior boathouse project the access road to the lake was to be planted to trees and shrubs and both
